334. Regulation of the Federal Minister of Transport, Innovation and Technology, with which the Motor Transport Act-Implementing Regulation (1967) is amended (52. Novelle to the KDV 1967)

Due to the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law, BGBl. I No 57/2006, shall be ordered:

The law on force driving-Implementing Regulation 1967, BGBl. No 399, as last amended by the BGBl Regulation. II No 412/2005, shall be amended as follows:

1. 1a (1a) reads:

The projecting outer edges of two-or three-wheel motor vehicles shall comply with the requirements laid down in Chapter 3 of Directive 97 /24/EEC, OJ L 73, 27.3.1997, p. No. OJ L 226 of 18 August 1997, as amended by Directive 2006 /27/EC, OJ L 206, 22.7.2006, p. No. OJ L 66 of 8 March 2006, S 7. In the case of three-wheel motor vehicles designed for the carriage of passengers, the projecting outer edges shall comply with the Annexes to Directive 74 /483/EEC relating to the projecting outer edges of motor vehicles of category M1. "

(2) In accordance with Article 1a (7), the following paragraph 8 is added:

" (8) frontal protection systems are self-contained structures, such as anti-ramming shackles, or additional bumpers which cover the outer surface of the vehicle above and/or below the bumper attached as the original part in the event of a collision with an object to protect against damage. Structures with a maximum mass of less than 0,5 kg intended solely for the protection of headlamps shall not fall within the scope of this definition. Frontal protection systems of vehicles of category M1 with a maximum authorised mass of no more than 3 500 kg and N1 must be subject to Directive 2005 /66/EC on the use of frontal protection systems, OJ L 206, 22.7.2005, p. No. OJ L 309 of 25 November 2005, S 37. "

3. § 1b para. 2 reads:

" (2) The engine power of compression-ignition and positive-ignition engines is in accordance with Directive 80 /1269/EEC, Annex I, as amended by Directive 1999 /99/EC, OJ L 327, 30.12.1999, p. No. OJ No L 334, 28. 12. 1999, S 32. For vehicles according to Appendix 1, Table 3 Z 4, the engine power can also be determined in accordance with the ECE Regulation No 24. The engine power of two-and three-wheel motor vehicles is in accordance with Directive 95 /1/EC, Annex II, as amended by Directive 2006 /27/EC, OJ L 206, 22.7.2006, p. 4. § 1c (1) to (3a) are:

" (1) Safety belts for adult persons shall be subject to the Annexes to Directive 77 /541/EEC, as amended by Directive 2005 /40/EC, OJ L 103, 25.4.2005, p. No. OJ L 255 of 30 September 2005, S 146, or of the ECE Regulation No 16.

(2) Restraint systems for children must be subject to the ECE Regulation No 44, BGBl. No 267/1990. Child restraint systems for children as defined in § 106 (5) of the 1967 KFG are valid for children

From a height of 135 cm, also in accordance with Regulation No. 16, height-adjustable three-point belts are approved, in which height-adjustable upper anchorage points or in connection with height-adjustable seats of the intended course of the Gurten over the body of the child is reached,

2.

from a weight of 18 kg, a lap belt without additional restraining means, if the seat is only equipped with a lap belt and when the other seats are occupied,

(3a) The anchorages for the safety belts and the safety belts of three-wheel mopeds, tricycles and four-wheeled vehicles (class L) must be provided for in Chapter 11 of Directive 97 /24/EC, as amended by Directive 2006 /27/EC, OJ L 73, 14.3.2006, p. No. OJ L 66 of 8 March 2006, S 7.

5. § 1d (1) (a), (2) and (3) are:

" (1a) motor vehicles with positive-ignition engines or compression-ignition engines with at least 4 wheels, a maximum authorised mass of more than 400 kg and a maximum design speed of at least 50 km/h, with the exception of land or Forestry tractors and working machines, as well as other machinery, insofar as they fall within the scope of Directive 70 /220/EEC, must comply with the requirements of this Directive as amended by Directive 70 /220/EEC, as amended in 2001 /100/EC . Vehicles or engines for motor vehicles which fall within the scope of Directive 2005 /55/EC, OJ L 327, 30.4.2005, p. No. OJ L 275, 20. 1, as amended by Directive 2005 /78/EC, OJ L 327, 30.12.2005, p. No. OJ L 313, 29.11.2005, p. 1, must comply with the requirements of these Directives in respect of their exhaust behaviour.

