On the basis of §§ 33 b paras 3, 4, 5 and 7 and 33 c para 1 of the water law of 1959 - 1959, BGBl. No. 215, I no. 123/2006, is amended by the Federal Act Federal Law Gazette WRG in agreement with the Federal Minister of Economics and prescribed work:

Ordinance of the Federal Minister for agriculture and forestry on the limitation of emissions of wastewater from tanneries, leather factories and Pelzzurichtereien (am. tannery), Federal Law Gazette II No. 10/1999 is amended as follows:

1. in article 1 former paragraphs 2-5 get the designation (3) to (6); the following paragraph  2 shall be inserted:



"(2) to prescribe for the water law granting of a discharge of waste water from establishments or plants referred to in paragraph 3 with a rated dirt load in the inlet to the biological level of the waste water treatment plant of equal to or more than 50 000 EW120 in a river section 2, in Appendix A are complementing or contrary to Annex A section 1, regulated parameters." The expression, EW120' may refer to a dirt cargo of unpurified wastewater by 120 g cod population equivalent per day. "

2. at the end of article 1, paragraph 6 a comma and then the phrase "The possibilities of a mechanical desalination before the crossover are also as far as possible to take advantage of" is added after the word "Sewage" Z 3 (new).

3. in article 1, paragraph 6 Z 6 (new) is the phrase "in accordance with § 33a WRG 1959" by the phrase "in accordance with § 33 b (2) and 11 hrs 1959" replaced.

4. paragraph 2:





§ 2. Below mentioned parameters of Annex A section 1 collects hazardous waste water ingredients according to § 33 1959 b para 2 and 11 hrs:



Arsenic (No. 6), chromium - chromium - VI (No. 8), ammonium (No. 10), sulfide (No. 14), AOX (No. 18) and sum of hydrocarbons (No. 20) total (No. 7),."

5. in section 4, paragraph 2, 7 is attached following Z:



"7. for the parameters of surface tension the emission limit is complied, if during five consecutive measurements four measured values are greater than or equal than the emission limit."

6 § 4 para 3 No. 2 is:



"2. for such parameters as temperature, pH, ammonium, GES. paragraph 2 applies born nitrogen and surface tension."

7 paragraph 5 paragraph 1:



"(1) a when in force of regulation BGBl. II No 261 / 2007 lawfully existing waste water discharge in accordance with § 1 para 2, which for the first time are granted after January 12, 2000 has to comply with the emission limits of Annex A section 2 within four years. "Other legally existing waste water discharges in accordance with § 1 para 2, for which already a general adjustment duty was raised, have to comply with the emission limits of Annex A section 2, only then within four years if it is facilities according to § 33 c para 7 Z 1 and 3 hrs in 1959 is."

8 5 paragraph 2 the following sentence is added to §:



"Regulation BGBl. II Nr 261/2007 effective with October 1, 2008."

9. in Annex A, the heading "Emission limits in accordance with § 1" is replaced by the phrase "Section 1 emission limits in accordance with § 1 para 1".

10. in annex section 1 the Z 15-Z 16 as follows:

11 in Appendix A section 1 footnote j, the phrase "cargo flowing from the biological level of the waste water treatment plant" is replaced by the phrase "the cargo effluent from the wastewater treatment plant".

12. in Annex A, section 1, o is attached the footnote n following footnote:



"(o) in the case of the TOC and cod parameters it is sufficient, if either the TOC or the cod parameter is being monitored."

13 following annex section 2 is added to Annex A section 1:



"Section 2 additional or different emission limits in accordance with section 1, paragraph 2

 







(q) at a the Tagesmischproben TOC inlet concentration of greater than 1400 mg / l (measured as arithmetic monthly average in the inlet to the biological level of the wastewater treatment system), a trace concentration of 95% according to a TOC minimum removal power is allowed. The minimum removal performance refers to the ratio of TOC day cargoes in the inlet of the biological level of the waste water treatment plant or in the process of cleaning throughout the facility.

r) if it is necessary in some cases due to the preload, is in a runoff situation in which drops the water flow of the receiving water to under 75 m3 per m3 of the sum of the rated values of the effluents referred to in section 1, paragraph 2, the according to q) to limit the resulting flow concentration with maximum 100 mg / l TOC. As a design value is the sum of the project proper introductions into a surface water body.

(s) at a CSB inlet concentration of Tagesmischproben of greater than 4000 mg / l (measured as arithmetic monthly average in the inlet to the biological level of the wastewater treatment system), a trace concentration of 95% according to a CSB minimum removal power is allowed. The minimum removal performance refers to the ratio of CSB day cargoes in the inlet of the biological level of the waste water treatment plant or in the process of cleaning throughout the facility.

t) if it is necessary in some cases due to the preload, is in a runoff situation in which drops the water flow of the receiving water to under 75 m3 per m3 of the sum of the rated values of the effluents referred to in section 1, paragraph 2, the under s) to limit the resulting trace concentration maximum 275 mg / l cod. As a design value is the sum of the project proper introductions into a surface water body.

(u) at the TOC and cod parameters it is sufficient, if either the TOC or the cod parameter is being monitored."

14. in Annex B, 5 4 following Z is appended after the Z:
