229. Federal Government Ordinance on the proof of professional knowledge (Federal-Fachkenntnisverification-Ordinance-B-FK-V)
On the basis of § § 62, 63 (1) and 72 (1) of the Federal Law on the Protection of Services (B-BSG), Federal Law Gazette (BGBl). I n ° 70/1999, as last amended by the Federal Law Gazette (BGBl). I No 53/2007, shall be:
Application of the provisions of the FK-V
§ 1. (1) § § 1 to 15, 16 para. 3 to 7 and paragraph 10 as well as the annexes 1 to 6 of the regulation of the Federal Minister of Economics and Labour on the proof of professional knowledge (Fachkenntnisverification-Regulation-FK-V), BGBl. II No 13/2007, as amended, are to be applied in the Federal Government's services, with the exception of the federal government, subject to the proviso that:

in place of the terms "Employees ' Protection Act" and "ASchG", the term "B-BSG", |

the terms "worker" or "employee" shall be replaced by the terms "employee" or "employee"; and |

| 3. |
in place of the term "employer" or "employer" of the term "employer" |
|||||||||
in the correct grammatical context in each case.
(2) Paragraph 16 (6) of the FK-V is to be applied with the proviso that the quotation "§ 87 para. 1" shall be replaced by the citation "§ 95 para. 1".
Transitional and final provisions
§ 2. (1) certificates concerning the proof of specialist knowledge which, before the entry into force of this Regulation, by educational institutions or authorized bodies according to § 7 (1) of the Regulation on the proof of expertise for certain works, BGBl. No 441/1975, or by authorized bodies in accordance with Article 5 (1) of the Regulation on the proof of expertise in the preparation and organisation of certain works under electrical voltage above 1 kV, BGBl. No. 10/1982, as well as those pursuant to Section 113 (3) of the Employees ' Protection Act (ASchG), Federal Law Gazette (BGBl). No. 450/1994, certificates recognized by the Federal Minister of Labour (Health) and Social Affairs and/or the Federal Minister for Economic Affairs and Labour shall be regarded as proof of expertise in the meaning of this Regulation.
(2) Training facilities which, in the event of entry into force of this Regulation, shall be subject to an upright authorisation in accordance with Article 7 (1) of the Regulation on the proof of expertise for certain works, BGBl. No 441/1975 or in accordance with Article 5 (1) of the Regulation on the proof of expertise in the preparation and organisation of certain works under electrical voltage above 1 kV, BGBl. No 10/1982, have to comply with the requirements of § § 9f of the FK-V in the version BGBl no later than 1 February 2008. II No 13/2007.
(3) This Regulation shall enter into force 1. October 2007, in force.