(2) Vehicles of categories M1 and N1 must be subject to an on-board diagnostic system (OBD) for emission control within the meaning of Directive 70 /220/EEC, as amended by Directive 98 /69/EC, 1999 /102/EC, 2001 /1/EC, 2002 /80/EC and 2003 /76/EC, OJ L 327, 22.11.2003, p. No. OJ No L 206, 15 August 2003, p. 29. Vehicles of categories M2, M3, N2 and N3 must have an on-board diagnostic system (OBD) or an on-board measurement system (OBM) for emission control within the meaning of Directive 2005 /55/EC, as amended by Directive 2005 /78/EC. The OBD system is a diagnostic system for emission monitoring installed on board the motor vehicle, which must be able to perform malfunctions of the emission control devices and their probable malfunctions with the aid of computer-stored fault codes. Causes to display. The OBD system shall be designed, constructed and installed in the vehicle in such a way as to be capable of indicating, throughout the life of the vehicle, certain types of deterioration and malfunctions of the emission control devices.

(3) Vehicles with compression-ignition engines or gas engines shall comply with the following requirements with regard to the durability of the emission control devices:

1.

the manufacturer of a self-ignition engine or a gas engine type-approved on the basis of the limit values set out in line B1, B2 or C of the tables in section 6.2.1 of Annex I to Directive 2005 /55/EC, as amended by Directive 2005 /78/EC, shall be applicable to all Vehicle types and engines shall demonstrate that the engine does not exceed these limit values during the following period of use:

a)

100000 km or five years, whichever is the first, in the case of engines for installation in vehicles of categories N1 and M2;

b)

200000 km or six years, whichever is the first, in the case of engines for installation in category N2, N3 vehicles with a technically permissible maximum mass of up to 16 tonnes and M3 class I, class II and class A, and class B with a technical grade the maximum authorised mass of up to 7.5 tonnes;

c)

500000 km or seven years, whichever is the first, in the case of engines for installation in category N3 vehicles with a technically permissible maximum mass of more than 16 tonnes and M3, Class III and Class B, with a technically permissible maximum mass of more than 7.5 tonnes.

2.

Furthermore, the functioning of the emission-relevant equipment must be confirmed during the normal life of a vehicle under normal operating conditions (conformity of in-service vehicles, which are: properly maintained and deployed). "

6. § 1d (9) reads:

" (9) Replacement Catalytic Converters

1.

The replacement catalytic converter shall be designed, constructed and installed in such a way that the vehicle is capable of complying with the provisions of the Directive which it originally complied with. In addition, its pollutant emissions must be effectively limited during the entire life of the vehicle under normal conditions of use. The replacement catalytic converter shall be installed at the same location as the initial equipment catalytic converter, and the position of any oxygen probe (s) on the exhaust pipe shall not be altered. If the catalyst for the initial equipment has heat protection devices, the replacement catalytic converter must also have corresponding protective devices. The replacement catalytic converter shall be permanent, that is to say it must be of such a nature and can be installed in such a way that it is adequately protected against corrosion and oxidation influences which it is exposed to depending on the use of the vehicle. is. "

Section 1f (1a) reads as follows:

" (1a) The rear underrun protection of vehicles of category M, N and O shall comply with the requirements of Annex II to Directive 70 /221/EEC, OJ L 327, 31.12.1991, p. 8. § 3 (3) reads:

Agricultural and forestry tractors (class T) with a maximum design speed of not more than 40 km/h, shall be subject to the Annexes to Directive 76 /432/EEC in respect of their braking systems, OJ L 73, 27.2.1976, p. 9. § 3m is deleted.

Section 4 (3d) reads as follows:

" (3d) tyres for two-or three-wheel vehicles (category L) shall be replaced by Chapter 1 of Directive 97 /24/EC, as amended by Directive 2006 /27/EC, OJ L 73, 14.2.2006, p. No. OJ L 66 of 8 March 2006, S 7. Tyres with a component type-approval pursuant to Directive 92/23/EEC may also be fitted on motorcycles fitted with side-cars, three-wheel mopeds, tricycles and four-wheeled vehicles. "

11. § 4 (4) and (4a) are:

" (4) The depth of the recesses of the tread (tread depth) required for the discharge of the water from the tread of the tyre shall be in the middle region of the tread, which occupies about three quarters of the tread width,

in the case of motor vehicles having a design speed of more than 25 km/h, with the exception of motorcycles, and in the case of trailers with which a speed of 25 km/h may be exceeded, at least 1.6 mm on the entire circumference,

in the case of motor vehicles and trailers with a maximum permissible gross laden weight of more than 3 500 kg, at least 2 mm,

Tyres for passenger cars and combined vehicles must be provided with indicators. These must be arranged on at least four points uniformly distributed over the circumference of the tyre in such a way that they make it permanently and clearly identifiable as to whether the minimum depth of the main profile grooves of 1.6 mm is reached or fallen below. 12. The previous § 7i is given the section title § 7c.

