275. Regulation of the Federal Minister of Transport, Innovation and Technology, which amalgles the Act Implementing the Force Act 1967 (53). Novelle to the KDV 1967)

Due to the Kraftfahrgesetz 1967, BGBl. No. 267, as last amended by the Federal Law, BGBl. I No 57/2007, is being ordered:

The law on force driving-Implementing Regulation 1967, BGBl. No 399, as last amended by the BGBl Regulation. II No 334/2006, shall be amended as follows:

1. § 1a (1) reads:

" (1) As projecting parts, edges and additional devices which are likely to cause serious physical injury in the event of traffic accidents (Section 4 (2) third and fourth sentence of the Kraftfahrgesetz 1967), those are deemed to be more severe Injuries or the degree of serious injury is increased. Section 1d (2) and (3) reads as follows:

" (1a) motor vehicles with positive-ignition engines or compression-ignition engines with at least 4 wheels, a maximum authorised mass of more than 400 kg and a maximum design speed of at least 50 km/h, with the exception of land or Forestry tractors and working machines, as well as other machinery, insofar as they fall within the scope of Directive 70 /220/EEC, must comply with the requirements of this Directive as amended by Directive 70 /220/EEC, as amended in 2001 /100/EC . Vehicles or engines for motor vehicles which fall within the scope of Directive 2005 /55/EC, OJ L 327, 30.4.2005, p. No. OJ L 275, 20. 1, as amended by Directive 2005 /78/EC, OJ L 327, 30.12.2005, p. No. 1, and Directive 2006 /51/EC, OJ L 313, 13.12.2006, p. No. OJ L 152 of 7 June 2006, S 11, must comply with the requirements of these Directives in respect of their exhaust behaviour.

(2) Vehicles of categories M1 and N1 must be subject to an on-board diagnostic system (OBD) for emission control within the meaning of Directive 70 /220/EEC, as amended by Directive 98 /69/EC, 1999 /102/EC, 2001 /1/EC, 2002 /80/EC and 2003 /76/EC, OJ L 327, 22.11.2003, p. No. OJ No L 206, 15 August 2003, p. 29. Vehicles of categories M2, M3, N2 and N3 shall be subject to an on-board diagnostic system (OBD) or an on-board measurement system (OBM) for emission control within the meaning of Directive 2005 /55/EC, as amended by Directive 2005 /78/EC and Directive 2006 /51/EC . The OBD system is a diagnostic system for emission monitoring installed on board the motor vehicle, which must be able to perform malfunctions of the emission control devices and their probable malfunctions with the aid of computer-stored fault codes. Causes to display. The OBD system shall be designed, constructed and installed in the vehicle in such a way as to be capable of indicating, throughout the life of the vehicle, certain types of deterioration and malfunctions of the emission control devices.

(3) Vehicles with compression-ignition engines or gas engines shall comply with the following requirements with regard to the durability of the emission control devices:

1.

the manufacturer of a self-ignition engine which is type-approved on the basis of the limit values in rows B1, B2 or C of the tables in section 6.2.1 of Annex I to Directive 2005 /55/EC, as amended by Directive 2005 /78/EC and Directive 2006 /51/EC or a gas engine must demonstrate to all vehicle types and engines that the engine does not exceed these limit values during the following period of use:

a)

100 000 km or five years, whichever is the first, in the case of engines for installation in vehicles of categories N1 and M2;

b)

200 000 km or six years, whichever is the first, in the case of engines for incorporation into vehicles of category N2, N3 with a technically permissible maximum mass of up to 16 tonnes and M3 class I, class II and class A, and class B with a technical standard the maximum authorised mass of up to 7.5 tonnes;

c)

500 000 km or seven years, whichever is the first, in the case of engines for installation in category N3 vehicles with a technically permissible maximum mass of more than 16 tonnes and M3, Class III and Class B, with a technically permissible maximum mass of more than 7.5 tonnes.

2.

Furthermore, the functioning of the emission-relevant equipment must be confirmed during the normal life of a vehicle under normal operating conditions (conformity of in-service vehicles, which are: properly maintained and deployed). "

3. § 1d (9) Z 2 reads:

" 2.

