430. Ordinance of the Federal Minister of the Interior on the basic training of the Executive Service (Basic Education Regulation-Executive Service of the BMI)

On the basis of § § 25 to 31 and 144 of the Civil Service Act 1979 (BDG 1979), BGBl. No. 333, as last amended by the Federal Law BGBl. I n ° 129/2006, and Section 11 (4) of the Security Policy Act (SPG), BGBl. No 566/1991, as last amended by the Federal Law BGBl. I n ° 56/2006, is being prescribed:

Scope

§ 1. This Regulation lays down rules for the area of the Federal Ministry of the Interior

1.

the basic training for the executive service;

2.

the basic training for the E 2a group of services (senior officials) in the Executive Service;

3.

the basic training for the E 1 use group in the Executive Service.

Objectives and principles of basic training

§ 2. (1) The basic training aims both in terms of content and methodology both on the teaching of factual knowledge and on the acquisition of methods and action knowledge in the sense of a practice-oriented training. In this context, taking into account scientific knowledge and methods, personal competence as well as professional skills and knowledge are imparted, which are necessary for a high-quality performance of the tasks, in order to To be able to meet requirements professionally and responsibly. The development of the employees is to be supported by the basic training and the personal work satisfaction is promoted.

(2) In the case of training, the following principles must be observed in particular:

The teaching material shall be provided in accordance with the state-of-the-art of science and the service requirements of the Executive Service.

The course participants are to be led to self-employment and cooperation.

Organisation and management of basic training

§ 3. (1) For the basic training courses referred to in § 1, the Safety Academy (SIAK) must carry out basic training courses in accordance with the training needs of the service authorities.

(2) The management of the basic training courses is the responsibility of the SIAK. With the direct organizational implementation and the necessary perception of the immediate service and professional supervision, the director of the SIAK is a professional and pedagogically suitable for every basic training course. Admission to basic training

§ 4. (1) The basic training for the Executive Service shall be assigned to federal staff, provided that they meet the general appointment requirements and the requirements of Z 11.1 of Annex 1 to the BDG 1979.

(2) The admission to basic training courses for the use group E 2a, apart from the fulfilment of the requirements of Z 9.11 of Appendix 1 to the BDG 1979, depends on the result of the selection test to be carried out in accordance with § 6.

(3) The admission to basic training courses for the E 1 use group, apart from the fulfilment of the requirements of Z 8.16 of Appendix 1 to the BDG 1979, depends on the result of the selection test to be carried out in accordance with § 6.

(4) The one for admission to the basic training course for the use group E 1 according to Z 8.16 para. 1 lit. (c) and (2) of Annex 1 to the BDG 1979 required practical use must have been completed on services with executive external service. In duly substantiated exceptional cases, another use may also be recognised if this is necessary with a view to obtaining specifically qualified personnel.

(5) Federal staff admitted to a basic training course shall be appointed by

an employment ban under the maternity protection law 1979 (MSchG), BGBl. 221,

2.

A Karenz according to the MSchG, the Fathers-Karenzgesetz, BGBl. No 651/1989, or in accordance with § 75 (1) BDG 1979 in conjunction with Section 10 (4) (1) of the salary law in 1956, BGBl. 54,

3.

a part-time job according to the MSchG or the Fathers Karenz Act, or

4.

A reduction in the weekly service period according to § 50b BDG 1979

, the staff member shall be allowed to attend the basic training course immediately following the completion of the obstacles periods referred to in Z 1 to 4.

(6) In accordance with the conditions set out in the last sentence of Section 11 (2) of the SPG, SIAK may also allow the participation of other local authorities ' staff in basic training courses according to § 1.

§ 5. (1) Executive staff shall only be admitted to basic training courses for the use group E 1 and E 2a if they have the personal and professional competence for the performance of the tasks associated with the use provided for them are to be expected.

(2) The personal aptitude shall be based on the general mental, physical and character ability to obtain the professional competence for the training and performance of the qualification. In particular, professional competence shall not be available if the staff member in the calendar year preceding the authorization did not show the success of the work to be expected by him.

Selection check

§ 6. (1) A Commission consisting of at least three qualified members shall be appointed by the Director of the Security Academy for the purpose of carrying out selection tests.

(2) If the number of applicants for a basic training course is greater than the number of available courses, the candidates shall be put in accordance with the number of points achieved in the successfully filed selection test.

(3) The passed selection examination shall apply to the immediately following basic training course.

Design of basic training

§ 7. (1) The basic training courses referred to in § 1 shall be designed in the form of a course of training. The contents can be seen from the systems 1, 2 and 3. As far as this is appropriate, training courses can also take place in modular form. Parts of the course can also be designed as e-learning, training in the workplace or practical use. The training at the workplace is intended to be introduced into the tasks of later use.

(2) The teaching staff shall continuously assess the performance of the course participants by means of examinations. Except for repetitions of the last used material, exams must be announced prior to their execution.

(3) The successful completion of such training modules and other training courses or qualification measures, professional experience and self-employed work can be credited after hearing the SIAK in accordance with § 30 BDG 1979.

