80. Federal Act, with which the Dental Act and the Dental Medical Law are amended

The National Council has decided:

Article 1

Amendment of the Dentist Act

The Dentist Act-ZÄG, BGBl. I No 126/2005, as last amended by the Federal Act
BGBl. I n ° 39/2006, is hereby amended as follows:

1. In the table of contents will be after the 7. Section of the following 7a. Section inserted:

2. In § 2 Z 3, the expression "78/1026" by the expression "78/1026/EEC" replaced.

Practical training of students of dentistry

General

§ 50a. (1) Within the framework of the study of dentistry, parts of the practical training carried out at the medical universities can, in accordance with the requirements of the study law, up to a maximum extent of 36 weeks in

1.		a recognised dental teaching practice,
2.		a recognised dental teaching group practice,
3.		a recognised dental amordiary ulatory, or
4.		another recognised dental training institution
be completed.

(2) Practising practical training in dentistry in recognised dental teaching practices, dental teaching groups, dental teaching laboratories or other dental training centres may only be used in the following fields:

1.		by members of the dental profession in accordance with § 50c and
2.		on the basis of a written agreement of the respective medical university with the holder of the dental teaching practice, with the dental teaching group practice or with the legal entity of the dental teaching ulcer or of the other dental training institution

§ 50b. (1) The Austrian Dentist Chamber has

1.		at the request of one of the members of the dental profession, the power of practical training in dentistry in accordance with § 50c,
2.		at the request of one of the members of the dental profession in accordance with § 50c, the recognition of an office of ordination or Group practice as dental teaching practice or dental teaching group practice according to § 50d para. 1 and 2 and
3.		at the request of the legal institution of a hospital in which the person of the dental profession is employed in accordance with § 50c, the recognition of a hospital as a dental teacher training institution or a dental training institution, respectively as other dental training institution pursuant to § 50d (3)
after consultation of the medical universities.

(2) The Austrian Dentist Chamber has

1.		a power granted pursuant to paragraph 1 (1) (1); and
2.		a recognition granted pursuant to paragraph 1 (2) or (3)
after consultation of the medical universities, if it is found that one of the conditions for the grant of the power or power to be granted has been fulfilled, the recognition was not initially given or has been subsequently omitted.

(3) The appeal to the Federal Minister for Health and Women (Federal Minister for Health and Women) shall be open to the decision on the granting or withdrawal of the power or recognition pursuant to para. 1 and 2.

Power of practical training in dentistry

§ 50c. The power of practical training in dentistry may only be granted if the person (s) of the dental profession (s)

L.		an at least eight-year independent exercise of the dental profession (§ 23) in Austria, another EEA State Party or the Swiss Confederation, in which comprehensive knowledge of the patient's frequency is included, Experience and skills in dentistry have been acquired, and
2.		Holder of a recognised dental teaching practice or partner of a recognised dental teaching group practice, or in the service relationship with a recognised dental lecturer or other recognised dental training centre.

Dental teaching practices, dental teaching group practices, dental teaching laboratories and other dental training centres

§ 50d. (1) The recognition of a place of ordination as a dental teaching practice may only be granted if it is guaranteed that:

1.		The dental services provided by the person (s) of the dental profession in accordance with § 50c in the Ordination Centre shall provide the students of dentistry with the necessary knowledge, experience and skills in accordance with the content and scope of the dental services provided. communicate and
2.		the ordination site has the patient frequency and equipment required to achieve the training target, in particular in terms of apparatus.

(2) The recognition of a group practice as a dental teaching group practice may only be granted if:

1.		at least two members of the dental profession in accordance with § 50c are active in the teaching group practice as partners during the opening hours of the teaching group practice,
2.		ensures that the dental services provided by the members of the dental profession in accordance with § 50c in the group practice shall provide the students of dentistry with the necessary knowledge, experience and experience in accordance with the content and scope of the procedure. Teaching skills and
3.		It is ensured that the group practice has the patient frequency and equipment required to achieve the training target, in particular in terms of the apparatus.

