147. Regulation of the Federal Minister for Economic Affairs and Labour, the Federal Minister of Transport, Innovation and Technology, and the Federal Minister for Justice on the compilation of indices of price developments in the economy

Pursuant to Sections 4 to 10, 19, 30 and 32 (2) and (4) (4) (4) of the Federal Statistics Act 2000, Federal Law Gazette (BGBl). I n ° 163/1999, as last amended by the Federal Law BGBl. I n ° 71/2003, is in agreement with the Federal Chancellor and in agreement with the Federal Minister for Finance, in addition to the provisions of Section 16:

Arrangement for the production of price indices

§ 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for the fulfilment of Austria's obligations under Regulation (EC) No 1165/98 concerning short-term statistics and Regulation (EC) No 2223/96 on the European system National and regional accounts in the European Community to carry out price surveys and indices of national and regional accounts

1.

Wholesale prices,

2.

Construction prices and construction costs,

3.

prices for equipment,

4.

Producer prices of tangible goods and

5.

Producer prices of business-related services

to create.

Definitions

§ 2. For the purposes of this Regulation:

1.

Materials:

a)

Products according to the list of products for the producing sector published in the Federal Institute according to § 4 (5) of the Federal Statistics Act 2000 and published under the Internet address www.statistik.at-ÖPRODCOM-CODE 1010113000 bis 4199000000, in the version valid for the reference period, and

b)

Goods in accordance with the basic system of the goods-ÖCPA 2002-Sections C to E, published in the Federal Institute according to § 4 (5) of the Federal Statistics Act 2000 and published under the Internet address www.statistik.at.

2.

company-related services: services of Sections I to K in accordance with the ÖCPA 2002;

3.

Sector-specific structural data: information on the relative importance of goods and services throughout the production, trade and investment spectrum of reporting units and industries which allow selective selection of To produce products and a weighting structure at the elementary level (microweights).

Periodicity, survey date

§ 3. (1) It is necessary to collect:

1.

wholesale prices, producer prices of goods and related survey characteristics in accordance with Article 5 (1) (6) and (7), as well as the construction costs per month;

2.

the prices of equipment and construction prices and related survey characteristics in accordance with Article 5 (1) (6) and (7) of this quarterly report;

3.

prices for company-related services and the related survey characteristics according to § 5 (1) (6) and (7) quarterly.

(2) The surveys referred to in paragraph 1 shall be carried out at the end of the day. The cut-off date is

1.

for the surveys referred to in paragraph 1 Z 1 of the 15. every month,

2.

for the surveys referred to in paragraph 1 (2) and (3) of the 15. of the second month of each quarter;

3.

for the surveys of the construction prices of civil engineering, by way of derogation from Z 2 of 31 March, 30 June, 30 September and 31 December.

(3) In the case of the surveys referred to in paragraph 2 (2) (1) to (3) of the reference date on a Sunday and public holiday, the date of the following working day shall be the date of the following working day.

Survey mass, statistical units

§ 4. (1) Statistical units within the meaning of this Regulation are:

1.

Undertakings and technical units at local level (establishments) in accordance with Articles 1 and 2 of Regulation (EEC) No 696/93 on the statistical units for the observation and analysis of the Community economy and

2.

Businesses of commercial nature of public bodies (§ 2 of the German Corporate Tax Act),

who carry out an activity in accordance with paragraph 2 independently, on a regular basis and with the intention of obtaining a yield or other economic benefits.

(2) Activities within the meaning of Section 1 are those of the following levels of classification of the nomenclature of the Federal Statistical Act 2000, published in the Federal Institute according to § 4 (5) of the Federal Statistics Act and published under the Internet address www.statistik.at. Economic activities-ÖNACE 2003 are:

1.

Division 10, 11, 13 and 14 (mining and quarrying);

2.

Division 15 to 36 (production of goods in kind), excluding "publishing", "production and processing of fissure and brood materials", "manufacture of weapons and ammunition", "shipbuilding", and "air and spacecraft construction";

3.

Division 40 and 41 (energy and water supply);

4.

Division 45 (Construction);

5.

