60. Ordination of the Federal Minister of Economics and Labour on the limitation of the emission of air pollutants from installations for cement production 2007-Cement V 2007

On the basis of § 82 (1) of the 1994 Commercial Code (Gewerbeordnung)-GewO 1994, BGBl. No. 194 (WV), as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 161/2006, is being prescribed in agreement with the Federal Minister for Agriculture, Forestry, the Environment and Water Management:

Scope

§ 1. (1) This Regulation shall apply to authorised industrial plants in which cement or cement clinker is produced (installations for the production of cement in accordance with § 2 Z 1), subject to the conditions laid down in § 9.

(2) For installations for cement production, which are within the scope of the Waste Incineration Ordinance-AVV, BGBl. II No 389/2002, only the provisions of § § 2, 5, 6, 7 (1) and (4), § 8 (1) (3), (2) and (3) and § § 9 to 11 shall apply.

Definitions

§ 2. For the purposes of this Regulation:

1.

Installations for the production of cement, in which at least one of the following activities shall be carried out:

a)

Transport, crushing and drying of the raw material, of the remediation materials and of the combustible material,

b)

Manufacture of raw meal,

c)

Burning of cement clinker (furnace system)

aa)

in rotary kilns with rust preheaters (Lepolfurnaces),

bb)

in rotary kilns with cyclone preheaters (with or without exhaust gas utilisation) or

cc)

in shaft furnaces,

d)

Further processing such as grinding of cement clinker or cement clinker produced or delivered in the plant

e)

Storage and manufacturing of the cement for direct sale or shipping;

2.

Emission limit values in accordance with the state of the art (§ 71a (1) 1994), the maximum permissible values of the substances emitted, which are linked to certain measuring and operating conditions and which are established during an assessment period or in a number of assessment periods shall not be exceeded; emission limit values shall be specified as the mass of air pollutants entering the free atmosphere per unit of volume of exhaust gas (mass concentration) at the source of emissions;

3.

Sources such as these sources of an installation for the production of cement, where it is possible to detect and discharge the exhaust gases in a targeted way;

4.

diffuse dust emissions from any dust emissions from an installation for the production of cement, which are not derived from sources;

5.

Powdered materials Cement, stone flour and other materials, which have a comparable grain size distribution.

Emission limit-furnace system

§ 3. Furnace installations for cement clinker production, which are not subject to the scope of the AVV, shall be operated in such a way that the following emission limit values (§ 2 Z 2) in the exhaust gas are not exceeded in accordance with § 4 (based on dry exhaust gas at 0 ° C and 1 013 mbar and to 10% volume concentration oxygen):

Exceeding this limit, which is shown to be caused by sulphide-containing inclusions (in particular iron sulphide in the form of pyrite or marshasit) in the raw material, is permitted, but not exceeding 350 mg/m³ shall be allowed.

b)

Nitrogen oxides (calculated as NO 2 ) .........................

500 mg/m ³

c)

If ammonia is used to reduce the emissions of nitrogen oxides, the Authority shall have a limit value for ammonia emissions from the denitrification.

3.

Heavy metals as mean values over a period of 0.5 to 8 hours:

a)

Cadmium, thallium and its compounds, expressed as Cd and Tl...

The emission limit values in Z 3 shall apply to the sum of the substances emitted in the solid and gaseous state.

§ 4. The emission limit values laid down in § 3 shall be complied with in full or partial load (continuous operation) in the case of continuous operation of the furnace installation, they may be used when the kiln is put into operation, shut down, fuel changes or changes during the addition of the the raw material or the correction substances shall be exceeded to the extent that these exceedances are unavoidable. The owner of the plant has the intransience, the duration and the amount of the exceedance, as well as the control measures carried out (such as the use of continuously registering measuring instruments or counting units for the the duration of the use of auxiliary amines) to be kept in writing and to be kept in the plant for at least three years in such a way that they can be introduced to the authorities at any time for inspection.

Emission limit-Aggregated Sources (excluding furnace facilities)

§ 5. (1) Sources (including the exhaust gases from dryers), other than the furnace installations referred to in § 2 Z 1 lit. c, shall be operated in such a way as to limit the emission limit of 20 mg/m for dust-like emissions. ³ (with respect to 0 ° C and 1 013 mbar and the oxygen content in each case) in the exhaust gas is not exceeded.

(2) Filter installations of fibre dust sources shall be maintained and kept in the proper state, in accordance with the information supplied by the manufacturer. Records shall be kept of the maintenance work carried out. Such records shall be submitted without delay to the Authority upon request.

Milling, crushing and screening systems-conveyor and filling systems-Silos-Transport routes

§ 6. (1) In order to avoid diffuse dust emissions, technical units for the processing of solid materials such as crushing, grinding, screening, mixing, as well as the task, transfer, filling and discharge points of bulk material, if they are in the form of pulverulent materials, are dusty materials, as far as possible to umhausen and/or to be capsules or to be equipped with emission reduction techniques comparable to those in effect.

