417. Regulation of the Federal Minister of Transport, Innovation and Technology on the tasks of the European Union for the carriage of ships in the field of traffic control (Schleusenprudential Regulation)

On the basis of § § 37 (3) and 38 (10) of the Maritime Law, BGBl. I n ° 62/1997 idF BGBl. I n ° 41/2005, is prescribed in accordance with section 153 (2) of this Federal Act:

Scope

§ 1. This Regulation applies to the lock-up of the floodgates of the dams of the waterway of the Danube according to § 11.02 Z 3 of the waterways traffic regulations, BGBl. II No 248/2005.

Maritime safety tasks within the framework of the control of the smuggling of people

Supervision and initiation of administrative criminal proceedings

§ 2. (1) The airlock intentions are obligated to communicate the responsible shipping supervision on suspicion of administrative surrender on the basis of obvious technical defects on vehicles.

(2) The airlock intentions shall be obliged to notify the competent shipping authority and the person entitled to dispose of the facility in the event of damage to the lock system.

(3) The airlock intentions are authorized, in the event of an urgent suspicion of an administrative surrender on the basis of their own merit, as well as the instructions of the shipping supervisor, the submission of ship surcustomers pursuant to § 1.10 of the Waterways traffic regulations as well as certificates of competency according to 7. Part of the Maritime Act and Schifferdienstbücher pursuant to § 6 of the Ordinance on Ship Remuneration, BGBl. II No 518/2004, and to transmit copies to the relevant shipping authority.

(4) The airlock intentions are authorized, if there is an urgent suspicion of administrative transgression on the basis of their own merit, as well as on the instructions of the shipping authority, to initiate the to include the data of ship guides and crew members required for administrative criminal proceedings, and to monitor compliance with the rules on minimum crews, including rest periods.

(5) The airlock intentions are obliged to check the performance of ship-travel-related arrangements at the instructions of the shipping authority.

§ 3. Regulation of navigation

§ 4. (1) The airlock intentions shall be entitled to affix and remove shipping signs and to operate signalling systems in order to regulate shipping in the lock area.

(6) The airlock intentions are obliged to participate in the operation of inland waterway transport information services in accordance with § 24 of the Maritime Law; this includes in particular:

1.

the monitoring of the tactical traffic image in the DoRIS inland waterway information system,

2.

measures to optimise the smuggling of goods and the order of smuggling, in particular the determination of the time required for the arrival at the lock,

3.

monitoring of the functioning and data content of the DoRIS Reviercentrals at the locks,

4.

the monitoring of marine equipment and the functioning of ship-transport equipment;

5.

the instigation of the inclusion of nautically relevant information in the DoRIS inland waterway information system.

(7) The floodgates are obliged, if there is a suspicion of too low a water depth in the lock area, the authorities responsible for the maintenance of the water of the via donau-Österreichische Wasserstraße-Gesellschaft m. b. H. and the relevant shipping authority.

Assistance for damaged vehicles

§ 5. (1) The airlock intentions shall be obliged to forward information on accidents by telephone and, if necessary, in writing, to the relevant shipping authority.

(2) The airlock intentions are obliged to support the ship inspection as well as possible in the case of the assistance for damaged vehicles in accordance with § 38 (4) of the Maritime Law.

(3) The airlock intentions, with the exception of the Nussdorf lock, are obliged to receive notifications concerning the transport of dangerous goods in accordance with § 8.02 of the waterway traffic regulations, until the transport of dangerous goods is completed. and to forward them to them as well as to emergency services via instructions from the shipping authority. They are obliged to pass on the notifications of vehicles in international traffic on the basis of bilateral agreements to the neighbouring countries.

Letter to the Shipping Supervision

§ 6. (1) The airlock intentions have to be addressed to the Shipping Supervision and applications such as applications for the recognition of certificates of competence pursuant to Section 121 (1) of the Maritime Law and to the Shipping Supervision forward.

§ 7. Only persons who have been instructed in the technical bases of the respective lock systems as well as in the handling of the operating and signalling devices may be used for the control of the toil. General knowledge of other shipping regulations and provisions of the protection of workers;

Navigation; manoeuvring and driving of the vehicle:

a)

general knowledge of navigation;

b)

Control of the vehicle, taking into account the influence of wind, flow, suction and draught, assessment of a sufficient swimming capacity and stability;

c)

Purpose and function of the rudder and the propeller;

d)

Anchorage and celebration;

e)

maneuvers in the sluice;

f)

Maneuver at the meeting and overtaking;

3.

Construction and stability of the vehicle:

a)

basic knowledge of shipbuilding, in particular in relation to the safety of passengers, crew and the vehicle;

b)

Basic knowledge of technical regulations;

c)

Basic knowledge of the most important components of vehicles;

d)

theoretical knowledge of stability and swimming ability and its practical application;

4.

Ship machines:

a)

basic knowledge of the construction and operation of marine machinery;

b)

operation and operational control of the main and auxiliary machines, behaviour in the event of a malfunction;

5.

Load and Delete:

a)

the application of the low-level scoreboard;

b)

Loading and unloading, Stauen of the load (Stauplan);

6.

Behavior under special circumstances:

a)

the principles of accident prevention;

b)

Operation of rescue equipment and rescue equipment;

c)

First aid in the event of accidents;

d)

fire prevention and operation of fire extinguishing systems and equipment;

e)

Measures in the case of accidents, collisions and fortifications, including the sealing of a leak;

f)

maintenance of the water;

7.

Guided tour of vehicles under radar:

a)

General knowledge of radio waves and the operation of radar systems;

b)

Capability in the use of the radar device, evaluation of the radar image and the information provided by the device, as well as knowledge of the limits of such information;

c)

Knowledge of the shipping policy provisions relating to radar-based ship management;

8.

Management of passenger ships:

a)

a basic knowledge of the technical requirements for the stability of passenger ships in the event of a shipwreck, for the division of Scotland and for the level of the greatest reduction;

b)

Measures to protect passengers in general and, in particular, in the event of evacuation, accident, collision, run-up, fire, explosion and other panic triggering situations.

Order and dismise

§ 9. (1) The staff of the Schleusensupervision are at the request of the via donau-Österreichische Wasserstraßen-Gesellschaft m. b. Transitional provisions

§ 10. (1) The requirements of Section 38 (8) (1), (2) and (4) of the Shipping Act apply to staff members who, according to § 22 (3) or § 23 (2) of the Wasserstraßengesetz (waterway law), BGBl. I No 177/2004, which has been allocated to the permanent service, than is fulfilled.

(2) With regard to Schleuse Nussdorf, the requirements of Section 38 (8) (1), (2) and (4) of the Maritime Law shall be deemed to be fulfilled by those employees who, pursuant to Section 22 (1) or section 23 (1) of the Water Road Act, are required to provide permanent services. , to the extent that, on the day before the entry into force of the waterway law, they were, for the most part, dealt with matters relating to the traffic control at the Nussdorf lock.
