284. Regulation of the Federal Minister for Economic Affairs and Labour on statistical surveys in the field of electricity industry (Electricity Statistics Regulation 2007)

On the basis of § 52 of the Electricity Economic and Organization Act (ElWOG), BGBl. I n ° 143/1998, as last amended by the Federal Law BGBl. I No 106/2006, shall be ordered:

1. Main item

General provisions

Subject of electricity statistics

§ 1. (1) Statistical surveys are to be carried out in the field of the electricity industry, statistics are to be compiled and published in accordance with § 19.

(2) The following statistics shall be compiled:

1.

Day, monthly and annual statistics on the loading of networks, the application and consumption of electrical energy (operating statistics);

2.

Statistics on the plant inventory of network operators and producers (stock statistics);

3.

Statistics on market activity (market statistics);

4.

Statistics on renewable energy sources (statistics on renewable energy sources);

5.

Statistics on the promotion of renewable energy sources according to green electricity law, BGBl. No 149/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 10/2007 (green electricity production statistics);

6.

Statistics on prices and quantities of balancing energy (compensatory energy statistics);

7.

Statistics on quality of supply (failure and fault statistics, and statistics on voltage quality);

8.

Statistics on the non-availability of power stations (non-availability statistics).

Definitions

§ 2. (1) For the purposes of this Regulation, the following definitions shall apply

1.

"levy to end users" means the sum of the determined (measured and/or Supply to end users (from the public network-related consumption of the final consumer);

2.

"working capacity" in the case of running power plants is the electrical work that can be generated in a given period of time from the (energy-economically) usable inflow;

3.

"Reference and delivery" means the physical load flow at the transfer points (lines). Reference and delivery (delivery) are to be recorded separately (not anodised). The following are to be distinguished:

a)

physical exchange of electricity with neighbouring countries (imports and/or exports),

b)

physical exchange of electricity with other control zones (references or Taxes),

c)

Supply to network areas in the own control zone outside the Austrian Federal territory,

d)

production directly fed into foreign control zones;

4.

"injected production" means the quantity of electrical energy produced from power stations into the public grid;

5.

"egg generator" means a company which, in addition to its principal activity, generates electrical energy for the complete (including without recourse to the public network) or partial coverage of its own needs, and which does not share this share of the Public network. ÖBB-Infrastruktur Bau AG is considered to be a self-producer;

6.

"public network" means an electricity network with a nominal frequency of 50 Hz, to which network access is to be granted in accordance with § 17 of the ElWOG;

7.

"Austrian systematics of economic activities (ÖNACE)" which according to § 4 paragraph 5 Federal Statistics Act 2000, BGBl. I n ° 163/1999, Austrian version of the European economic classification NACE (ÖNACE, as amended), published in the Federal Statistical Office of Austria and published under the Internet address www.statistik.at;

"counting point" means a measuring point for electrical variables identified by a unique alphanumeric name, by means of which a network operator allocates all the measured values relevant to the offsetting;

9.

"survey date" shall be the date on which the survey has to be taken;

10.

"survey period" means the period over which data to be collected are to be aggregated;

11.

"size class of reference" means those values in kWh which are used for the classification of end consumers;

12.

"maximum net heating power" of a thermal power plant with combined heat and power generation of the heat of the heat transfer medium supplied by the plant to the heat grid (Fern) heat grid.

(2) 'power plant types' within the meaning of this Regulation are:

1.

Hydroelectric power stations:

a)

Running power stations with and without threshold operation,

b)

Storage power stations (daily, weekly and annual storage power plants) with and without pump storage;

2.

Thermal power plants:

a)

with combined heat and power, broken down in accordance with Annex II to the ElWOG,

b)

without combined heat and power;

3.

Photovoltaic systems;

4.

wind power stations;

5.

geothermal systems.

(3) 'Components of use (of the levy)' within the meaning of this Regulation are:

1.

Final consumers:

a)

load-measured end-users,

b)

households (standard load profile),

c)

Trade (standard load profile),

d)

agriculture (standard load profile),

e)

Others (interruptible, paused, etc.);

2.

Self-consumption for production. Transformer losses;

3.

Network losses;

4.

Consumption of pumped storage.

(4) "supply areas" within the meaning of this Regulation are:

1.

"urban areas of supply" count sprengel with a resident population of more than 1,000 inhabitants per square kilometre of permanent settlement area,

2.

"Rural Areas of Supply" Count Sprengel with a resident population of not more than 1,000 inhabitants per square kilometre of permanent settlement space.

