Regulation of the Federal Minister of Health, amending the Regulation on an investigative programme to combat bovine viral diarrhoea and Mucosal Disease in cattle (BVD Regulation 2007)

On the basis of § 2 (1) to (3) and § 7 of the Animal Health Act (TGG), BGBl. I n ° 133/1999, as last amended by the Federal Law BGBl. I n ° 80/2013, is assigned in agreement with the Federal Minister of Finance and the Federal Minister for Agriculture, Forestry, Environment and Water Management:

The BVD Ordination 2007, BGBl. II No 178/2007, shall be amended as follows:

1. The Section 3 section of the table of contents reads:

" § 3

Investigative bodies, sampling in the context of official labelling and electronic transmission of data on stock and animal data "

2. The Section 16 section of the table of contents is:

3. In § 2 (1) the following Z 15 is added:

" 15.		VIS: according to § 8 of the Animal Health Act (TSG), RGBl. No 177/1909, as last amended by the Federal Law BGBl. I No 80/2013, established electronic veterinary register. "

4. The heading of § 3 reads:

"investigative bodies, sampling within the framework of official labelling and electronic transmission of inventory and animal data"

5. In Section 9 (2), the second sales designation shall be deleted. "(2)" .

6. § 14 para. 1 Z 1 lit. a is:

" (a)			the basic or final inspection has not been longer than three months, and in the case of animals which are allied, a one-time interval of no more than four months between two check-ups shall be allowed for the period of the Alpung, or "

7. § 14 (3) reads:

" (3) A pregnant bovine animal from an officially recognised BVD virus free stock may be placed on the market if it is ensured that the bovine animal is not persistently infected and if it is at least three months prior to the date of the The placing on the market of a single animal test with BVD antibody-negative result has been subjected to the procedure. This single animal test shall be deleted if:

1.		the basic or final inspection has been carried out for a period not exceeding three months, and the bovine animal in question has already been held at the time of the last investigation for at least six months in the stock concerned; or
2.		the conditions laid down in paragraph 6 (2) are satisfied, provided that the bovine animal concerned has already been held at least six months in the relevant stock at the time of the basic or final inspection, or
3.		in the case of a bovine animal from a BVD-free stock officially recognised in accordance with Article 9 (8) or (10) (2), which is to be made available on a Community grazing, it is ensured that it is not persistently infected and that it is not to be expected that: it calves down on the common pasture, or
4.		the detection of BVD antibodies has been carried out after the ninth month of life and prior to the occupation. "

8. In § 14 (4), first sentence, the word "only" .

9. § 14 (5) reads:

" (5) By way of derogation from paragraph 4, a pregnant beef may be placed on the market from a suspected stock even if the detection of BVD antibodies has taken place after the ninth month of life and before the occupancy and the bovine is not against BVD. have been vaccinated. "

10. § 14 (6) Z 2 lit. c is:

" (c)			the number of officially recognised BVD-virus-free holdings is at least 95%, and this percentage may also be undershot in justified cases and "

11. The final part of Section 14 (6) reads as follows:

12. § 15 para. 1 first sentence reads:

" § 15. (1) The animal owner or the owner of the animal shall ensure that the veterinary health certificates are available for bovine animals at the time of their placing on the market. "

13. § 16 together with the title is:

§ 16. (1) Only bovine animals which have been placed on the market in accordance with the provisions of sections 14 and 15 of this Regulation may be introduced into stocks which are subject to this Regulation.

(2) Non-proven BVD-virus-free bovine animals which are brought into an operation under this Regulation shall be kept at a separate epidemiological unit for as long as an examination result is available showing that: that the cattle spent are BVD virus-free. "