Division 50 and 51 (motor vehicle trading; maintenance and repair of motor vehicles and consumer goods; petrol stations; wholesale trade and wholesale trade);

6.

Division 60 to 64 (transport and communication), class 60.24 (freight transport by road), groups 61.1 (sea and coastal shipping) and 62.1 (scheduled air transport), classes 63.11 (cargo handling), 63.12 (warehouse), 64.11 (postal services) and 64.12 (private courier services) and Group 64.2 (telecommunications services);

7.

Division 72 (data processing and databases);

8.

Division 74 (provision of business services) without class 74.15 (management activities of holding companies) and without group 74.8 (provision of other business-related services), but the classes 74.11 (Auditor and Tax Consultant), 74.13 (Market and opinion research), 74.14 (Business and Public Relations Consulting), 74.2 (Architecture and Engineering Offices), 74.3 (technical, physical and chemical), 74.13 (Legal advice), 74.13 (Business and Public Relations), 74.14 (Business and Public Relations), 74.14 (Business and Public Relations), 74.2 Investigations), 74.4 (advertising), 74.5 (commercial omission of Workers), 74.6 (detectives and protective services) and 74.7 (cleaning industry).

(3) The local level within the meaning of paragraph 1 (1) (1) is determined by the location, the technical unit in principle by allocation of the respective activity to the levels of detail of the ÖNACE 2003 referred to in paragraph 2.

Survey characteristics

§ 5. (1) It is necessary to collect:

1.

the prices actually invoided and the price-determining characteristics of the goods sold in the wholesale trade and the services rendered in connection therewith;

2.

the contractually agreed prices and the price-determining characteristics of construction services;

3.

the contractually agreed prices and price-determining characteristics for equipment (e.g. purchase of a machine) plus the related services, such as planning, transport and installation costs;

4.

the prices actually invoied and the price-determining characteristics of goods sold at ex-works in the country and in the export;

5.

the prices actually invoied (transaction prices) and price-determining characteristics of company-related services carried out domestily and in export;

6.

the product-specific shares of property and company-related services in the total turnover of the statistical unit concerned;

7.

the sector-specific structural data, in so far as they are not already based on the Regulation on short-term statistics in the producing sector, BGBl. II No 210/2003, the Regulation on short-term economic statistics in the service sector, BGBl. II No 233/2003, or by virtue of the performance and structural statistics regulation, BGBl. II No 428/2003, by the Bundesanstalt.

(2) Price-determining characteristics as referred to in paragraph 1 are characteristics in accordance with Regulation (EC) No 588/2001 implementing Regulation (EC) 1165/98 concerning short-term statistics: definition of variables.

(3) The prices referred to in paragraph 1 are without VAT, minus rebates granted and in the case of exported goods (para. 1 Z 4) Free State border or "free on board".

Type of survey

§ 6. (1) The survey shall be carried out in the form of a sample survey.

(2) It should be collected in the form of the survey:

1.

the characteristics referred to in Article 5 (1) (1) (1) for statistical units carrying out an activity in accordance with Article 4 (2) (5);

2.

the characteristics referred to in Article 5 (1) (2) relating to housing and settlement construction as well as to the building of other buildings in the case of statistical units carrying out an activity in accordance with Article 4 (2) (4) (4) (4);

3.

the characteristics referred to in Article 5 (1) (3) for statistical units carrying out an activity in accordance with Article 4 (2) (1) (1) to (6);

4.

the characteristics referred to in Article 5 (1) (4) for statistical units which carry out an activity in accordance with Article 4 (2) (1) (1) to (3);

5.

the characteristics in accordance with § 5 (1) Z 5 in the case of statistical units which carry out an activity in accordance with § 4 (2) Z 6 to 8.

(3) The characteristics in accordance with § 5 (1) (2) relating to road construction, bridge construction and other civil engineering are to be collected by the procurement of administrative data at the following facilities:

1.

in the relevant departments of the federal government, the country, the municipalities or community associations,

2.

in the case of legal persons who are responsible for planning, financing, construction, maintenance or operation by federal or state law

a)

of federal, state or municipal roads,

b)

by rail or sea transport, or

c)

of installations for energy production or distribution

has been transferred.

