223. Regulation of the Federal Minister for National Defence on the basic training for the groups of use A 4 and A 5 as well as on the skilled workers ' ascent training

On the basis of § § 26 to 31 of the Civil Service Act 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I No 129/2006, shall be ordered:

Scope

§ 1. This Regulation lays down the basic training for the use group A 4 for

1.

the administrative service,

2.

the technical service and

3.

other uses,

the basic training for the Working Group A 5 and the skilled worker advancement training in the department of the Federal Ministry for National Defence.

Objectives

§ 2. The basic training has to convey the knowledge and skills required for the fulfilment of tasks at a workplace of the use group A 4 and A 5 in the department area of the Federal Ministry of National Defence. The necessary knowledge shall be achieved by:

1.

to provide the necessary basic knowledge in the area of constitutional law and the organisation of the authorities, the right of the European Union, the administrative procedural law, and the service and remuneration law of the federal staff; and

2.

Acquisition of the necessary basic and special knowledge in the field of tasks typical for the respective area according to § 1.

Construction of basic training and forms of training

§ 3. (1) The basic training is modular and has the following training sections (modules) to include:

1.

an introductory module,

2.

a basic module and

3.

a technical module for the technical service.

(2) The introductory module is intended for the first orientation in the Federal Service and has the basic knowledge necessary for the execution of the service. It must be carried out in the course of a maximum of one week, and has the following Appendix 1 consist of training subjects (teaching and timetable "introductory module").

(3) The basic module shall be used to impart the necessary legal knowledge of the service to the service. It must be carried out as a training course and has to include:

1.

for use group A 4 in the uses administrative service and other uses which are used in the Appendix 2 Teaching subjects included (teaching and timetable "Basic module A 4") and

2.

for the A 4 use group in the use of technical services and for the A 5 use group, which shall be used in the Appendix 3 "Basic module A 4-Technical service", "Basic module A 5").

(4) The technical module serves to communicate and deepen the technical knowledge required for the technical service and has the expertise in the Appendix 4 (teaching and timetable "Fachmodul A 4-Technischer Dienst").

Expiration of the basic training (examination plan)

§ 4. (1) In the framework of the basic training, all training sections (modules) must be completed, unless expressly stated otherwise. These can be completed in any order.

(2) The individual courses shall be held in accordance with the service requirements. Suitably qualified staff members are to be used as members of the Federal Ministry of Defence in the field of regional defence, if possible. The teaching of the content of training is also permitted in the form of seminars or e-learning systems or trainee programmes or practical uses or self-studies or other appropriate forms.

(3) After a positive completion of all modules, the basic training is completed. In any case, the required knowledge of the course contents must be proven by the positive assessment of the examination subjects listed in the respective examination regulations. No exams are to be taken over the course contents of the introductory module. In this case, the successful participation is to be confirmed.

Examination regulations for the Working Group A 4 for the administrative service and the other uses

§ 5. (1) The service examination shall include the examination subjects

1.

Foundations of the Austrian constitutional law and the authorities ' organisation as well as the law of the European Union,

2.

Basic principles of the service and remuneration law of the federal staff and

3.

Administrative procedural law.

The level of requirements of the examination subjects according to Z 1 to 3 results from the teaching contents of Appendix 2.

(2) The examination shall be subject to oral examination in the examination subjects referred to in paragraph 1 (1) (1) to (3) as an overall examination.

(3) The repeat tests shall be made possible within three months.

Examination regulations for the use group A 4 for the technical service

§ 6. (1) The service examination shall include the examination subjects

1.

Principles of the Austrian Constitutional Law and the Organisation of Public Authorities and the European Union's right,

2.

Basic principles of the service and remuneration law of the federal staff and

3.

Supply and preservation of materials .

The level of requirements of the examination subjects according to Z 1 to 2 results from the teaching contents of Appendix 3 and that of the examination subject according to Z 3 from the contents of the teaching contents of Appendix 4.

(2) The service examination is in the examination subjects

1.

pursuant to paragraph 1 (1) (1) and (2) of

2.

pursuant to paragraph 1 Z 3 in writing and oral

to be taken as an overall examination. In the examination subject according to paragraph 1, Z 3, the written examination part must be placed before the oral examination part in the form of a written examination. The oral examination part shall indicate the rash.