Category L must be approved in accordance with Chapter 5 of Directive 97 /24/EC, as amended by Directive 2005 /30/EC, OJ L 327, 30.4.2005, p. No. OJ L 106 of 27 April 2005, p. 17 and in the version of Directive 2006 /120/EC, OJ L 106, 17.4.2006, p. No. OJ L 330 of 28 November 2006, S 16. "

4. In accordance with Section 1d (9), the following paragraph 10 is added:

5. § 4 (4) Z 2 reads:

" 2.

in the case of motor vehicles having a design speed of more than 25 km/h and trailers with which a speed of 25 km/h may be exceeded, each with a maximum permissible gross laden weight of more than 3 500 kg, at least 2 mm, "

6. § 4 (4c) and (4d) reads as follows:

" (4c) For motor vehicles with a maximum permissible gross laden weight of not more than 3 500 kg and a design speed exceeding 40 km/h, and to trailers which may be drawn with such motor vehicles, shall be used for use as snow and Matelling of certain tyres, provided that their profile depth does not fall below the level specified in paragraph 4 Z 4, shall be appropriate only if all the wheels which transmit forces to the roadway have such tyres. 7. § 7a reads:

" § 7a. (1) Films are divided into splinter protection films and tinting films. Splinter protection films are clear and have a light transmission of not less than 85%. All other films are tinting foils.

(2) Films may only be applied to the inside of the panes. The subsequent application of films on the windscreen of motor vehicles is not permitted.

(3) The application of splinter protection films is permitted on all side windows, on the rear window and on roof windows. The application of tinting films shall be permitted on side windows from the second row to the rear, on the rear window and on roof windows, unless they are discs which, in accordance with the ECE Regulation No 43, have the symbol "V" in the Approval marks are marked. The glass must be coated with the film only up to the disc holder, a jamming with the frame or the seal can be ruled out. (4) If a tinting foil is fitted on the rear window of the vehicle, the vehicle must have two main rear-view mirrors of category III or II in accordance with Directive 2003 /97/EC.

(5) If a tinting foil is fitted on the side windows from the second row of seats, the vehicle must have two main rear-view mirrors of category III or II in accordance with Directive 2003 /97/EC. If the film has a light transmission of less than 20%, a wide-angle mirror of class IV is to be installed on the right-hand side in accordance with Directive 2003 /97/EC and compliance with the required field of vision in accordance with the Directive 2003 /97/EC for the vehicle. This can be done either by marking the mirror glass itself (engraving, laser lettering) or in the form of a certificate from the mirror manufacturer with a unique certificate of membership or by a test report from a test institute which is considered to be a technical service for the tests referred to in Directive 2003 /97/EC, as opposed to the Commission and the other Member States.

(6) The commercial establishment trained and entitled by the film manufacturer must issue a confirmation of the correct application of the film and hand it out with a copy of the type-approval certificate of the film to the customer. When tinting films with a light transmission of less than 20% are attached, proof of compliance with the required fields of vision shall be carried out. however,

-for vehicles of categories 3.1. and 3.3. fitted with a direct injection diesel engine, the limit values shall be increased by 1 dB (A);

-for vehicles with a maximum authorised mass of more than 2t designed for use away from the road, the limit values shall be increased by 1 dB (A) if their engine has a power of less than 150 kW, or 2 dB (A) if their engine is a the power of at least 150 kW;

-in the case of vehicles of the class in accordance with 3.1 which are equipped with a manual transmission with more than four forward gears and a motor with a rated power of more than 140 kW and whose ratio of rated power/maximum permissible mass is greater than 75 kW/t, the limit values shall be increased by 1 dB (A) if the speed at which the rear vehicle limit passes the line BB ' in the third gear is more than 61 km/h. "

9. § 10 (7) reads:

" (7) The lighting equipment referred to in § § 14 to 20 of the 1967 KFG must be fitted on the vehicle in the case of motor vehicles and trailers in such a way as to ensure that they are subject to the provisions of the annexes to the relevant directives.

10. § 17i reads:

11. According to § 17i, the following § 17j with headline is inserted:

" Air Conditioners

§ 17j. (1) In vehicles of category M1 and N1, Group I (reference mass up to 1 305 kg), installed air conditioning systems must comply with the requirements of Directive 2006 /40/EC as regards their emissions and their safe functioning, OJ L 103, 25.4.2006, p. No. L 161, of 14 June 2006, p. 12. In the case of air-conditioning systems designed to contain a fluorinated greenhouse gas with a GWP value greater than 150, the leakage rate of this gas shall not exceed the maximum permitted limits laid down in Article 5 of the Directive. Before issuing an EC type-approval, vehicle manufacturers shall provide information on the refrigerant type used in the air conditioning systems.