13. The previous § 7j is given the section title § 7d and reads as the title:

" Motor vehicles powered by natural gas (CNG)

§ 7d. Motor vehicles powered by natural gas (CNG) and their special equipment for the propulsion of natural gas (CNG) must comply with the ECE Regulation No 110. "

14. In accordance with § 7d the following § § 7e and 7f shall be added together with the headings:

" Operating regulation and operating manual for motor vehicles powered by natural gas (CNG)

§ 7e. (1) An operating rule must be provided for each vehicle with propulsion by natural gas (CNG), which is being carried out in § 7d. The operating instructions are to be carried on journeys. It shall contain the rules generally applicable to the handling of natural gas (CNG) as fuel, as well as the instructions for use to be kept in respect of the construction and equipment of the vehicle. The operating rules must include in particular the following provisions:

1.

Functional description and technical data of the CNG fuel system,

2.

Instructions for the proper operation of the CNG fuel system,

3.

Notes on the maintenance requirements relating to the CNG fuel system,

4.

an indication of the need to carry out periodic reviews of the CNG fuel system;

5.

Instructions on how to behave in the event of gas odour,

6.

Description of the way in which the CNG fuel system is temporarily and permanently taken out of operation,

7.

Reference to the responsibility for carrying out repairs and structural changes to the CNG fuel system,

8.

An indication of the obligation to maintain an operating book.

(2) For each of the vehicles listed in Section 7d, there must be an operating manual, which is either from the vehicle manufacturer, the manufacturer of the CNG fuel system or from the company that carried out the installation of the CNG fuel system, is issued. The following documents shall be entered in this document:

1.

Manufacturer's numbers of the power tank,

2.

the date and the outcome of the periodic reviews carried out,

3.

the date and extent of repairs and structural changes to the CNG fuel system,

(3) The operating book shall be kept for at least two years from the last registration and shall be kept by the authority upon request and within the framework of the official inspection of the vehicle in accordance with Section 57 of the Kraftfahrgesetz 1967 or the returning date To be presented in accordance with § 57a of the Kraftfahrgesetz 1967.

Retrofitting of vehicles with gas installations

§ 7f. The retrofitting or conversion of vehicles to LPG (LPG) or natural gas (CNG) vehicles shall comply with the requirements of ECE Regulation No 115 and may only be fitted with special retrofit systems approved in accordance with the provisions of the EC Regulation No 115 for Liquefied petroleum gas (LPG) or for natural gas (CNG). After the conversion, the provisions of § § 7c and 7e for these vehicles must be in place and an operating book must be carried out in accordance with the provisions of § § 7c and 7e. "

Section 8b (2) reads as follows:

" (2) The fulfilment of the conditions set out in paragraph 1 shall be based on an expert opinion according to § 125 KFG 1967, a civil engineer, a technical office-engineering office, a technical service or the approval authority of the respective Certification State on a form according to Appendix 1h. For vehicles which are in conformity with the measured vehicle with respect to the noise-relevant parts, this agreement shall be confirmed by the manufacturer or his authorised representative in the issuing State in a form according to Appendix 1h. This form is issued by the Federal Ministry of Transport, Innovation and Technology only to persons who are authorized to issue the exhibition. 16. § 10 (7) reads:

" (7) The lighting equipment referred to in § § 14 to 20 of the 1967 KFG must be fitted on the vehicle in the case of motor vehicles and trailers in such a way as to ensure that they are subject to the provisions of the annexes to the relevant directives.

. Fog lights, the outermost point of which is more than 40 cm away from the outermost edge of the vehicle, must be switched in such a way that they can only illuminate together with the dipped-beam. In the case of subsequent installation of fog lamps, the distance allowed for the lowest point of the light exit area of 25 cm shall also be slightly below the roadway, provided that the effect of the fog lamp is maintained, and an excessive glare of the oncoming traffic cannot occur. "

17. § 15a reads:

" § 15a. (1) Warning luminaires are luminaires that emit blue or yellow flashing or rotary light (§ 20 para. 7 KFG 1967) as all-round light or directional flashing light. Warning lights are divided into the following categories:

1.

Category I-luminaires with all-round light

2.

Category II-directional flashing lights

3.

Category III-Warning lights with yellow flashing light for school transport in accordance with § 106 (10) KFG 1967

4.

Category IV-Warning lamps for the exclusive use as loading warning lamps for the identification of attachments or lifting platforms according to Article 20 (1) (lit). g KFG 1967.

(2) Warning lamps in categories I to IV shall have the general technical requirements for resistance to vibration, corrosion phenomena, temperature influences, moisture and material changes due to ageing .

