221. Regulation of the Federal Minister for National Defence on the basic training for the use group A 2

On the basis of § § 26 to 31 of the Civil Service Act 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I No 129/2006, shall be ordered:

Scope

§ 1. This Regulation lays down the basic training for the use group A 2 in the department of the Federal Ministry of Defence for the Federal Republic of Germany

1.

the administrative service,

2.

the technical service,

3.

the construction service,

4.

the surveying service and

5.

the other uses.

Objectives

§ 2. The basic training must provide the knowledge and skills required for the fulfilment of tasks as a management and specialist in a workplace of the use group A 2 in the department of the Federal Ministry of National Defense . The necessary knowledge shall be achieved by:

1.

To provide the necessary basic and technical knowledge in the area of constitutional law and the organisation of the authorities, the law of the European Union, the administrative procedural law, the military law, the service and salary rights of the Federal officials and the budget law,

2.

Acquisition of the necessary basic and special knowledge in the areas of responsibility typical for the respective areas according to § 1,

3.

-providing in-depth knowledge in the areas referred to in § 1, insofar as these are necessary for the area of responsibility envisaged,

4.

Transfer of the social and methodological knowledge, skills and skills required for the area of responsibility envisaged,

5.

Transfer of communicative and organizational skills and skills for the implementation of projects and work within a team, as well as

6.

Transfer of the necessary basic knowledge of the general management training.

Construction of basic training and forms of training

§ 3. (1) The basic training is modular and has the following training sections (modules) to include:

1.

an introductory module,

2.

a basic module,

3.

a technical module and

4.

an election module.

(2) The introductory module is intended for the first orientation in the Federal Service and has the basic knowledge necessary for the execution of the service. It must be carried out in the course of a maximum of one week, and has the following Appendix 1 consist of training subjects (teaching and timetable "introductory module").

(3) The basic module shall be used to impart the necessary legal knowledge of the service, as well as the extension and deepening of methodological and social skills. It must be carried out as a training course and has the Appendix 2 (teaching and timetable "Basic module A 2").

(4) The technical module serves the purpose of imparting and deepening the expertise required for the respective service. It must be carried out as a training course and has to include:

1.

for the administrative service and the other uses referred to in Appendix 3 Teaching subjects (teaching and timetable "Fachmodul A 2-administrative service"),

2.

for the technical service provided in the Appendix 4 (teaching and timetable "Fachmodul A 2-Technischer Dienst") and

3.

for the construction service in the Appendix 5 Teaching subjects included (teaching and timetable "Fachmodul A 2-Baudienst").

For the surveying service, the technical module includes the successful completion of the training modules "relevant legislation and its application" as well as "professional knowledge" in accordance with § 11 para. 2 of the regulation of the Federal Minister of Economics and Business Work on basic training in the Federal Office of Eich-und Vermessungswesen (Federal Office for Eich-und Vermessungswesen), BGBl. II No 402/2004.

(5) The elective module serves to further develop the social-communicative behavior as well as to communicate and deepen economic and efficient working techniques. Within the scope of the election module, one in each of the candidates, taking into account the requirements of their workplace by the candidates Appendix 6 -to complete the seminar.

Expiration of the basic training (examination plan)

§ 4. (1) In the framework of the basic training, all modules must be completed, unless expressly stated otherwise. These can be completed in any order.

(2) The individual courses shall be held in accordance with the service requirements. Suitably qualified staff members are to be used as members of the Federal Ministry of Defence in the field of regional defence, if possible. The teaching of the content of training is also permitted in the form of seminars or e-learning systems or trainee programmes or practical uses or self-studies or other appropriate forms.

(3) For the administrative service and other uses, the technical module shall be completed immediately following the basic module.

(4) After a positive completion of all modules, the basic training is completed. In any case, the required knowledge of the contents of the basic module and of the technical module must be demonstrated by the positive assessment of the examination subjects listed in the respective examination regulations.

(5) For the surveying service, the required knowledge of the teaching contents of the technical module must be proven by the positive assessment of the training modules referred to in § 3 (4) according to § 13 of the BEV Basic Training Ordinance.

(6) There are no exams to be taken on the contents of the introductory and electoral modules. In these cases, the successful participation must be confirmed.

Examination regulations for the administrative service and the other uses

§ 5. (1) The service examination shall include the examination subjects

1.

Constitutional law, the organisation of public authorities and the law of the European Union,

2.

the right of service and remuneration of the federal staff,

3.

Administrative procedural law I,

4.

Defence Law I,

5.

Foundations of the federal budget law,

6.

Administrative procedural law II and

7.

Defense Law II.

The level of requirements of the examination subjects according to Z 1 to 5 is obtained from the teaching contents of Appendix 2 and that of the examination subjects according to Z 6 and 7 from the contents of the teaching contents of Appendix 3.

(2) The official examination is to be taken as an overall examination in the examination subjects

1.

pursuant to paragraph 1 (1) to (6) oral and

2.

pursuant to paragraph 1 (1) (7) in writing and oral.

In the examination subject according to paragraph 1 Z 7, the written examination part must be submitted as a written examination. The oral examination part shall indicate the rash.

(3) The repeat tests shall be made possible within three months.

§ 6. (1) The service examination shall include the examination subjects

1.

