145. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on interventions in case of radiological emergency situations and in the case of permanent radiation exposures (intervention ordinance-IntV)

Part 1

General provisions

Objective and scope

§ 1. (1) The aim of this Regulation is to protect the health of persons against the dangers arising from ionizing radiation in the event of radiological emergencies or, in the event of permanent exposure, due to the consequences of a radiological Emergency situation or on the basis of a previous round or earlier work with radiation sources.

(2) This Regulation shall

Title IX of Directive 96 /29/EURATOM laying down basic safety standards for the protection of the health of workers and the general public against the dangers arising from ionizing radiation, OJ L 206, 22.7.1996, p. No. OJ L 159, 29.06.1996 p. 1, and

2.

Directive 89 /618/EURATOM on informing the general public of the rules of conduct and health protection measures to be taken in the event of a radiological emergency, OJ L 327, 28.12.1989, p. No. OJ L 357, 07.12.1989 p. 31,

to be transposed into Austrian law.

(3) This Regulation shall apply

1.

for intervention in the event of a radiological emergency situation or in the event of a permanent exposure to radiation due to the consequences of a radiological emergency situation or of a previous or earlier work with radiation sources, and

2.

in order to inform the public in preparation for a radiological emergency situation and in the event of a radiological emergency situation.

Definitions

§ 2. For the purpose of this Regulation:

1.

"effective dose" is the dose as defined in Appendix 2 of the General Radiation Protection Regulation (AllgStrSchV), BGBl. II No 191/2006;

2.

"intervention personnel" means those persons who are suitable and trained for carrying out intervention measures in the event of a radiological emergency;

3.

"intervention values" means dose values for intervention measures, which shall be established and applied in the event of a radiological emergency situation, taking into account the situation;

4.

"catalogue of measures" means the compilation of intervention measures for radiological emergency situations.

Principles of intervention

§ 3. (1) In the sense of Section 36l (2) (1) of the StrSchG, intervention in the event of a radiological emergency shall be effected only if the reduction of the health impairment by radiation is sufficient to cover the damage and costs. including the economic cost of the intervention.

(2) The form, scope and duration of interventions shall be chosen in the sense of Article 36l (2) of the German StrSchG for the purpose of optimization in such a way that the benefit achieved by reducing the health impairments of the affected population is less of the damage associated with the intervention, is maximized.

(3) The dose limits for individuals and persons exposed to radiation exposed shall not be applied in case of radiological emergency situations.

Part 2

Interventions in case of a radiological emergency situation

Intervention values

§ 4. (1) In the event of a radiological emergency situation, the Federal Minister for Agriculture, Forestry, Environment and Water Management has to evaluate the situation. If necessary, it shall establish intervention values.

The intervention values shall be subject to the intervention guidelines referred to in Appendix 1 differ only if there are serious reasons. The establishment of different intervention values for different regions of the Federal Republic is to be avoided. In the event of a cross-border radiological emergency, harmonisation of the intervention values with potentially or actually affected neighbouring countries shall be sought.

Intervention measures

§ 5. (1) In the case of a radiological emergency situation, the Federal Minister for Agriculture, Forestry, Environment and Water Management, with the participation of the Federal Minister for Health, Family and Youth, has on the basis of section 37 (5) Z 3 StrSchG on the basis of the evaluation of the situation, if necessary, to recommend intervention measures. If it is to be expected that the intervention values determined in accordance with § 4 are exceeded, it shall at any rate make such a recommendation pronounce.

(2) In the event of a cross-border radiological emergency, harmonisation of the intervention measures with the neighbouring countries concerned shall be sought.

(3) The Federal Minister for Agriculture, Forestry, the Environment and Water Management has a catalogue of measures, taking into account the Appendix 2 to work together with intervention measures. In the event of a radiological emergency, the catalogue shall be taken into account in the case of the recommendation of intervention measures.

Evaluation and adaptation of intervention measures

§ 6. If intervention measures are implemented, the Federal Minister for Agriculture, Forestry, the Environment and Water Management

1.

to assess their effectiveness and

2.

adjustments to these measures, or to recommend their repeal.

To this end, the State Captains have to submit information on the status and effectiveness of the intervention measures taken in implementation to the Federal Minister for Agriculture, Forestry, the Environment and Water Management.

Location Representation

§ 7. The Federal Minister for Agriculture, Forestry, the Environment and Water Management has to set up and operate a suitable computer-aided system for the presentation of the situation. This system must enable the collection, in particular, of the following information:

1.

Data on the radiological emergency situation,

2.

the assessment of the situation and the impact assessment,

3.

