12. Regulation of the Federal Minister of Transport, Innovation and Technology, amending the Regulation on the transfer of responsibilities to the Austrian Aero Club

On the basis of § 140b of the Aviation Act, BGBl. No. 253/1957, in the version of the Federal Law BGBl. I No 123/2005, shall be arranged:

The regulation of the Federal Minister of Public Economy and Transport on the transfer of responsibilities to the Austrian Aero Club, BGBl. No 394/1994, as last amended by the BGBl Regulation. II No 426/2003, shall be amended as follows:

1. In the title, the phrase "(ÖAeC-jurisdiction-ÖAeCVO)" .

2. § 1 reads:

" § 1. (1) The responsibility for the implementation of administrative procedures, including decision-making powers for the

Exhibition of Flight Students (§ 1 of the Civil Aviation-Personnel Ordinance-ZLPV),

2.

Exhibition of civil aviation-identity certificates (basic rights as well as extensions of the basic rights and special allowances) for glider pilots, parachutists, outdoor cyclists and pilots for hangings or paragliders (§ 1 ZLPV) as well as revocation and disregard in relation to this badging (§ 40 of the Aviation Act-LFG),

3.

Recognition of foreign civil aviation services for the categories mentioned in Z 2 (§ 39 LFG),

4.

Extension of the categories mentioned in Z 2 (§ 11 ZLPV),

5.

Renewal of the rights of the categories listed in Z 2 (§ 13 of the ZLPV),

6.

Exhibition of the teaching qualification for the categories mentioned in Z 2,

7.

Formation of the examination commissions and appointment of the examiners for the categories mentioned in Z 2 and 6 (§ § 35 and 36 LFG),

8.

Grant of the training permit and the operating licence for civil aviation schools, subjection to the training operation and revocation of the training permit for glider pilots, pilots for hangings and paragliders, Paratroopers and outdoor swimming pools (§ § 42, 44, 45 and 46 LFG),

9.

Management of the aircraft register for gliders, outdoor pools, ultralight aircraft and motorised hangings and paragliders (§ 16 LFG),

10.

Assessment of airworthiness for parachutes, hangings and paragliders as well as motorized slopes and paragliders (Section 30 (3) of the Civil Aviation Vehicle and Aeronautical Equipment Ordinance 2005-ZLLV 2005) and Exhibition of the Noise Certificate for motorized hangings and paragliders (Section 4 of the Civil Aircraft Noise Admissibility Regulation 2005 (ZLZV 2005),

Recognition of foreign piece tests for parachutes, hangings and paragliders as well as motorized slopes and paragliders (§ 39 ZLLV 2005),

12.

Approval of the maintenance programme for motorized slopes and paragliders (§ 48 para. 2 ZLLV 2005) and verification of parachutes, hangings and paragliders as well as motorised slopes and paragliders (§ 40 para. 1 ZLLV 2005),

13.

Granting of probation permits and interim authorisations for parachutes, slopes and paragliders as well as motorized slopes and paragliders (§ 20 LFG, § 42 para. 1 ZLLV 2005)

14.

Sample inspection of multi-seater parachutes, slopes and paragliders as well as motorised slopes and paragliders (Section 32 of the ZLLV 2005),

15.

Recognition of foreign sample tests for the categories mentioned in Z 14 (§ 36 ZLLV 2005),

16.

Recognition of foreign confirmations of permitted use in flight for parachutes, hangings and paragliders , as well as motorized slopes and paragliders and revocation of these recognitions (§ § 18 para. 2 and 19 para. 2 LFG) as well as authorization of the extension of the time limit pursuant to § 15 para. 4 LFG for motorized hangings and paragliders,

Determination of the lack of conditions for use in the flight (§ 45 ZLLV 2005) for the categories mentioned in Z 10,

18.

Inspection of gliders (§ 40 para. 1 Z 1, 2, 3, 4, 5 and 7 ZLLV 2005),

19.

Verification of ultra-light aircraft (§ 40 para. 1 Z 1, 2, 3, 4, 5 and 7 ZLLV 2005),

20.

Periodic review (Section 40 (1) Z 4 of the ZLLV 2005) by motor-seaters, which are not used in the framework of air carriers (§ 102 para. 2 LFG), and

21.

Approval of maintenance, development, manufacturing and maintenance aid for parachutes, hangings and paragliders as well as motorized slopes and paragliders (§ § 51 to 53 ZLLV 2005),

will be transferred to the Austrian Aero Club. There is a duty to carry out these tasks.

(2) The transfer pursuant to Section 1 (1) (12), (18), (19) and (20) shall not affect the powers conferred pursuant to Section 40 (4) of the ZLLV 2005.

(3) A copy of the review certificates and, where appropriate, the certificate of use after carrying out the inspections referred to in paragraph 1 (18) to (20), and, in the case of a reduction in the verification date, a copy of the certificate In accordance with § 40 (1) Z 4 of the ZLLV 2005, Austro Control GmbH shall be transmitted immediately.

(4) The transfer of the powers referred to in paragraph 1 (1) (10), (11), (13) to (16) shall not apply to parachutes and harness which, within the framework of an ETSO entitlement within the meaning of Regulation (EC) No 1702/2003, OJ L 327, 31.12.2003, p. No. OJ L 243 of 24 September 2003, p.

In § 2 (1) the words shall be: "Civil Aviation-Staff Regulation and the Civil Aviation Vehicle and Aeronautical Equipment-Regulation 1999" by the words "Civil Aviation-Staff Regulation, the Civil Aviation Vehicle and Aeronautical Equipment-Regulation 2005 and the Civil Aviation Vehicle Noise admissibility Regulation 2005" replaced.

4. In § 3 (1), § 4 (1) and (3), § 5, § 6 (3), § 7 (1) and (2) as well as § 8, the words shall be "Public economy and transport" by the words "Transport, innovation and technology" replaced.

5. In § 9, the following paragraph 6 is added:

" (6) § 1, § 2 para. 1, § 3 para. 1, § 4 para. 1 and 3, § 5, § 6 para. 3, § 7 para. 1 and 2 as well as § 8, in each case in the version of the Ordination BGBl. II No 12/2006, with 20. Jänner 2006 in force. Administrative procedures pending at this time in accordance with § 1 (1) (8) (8) relating to sailing flying, as well as pursuant to Article 1 (1) (10) to (17) and (21) concerning motorised slopes and paragliders, shall be carried out in accordance with the procedure laid down before the end of the 19.
