43. Federal Law, with which the University of Applied Sciences Law, the MTD Act and the Hebammengesetz are amended

The National Council has decided:

Article 1

Amendment of the Universities of Applied Sciences Law

The Federal Act on Universities of Applied Sciences (Fachhochschul-Studiengesetz-FHStG), BGBl. No 340/1993, as last amended by the Federal Law BGBl. I No 110/2003, shall be amended as follows:

1. § 3 para. 2 Z 2 first sentence reads:

"The period of study has to be six semesters in universities of applied sciences (universities of applied sciences), two to four semesters in Master's degree programs of applied sciences and eight to ten semesters in Bachelor's degree programs."

2. Section 3 (2) (2a) shall read:

" 2a.		Universities of applied sciences (Fachhochschul-Bachelorstudiducts) may only be set up in connection with master's degree programmes of a university of applied sciences or university degree programs of the same holder. "

3. § 3 para. 2 Z 3 first sentence reads:

"Within the framework of universities of applied sciences and universities of applied sciences, students are required to apply for a professional internship, which is a part of the course of study that is relevant to the training."

4. § 3 para. 2 Z 6 reads:

" 6.		The final diploma examination is an overall examination, which is composed of the writing of a thesis and an examination of a commission. In universities of applied sciences (universities of applied sciences), there is an obligation to produce independent written work which is to be written within the framework of courses (Bachelor thesis); the final Bachelor examination consists of a Commission Examination. "

5. § 4 para. 2 first sentence reads:

" Professional admission to a university of applied sciences or a university of applied sciences degree course is the general university entrance qualification or a relevant professional qualification; a professional access condition to a university degree course Master's degree program is a completed subject-relevant university of applied sciences bachelor program or the completion of an equivalent course of studies at a recognized domestic or foreign post-secondary educational institution. "

6. § 5 (2) reads:

"(2) The academic degrees have a" Bachelor ... "for universities of applied sciences," Master ... ", or" Diplom-Ingenieurin/Diplom-Ingenieur ... ", respectively, with an addition characterizing the subjects of the subjects. The academic degrees "Magistra/Magister ..." or "Diplom-Ingenieurin/Diplom-Ingenieur ...", each with an addition of the subject groups and the "(FH)", have to be read for the "Fachhochschul-Diploma" degree programs. If an academic degree has "(FH)", the leadership of this academic degree is inadmissible without the addition of "(FH)". The permissible academic degrees, the additional designations and the abbreviation of the academic degrees are fixed by the University of Applied Sciences Council; this decision requires the approval of the relevant Federal Minister or of the competent Federal Minister. For the individual university of applied sciences, the respective academic degree and the additional title must be determined by the University Council of Applied Sciences in the letter of accreditation. "

7. § 5 (3) reads:

" (3) The successful completion of a Master's degree course of applied sciences or a degree course of a university of applied sciences entitles you to a subject-specific doctoral programme at a university which, in the case of a student in comparison with the relevant subject-related subject Master or diploma studies at the universities of the shorter study period of the "Fachhochschul-Masterstudiengang" or the "Fachhochschul-Diploma" degree program will be extended by the difference. "

8. § 15 para. 2 Z 1 reads:

" 1.		At least two courses of study of the institution applied for are accredited as a Bachelor of Applied Sciences degree course with a Master's degree course of applied sciences or a Diploma of the University of Applied Sciences (UAS); "

9. § 21 (4) reads:

" (4) The right to maintain an academic degree already conferred shall remain unaffected. If the academic degree was awarded "(FH)", the leadership of this academic degree is not permitted without the addition "(FH)". Graduates are, however, entitled to lead the academic degree to the academic degree set on the basis of section 5 (2) instead of the academic degree awarded. On request, the holder shall issue a confirmation of this. "

10. The following paragraph 6 is added to § 21:

" (6) Previous universities of applied sciences and universities of applied sciences (Fachhochschul-Magister courses) are considered as universities of applied sciences and applied to the Master of Applied Sciences Master's programs in accordance with § 3 paragraph 2 Z 2, previous Bakkalaureatstheses are considered to be Bachelor theses in accordance with § 3 paragraph 2 Z 6. "

Article 2

Amendment of the MTD Act

The federal law on the regulation of high-end medical-technical services (MTD law), BGBl. No. 460/1992, as last amended by the Federal Law BGBl. I No 70/2005, is amended as follows:

1. In § 3 (4), the word "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.

2. In § 3 (5) the word "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.

3. In § 3 para. 6 Z 1 the word "Fachhochschul-BakkalaureatsstudiProgrammes" by the word "Fachhochschul-BachelorstudiProgrammes" and the word "Fachhochschul-Bakkalaureatsstudipassages" by the word "Fachhochschul-Bachelorstudipaths" replaced.

4. In § 3 para. 6 Z 2, the word "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.

Article 3

Amendment of the Hebammen Act

The Hebammen Act, BGBl. No. 310/1994, as last amended by the Federal Act BGBl. I No 70/2005, is amended as follows:

1. In Section 11 (2), the word shall be: "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.

2. In Section 11 (3), the word "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.

3. In § 11 para. 4 Z 1 the word "Fachhochschul-BakkalaureatsstudiProgrammes" by the word "Fachhochschul-BachelorstudiProgrammes" and the word "Fachhochschul-Bakkalaureatsstudipassages" by the word "Fachhochschul-Bachelorstudipaths" replaced.

4. In § 11 para. 4 Z 2, the word shall be "Fachhochschul-Bakkalaureatsstudiengang" by the word "Fachhochschul-Bachelorstudiengang" replaced.
