129. Federal law on the establishment of an advisory board to the Federal Ministry of Health and Women for questions relating to the training and further training of personnel of official control for the protection of consumer health (Training Act on Consumer Health- AGVG)

The National Council has decided:

Subject matter and objective

§ 1. (1) This federal law regulates the establishment of an advisory board to the Federal Ministry of Health and Women for questions relating to the vocational education and training of personnel of official control for the protection of consumer health in the fields of Food safety, animal feed control, veterinary and animal welfare.

(2) The aim of this Act is to contribute to this through the creation of an Advisory Board in which all the Länder are represented,

1.

to ensure a high-quality, up-to-date training of the persons referred to in paragraph 1, corresponding to the latest state of science as well as to the relevant legal requirements and EU requirements,

2.

to make the best use of the resources available to the federal and state governments in these areas, in the common interest; and

3.

to support the creation of uniform teaching, learning and examination documents throughout Germany in these areas.

The work of the Advisory Board established by this Federal Law thus serves the overall objective of ensuring a high level of protection of consumer health in the above-mentioned areas in Austria.

Definitions and references

§ 2. (1) In the sense of this Federal Law:

1.

AGES: the Austrian Agency for Health and Food Security GmbH according to § 7 of the Health and Food Safety Act-GESG, BGBl. I No 63/2002;

2.

Training: measures prescribed by law, regulation or directly applicable Community legislation in respect of content and compulsory education, acquisition and verification of the knowledge and skills required for the purpose of the pursuit of the professional activities of persons referred to in § 1 are required;

3.

Further training: measures to obtain additional qualifications or to deepen, expand or consolidate existing knowledge and the existing skills of the persons mentioned in § 1 following the successful completion of the training. Further training in the sense of this federal law includes the term further education with one.

(2) As far as this federal law refers to provisions of other federal laws, these provisions shall be applied in their respectively applicable version.

(3) In the case of all personal names used in this Federal Act, the chosen form shall apply to both sexes.

Consumer Health Training Council

§ 3. (1) In order to support the achievement of the above objectives, the Federal Ministry of Health and Women shall designate an Advisory Board under the name "Training Council Consumer Health" (hereinafter referred to as the "Training Council" or "Advisory Board"). Advising the Federal Minister for Health and Women, as well as the Federal Minister for Agriculture, Forestry, Environment and Water Management, on all matters relating to the training and further training of persons mentioned in § 1.

(2) The Training Council is a member of the Federal Ministry of Health and Women, on a proposal from the Federal Minister for Health and Women, as chairman and fourteen other members, who are appointed by the Federal Minister for Health and Health Women are appointed in agreement with the Federal Minister for Agriculture, Forestry, Environment and Water Management.

(3) Of the fourteen other members referred to in paragraph 2 above,

1.

a member of the Federal Ministry of Health and Women, on a proposal from the Federal Minister for Health and Women,

2.

a member of the Federal Ministry of Agriculture, Forestry, Environment and Water Management on a proposal from the Federal Minister for Agriculture, Forestry, the Environment and Water Management,

3.

a member of the teaching body of the University of Veterinary Medicine, Vienna, on a proposal from the Rector,

4.

a member of the teaching body of the University of Natural Resources and Natural Resources, on a proposal from the Rector,

5.

a member of the AGES on a proposal from the management board of the AGES and

6.

one member for each federal state on a proposal from the federal state

ordered.

(4) The Federal Minister of Health and Women, in agreement with the Federal Minister for Agriculture, Forestry, Environment and Water Management, shall appoint two Vice-Chairmen of the Chairperson. A deputy is to be appointed from the circle of the members nominated by the Länder, the other from the circle of other members. In the event of the appointment of a Vice-Chairman as a member of the Training Council, a member of the Training Council shall once again be appointed as a deputy after the expiry of the deadlines in accordance with § 4.

(5) The Chairman shall be entitled, after consultation with the Advisory Board, to consult experts for advice.

(6) The training period of the training council shall be five years. Reorder is allowed. The operating period begins with the first meeting of the members of the newly appointed advisory board. (7) The Federal Minister, on a proposal from the Chairman and in agreement with the Federal Minister for Agriculture, Forestry, Environment and Water Management, may appoint working groups to support the training council. The admissibility of such a proposal to the Federal Minister for Health and Women requires the prior authorisation of the Chairman by a decision of the majority of the members of the Training Council to be approved.

Information on the right of proposal

§ 4. (1) Before the appointment of the members of the Training Council for a new term of office (Section 3 (6)), the Federal Minister of Health and Women's Federal Minister for Health and Women shall be the Federal Minister for Land-and Forestry no later than four months before the end of the current term of office. § 5. Volunteering, travel expenses

§ 7. (1) The activity in the Training Council is voluntary. Tasks of the Training Council

§ 9. (1) The Training Council serves the advice of the Federal Minister for Health and Women and the Federal Minister for Agriculture, Forestry, Environment and Water Management in all matters concerning vocational education and training within the meaning of § 1. It represents a place of institutionalized dialogue between the decision-makers of the Federal Government and the Federal States, as well as experts of the other institutions referred to in § 3, between the questions of education and training within the meaning of § 1.

(2) The tasks of the training council in detail within the meaning of the objectives set out in § 1 are:

1.

the reimbursement of proposals for the content and organisation of training programmes, the provision of training regulations and the design, publication and management of training and training materials,

2.

the development of a long-term concept ("master plan training and further training of consumer health"), including proposals to finance the implementation of this approach,

3.

the reimbursement of opinions on draft laws and regulations which may affect or affect questions relating to education and training within the meaning of Section 1;

4.

the reimbursement of proposals for improvement of the education and training of the persons referred to in § 1, in particular with a view to making better use of the resources available by the Federal Government and the Länder; and

5.

the reimbursement of recommendations for a comprehensive quality assurance programme concerning the education and training of persons referred to in § 1.

Quorum, decision-making requirements

§ 10. (1) The Training Council shall have a quorum if at least half of the members are present after the duly successful invitation of all the members.

(2) The decision-making capacity shall be determined at the beginning of the meeting by the Chairman of the Training Board.

(3) The Training Council shall take its decisions by a simple majority of the members present. A abstention is inadmissible. In the event of a tie, the Chairperson shall vote.

Office