(4) The survey may be carried out in writing or orally, depending on the expediency.

Selection of the survey units; sample

§ 7. (1) The Bundesanstalt has to select the survey units as well as material and business-related services for the survey, which are considered to be representative (principle of representative selection).

(2) As representative,

1.

Survey units, if they have an industry-specific type of turnover meaning that they are likely to have the price evolution of the industry represented, and

2.

Goods and services close to the company, if they are at the production value, the turnover of the industry or the investment value has such a proportion that it can be assumed that they have been able to develop the price of the traded, traded or Tangible goods and services provided by the company

are sufficiently reliable.

(3) In the case of the survey according to § 6 (2) (2) (2), in any case, nine technical units shall be selected at the local level.

(4) The Federal Institute has to select the survey units on the basis of the data of the Business Register pursuant to Section 25 of the Federal Statistics Act 2000.

(5) In the specific selection of the survey units to be surveded, the Federal Institute has on the principle of the discharge of responders within the meaning of Section 7 (3) of the Federal Statistics Act 2000 and for the price surveys in accordance with § 1 Z 1 to 3 on the aspect the willingness to provide information.

Quality control

§ 8. In order to monitor compliance with the principles set out in § 24 Z 2 to 5 of the Federal Statistics Act 2000, the Federal Institute has all the necessary information for the compilation of the indices in accordance with § 1 of the Quality Committee of the Federal Institute of Statistics (Bundesanstalt). , which are necessary for the examination of the representativeness in accordance with § 7, in particular with regard to the maintenance of sufficient representativeness of the respondents.

Exchange of information

§ 9. (1) The exchange of information on the statistical units selected by the Federal Institute in accordance with § 7 shall be carried out on a voluntary basis in the case of surveys of the indices in accordance with § 1 Z 1 to 3.

(2) For the purpose of providing information, the natural persons, legal persons or partnerships of the commercial law which operate the statistical units in question in their own name shall be used.

(3) The Bundesanstalt has

1.

in the case of the survey in accordance with § 1 Z 1 to 25. of the reporting month,

2.

in the case of the survey according to § 1 Z 2 in relation to construction prices in the building up to one week in accordance with the dates laid down in accordance with Article 3 (2) (2) (2) (2) and

3.

in the case of the survey according to § 1 Z 3, to the end of the month following the reporting quarter

the prices to be collected.

Obligation to provide information

§ 10. (1) The collection of indices pursuant to § 1 Z 4 and 5 shall be subject to the obligation to provide information.

(2) For the purpose of providing information, those natural persons, legal persons or partnerships of commercial law are obliged to operate a statistical unit according to § 4 in its own name, which has been selected in accordance with § 7.

(3) The Federal Institute has the duty to inform and to cooperate on the legal consequences in accordance with Section 66 of the Federal Statistics Act 2000 in case of refusal of participation or information and in the case of knowingly incomplete or not the best knowledge. to be provided with relevant information.

Obligation to provide information to the parties responsible for providing information

§ 11. The parties responsible for providing information pursuant to § 10 shall be obliged to complete the survey forms laid down by the Federal Office in full and to the best of their knowledge, and

1.

in the case of § 1 Z 4 to the 14. of the month following the reporting month, and

2.

in the case of § 1 Z 5 to the 15. of the month following the reporting quarter

the Bundesanstalt to the address given in the survey document.

Collection documents

§ 12. (1) The Bundesanstalt has to ensure that the survey forms are delivered free of charge to the information giants. On request, the survey forms shall be made available by electronic means.

(2) The Bundesanstalt has to make provision that the exchange of information and the transmission of the survey forms can be carried out electronically.

Obligations of the holders of administrative data

§ 13. The bodies referred to in Article 6 (3) shall be obliged to provide the administrative data necessary for the determination of prices and price-determining characteristics of construction services in the field of road construction, bridge construction and other civil engineering, at the request of the Federal institution pursuant to Section 10 (2) of the Federal Statistics Act 2000, to be transmitted no later than the reference dates specified in Section 3 (2) (2) (3) of the Federal Statistical Act.

