154. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management, amending the Regulation on the implementation of Community market measures in the wine sector

Pursuant to § § 96 (1) and (2), 99 (1) and (108) of the 1985 Act on the Rules of the Market Act, BGBl. No 210 in the BGBl version. I n ° 156/2006, is being prescribed:

The regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the implementation of Community market measures in the wine sector, BGBl. II No 98/2005, shall be amended as follows:

(1) In § 20 (2), the following sentences shall be inserted after the first sentence:

" Land-related information, which is only fixed after the implementation of the conversion measures (e.g. the extent and slope of the completed vineyard due to deferment and earthworks) and therefore not yet at the time of the planning of the plan , shall be included in the plan design in the estimated maximum extent. Their actual extent is known after the completion of the reconversion measures. "

2. In Section 21 (3), the phrase " is 50% or in the Objective area 75% " through the phrase " is 50% or in areas referred to in Article 13 (3) of Regulation (EC) No 1493/1999, 75% " replaced.

3. The last sentence of section 21, para. 4, first and second indent reads as follows:

"The level of aid shall be 50% (in areas referred to in Article 13 (3) of Regulation (EC) No 1493/1999, 75%) of the costs of the establishment of the aid."

4. § 22 (7) reads:

"(7) The multiple implementation of a sub-measure on the same area is excluded for the duration of the measure" Restructuring and conversion ". Exceptions to this are cases of force majeure which require the multiple implementation of a partial measure. "

5. In Section 26 (2), the word order shall be "until the next 15 March" through the phrase "within one year from the modest approval of the change-over plan" replaced.

6. § 27 (1) second sentence reads:

" The work within the framework of the conversion measures without advance payment shall be completed within 5 years from the modest approval of the conversion plan, but at the most up to that by the Federal Minister for Land-and Forestry, the environment and water management in accordance with Article 28 (1). "

7. § 27 the following paragraph 7 is added:

"(7) For each vineyard, which is related to a partial measure of the conversion carried out, a permanent economic use must be given as a yield vineyard."

8. Annex I C (1) reads as follows:

" (1) Within the scope of this sub-measure, in existing vineyards (or in addition to the new plant of a vineyard), terraced slopes (without a wall) are newly erected, in particular for erosion protection, or existing, severely damaged terraced slopes recultivated. "

9. Annex I C (3) reads as follows:

"(3) The vineyard shall consist of one or more quality wine varieties of the quality wine grape varieties regulation."

10. Annex I D (1) reads:

" (1) Within the framework of the sub-measure, in existing vineyards (or in addition to the new plant of a vineyard) Terrace walls (e.g. dry stone walls, mortar walls, concrete walls) are built, in particular for erosion protection, or existing ones, Damaged terraced walls recultivated. "

11. Annex I D (2) reads as follows:

"(2) The vineyard shall consist of one or more quality wine varieties of the quality wine grape varieties regulation."

(12) In Annex I E (1), after the word order "of parts of a permanently stationary sprinkled plant" the phrase "in existing vineyards (or in addition to the new plant of a vineyard)," inserted.

The following paragraph 4 is added to Annex I E:

"(4) The vineyard shall consist of one or more quality wine varieties of the quality wine grape varieties regulation."

14. Annex I G (1) reads:

" (1) This sub-measure comprises the new direction of the fencing of an existing vineyard (or in addition to the new plant of a vineyard) to protect the vineyard from wild bite (eg the erection of wild fences, electric fences or similar). The vineyard must be made up of one or more quality wine varieties of the quality wine grape varieties regulation. "

15. In the table of Annex II, the word order in the first column "Not Objective 1 Area" deleted and the phrase "Objective 1 Area" through the phrase "in areas referred to in Article 13 (3) of Regulation (EC) No 1493/1999" replaced.

16. In the table of Annex II, sections E and G shall be followed by the following: "-invoice amount incl. Sales tax less all discounts for non-pretax-deductible promotional advertisers; " and "for all other promotional advertisers (this also applies to all agricultural and forestry holdings to which Article 22 (1) and (5) of the UstG 1994 are to be applied-flat-rate holdings)" is deleted.
