Regulation of the Federal Minister for Social Security, Generations and Consumer Protection on the adjustment of pensions, and on the determination of certain values in the pension rights for the calendar year 2006

Article I

Adjustment in the provision of war victims

On the basis of § 63 of the War Victims Supply Act 1957, BGBl. No. 152, as last amended by the Federal Law BGBl. I No 90/2005, shall be ordered:

§ 1. The adjustment factor fixed for the area of the General Social Security Act for the calendar year 2006 with 1.025 is binding to this extent for the calendar year 2006 also for the area of the War Sacrifice Supply Act 1957.

§ 2. The amounts to be paid for the calendar year 2006 to replace the amounts mentioned in the 1957 War Victims Pension Act are to be found on the basis of the amounts in the BGBl. II No 504/2004 as follows:

1.		In § 11 paragraph 1 instead of 430,20 € with 441,00 €;
2.		in Section 11 (2) instead of 17,70 € with 18,10 €;
3.		in Section 11 (3)

§ 3. (1) The basic pension amounts calculated and rounded in accordance with Article 11 (1) of the War Victims Pension Act 1957 from the hundreds of the amounts of the basic pension for working-incapable severely damaged persons are determined as follows:

(3) The basic pension amount calculated in accordance with Article 35 (2) of the War Victims Supply Act 1957 from the percentage of the amount of the basic pension for ineligible severely damaged and rounded basic pension amount is determined at € 176.40.

Article II

Adjustment in victims ' welfare

On the basis of § 11a of the Opferfürsorgesetz, BGBl. No. 183/1947, as last amended by the Federal Law BGBl. I No 86/2005, shall be assigned:

§ 1. The adjustment factor fixed for the area of the General Social Security Act for the calendar year 2006 with 1.025 is also binding in this extent for the calendar year 2006 also for the area of the Opferercare Act.

§ 2. The amounts to be paid for the calendar year 2006 to replace the amounts referred to in the Victim Welfare Act shall be made on the basis of the amounts in the BGBl. II No. 504/2004 as follows, whereby according to Article 11a (2), in respect of the maintenance pensions (§ 11 paragraph 5), the increase of the judge's sentence beyond the adjustment factor according to § 293 para. 1 lit. a ASVG on the basis of the BGBl. I n ° 132/2005 for eligible victims and survivors due to an increase of € 27.01 compared to the previous year:

1.		In § 6 Z 5instead 672 406,90 € with 689 217,10 €;
2.		in § 11 para. 2instead 40,20 € with 41,20 €;
3.		in § 11 para. 5instead 885,70 € with 912,70 €,
		instead 805,20 € with 832,20 €,

Article III

Adaptation and determination of certain values in the army supply

On the basis of § 24c and § 46b (1) and (7) of the Army Supply Act, BGBl. No 27/1964, as last amended by the Federal Law BGBl. I No 90/2005, shall be ordered:

§ 1. For the calendar year 2006, the recovery factors according to § 24a of the Army Supply Act shall be determined as follows:

§ 2. The minimum and maximum basis of measurement in accordance with § 24b of the Army Supply Act will be determined for the calendar year 2006 with € 590.40 and € 2 448,90.

§ 3. The adjustment factor fixed for the area of the General Social Security Act for the calendar year 2006 with 1.025 is also binding in this extent for the calendar year 2006 also for the area of the Army Supply Act.

§ 4. The amount of the amounts to be paid in accordance with § 53 (2) of the Army Supply Act shall be determined for the calendar year 2006 with € 38.50 for the main insured person and € 7.40 for additional insured persons.

Article IV

Adjustment in the vaccine damage compensation

On the basis of § 3 (4) of the German Vaccine Bill, BGBl. No. 371/1973, as last amended by the Federal Law BGBl. I No 48/2005, shall be:

The adjustment factor fixed for the area of the General Social Security Act for the calendar year 2006 with 1.025 is also binding in this extent for the calendar year 2006 also for the area of the Vaccine Damage Act.

Article V

This Regulation shall enter into force 1. Jänner 2006 in force.