(3) The recognition of a hospital in the form of an independent ambulatory for dentistry as a dental teacher training institution as well as of hospitals other than dental training centres may only be granted if:

1.		at least two members of the dental profession are employed in the hospital in accordance with § 50c,
2.		the members of the dental profession are employed in accordance with § 50c to such an extent that their presence during the working hours of the teaching institution or the other training institution shall be attended by an activity of the student of the Dentistry is only guaranteed under the guidance and supervision of the person concerned of the dental profession in accordance with § 50c,
3.		the training programme or the departments or organisational units of the hospital which have been envisaged for training have the necessary health-care facilities,
4.		ensures that the dental services provided by the relatives of the dental profession in accordance with § 50c in the hospital provide the students of dentistry with the necessary knowledge, experience and experience in accordance with the content and scope of the procedure. Teaching skills and
5.		It is ensured that the device has the patient frequency and equipment required to achieve the training target, in particular in terms of the apparatus.

Training in dental teaching practices, dental teaching group practices, dental teaching laboratories and other dental training centres

§ 50e. (1) The member of the dental profession according to § 50c is in the framework of the training in dental teaching practices, dental teaching group practices, dental teaching laboratories or other dental training centres for the mediation of the Practical knowledge and skills required for the students of dentistry in the course of his/her professional practice.

(2) The students of dentistry may be enrolled in dental teaching practices, dental teaching group practices, dental teaching laboratories or other dental training places in accordance with § 4 only under the guidance of the students. and supervision of a member of the dental profession in accordance with § 50c.

(3) The members of the dental profession in accordance with § 50c shall, in accordance with the provisions of the law of study, continuously review the acquisition of practical knowledge and skills and shall assess whether they meet the requirements of the to the relevant medical university. The assessment should be noted in the service catalogue.

(4) Only one student/student of dentistry may be trained in a dental teaching practice. In a dental teaching group practice, a dental lecturer or other dental training institution, the number of students of dentistry to be trained may be the number of students in the dental teaching group practice, in the In accordance with § 50c of the dental profession, or in the other dental training institution, persons employed in the dental profession shall not exceed the requirements laid down in § 50c.

(5) The training in dental teaching practices, dental teaching group practices, dental teaching laboratories or other dental training centres does not establish a service relationship. "

4. In Section 51 (3) Z 1, according to the paragraph-and sentence-string "§ 49 (1)," the paragraph and sentence string "§ 50a (2), § 50e (1) to (4)," inserted.

5. The previous wording of § 72 shall be replaced by the sales designation "(1)" , the following paragraph 2 is added:

" (2) With the expiry of the 31 December 2012

1.		in the table of contents of 7a Section of the 1. Main item,
2.		1. The main part of the 7a. Section and
3.		in Section 51, Section 3, Z 1, the paragraph and sentence string "§ 50a Para. 1, § 50e para. 1 to 4,"
in the version of the Federal Law BGBl. I No 80/2006. '

Article 2

Amendment of the Dentist Protection Act

The Dental Medical Association Act-ZÄKG, BGBl. I n ° 154/2005, is amended as follows:

1. In accordance with § 20 (1) Z 7 the following Z 7a and 7b shall be inserted:

" 7a.		the granting and withdrawal of the power of practical training in dentistry;
7b.		recognition and withdrawal of the recognition of dental teaching practices, dental teaching group practices, dental teaching laboratories and other dental training centres; "

1a. § 39 (2) reads:

"(2) The meetings of the State Committee shall be convened and chaired by the President/President of the State Dentistry Chamber."

2. In § 52 (1) (4), the word shall be "Society" by the word "Setup" replaced.

3. In § 69 (3), first sentence, the word "You" by the word "The" replaced.

4. § 109 para. 1 Z 10 shall be added at the end of an indents.

5. In § 116 (4) (3), the word "Provincial Dental Chambers" by the word "Landeszahnärztekammer" replaced.

6. In § 122 (1), after the word "Erlassung" the word "the" inserted.

7. The previous wording of § 126 shall be replaced by the sales designation "(1)" , the following paragraph 2 is added:

" (2) With the expiry of 31 December 2012, Section 20 (1) Z 7a and 7b of the Federal Law of the Federal Republic of Germany shall be replaced by the Federal Law BGBl Act. I No 80/2006. '
