87. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, amending the Plant Protection Regulation

On the basis of the Articles 6, 14(1). 2, 35. 4 and 38 paragraphs. 1 of the Plant Law 1995, BGBl. No 532, last amended by the Federal Law BGBl. I No. 87/2005, will be prescribed - with regard to Annex 5 in agreement with the Federal Minister for Finance:

The Plant Protection Regulation, BGBl. No 253/1996, last amended by Regulation BGBl. II No 312/2005, as follows:

1. § 6a and heading:

"labelling of packaging wood

(1) The marking of packaging wood has to correspond to one of the models set out in Annex 6.

(2) The labelling must include:

1.

the symbol protected by the FAO (the United Nations Food and Agriculture Organisation) (the link of the figure in Annex 6, the word image with the word "IPPC");

2.

the two-digit ISO country code (AT), followed by an admissible number which the local authority is responsible for the producer or producer of the packaging wood, responsible for the use of suitable, properly marked wood, in accordance with Section 35 of the Plant Law 1995 ( rechte column of the figure in Annex 6, upper and medium line); This number has to start with a letter code for each of the countries concerned, as a result, containing paragraph 8 as a coding of the plant protection area of wood and ending with a number combination of numbers that will be identified for each operation;

3.

Acronym for each approved measure ( rechte column of the picture in Annex 6, below line):

(a)

HT (Heat treatment) for heat treatment,

(b)

KD (Kiln-drying) for technical drying,

(c)

CPI (Chemical pressure inpregnation) for chemical pressure impregnation,

(d)

MB (methyl bromide) for gasification with methyl bromide or

(e)

DB (Debarking).

(3) Producers or guardians can add control numbers or other information to identify certain batches. Other information can be included if it is ensured that it is not confusing, misleading or misleading.

(4) Labelling

1.

must be legible, durable and non-transferable,

2.

must be visible, preferably on at least two opposite sides of the labeled packaging wood, and

3.

must not be exported to the colours of red or orange.

Re-valued, reprocessed or improved packaging wood has to be relabelled, with all elements of this packaging wood being treated.

(5) The following definitions and requirements apply to the application of the measures referred to in paragraph 2 Z 3:

1.

HT: heat treatment is the process where a product is heated until it reaches a minimum temperature for a minimum period of time; ensure that a minimum core temperature of the packaging wood of 56oC is reached for at least 30 minutes by applying a specific time temperature scheme;

2.

KD: Technical drying is the process where wood is dried in a closed chamber under heat effects or humidity control;

3.

CPI: Chemical pressure impregnation is the process in which wood is treated with a chemical preservative under specific pressure using steam, hot water or dry heatze;

4.

MB: Gasification is the process of treating a type of goods with a chemical that is completely or mainly in gaseous state; In the case of gasification with methyl bromide in a closed area, the minimum standard must be observed:

(a)

The minimum temperature must not be less than 10oC;

(b)

the minimum treatment period may not be less than 16 hours;

(c)

The following dosages must be observed:

DB: Defection is the case in which cattle are removed from roundwood, with the wood not necessarily completely rigorous; In the case of detachment, the wood bovine, except the basal tissue, adult cattle around ast nodes and bovine bags must be removed between year ringens.

(6) The measures referred to in paragraph 5 Z 2 (KD) and in accordance with paragraph 5. 5 Z 3 (CPI) can only be applied if, according to the state of science and technology, it is possible to ensure that the measure is implemented in accordance with paragraph 2. 5 Z 1 (HT) required treatment results. The phytosanitary provisions of the third country or, where appropriate, of the transit countries are relevant for the application of the measure in accordance with paragraph 5 (DB). “

2. In § 17 Z 7, the word sequence will be "in the version of Directive 2005/15/EC amending Annex IV to Council Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plants and plant products (OJ L 56, 2.3.2005 S 12)" by the words "in the version of Directive 2006/14/EC amending Annex IV to Council Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plants and plant products (OJ No L 34, 7.2.2006 S 24)" replaced.

In § 17 Z 9, a, the word sequence will be "in the version of Directive 2005/16/EC amending Annexes I to V of Council Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plant and plant products (OJ L 57, 3.3.2005 S 19)" by the words "in the version of Council Directive 2005/77/EC amending Annex V to Council Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plant and plant products (OJ No L 296 of 12.11.2005 S 17)" replaced.

4. In § 18, after Z 32 of the point, it is replaced by a bar point and is added to:

"33.

Directive 2005/77/EC amending Annex V to Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plant and plant products (OJ No L 296 of 12.11.2005 S 17);

34.

Directive 2006/14/EC amending Annex IV of Council Directive 2000/29/EC on measures to protect the Community against the introduction and spread of harmful organisms of plants and plant products (OJ No L 34, 7.2.2006 S 24). “

5. In § 19, 15 am added:

"(15) § 17 Z 7 as amended by Regulation BGBl. II No. 87/2006 March 2006. § 17 Z 9 (a) as amended by Regulation BGBl. II No. 87/2006 May 2006 in force. “
