390. Ordinance of the Federal Minister of Education, Science and Culture, with which a State Teacher Controlling Regulation is issued and the Education Documentation Ordinance is amended

Because of

1.

§ 4 (7) of the Financial Equalization Act 2005, BGBl. I n ° 156/2004, in the version of the Federal Law BGBl. I No 34/2005 and BGBl. I No 105/2005; and

2.

§ 4 of the Education Documentary Act, BGBl. I n ° 12/2002, in the version of the Federal Law BGBl. I No 169/2002,

-as regards Article 1, in agreement with the Federal Minister for Finance:

Article 1

Regulation concerning information on personnel costs and controlling in the area of national teachers (Landeslehrer-Controllingverordnung)

Section 1

General provisions

Scope

§ 1. This Regulation regulates the information on staff expenses in accordance with § 4 of the Education Documentation Act, BGBl. I n ° 12/2002, as well as the control and accounting of staff expenditure in accordance with § 4 of the Financial Equalization Act 2005, BGBl. I No 156/2004. Excluded from the regulatory area of this regulation is the controlling of personnel expenses at agricultural and forestry vocational and technical schools.

Definitions

§ 2. (1) For the purposes of this Regulation, the following shall be understood:

1.

under full employment: employment at the level of the respective use and/or Remuneration group and taking into account the service and remuneration legislation the basis of the calculation of the remuneration of 100 vH of the salary to be applied to the person concerned, respectively Level of remuneration in the use or use of Remuneration group;

under full employment equivalent (VBÄ): the percentage of employment as a percentage divided by 100%, the sum of the employment dimensions of a post-office area divided by 100;

3.

under multi-service performance:

a)

Every lesson according to § 50 (1), (2), (3) or (6) Landeslehrer-Dienstrechtsgesetz, BGBl. No 302/1984 (LDG), pursuant to Section 61 (1) (1) (1) or (12) of the salary law of 1956, BGBl. No. 54, (GehG) iVm § 106 paragraph 1 Z 1 LDG, or pursuant to § 50 para. 1, 2, 3 or 6 LDG iVm § 2 para. 2 lit. k Land Contract Teachers Act 1966, BGBl. No. 172, (LVG), pursuant to § 61 paragraph 1 Z 1 or para. 12 GehG iVm § 45 Contract Order Act 1948, Federal Law Gazette (BGBl). No. 86, (VBG) iVm § 2 para. 1 lit. a LVG, for which the national teacher is paid a remuneration (permanent additional service);

b)

Every lesson in accordance with § 50 (4) or (6) LDG or pursuant to § 61 paragraph 8 or 12 GehG iVm § 52 para. 21 LDG or pursuant to § 50 para. 4 or 6 LDG iVm § 2 para. 2 lit. k LVG or pursuant to § 61 paragraph 8 or 12 GehG iVm § 45 VBG iVm § 2 para. 1 lit. a LVG, for which the national teacher is paid a remuneration (single service).

(2) Other terms are in accordance with the provisions of these rules (duty and duty law), in particular in accordance with the rules laid down in the Annex , the provisions of the LDG, the GehG, the LVG and the VBG are to be understood.

Section 2

Data provision

Data transmission, survey dates and reporting dates

§ 3. (1) The Länder have the Federal Minister of Education, Science and Culture to electronically transmit data in the presentation according to the system in such a way that a data record corresponds to a person (anonymized individual data sets). In the case of transmission, the data format provided for in the installation shall be used.

(2) The survey date shall be the last day of each month. The reporting date for the respective monthly stand is not later than the tenth day of the second following month. For teachers at vocational schools, the data are to be submitted annually until 10 November of each calendar year. These transfers have to contain the values of the entire previous school year, with the countries free to submit the values monthly.

(3) Prior to the transmission of the data, all necessary edits shall be carried out in the data set.

Information rights and obligations of the Federal States

§ 4. (1) Each country shall have the right to inspect and use the data transmitted by the Federal Minister for Education, Science and Culture with regard to the data transmitted by the Federal Minister for Education, Science and Culture.

(2) At the request of the Federal Minister for Education, Science and Culture, the respective country shall immediately, in any case within six weeks, explain the data transmitted, if the data are not completely transmitted by the Federal Minister for Education and Research for education, science and culture, to supplement precisely named information and to answer questions from the Federal Minister for Education, Science and Culture.

Section 3

Settlement of the establishment plans

Accounting Base

§ 5. The accounting basis of a country are those of the Federal Minister of Education, Science and Culture in agreement with the Federal Minister of Finance on the basis of the provisions of the Art. IV (2) and (3) Federal Constitutional Law BGBl. No 215/1962 and Art. 1 Z 2 of the Agreement in accordance with Art. 15a B-VG on joint measures by the Federal Government and the Länder concerning staff costs for teachers in general compulsory schools, in the promotion of housing and housing renovation as well as with the doping of the Environment and Water Management Fund, BGBl. No 390/1989, approved establishment plans (defined establishment plan). The federal government has applications that from the 15. Vacant posts of a school year

§ 6. The number of posts occupied shall be determined on the basis of the sum of the full-employment equivalent of a post-office area (school type) to be deducted from the reports in accordance with § 3:

Number of full-employment equivalents of basic employment: The reported values from the BAUSM data field in the plant are to be added to each plank area (school type) and to be divided by (100 x 12).