Intervention and evaluation of their effectiveness and

4.

Background information.

The bodies active in the context of interventions shall obtain access rights to the information relevant to them.

Information to the public

§ 8. (1) The Federal Minister for Agriculture, Forestry, the Environment and Water Management has the public

1.

in order to prepare for a radiological emergency situation in an appropriate manner; and

2.

in the case of a radiological emergency situation as required by the situation

to inform. This information is available in Appendix 3 to meet predetermined criteria.

(2) The information to prepare for a radiological emergency has to be constantly available to the public via electronic media.

Intervention plans

§ 9. (1) The Federal Minister for Agriculture, Forestry, the Environment and Water Management, with the involvement of all the Federal Ministries concerned, has to draw up a general government intervention plan.

(2) On the basis of the general government intervention plan, the provincial authorities responsible for the implementation of the intervention measures pursuant to § 38 StrSchG have to draw up intervention plans for their scope of action.

(3) The intervention plans referred to in paragraphs 1 and 2 shall be the subject of: Appendix 4 content mentioned above. The intervention plans shall be reviewed and, where necessary, updated at appropriate intervals by the competent authorities for their preparation.

(4) The one prepared by the national captains or updated intervention plans are to be brought to the attention of the Federal Minister for Agriculture, Forestry, Environment and Water Management.

Emergency drills

§ 10. The authorities responsible for intervention in the case of a radiological emergency shall, with the involvement of the intervention agency, hold emergency drills at appropriate intervals. In particular:

1.

carry out a review of the intervention plans for vulnerabilities,

2.

to exercise cooperation between the persons and organisations involved in assistance, and

3.

The use of organizational and technical means under the most realistic conditions and to check for weaknesses.

In the case of these emergency drills, the Appendix 5 shall be taken into account.

Reporting requirements for events on Austrian territory

§ 11. (1) In the event of a radiological emergency caused by an event on an Austrian territory, the competent authority has the Federal Minister for Agriculture, Forestry, Environment and Water Management, in compliance with the Intervention plans in accordance with the notification channels referred to in Appendix 6 the contents of the website. This obligation shall not apply to events whose effects, in the opinion of the competent authority, may be disregarded from the point of view of radiation protection.

(2) Initial notifications shall be made without delay and shall at least be subject to the content referred to in Appendix 6 Z 1 to 4. Updated reports shall be transmitted on the basis of substantial new findings and in the event of serious changes in the situation.

(3) In the case of the reports referred to in paragraph 1, information provided by the holder of a radiation protection authorization pursuant to § § 6, 7 and 10 of the StrSchG in the event of a radiological emergency situation in the approved facility or in the case of the authorised handling of the competent authority, should be taken into account.

Intervention staff

§ 12. (1) Intervention staff must have training which enables them to carry out the intervention measures, to assess the risk involved and to take self-protection measures. The content and scope of such training for intervention personnel shall be Appendix 7 .

(2) For the use of intervention personnel in case of radiological emergency situations, the Appendix 8 shall take into account the dose setting values for emergency exposure positions. A guideline value of 250 millisievert for the total effective dose during the lifetime of these persons should not be exceeded. Operations in which an effective dose of 20 millisieverts could be exceeded may only be carried out voluntarily.

(3) Interventional personnel must be equipped with the necessary personal protective equipment for their use.

Physical and medical control of intervention personnel

§ 13. (1) For physical control, the intervention staff shall be equipped with personal dosemeters assigned to them in person. The display of these dosimeters may only be displayed with special aids or in case of damage. These dosimeters shall be obtained from a dose-measuring point authorised for this purpose in accordance with § 34 StrSchG.

(2) The dosimeters shall be carried at a representative point on the body stem, usually at the front of the hull, during all activities in which exposure is possible. If this type of exposure cannot be sufficiently accurately determined, additional dosimeters shall be used.

(3) The dosimeters shall be transmitted by the person responsible for the intervention personnel immediately after an intervention as well as, otherwise, once a year to a dose measuring point according to § 34 StrSchG for evaluation. In the event of an intervention, the dose measurement point shall be informed that emergency exposure positions are concerned.

(4) In so far as the radiological emergency situation requires, additional dosimeters are to be used in the implementation of an intervention which, when an adjustable dose or dose rate is exceeded, an acoustic or optical system Emit a warning signal (warning dosimeter). The number of warning dosimeters allocated to an intervention team is to be adapted to the radiological emergency situation and the nature of the intervention.