(3) § 5 (3) concerning the repetition of tests shall apply.

Examination regulations for the use group A 5

§ 7. (1) The service examination shall include the examination subjects

1.

2.

Basic principles of the service and remuneration law of the federal staff.

The level of requirements of the examination subjects according to Z 1 to 2 is derived from the teaching contents of Appendix 3.

(2) The examination shall be subject to oral examination in the examination subjects referred to in paragraph 1 (1) (1) and (2) as an overall examination.

(3) § 5 (3) concerning the repetition of tests shall apply.

Audit bodies

§ 8. (1) The Examination Committee shall consist of:

1.

the Head of the Central Section of the Central Office of the Federal Ministry for National Defence as Chairperson or Chairperson, and

2.

the required number of other members.

(2) The other members shall be members of the group of officials of the group A 1 or A 2 or A 3 or equivalent categories of use or of the comparable contract staff or other persons recognised in their subject for a period of five years. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective term of office.

(3) The examination senate shall consist of at least three members of the examination board. Preference is preferably to be taken into account. In the event of a tie, the vote of the Senate Chairperson or of the Senate Chairperson shall be decided.

Specialist career advancement training

§ 9. (1) Only those staff members who, at the time of the service examination, are engaged in the relevant subject-related activity after the completion of the 18-year period shall be admitted to the training in the field of training in the department of the Federal Ministry of Defence. They have already exercised their life year by a period corresponding to the duration of the teaching period for the teaching profession concerned.

(2) The training of skilled workers has to include:

1.

The training subjects included in Appendix 3 ("Basic module A 4-Technical service", "Basic Module A 5") and

2.

an examination of the teaching profession or equivalent technical area of the staff of the staff member concerned.

(3) The examination is to be carried out as an overall examination in the examination subjects.

1.

pursuant to paragraph 2 (2) (1) orally

2.

pursuant to paragraph 2 (2) (2) in writing or in practical and orally

In the examination subject referred to in paragraph 2 (2), the written or practical part of the examination shall, in any case, be placed before the oral examination part. The oral examination part shall indicate the rash.

(3) § 5 (3) concerning the repetition of tests shall apply.

Calculation of basic training

§ 10. (1) Staff members of the uses according to § 1, who were admitted to a service in the department of the Federal Ministry of Defence before 1 July 2006, are exempt from the completion of the introductory module.

(2) In any case, the successful completion of the introductory module shall be deemed to be successful completion

1.

A basic training in the department of the Federal Ministry of Defence,

2.

"Military Leadership" and the degree course of the university of applied sciences and

3.

Teaching as administrative assistant or assistant administration assistant or information, library and archive assistant or assistant to the information, library and archive assistant, each in the department of the Federal Ministry of Education and Research National Defense.

(3) The successful completion of the basic training for the use group M BUO 2 in all uses shall be considered to be a successful completion of the basic training for the use group A 4 with regard to the Administrative services and other uses.

(4) The successful completion of the basic training for the use group M BUO 2 in the use of technical service shall be considered to be a successful completion of the basic training for the use group A 4 in respect of of the technical service.

Transitional provisions

§ 11. (1) The successful completion of the basic training

1.

According to the Federal Government's Regulation on basic training for the D and P3 use groups and on the skilled worker ascent training, BGBl. No 519/1979, and

2.

according to the regulation of the Federal Minister for National Defense on the basic training for the use group A 4 and A 5 as well as on the skilled worker ascent training, BGBl. II No 522/2003,

is considered to be a successful completion of basic training under this Regulation.

(2) The Regulation of the Federal Ministry for Defence of the Federal Republic of Germany, which began until 31 August 2007, is based on basic training for the use group A 4 and A 5 as well as the skilled worker advancement training in the department of the Federal Ministry of Defence, which was started until 31 August 2007. Federal Minister for National Defense on Basic Training for Use Group A 4 and A 5 as well as on the Specialworkers ' Education Training, BGBl. II No 522/2003.

Final provisions

§ 12. (1) This Regulation shall enter into force on 1 September 2007.

(2) With the expiry of 31 August 2007, the Federal Minister for National Defence of the Federal Republic of Germany shall enter into force on the basic training for the use group A 4 and A 5 as well as on the skilled worker ascended training, BGBl. II No 522/2003, except for force.