(5) For all other terms, the definitions of § 7 ElWOG apply.

Statistics

Section 1

Operating Statistics

Quarterly values

§ 3. (1) The balance group coordinators shall, separately according to network operators, have a quarter of an hour in each of the day-to-day period (0.00 am to midnight) for the survey period:

1.

the total supply of electrical energy to final consumers from the public network;

2.

the total supply of electrical energy to pumped-storage power stations;

3.

the sum value of the line and transformer losses (charge to the balance sheet groups network losses);

4.

the sum value of domestic production (feed-in).

Corrections due to the second clearings must be reported immediately.

(2) The network operators shall each have a quarter of an hour for the survey period:

1.

the total supply of network areas in its own control zone outside the Austrian territory;

2.

the supply to the public grid of power stations with a bottleneck output of more than 25 MW separately from power stations;

3.

the sum value of physical exports;

4.

the sum value of physical imports.

(3) For the survey period, producers shall have a quarter of an hour to collect the production directly fed into foreign control zones.

(4) In the case of power stations with a constricted capacity of greater than 5 MW, the producers of power plants shall each have to collect a quarter of an hour on each third Wednesday of a calendar month for the survey period:

1.

the total gross production of electrical energy separately by type of power station;

2.

the reference from the public network;

3.

the reference from foreign power stations operating at a frequency other than 50 Hz, separated by type of power station;

4.

the supply to the public network;

5.

the sum value of physical imports;

6.

the sum value of physical exports;

7.

the consumption of pump storage (pumping power consumption).

Daily values

§ 4. Transmission system operators shall, in accordance with Article 25 (5) (5) (1) to (3) of the ElWOG network, have the transmission capacity specified, with the period of validity specified, in each case separately according to the period of validity of the transmission system. Rule zone boundary, in each case at the survey dates 1. Jänner and 1 July.

Monthly Values

§ 5. (1) The network operators with a direct delivery to end users of at least 40 GWh in the previous calendar year shall have to collect a calendar month for each of the survey period:

1.

the total input of electrical energy from power stations (physical);

2.

the physical imports of electrical energy over the individual lines, separated by lines;

3.

the physical exports of electrical energy over the individual lines, separated by lines;

4.

direct supply to the final consumer, indicating the loss of the network and the supply of power stations for pumped storage;

5.

the total supply of network areas in its own control zone outside the Austrian territory;

6.

the total supply of load-measured final consumers.

(2) The producers shall have for the survey period a calendar month for each power station with a bottleneck output of more than 10 MW and the egg generators for the survey period of one calendar month for each power station with a bottleneck performance of more than 5 MW:

1.

in the case of hydroelectric power stations, the total gross electricity production separately by type of power station;

2.

in the case of running power plants, in addition to the normal working capacity and the working capacity;

3.

in the case of storage power stations, the energy content, in relation to the last month of the month, separately after storage, indicating the consumption of pumped storage;

4.

in the case of thermal power stations, gross electricity generation separately from power plant block and primary energy sources, as well as, in the case of plants with combined heat and power generation, the heat generation and delivery separately according to power plant block and primary energy sources; self-consumption for production, including losses of transformer, as well as the type and quantity of primary energy sources intended for the generation of electrical energy and heat, with the indication of consumption and storage at the last month of the month;

5.

in the case of wind power plants (wind farms), photovoltaic installations and geothermal installations, power generation (feed-in) separately by type of power plant;

6.

in the case of self-producers, in addition to the reference from the public network, the reference to external power plants (16 P Hz), the feed into the public grid and the consumption for pump storage.

For recognised green power plants (§ 5 para. 1 Z 27 in conjunction with § 7 of the Ecoelectricity Act), the reported power plants must be named and the associated counting points should be specified in addition to the data according to Z 1, 4 and 5.

(3) The producers of the eggs shall each have a calendar month for the survey period:

1.

physical imports by country;

2.

physical exports to states.

Annual Values

§ 6. (1) The network users shall each have a calendar year to be collected for the survey period:

1.

Annual values pursuant to § 5 (1) (1) to (6);

2.

the direct levy, as well as the number of final consumers, broken down into the household, commercial and agricultural components, as well as the final consumer measured by the load, broken down by size class according to the relation from the network a distinction between supply areas;

3.

In addition, the direct delivery to final consumers is a distinction between the Federal States.

(2) The producers who operate at least one power plant with a bottleneck output of at least 1 MW as at 31 December have for each year a calendar year for all power stations, in the case of thermal power stations, in each case referred to Power plant blocks to collect each power plant in all other types of power plants:

1.