Constitutional law, the organisation of public authorities and the law of the European Union,

2.

the right of service and remuneration of the federal staff,

3.

Administrative procedural law I,

4.

Defence Law I,

5.

Foundations of the federal budget law,

6.

Technical system support,

7.

Technology and

8.

Security technology.

The level of requirements of the examination subjects according to Z 1 to 5 is obtained from the teaching contents of Appendix 2 and that of the examination subjects according to Z 6 to 8 from the teaching contents of Appendix 4.

(2) The service examination is in the examination subjects

1.

1 to 5 and

2.

pursuant to paragraph 1 Z 6 to 8

to be taken as an overall examination. The examination subject referred to in paragraph 1 Z 6 shall be submitted in writing and orally. The remaining examination subjects are to be deposited orally.

(3) In the examination subject according to paragraph 1, Z 6, the written examination part shall be deposited as a written examination before the oral examination part. The oral examination part shall indicate the rash.

(4) § 5 (3) concerning the repetition of tests shall apply.

§ 7. (1) The service examination shall include the examination subjects

1.

Constitutional law, the organisation of public authorities and the law of the European Union,

2.

the right of service and remuneration of the federal staff,

3.

Administrative procedural law I,

4.

Defence Law I,

5.

Basic principles of the federal budget law and

6.

Construction-technical service.

The level of requirements of the examination subjects according to Z 1 to 5 results from the teaching contents of Appendix 2 and that of the examination subject according to Z 6 from the contents of the teaching contents of Appendix 5.

(2) The service examination is in the examination subjects

1.

pursuant to paragraph 1 (1) (1) to (5) oral

2.

1 Z 6 in writing and verbal

to be taken as an overall examination. In the examination subject according to paragraph 1 Z 6, the written examination part shall be deposited as a written examination before the oral examination part. The oral examination part shall indicate the rash.

(3) § 5 (3) concerning the repetition of tests shall apply.

Examination regulations for the surveying service

§ 8. (1) The service examination shall include the examination subjects

1.

Constitutional law, the organisation of public authorities and the law of the European Union,

2.

the right of service and remuneration of the federal staff,

3.

Administrative procedural law I,

4.

Defence Law I and

5.

Foundations of the federal budget law.

The level of requirements of the examination subjects according to Z 1 to 5 results from the teaching contents of Appendix 2.

(2) The examination shall be subject to oral examination in the examination subjects referred to in paragraph 1 (1) (1) (1) to (5) as an overall examination.

(3) § 5 (3) concerning the repetition of tests shall apply.

Audit bodies

§ 9. (1) The Examination Committee shall consist of:

1.

the head of the central section of the Federal Ministry of Defence of the Federal Republic of Germany as chairperson or chairperson of the Federal Ministry of Defence

2.

the required number of other members.

(2) The other members shall be members of the group of officials of the A 1 or A 2 or equivalent categories of use, or of the comparable contract staff or other persons recognised in their subject Duration of five years. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective term of office.

(3) The examination senate shall consist of at least three members of the examination board. Preference is preferably to be taken into account. In the event of a tie, the vote shall be taken by the chairman or the chairman of the Senate.

Calculation of basic training

§ 10. (1) Staff of the uses according to § 1, which shall be before the 1. Jänner 2005 was admitted to a service in the department of the Federal Ministry of Defence of the Federal Republic of Germany, and are exempt from the completion of the introductory module.

(2) In any case, the successful completion of the introductory module shall be deemed to be successful completion

1.

A basic training in the department of the Federal Ministry of Defence,

2.

"Military Leadership" and the degree course of the university of applied sciences and

3.

Teaching as administrative assistant or assistant administration assistant or information, library and archive assistant or assistant to the information, library and archive assistant, each in the department of the Federal Ministry of Education and Research National Defense.

(3) The necessary knowledge in the examination subjects in accordance with § § 5 to 8, in each case subsection 1, points 1 to 4, are in any case proven by the successful completion of the "Military Leadership" degree course of the University of Applied Sciences.

Transitional provisions

§ 11. (1) The successful completion of the basic training

1.

according to the Federal Government's Regulation on basic training for use group B, BGBl. No 9/1979,

2.

according to the regulation of the Federal Minister for National Defense on the basic training for the use group A 2, BGBl. II No 520/2003, and

3.

according to the regulation of the Federal Minister for National Defense on the basic training for the use group A 2, BGBl. II No 322/2005,

is considered to be a successful completion of the basic training for use group A 2 in accordance with this Regulation.

(2) The successful completion of training sections of basic training according to the Federal Minister of State Defense Ordinance on the basic training for the use group A 2, BGBl. II No 322/2005, shall be considered to be a successful completion of the corresponding training sections under this Regulation.

(3) For sections of training which have been started until 31 August 2007, the Regulation of the Federal Minister for National Defence on the basic training for the use group A 2, BGBl. is the Federal Minister for the Defence of the Federal Republic of Germany. II No 322/2005.

Final provisions

§ 12. (1) This Regulation shall enter into force on 1 September 2007.

(2) With the expiry of 31 August 2007, the Federal Minister for National Defence of the Federal Republic of Germany shall enter into force on the basic training for the use group A 2, BGBl. II No 322/2005, except for force.