§ 8. (1) Staff members of the Working Group E 2b, E 2a or E 1 of the Judicial Service or guard officers of municipalities who are appointed to a post of Executive Service in the field of the Federal Ministry of the Interior shall have at least six months of training. The training may be prevented if the staff member has successfully completed the basic training in accordance with § 1.

(2) The staff of the Working Group E 2a which, pursuant to paragraph 1 of § 16 of the Regulation of the Federal Minister of the Interior, on the basic training for the Executive Service and the groups of uses E2a and E1 in the gendarmerie, security scale and Crime service, BGBl. II No 433/1999, as amended by the BGBl version. II No 330/2004, which are in special use and who are seeking a function outside their special use, have to attend a supplementary course. The content and scope of this supplementary course shall be in accordance with the "guidance training" sub-area of a basic training course for the use group E 2a according to Appendix 2 to this Regulation. The supplementary course shall be completed with an examination which is to be kept in the same way as the part-examination according to Annex 2 to this Regulation. The provisions of § § 5 and 6 shall apply.

Exclusive of basic training

§ 9. (1) A staff member shall be excluded from the further basic training if he no longer has the personal or professional competence or if he/she has to be accepted according to his achievements in the course of his training that he/she does not have the training objective will be reached.

(2) The service authority shall decide on the exclusion from a basic training on request or after hearing the SIAK.

Service Review

§ 10. (1) The completion of the basic training is to be demonstrated by the successful completion of the appropriate service examination before an examination senate. The structure, sequence and contents of the service check are shown in the annexes 1, 2 and 3.

(2) Staff members shall be classified by office on the grounds of official examinations. The prerequisite for the admission to the service examinations for the Executive Service and for the E 2a group of applications is the positive conclusion in those subject matter which are neither binding exercises nor free objects. The prerequisite for the admission to the service examination for the application group E 1 is the positive conclusion of the Bachelor of Applied Sciences degree course "Police Leadership".

(3) A test which has not been passed can be repeated twice. The reprobative period shall be fixed for at least two weeks and not more than three months.

Audit Commissions

§ 11. (1) The Federal Minister for Home Affairs has to form examination commissions for the conduct of service audits for the Executive Service and the use groups E 2a and E 1. The Chairman of the Audit Commissions is the Director of the SIAK, in the event of his prevention his deputy.

(2) The Examination Committee for Service Examinations for the Executive Service is, in addition to the Chairman of the Centre for Education and Training in the SIAK, the heads of the training centres and their alternates and from the circle of to form teachers working primarily for the SIAK. If required, a representative can be sent to the examination board as a further member of the respective competent service authority.

(3) In addition to the Chairman of the Centre for Education and Training in the SIAK, and from the staff of the A1/v1 and A1/v1 applications, the Examination Commission for Service Tests for the Working Group E 2a shall be the Chairperson of the Commission for the purposes of the examination of the application. Use group E 1, who are or were responsible for teaching the SIAK as a principal or part-time occupation. (4) In addition to the Chairman of the Centre for Education and Training in the SIAK, and from the staff of the A1/v1 and A1/v1 applications, the Examination Commission for Service Tests for the Working Group E 1 shall be the President of the Commission. Use group E1, who are or were responsible for teaching the SIAK in the main or part-time occupation. In addition, the personnel responsible department of the Federal Ministry of the Interior can send a representative as a further member to the Examination Committee.

(5) The official examinations are to be submitted before an examination senate. The examination senates consist of three members. The chairperson of the examination committee determines the chairperson of the examination board and the two other members before each official examination from among the members of the examination board. At least one member of the examination board is to be determined from the group of lecters in the respective training course.

(6) The membership of the Examination Commission shall end with the departure from the staff level of the Federal Government. It rests on the day of the initiation of a disciplinary procedure until its final conclusion, during the period of the (provisional) suspension of the service or the service. in an out-of-service position. The membership of a member of the Board of Examiners, which comes from the staff level of the internal department, ends with his departure from the active staff of the Federal Ministry of the Interior.

Certificate

§ 12. (1) A certificate must be issued by the Chairman of the respective Examination Council on the passing of the service examination. In the certificate, all the partial exams of the service examination must be designated and the respective assessment should be recorded. (2) The original of the certificate shall be handed out to the staff member. A copy of the certificate shall be deposited in the personnel act.

Linguistic equality

§ 13. As far as natural persons are referred to in this Regulation only in male form, they shall refer to women and men in the same way. In applying the name to certain natural persons, the gender-specific form shall be used.

Closure and transitional provisions

§ 14. (1) This Regulation shall enter into force at the end of the day of the customer's agreement. At the same time, the regulation of the Federal Minister of the Interior on the basic training for the Executive Service and the groups of uses E 2a and E 1 in the Gendarmerie, Security Guard and Crime Service, BGBl. No 433/1999, as last amended by the BGBl Regulation. II No 315/2005, except for force.

(2) Basic training for the Executive Service or for security officers in the field of the Federal Ministry of the Interior, which has been successfully completed before the entry into force of this Regulation, shall be considered as basic training within the meaning of this Regulation.

Basic training begun before the entry into force of this Regulation may already be carried out in accordance with the provisions of this Regulation if the application thereof is deemed appropriate in order to achieve the aim of training; otherwise these shall be: To continue and to complete basic training in accordance with the rules in force so far.