(5) If there is a suspicion that radioactive substances have been incorporated in the course of an intervention, the competent authority shall decide whether a determination of the dose of incorporation should be carried out.

(6) With regard to the evaluation of personal dosimetry and the monitoring of the collection, as well as the obligation to transmit the results to the Central Dose Register, the provisions of § 27 (1) to (3) AllgStrSchV shall apply, with the following: in place of the holder of the authorization, the person responsible for the intervention shall be replaced by the person responsible for the intervention. In addition, the responsible person has to inform the person concerned of the results of the evaluation of their personal dosimeter and of the surveillance of the information.

(7) In order to determine the dose, if the dose is exceeded in accordance with § 12 AllgStrSchV for persons exposed to radiation, the responsible person shall immediately arrange for a medical examination of the person concerned.

(8) The medical examination referred to in paragraph 7 shall be carried out by physicians, occupational health services or hospitals authorized in accordance with § 35 of the German StrSchG. The costs of the medical examinations are to be deducted from the Federal Ministry for Agriculture, Forestry, Environment and Water Management.

(9) The investigating body must carry out a health assessment and, in a medical certificate, determine whether exposure to the health of the person under examination has been affected by exposure. It shall transmit the medical certificate to the person responsible for the person being examined, who shall keep the medical certificate for seven years and shall submit a copy of the certificate to the person under investigation. Furthermore, the results of the health assessment are to be passed on from the examining body to the central dose register.

(10) The provisions of paragraphs 7 to 9 shall also apply to those persons who carried out intervention measures in accordance with Section 15 (4). In the absence of individual physical control, the effective dose received by the persons concerned in the implementation of the intervention measures shall be assessed by the competent authority.

Recording requirements

§ 14. (1) For the intervention staff, the person responsible shall keep individual records of the doses received, the training and further training completed, and the participation in emergency exercises. Doses obtained in the course of interventions shall be shown separately.

(2) The authorities responsible for intervention shall be granted access to such records upon request.

(3) In order to ensure uniformity and comparability of records, the Federal Minister for Agriculture, Forestry, the Environment and Water Management has to provide appropriate forms for such records in sufficient numbers.

Personnel deployment in case of a radiological emergency situation

§ 15. (1) In the course of the implementation of intervention measures, the doses permitted under Section 14 of the AllgStrSchV for individuals of the population may be exceeded, the competent authority shall determine, taking into account the provisions of paragraphs 2 to 4, which: Persons under which conditions may be used for these intervention measures.

(2) In order to implement intervention measures in accordance with paragraph 1, the following shall not be used:

1.

People who are the 18. have not yet completed their life year,

2.

Pregnant and

3.

Women who are breast-feeding, provided that the permissible doses referred to in paragraph 1 above can be exceeded by the inclusion of radioactive substances.

(3) Priority should be given to the implementation of intervention measures in accordance with paragraph 1 of the intervention staff.

(4) The competent authorities may also use other persons, provided that:

1.

their use is voluntary,

2.

they have the knowledge they need, or have received corresponding instructions,

3.

they have been informed of the risk associated with it,

4.

This will lead to a substantial improvement of the intervention.

Except in justified exceptional cases, an effective dose of 20 millisieverts may not be exceeded in the use of these persons. The persons employed must be equipped with appropriate personal protective equipment as well as with dosimeters, provided that the exposure cannot be estimated in a different way.

(5) In order to protect persons who have to perform urgently necessary activities during a radiological emergency situation, without these activities being an intervention in the sense of § 2 para. 21 StrSchG, the competent authorities shall to lay down appropriate arrangements.

Information on military services

§ 16. In the event of a request for assistance from the Bundesheeres, the Federal Minister for Agriculture, Forestry, the Environment and Water Management has to provide the relevant military services with information that at least the relevant military services in the Federal Republic of Germany. Appendix 9 content mentioned above.

Part 3

Interventions in the case of permanent exposure to radiation

§ 17. (1) Where there is a situation leading to a permanent exposure to radiation due to the consequences of a radiological emergency situation or to previous work with radiation sources, the competent authority shall: if necessary, and taking into account the extent of the exposure risk, to ensure that:

1.

the area concerned is demarcated,

2.

a system for the monitoring of radiation exposure is established;

3.

, taking into account the actual characteristics of the situation, all appropriate intervention measures shall be implemented, and

4.

access to land or buildings within the demarcated area and the use of such land.

(2) Except in duly substantiated exceptional cases, the dose limits for persons exposed to occupationally exposed persons shall be complied with in accordance with Section 12 of the AllgStrSchV in the case of such interventions.