(2) Air-conditioning systems designed to contain fluorinated greenhouse gases with a GWP value of more than 150 shall be allowed to take place from 1 January 2008 onwards. Jänner 2011 will no longer be retrofitted into vehicles that have been approved after this date. (3) Air-conditioning systems installed in vehicles for which type-approval has been granted after 31 December 2010 shall not be filled with fluorinated greenhouse gases with a GWP value of more than 150. Article 18 (8) reads as follows:

" (8) Vehicles of categories N2, N3 and M3, on which return lights are mounted in accordance with Article 14 (2) and Article 20 (1) of the KFG 1967, excluding military vehicles and fire-fighting vehicles, shall be fitted with a device (return warning) which shall: ejects a clearly perceptible intermittent sound to the rear when the return device is switched on. The number of cycles per minute must be between 60 and 100, with approximately the same proportion of signal and rest time. The A-weighted sound pressure level of this warning device must be at least 68 dB (A) and a maximum of 78 dB (A), at least 64 dB (A) and a maximum of 78 dB (A), measured at nominal voltage, in the 400 Hz-10 kHz frequency range for rear-end warners with a broadband sound level (A), . This shall be at a distance of 7.5 m between the microphone of the measuring instrument and the return warning and at the same distance from the road surface between 0.5 and 1.5 m. Article 18a (2) reads as follows:

" (2) Multi-track motor vehicles shall be fitted with at least two suitable, correspondingly large rear-view mirrors. These must be

14. According to § 18c, the following § 18d with headline is inserted:

Article 22a (1) (1) (1) (1). b is:

" (b)

Section 22a (1) Z 3 reads as follows:

17. In Section 22a (1), the following Z 4 is added after Z 3:

18. In accordance with Section 25d (3), the following paragraph 4 is added:

" (4) Identification boards for three-wheel motor vehicles without bodywork shall be designed in accordance with the model VIII of Appendix 5e. 19. § 26 para. 4 lit. b is deleted.

20. § 47 para. 1 lit. b is:

Section 61 (4) reads as follows:

26. § 63 (2).

29. § 69 (21) reads:

30. In § 69, the following paragraph 26 is added in accordance with paragraph 25:

1.

Section 1a (1) of the BGBl version. II No 275/2007 does not apply to vehicles which have already been approved before 5 April 2008, but they must comply with the previous rules;

2.

Section 1d (1a), (2) and (3) and Annex I, Table III in the version BGBl. II No 275/2007 shall not apply to vehicles which have already been approved before the entry into force of those provisions, but which must comply with the previous rules;

3.

§ 8 (1) (1) (3) of the BGBl version. II No 275/2007 does not apply to vehicles which have already been approved before 6 July 2008, but they must comply with the previous rules;

4.

Section 10 (7) of the BGBl version. II No 275/2007 does not apply to vehicles which have already been approved before 10 July 2008, but they must comply with the previous rules; however, such vehicles may no longer be admitted to circulation after 10 July 2011 ,

5.

§ 17i in the version BGBl. II No 275/2007 does not apply to vehicles which have already been approved before 1 November 2007, but they must comply with the previous rules;

6.

§ 17j in the version BGBl. II No 275/2007 does not apply to vehicles that are before the 4. They have already been approved in January 2008. After 1 July 2008, an EC type-approval or national type-approval of vehicles whose air-conditioning system is designed to contain fluorinated greenhouse gases with a GWP value above 150 shall be granted only if: the leakage rate of this system is no more than 40 grams of fluorinated greenhouse gases per year for systems with an evaporator, or 60 grams of fluorinated greenhouse gases per year in systems with two evaporators. After 1 July 2009, vehicles whose air conditioner is designed to contain fluorinated greenhouse gases with a GWP value above 150 may only be allowed to be marketed for the first time if the leakage rate of this system is not more than 40%. § 18d in the version BGBl. II No 275/2007 shall not apply to vehicles which have already been approved before 15 December 2008. However, such vehicles may no longer be admitted to traffic after 14 July 2010;

8.

Section 22a (1) (1) (1) b in the version BGBl. II No 275/2007 shall not apply to any changes made before 1 November 2007;

9.

Already issued identification plates for vehicles of the Federal Police with the designation of the factual area "BG" may continue to be conducted. "

31. In § 70, the following paragraph 10 is added to the following paragraph:

" (10) The changes made by the BGBl Regulation. II No 275/2007 shall enter into force as follows:

1.