(2) Powder-like dusting materials such as cement or stone powder shall be stored in closed containers. Such containers are to be equipped with a protection against overfilling (e.g. silage guards). The dust-containing displacement air during the filling of these silo installations must be fully grasped and be supplied to dedusting equipment or equipment which is comparable in effect to it.

(3) Case distances when dropping powdery dust in the open air are to be minimized. The drop height has to adapt to the changing height of the bed.

(4) Areas of conveyor belts for the transport of fine-grained materials, which are exposed to the wind, are to be incorporated.

(5) Road transport routes for motor vehicles shall be fitted with a ceiling made of asphalt, concrete or equivalent material, kept in a proper state and, in accordance with the degree of pollution, to be cleaned.

Emission measurements

§ 7. (1) The holder of the operating system shall be

continuous measurements of emission concentrations of total dust, SO 2 and oxides of nitrogen (calculated as NO 2 ) the furnace installation (§ 2 Z 1 lit. (c) to implement this Regulation in accordance with Z 1 of the Annex,

2.

Carry out individual measurements of the contents of the furnace installation materials listed in § 3 Z 3, in accordance with Z 2 of the Appendix to this Regulation, when the plant is in operation and subsequently at least at intervals of not more than one year ,

3.

Individual measurements of the content of dust-like emissions at

a)

all types of Mahlanlagen and

b)

those sources, each of which has an exhaust gas volume flow of more than 8 000 m ³ /h, and operate more than 2 000 hours per year,

in accordance with Z 2 of the annex to this Regulation, at regular intervals not to exceed three years,

4.

a one-off determination of the particle size distribution in the total dust of the main chamber in accordance with Z 2 of the Appendix to this Regulation. In the case of changes in the dedusting device, the grain size distribution is to be determined again.

(2) In order to carry out the measurements referred to in points 1 (2) and (3) and the determination of the grain size distribution in accordance with paragraph 1 (1) (4), the following points shall be drawn up:

1.

Accredited bodies (Accreditation Act, BGBl. N ° 468/1992, as last amended by the Federal Law BGBl. I No 85/2002),

2.

institutions of the Federal Government or of a federal state or bodies of public law,

3.

legally authorized bodies,

4.

Civil engineers of the relevant specialist area, technical offices-engineering offices of the relevant specialist area and chemical laboratories,

5.

the trader, within the limits of its powers;

provided that validated analytical methods are used, a quality assurance system is established and the analyses are documented in a comprehensible way.

Measurement Report

§ 8. (1) The results of the measurements in accordance with § 7, including the one-off determination of the particle size distribution in the total dust of the main chimp, are presented in a measurement report according to the ÖNORM M 9413 measurement report for To record air pollutant emission measurements-requirements for the production 2002-07-01, which in any case

in the case of measurements in accordance with § 7 (1) (1) (1), the measured values in the form of records of a continuously registering measuring instrument and the records relating to the exceeding of limit values as required in accordance with § 4,

2.

in the case of measurements in accordance with Article 7 (1) Z 2, the measured values and the operating conditions during the measurements (operating state, fuel consumption, raw material and correction substances) and

3.

in the case of measurements in accordance with § 7 (1) Z 3, the measured values and the operating conditions during the measurements (operating state, maintenance condition of the cloth filters)

to be included.

(2) The measurement report shall be kept for at least three years in the operating system in such a way that it can be introduced at any time to the authorities of the public authorities for inspection.

The plant owner shall, within three months of the end of a calendar year, submit to the Authority a report on the results of the measurements carried out in accordance with Article 7 (1) in the reporting year. This report shall confirm compliance with the limit values for the pollutants to be measured continuously, or shall be notified of exceedances of the limit values of the individual pollutants, indicating the level of exceedance, the cause of exceedance and the duration of the exceedances. This report shall also contain the results of the measurements to be carried out in accordance with Article 7 (1) (2) and (3) (individual measurements).

Transitional provisions

§ 9. (1) At the time of the entry into force of this Regulation, installations already authorized for the production of cement, unless otherwise specified in paragraph 2, shall comply with the provisions of this Regulation no later than 1 November 2009.

(2) At the time of the entry into force of this Regulation, installations already authorized for the production of cement, which are subject to Annex 3 to Annex 3 to the TCO in 1994 (IPPC installations), must comply with the provisions of this Regulation by 1 November 2007 at the latest .

§ 10. This Regulation shall enter into force with the month following its presentation.

Out-of-Force Trees

§ 11. (1) The Regulation on the limitation of the emission of air pollutants from installations for cement production, BGBl, enters into force with the entry into force of this Regulation. No 63/1993, except for force.

(2) The provisions of the Regulation on the limitation of the emission of air pollutants from installations for cement production, BGBl, are based on operating facilities according to § 9. No 63/1993, until at the latest by the dates specified in paragraph 9.