2.

The number of multi-services of the 12 months of a school year in hours from the data field MDL in the facility is to be converted into full-employment equivalent in the individual planning areas as follows:

a)

The number of hours is divided by (4.33 x 12 x 22) in the planning areas of primary schools and special education;

b)

the number of hours is divided by (4,33 x 12 x 21) in the main schools and polytechnic schools;

c)

The number of hours is divided by (4.33 x 12 x 23) in the vocational schools ' vocational training centre.

3.

The sum of the full employment equivalent (basic employment) calculated in accordance with Z 1 is to be added to the full employment equivalent (converted multiservices) determined in accordance with Z 2.

4.

The number of vacant posts of a planning site area thus determined will be rounded in two places after the comma.

5.

The total number of posts in the general education system, or of the vocational school system is to reduce the number of full-employment equivalents, the cost of which is not carried out on the basis of § 4 FAG 2005, with the exception of the subsidy on the personnel costs of private schools, the costs of which according to § 19 para. 2 private school law, BGBl. N ° 244/1962, are supported by the Federal Government.

Accounting for the establishment plans of a school year

§ 7. (1) The accounting of the establishment plans of a school year is carried out separately for general education and vocational education and training schools. Deviations from the definitive establishment plan (§ 5) will be made by comparison of the number of posts approved in the definitive establishment plan of all posts in the general education compulsory schools as well as the vocational education and training schools of compulsory education of the number of occupied posts determined in accordance with § 6.

(2) Where, in the past school year, teachers have been employed in addition to the approved posts, the amount subject to the financial compensation shall be determined as follows:

For each full employment equivalent above the approved establishment plan, the expenditure of an annual week of week of pay group l2a2 is multiplied by 23 multiplied by 23 plus the monthly educational supplement multiplied by twelve, to apply the two shared allowances in accordance with Section 44b (1) Z 3 VBG, the special payments and the service provider contributions.

2.

The number of posts by which the value determined in accordance with § 6 exceeds the number granted in accordance with § 5 shall be multiplied by the amount determined in accordance with Z 1.

(3) If the Federal Government determines that the establishment plan is exceeded by a federal state, it shall inform the federal state concerned and ask it to take a position within two weeks. The Federal Government is obliged to comment on the opinion of the country within a further two weeks.

Section 4

Final provisions

The validity and effectiveness of other legislation

§ 8. Where other legislation is referred to in this Regulation, the provisions of this Regulation shall apply in the version applicable to the entry into force of this Regulation.

Personal names

§ 9. Personal names in this Regulation and in the annex to this Regulation shall also apply in their female form.

Transitional provisions

§ 10. Until 31 August 2006, the Federal Minister of Education, the Federal Minister of Education and the Federal Republic of Germany shall use the electronic data transfer in accordance with § 3 in connection with the installation of data transfers using the up to the entry into force of this Regulation. Science and culture made available form sheets are allowed. If the electronic data transmission in accordance with § 3 in connection with the plant does not take place in sufficient quality, the Federal Minister of Education, Science and Culture may in agreement with the Federal Minister for Finance in addition to the Data transmission in accordance with § 3 the data transfer using the forms made available by the Federal Minister for Education, Science and Culture until the entry into force of this Regulation, as well as the forms provided by the Federal Institute for Education, Science and Culture "Statistics Austria"-supplementary statistical data provided Order form sheets as well as new forms for the reporting of annual sum values, in particular for the fields SBSPau, SBNMau, SBSOau, NASPau, MUZUau, LEREau and ERZIau of the plant.

§ 11. This Regulation shall enter into force at the end of the day of the customer's notice in the Federal Law Gazans.

Article 2

Amendment of the Education Documentary Regulation

The Education Documentary Regulation, BGBl. II No 499/2003, shall be amended as follows:

1. § 10 (2).

Section 10 (3) reads as follows:

" (3) With regard to persons employed in educational establishments, the function of which is perceived by other entities as a federal or country, and also with regard to the staff costs borne by the Federal Government for these persons to apply the survey dates and reporting dates set out in paragraph 1. "

Section 11 (1) first sentence reads as follows:

" The legal entity (with the exception of the Länder), which carries out the service function at the educational institution, whose personnel expenses are borne by federal funds, has the evidence on the expenditure for educational institutions in § 4 (1) (1) (1) (1). Data referred to in the Education Documentation Act. "

4. In accordance with § 23, the following § 24 and title shall be added:

§ 24. Section 10 (3) and § 11 (1), first sentence of this Regulation, as amended by the BGBl Regulation. II No 390/2005 shall enter into force on the expiry of the day of the event in the Bundesgesetzblatt; at the same time, Section 10 (2) shall expire in the version in force at that date. "