Annual values pursuant to § 5 (2) (1), (4), (5) and (6)

2.

in the case of thermal power stations, the mean calorific value of each primary energy source used;

3.

for thermal power plants with combined heat and power generation, the theoretical primary energy input for given power generation and minimum heat decoupling, as well as in the case of a given net heat generation and minimum electric generation, in each case for Best point separated by power plant block and primary energy carrier;

4.

for storage power plants, moreover, the generation from pump storage.

For recognised green power plants (§ 5 paragraph 1 Z 27 in conjunction with § 7 of the Ecoelectricity Act), the reported power plants must also be named and the associated counting points to be specified.

Section 2

Inventory Statistics

§ 7. (1) The network operators as well as the egg generators shall collect the stock statistics at the respective survey date of 31 December 24h00:

1.

the route and system lengths of installations for the transmission and distribution of electrical energy, separately for the network levels according to § 25 (5) Z 1 to 7 ElWOG, broken down by type of equipment (overhead line, cable);

2.

Number, type and characteristics of the substations and transformers, separated for the network levels according to § 25 (5) Z 2 to 6 of the ElWOG, divided by voltage levels as well as by type of plant (substations, substations, transformer stations) by area of supply;

3.

the number of counting points and points of consumption, as well as the corresponding quantities of final consumers, in each case separately according to network levels according to network levels. Section 25 (5) Z 1 to 7 of the ElWOG, as well as subdivisions into the components of the use as well as to the supply areas.

(2) The producers who operate at least one power plant with a bottleneck output of at least 1 MW as at 31 December have for the stock statistics on the respective survey date 31 December 24 h, for all their installations:

1.

gross and net close-up performance, annual regular working capacity, maximum net heating power in thermal power stations, maximum storage capacity of primary energy carriers, maximum energy content of the associated storage capacity of storage power plants, in the case of thermal power stations, in each case, in relation to power plant blocks, in all other types of power stations, each power plant;

2.

the respective number, power and type of emergency power plants associated with power stations (spare power supply systems).

(3) The producers have to collect the relevant counting points for the stock statistics at the respective survey date of 31 December 24:00 o'clock for recognised green power plants (§ 5 para. 1 Z 27 in conjunction with § 7 of the Ökostromgesetz).

Section 3

Market Statistics

§ 8. (1) For market statistics, have to be collected:

1.

the suppliers supplying domestic end-users, provided that such non-industrial end-users are not, within the meaning of Directive 90 /377/EEC, establishing a Community procedure to ensure the transparency of the industrial Final consumer to be paid gas and electricity prices, OJ L 327, 28.4.2002, p. No. 16., the volume-weighted average energy price in Eurocent/kWh for each of the survey periods January and July, for end users separately according to customer groups according to § 2 para. 3 Z 1 lit. b to e, in addition, all by default (ua. prices offered by means of price sheets);

2.

the suppliers supplying domestic end-users, the number of counts supplied at the respective survey date of 31 December 24:00 and the supply to the final consumer for each calendar year, for each calendar year, for Final consumer separately according to customer groups according to § 2 para. 3 Z 1 lit. b to e;

3.

producers with at least one power plant with a bottleneck performance of at least 25 MW at the respective survey date of 31 December 24.00, as well as the ownership structure (for those companies with a holding of more than 5%);

4.

electricity exchanges for electrical energy for each calendar year, the monthly volume of sales of each product traded on the stock exchange or on the market place, and the corresponding average prices, monthly anonymized market concentration statistics in each case separately after purchase and sale, the monthly import and export flows triggered by the trade broken down by country, as well as a short comment on the development of quantities and prices;

5.

the network operators, in each case for the survey period of one calendar month, the total number of final consumers and the number of end users who have switched the supplier, in each case separately by network level, and in the case of non-load-based End consumers are separated according to customer groups according to § 2 para. 3 Z 1 lit. b to e and, in the case of load-measured final consumers, by size class of the reference referred to in Annex II, lit. (j) the Commission Decision of 7 June 2007 amending Council Directive 90 /377/EEC on the introduction of a Community procedure to ensure the transparency of gas to be paid by industrial end-users; and Electricity prices, OJ C No. OJ L 148, 09.06.2007 p. 11;

6.

the network operators, each for the survey period of a calendar year, the average time required for the production and repair of terminals, in each case separately by network level.

