261. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, with which the AEV Gerberei is amended

On the basis of § § 33b (3), (4), (5) and (7) and 33c (1) of the Water Rights Act 1959-WRG 1959, BGBl. No. 215, as last amended by the Federal Law BGBl. I n ° 123/2006, is being prescribed in agreement with the Federal Minister for Economic Affairs and Labour:

The regulation of the Federal Minister of Agriculture and Forestry on the limitation of waste water emissions from tanneries, leather factories and fur zurichtereien (AEV Gerberei), BGBl. II No 10/1999, shall be amended as follows:

1. In § 1, the previous paragraphs 2 to 5 shall be given the name "(3)" to "(6)"; the following paragraph 2 is inserted:

" (2) In the case of the water-law approval of an introduction of waste water from plants or plants according to paragraph 3 with a dimensioning dirt load in the feed to the biological stage of the waste water purification plant of equal or more than 50 000 p.a. 120 into a flowing water are the Annex A, section 2 , in addition or by way of derogation Annex A, section 1 , to prescribe regulated parameters. The expression,, EW 120 " means a dirt load of the uncleaned waste water of 120 g CSB per inhabitant value and day. "

2. At the end of § 1 para. 6 Z 3 (new) shall be after the word "Sewage" a dash followed by the word order "Furthermore, the possibilities of a mechanical desalination before the switch are to be exploited to the extent possible" .

3. In § 1 para. 6 Z 6 (new) the phrase "according to § 33a WRG 1959" through the phrase "pursuant to § 33b (2) and (11) WRG 1959" replaced.

4. § 2 reads:

" § 2. The following parameters of the Annex A, section 1 Hazardous waste water content is recorded according to § 33b (2) and (11) WRG 1959:

Arsenic (No. 6), total chromium (no. 7), chromium-VI (no. 8), ammonium (No. 10), Sulphide (No. 14), AOX (No. 18) and sum of the hydrocarbons (No. 20).

5. In § 4 (2), the following Z 7 is added:

" 7.

In the case of the surface tension parameter, the emission limit shall be deemed to be complied with if, for five consecutive measurements, four measured values are greater than or equal to the emission limit. "

6. § 4 (3) Z 2 reads:

" 2.

For the parameters temperature, pH value, ammonium, Ges. Nitrogen and surface tension is subject to para. 2. "

7. § 5 (1) reads:

" (1) One at the entry into force of the BGBl Regulation. 261/2007, lawfully existing waste water management pursuant to § 1 para. 2, which is based on the 12. 9. In Annex A, the heading shall be: "Emission limits according to § 1" through the phrase "Section 1 Emission limitation according to § 1 (1)" replaced.

10. In Annex A, Section 1, the Z 15 and Z 16 are as follows:

11. In Annex A, Section 1, footnote j, the word sequence shall be: "the cargo flowing out of the biological stage of the waste water purification plant" through the phrase "the cargo flowing out of the wastewater treatment plant" replaced.

In Annex A, Section 1, the footnote o shall be added to the footnote o:

"o) The TOC and CSB parameters are sufficient if either the TOC parameter or the CSB parameter is monitored."

Section 1 of Annex A shall be added to the following Annex A, Section 2:

" Section 2 Additional or deviating emission limits according to § 1 (2)

At a TOC feed concentration of the daily mixed samples of greater than 1400 mg/l (measured as the arithmetic monthly mean in the feed to the biological stage of the waste water purification plant), a discharge concentration corresponding to one Minimum TOC capacity of 95% allowed. The minimum building performance relates to the ratio of the TOC daily loads in the feed of the biological stage of the waste water purification plant or plant, respectively. at the end of the entire cleaning system.

If it is necessary on a case-by-case basis due to the pre-loading, a drainage situation in which the water guidance of the curator is less than 75 m 3 per m 3 the sum of the assessment values of the waste water discharges in accordance with § 1 (2) shall be reduced, the resulting concentration resulting in accordance with q) shall be limited to a maximum of 100 mg/l of TOC. The sum of the project-specific discharges into a surface water is to be used as the rated value.

In the case of a COD feed concentration of the daily mixed samples of greater than 4000 mg/l (measured as the arithmetic monthly average in the feed to the biological stage of the waste water purification plant), a discharge concentration corresponding to one CSB minimum building capacity of 95% allowed. The minimum building performance refers to the ratio of the CSB daily rates in the feed of the biological stage of the wastewater treatment plant or water purification plant, respectively. at the end of the entire cleaning system.

If it is necessary on a case-by-case basis due to the pre-loading, a drainage situation in which the water guidance of the curator is less than 75 m 3 per m 3 the sum of the assessment values of the waste water discharges in accordance with § 1 (2) decreases, the resulting concentration of 275 mg/l COD must be limited in accordance with s). The sum of the project-specific discharges into a surface water is to be used as the rated value.

For the TOC and CSB parameters, it is sufficient if either the TOC parameter or the CSB parameter is monitored. "

14. In Annex B, the following Z 5 shall be added after Z 4:

" 5.