(3) Alert lamps in categories I and II must comply with the relevant provisions of ECE Regulation No 65. Category III warning lamps must comply with Appendix 2b. Category IV warning lamps (loading warning lamps) shall comply with the technical lighting requirements for rear-mounted direction indicator lamps in accordance with ECE Regulation No 6.01.

(4) The following warning lights may be used as warning lights for buses which are used for student transport in the sense of § 106 para. 10 KFG 1967:

1.

gated warning lights of category I with all-round light (rotary light)

2.

Category II gated warning lights with directional flashing light

3.

Category III warning lamps with yellow flashing lights specially designed for the transport of pupils with buses; these lights must emit at least 700 cd flashing lights on the left and on the right with a light intensity.

The pairwise attachment of these warning lights shall be located at the rear upper edge of the vehicle or where the roof top is started or on the roof. They can be attached to the outside of the vehicle or integrated into the body. Fitting inside the vehicle in the upper part of the vehicle behind the rear window is permitted, provided that the light intensity measured externally is at least 700 cd. The warning lights must be able to be switched on independently of other headlights and luminaires and in addition to the alarm system. "

18. § 17b (1) reads:

" (1) The electromagnetic compatibility of vehicles of categories M, N and O must comply with the requirements of the Annexes to Directive 72 /245/EEC, OJ L 206, 22.7.1972, p. Section 17b (4) reads as follows:

" (4) Electrical/electronic sub-assemblies, parts and equipment which are connected to the electrical vehicle electrical system of the vehicle and are normally used during the journey, the electromagnetic disturbance within the meaning of the Directive 72 /245/EEC, as amended by Directive 2005 /49/EC, OJ L 73, 27.2.2005, p. "

20. § 17f (3) reads:

In the case of two-or three-wheel motor vehicles (class L), the defrosting plant and the windscreen drying system shall be replaced by Chapter 12, Annex II to Directive 97 /24/EC, as amended by Directive 2006 /27/EC, OJ L 327, 22.12.2006, p. No. OJ L 66 of 8 March 2006, p. 7.

21. § 18a (1) and (2) are:

" (1) single-track motor vehicles with a design speed of

22. § 18b reads:

" § 18b. Seats, the anchorage and headrests of which shall be attached to vehicles of categories M and N to the Annexes to Directive 74 /408/EEC, OJ L 103, 25.4.1974, No. OJ L 221 of 12 August 1974, p. 1, as amended by Directive 2005 /39/EC, OJ L 327, 30.12.2005, p. No. L 255 of 30 September 2005. "

23. § 19b (5) and (6) are:

Roll-over protection structures for agricultural and forestry tractors of the lof class shall be subject to the provisions of the Annexes to the relevant EC Directive.

(6) The sound level measured at the height of the handlebars of agricultural tractors shall be subject to the provisions of Directive 77 /311/EEC, as amended by Directive 2006 /26/EC, OJ L 73, 14.2.2006, p. No. OJ L 65 of 7 March 2006, p. 22.

Article 20a (1) reads as follows:

" (1) The relevant provisions of this Regulation shall be deemed to have been complied with if, instead of the provisions of this Regulation, the vehicle complies with the relevant harmonised provisions of the separate Directives which:

Test specifications for warning lights

The warning lamps of category I to IV have general technical requirements with regard to resistance to normal vibration, corrosion phenomena, temperature influences, moisture, material changes due to ageing. .

1. Category I: Lights with all-round light:

Lamps with all-round light must comply with the relevant provisions of ECE Regulation No 65.

2. Category II: Direction-bound flashing lights:

Directional flashing lights must comply with the relevant provisions of ECE Regulation No 65.

General provisions relating to luminaires of categories I and II:

Where gas discharge lamps are used for the production of light flashes, they must be an integral part of the lamp in such a way that replacement of the light source can only take place in the responsibility of the manufacturer of the lamp.

All the components required for the operation of the luminaire must be part of the lamp. If, by way of derogation from this, electrical subassemblies are not an integral part of the lamp, they must be provided with the approval mark.

3. Category III: Warning lights with yellow flashing light for school transport in accordance with § 106 para. 10 KFG 1967:

In the main emission direction, the light intensity shall not be less than 700 cd and in no light direction shall be more than 1400 cd.

Light distribution:

The light intensity distribution of category III warning lamps shall be determined in accordance with Appendix 3. For the following points, the specified minimum values in% of the main emission direction HV shall be provided:

Warning lamps for the exclusive use as a loading warning lamp for the identification of attachments or lifting platforms according to § 20 (1) (lit). g KFG 1967 must comply with the lighting specifications for rear-mounted direction indicator lamps in accordance with ECE Regulation No 6.01. "