(2) Market concentration statistics referred to in paragraph 1 Z 4 are the Hirschman Herfindahl index (sum of the squared market shares of the enterprises), separate data on the concentration rate (sum of the market shares) of the three largest (CR3), the four largest (CR4) and the five largest (CR5) companies, differentiated according to the quantity and turnover traded, the average number of participants per day and the average number of participants per day, which made a turnover.

Section 4

Statistics on renewable energy sources

§ 9. For statistics on renewable energy sources, the data collected in accordance with § 5 (2) (monthly values) and § 6 (2) (annual values) must be collected:

1.

the network operators for the survey period of one calendar month each feeding into the public network of recognised green electricity systems as measured by load (section 5 (1) (Z 27) in conjunction with § 7 of the Ecoelectricity Act), separated by plant (power stations), with the indication of the number of points, the type of power plant and/or the type of power plant, respectively. of the primary energy carrier as well as of the membership of the LCA group. Corrections due to the second clearing shall be reported without delay;

2.

the network operators for the survey period of one calendar year in each case the feed into the public network of non-load-based green power plants (§ 5 para. 1 Z 27 in conjunction with § 7 of the Oekostromgesetz) separately according to plants (power stations), with the respective indication of the counting point designation, the power plant type and/or the power plant type. of the primary energy carrier as well as of the membership of the LCA group. Corrections due to the second clearing shall be reported without delay;

3.

producers are responsible for the bottleneck performance of the recognised green power plants operated by them (Section 5 (1) Z 27 in conjunction with Section 7 of the Ecoelectricity Act) at the relevant survey date 31 December 24.00, broken down by plant, indicating the Location (state).

Section 5

Green electricity transport statistics

§ 10. For statistics on the promotion of renewable energy sources in accordance with the law on green electricity, the Ecoelectricity Development Office has to collect:

1.

quarterly the amounts of electrical energy taken over by the eco-current winding site, broken down by the classification of the current Regulation on the current eco-electricity regulation;

2.

The number of green electricity plants under contract at the beginning of the year and at the end of the year, as well as the number of eco-electricity systems which have been discharged from the support system during the course of the year, broken down according to the classification system of each of the Existing Regulation on green electricity;

3.

the total congestion at the beginning of the year and at the end of the year under contract of green electricity, broken down according to the classification of the existing eco-electricity regulation;

4.

quarterly the total quantity of the green electricity allocated to the electricity traders and the charges for which they are based, broken down by the system of the applicable eco-electricity regulations;

5.

annually the total available funding and quarterly the subsidies paid in accordance with the feed-in tariffs, broken down according to the nomenclature of the Ecoelectricity Regulation;

6.

quarterly the amount of and expenses for balancing energy, broken down within the meaning of § 15 (4) of the Ecoelectricity Act;

7.

annually the funds made available by the countries pursuant to Section 10a (9) of the Ecoelectricity Act.

6.

Balancing Energy Statistics

§ 11. For the balancing energy statistics, the balance group coordinators, separated by regular zones, shall each have a quarter of an hour for the survey period:

1.

the quantity of the balancing energy as a whole;

2.

the amount of balancing energy per balance sheet;

3.

the prices of the balancing energy.

Corrections due to the second clearings must be reported immediately.

Section 7

Supply Quality Statistics

Failure and Incident Statistics

§ 12. For the failure and malfunction statistics, the network operators for the survey period of 1. Jänner 00.00 am until 31 December 24:00 o clock the planned and unplanned disturbances (interruptions of supply), indicating the cause, the causing and affected network and voltage level (s), the beginning and the duration, the number of and performance (MVA) of the affected substations (installations), the number of network users concerned, the respective power and energy concerned, in each case separately according to voltage levels. The amount of electrical energy affected by the failure is to be estimated.

Statistics on voltage quality

§ 13. For the statistics on the voltage quality, the network operators have for the survey period of 1. Jänner 00.00 o'clock to 31st December 24h00 the characteristics of the voltage in public electricity supply networks in accordance with the characteristics described in the contractual (e.g. rated voltage, agreed supply voltage, slow and fast voltage change, voltage fluctuation, voltage drop, supply interruption, flicker, temporarily mains-frequency overvoltage, transient overvoltage, harmonic voltage, voltage of intermediate harmonics, Voltage asymmetry, signal voltages, frequency)

1.

for the network levels according to § 25 (5) Z 4 and Z 5 ElWOG nationwide, which means that the recording of the voltage quality by means of technical/scientific or mathematical models with the necessary measuring effort in the A medium-voltage range is to be carried out, whereby individual measuring points, corresponding to the model used, must allow comprehensible statements about the voltage quality in the network area under consideration, and

2.

for the network levels according to § 25 Abs. 5 Z 6 and Z 7 ElWOG punctual

Non-availability statistics

§ 14. For non-availability statistics, the producers for power stations with a bottleneck performance of at least 25 MW shall have the data for the survey period of 1. Jänner 00.00 o'clock to 31st December 24:00 o ` clock the year of commissioning and the last conversion, the operating time, the planned and unplanned (unintended) non-availabilities, indicating the beginning and end of each event, the respective Reduction of power and the respective cause, for thermal power stations separately according to power plant blocks and for all other types of power plants separately according to levels.