Calculation of the price indices

§ 14. In calculating the price indices, the Bundesanstalt has to use the following price surveys:

1.

for the indices of wholesale prices, the data collected in accordance with Article 5 (1) (1), (1), (6) and (7);

2.

for the indices of construction prices and construction costs, the data collected in accordance with Article 5 (1), (1), (2), (4), (6) and (7);

3.

for the indices of the prices of equipment, the data collected in accordance with Article 5 (1), (3), (6) and (7);

4.

for the indices of producer prices of property, the data collected in accordance with Article 5 (1), (4), (6) and (7), as well as the data on economic statistics in the producing sector,

5.

for the indices of producer prices of services close to the enterprise, the data collected in accordance with Article 5 (1) (e) (5) to (7) and the data on business cycle statistics in the service sector.

Publication of results

§ 15. (1) The Federal Institute shall make the indices available to the public free of charge on the Internet in accordance with § 1:

1.

the wholesale price index within ten days of the end of the reference month,

2.

the construction price index within 45 days of the end of the reporting quarter,

3.

the construction cost index within 15 days of the end of the reporting month,

4.

the price index for equipment goods within 90 days of the end of the reporting quarter,

5.

the producer price index of goods within 50 days of the end of the reference month,

6.

the producer price index of company-related services within 90 days of the end of the reporting quarter.

(2) The publication in accordance with Section 1 of the Federal Statistical Act 2000 shall be carried out in the following subsection, taking into account the provisions of Section 19 (2) of the Federal Statistics Act 2000:

1.

the wholesale price index in sub-indices at the sixth level of the ÖCPA 2002,

2.

the construction price index in the structure of building construction (broken down by housing and settlement construction and other construction) and civil engineering (broken down by road construction, bridge construction and other civil engineering),

3.

the construction cost index for housing and settlement construction is divided into master works and total construction costs,

4.

the construction cost index for civil engineering is broken down into road construction (broken down into total construction costs, labour costs and other construction costs) and bridge construction (broken down in wage costs and other construction costs),

5.

the price index for equipment in sub-indices at the level of the departments of the ÖCPA 2002,

6.

the producer price index of goods in sub-indices at the level of the departments of the ÖNACE 2003 and the departments of the ÖCPA 2002,

7.

the producer price index of company-related services in sub-indices at the level of the divisions, groups and classes of the NACE 2003.

(3) The Federal Institute has to document the calculation of the indices by metadata according to the Special Data Dissemination Standard of the International Monetary Fund. In particular, the respective valid weighting schemes and the concatenation factors (for all existing old index series) must be made available free of charge for all indices on the homepage of the Bundesanstalt.

(4) In the index series published by the Federal Institute, the current index value is to be regarded as provisional. A provisionally published index is for the construction cost index road and bridge construction in the third following period, for the producer prices of property in the second following period and for all other indices in the following period in of final form.

(5) In the index series published by the Federal Institute, revisions shall be clearly marked.

(6) The publication dates for all the indices referred to in § 1 shall be published by 31 December of the year preceding the publication of the index to the public.

Cost replacement

§ 16. (1) The Bundesanstalt shall be entitled to an additional annual cost replacement at the following level:

1.

in 2007: 276 835 euro

2.

in 2008: 285 140 Euro

3.

in 2009: 293 694 Euro

4.

in 2010: 302 505 Euro

(2) In 2009, the cost of carrying out the statistics under this Regulation shall be subject to evaluation and redefined for the survey years from 2011 onwards.

(3) The Bundesanstalt is obliged to make use of all possible donations to the European Union for the implementation of the statistics provided for in this Regulation. The cost reduction is reduced in each case by the amount received by the Federal Institute of the European Union.

(4) The right to reimbursement of expenses exists in relation to the Federal Ministry for Economic Affairs and Labour, to the Federal Ministry for Transport, Innovation and Technology and to the Federal Ministry of Justice at the following level:

§ 17. To the extent that personal terms are used in this Regulation, they do not have a gender-specific meaning. They are to be used in the application to specific persons in the gender-specific form.