Implementation of surveys and evaluations and publications

Implementation of the surveys

§ 15. (1) surveys carried out in the framework of electricity statistics shall be carried out by

1.

the use of administrative and other data of the Energie-Control GmbH, of data of the network operators, of the clearing points for transactions and price formation for the balancing energy, as well as of the balance-sheet groups and the green-current winding station;

2.

periodic reporting by the companies subject to reporting requirements.

(2) The implementation of statistical surveys and other statistical work is carried out by Energie-Control GmbH. The data are to be anonymized as soon as a personal reference for the statistical work is no longer necessary.

(3) The Bundesanstalt Statistik Austria (Bundesanstalt Statistik Österreich) has the names, addresses and economic activities of Energie-Control GmbH at its request for the implementation of the statistics from the business register (Section 25 of the Federal Statistics Act 2000). in accordance with the ENACE, free of charge, according to the companies responsible for the information provided for in this Regulation.

(4) The Energy-Control GmbH has, at the request of the Federal Statistical Office, Austria, at the request of the Federal Statistical Office, to transmit electronically, free of charge, individual data collected pursuant to this Regulation to the extent that it is used for the compilation of the business cycle statistics in the production area, performance and structural statistics, statistics on the use of goods and statistics under the Trade Statistics Act.

Scope of surveys

§ 16. In the context of the Austrian electricity statistics, the surveys shall cover:

1.

Network operator;

2.

end-users;

3.

producers;

4.

Ice-generator,

5.

electricity traders;

6.

Balance group responsible;

7.

Balance group coordinators;

8.

Eco-pantograph;

9.

power exchanges;

10.

Rule zone guides;

11.

Suppliers.

Reporting obligation

§ 17. (1) Reporting obligation is the owner or responsible manager of a reporting company.

For the purposes of this Regulation, notifiable undertakings shall be operators of transmission systems, distribution system operators, balance group coordinators (clearing houses), balance-sheet groups responsible, producers, egg producers, rule-zone leaders, Electricity exchanges, electricity traders and the settlement site for green electricity (§ 14 of the Ecoelectricity Act).

(3) Data relating to final consumers-these are the quantities of electrical energy and electrical power-are to be identified by the network operator, to whose network the final consumer is connected, and in the context of the electricity statistics of the Energie-Control GmbH to announce.

(4) The data on balancing energy shall be made available by the balance sheet group coordinators.

(5) The data forming the subject of the notification obligation shall be transmitted electronically (e-mail or data carrier) of the Energie-Control GmbH in electronic form using the formats specified by Energie-Control GmbH.

Reporting

§ 18. (1) The information in accordance with § 3 (quarter-hour values) shall be provided by the balance sheet group coordinators, the network operators, producers and the self-producers up to the 20th of each year. The calendar day of the following month of the Energie-Control GmbH. Data which have been changed after the clearing has been made shall be transmitted immediately to Energie-Control GmbH.

(2) The data in accordance with § 11 (quarter-hour values of balancing energy statistics) are from the balance sheet group coordinators up to the 20th century. (3) The data according to § 4 (daily values), § 5 (monthly values) and § 9 Z 1 (monthly values renewable energy sources) are from the reporting party up to the 20. The calendar day of the following month of the Energie-Control GmbH.

(4) The information in accordance with § 8 Z 1 shall be provided by the suppliers in each case up to 20. Calendar day of the following month, changes by default (ua. prices) offered at the latest at the time of the date of effect of the change of the Energie-Control GmbH.

(5) The information in accordance with § 8 Z 5 shall be provided by the network operators up to the 20. The calendar day of the following month of the Energie-Control GmbH.

(6) The information in accordance with § 12 and § 13 shall be transmitted by the network operators respectively by 31 March of the year following the reporting year of Energie-Control GmbH.

(7) The information referred to in § 10 Z 1, 4, 5, 6 and 7 shall be provided by the eco-current winding station in each case up to and including 20. The calendar day of the second month following the last month of the respective quarter of the second month of the Energie-Control GmbH.

(8) All other information shall be provided by the party responsible for providing information up to 15 February of the year under review. the following year of the Energie-Control GmbH.

Evaluation and Publications

§ 19. (1) The data collected in the framework of the Electricity Statistics Regulation 2007 will be:

1.

the implementation of national and international statistical obligations;

2.

for publications and previews

(2) The following publications shall be produced annually by Energie-Control GmbH and shall be published on the Internet at the latest by the end of September of the following year in a suitable form (in particular tables, graphics and long-time series) with a respective one Summary, which summares the core statements of the respective statistics:

daily workload in the public network and the total current account balance on the third Wednesday of each month;

b)

c)

Annual and annual values of the production of electrical energy (physical) produced and fed into the public network (physical), separated by type of power plant and primary energy sources, specifying gross and net production, for thermal power stations above In addition, the primary energy input for generating electrical energy and heat;

d)

Monthly and annual values of physical imports and exports, separately by country;

e)

the monthly production coefficient of the running power stations, as well as the storage capacity and storage capacity of primary energy sources, in each case at the last month of each month;

2.

Inventory statistics, which have to include:

a)

Inventory of equipment for the transmission and distribution of electrical energy, broken down by network level according to § 25 (5) Z 1 to 7 ElWOG, broken down by type of installation;

b)

Stock of power stations, broken down by power plant types and narrow-pass performance classes;

c)

Monthly and annual values of the normal working capacity of the running power stations;

3.

Market statistics, which have to include:

a)

Price development, broken down by end-use categories;

b)

Seasonal and regional development of the change of supply, broken down by network level, for non-load-measured end users separately according to customer groups according to § 2 (3) (1) (1) (1) lit. b to e as well as for load-related final consumers in addition to the size classes of the reference;

c)

concentration data on the production and retail markets and on the electricity exchanges and other electrical energy trading venues;

d)

the average length of time for the manufacture and repair of connections;

4.

Statistics on renewable energy sources, which have to be included:

a)

Monthly values (at load-measured recognised installations) and annual values (for non-load-measured recognised installations) of the total produced and of recognised green electricity systems (§ 5 para. 1 Z 27 in conjunction with § 7 of the Ecoelectricity Act) in the public grid of electrical energy production, broken down by type of power station; primary energy sources;

Monthly values (in the case of recognised installations measured in the case of load) and annual values (for non-load-measured recognised installations) of the production of electrical energy fed into the public grid by small-scale hydroelectric power stations (up to 10 MW of congestion);

c)

Monthly and annual values of the total electrical energy and heat generated in thermal power plants with combined heat and power generation, indicating the thermal output and the bottleneck performance, the primary energy input and technical characteristics (efficiencies);

5.

Eco-electricity production statistics, which have to include:

a)

Monthly and annual values of the production of electrical energy fed into the public grid, broken down in accordance with the Nomenclature of the Ecoelectricity Regulation, of recognised green power plants (§ 5 para. 1 Z 27 in conjunction with § 7 of the Ecoelectricity Act);

b)

the number of installations of the respective categories in accordance with the ecoelectricity regulation in the course of the year;

c)

Development of the financial management of green electricity production, including expenditure on balancing energy;

6.

Compensatory energy statistics, this has to include:

a)

number of balance sheet groups per rule zone;

b)

prices for balancing energy per control zone based on quarter-hour values and average prices;

c)

Quantity of balancing energy per control zone based on quarter-hour values;

d)

the amount of balancing energy of the individual LCA groups based on quarter-hour values;

7.

Failure and fault statistics, which have to include separately according to the network and voltage levels:

a)

the network operator concerned;

b)

the average and longest duration of supply interruptions;

c)

Number of network users affected;

d)

the cause of the supply disruption (the failure);

e)

the estimated quantity of electrical energy affected by the interruption of the supply (failure);

f)

reliability measures;

8.

Statistics on the voltage quality, which has to include separately according to network levels:

a)

the network operators involved;

b)

the number of measurements and measurement sites carried out;

c)

the duration of the measurements;

d)

the results of the measurements on the characteristics of the voltage in public electricity supply networks in accordance with the characteristics described in the contract (e.g. nominal voltage, agreed supply voltage, slow and Rapid voltage change, voltage fluctuation, voltage drop, supply interruption, flicker, temporarily mains-frequency overvoltage, transient overvoltage, harmonic voltage, voltage of interharmonics, voltage asymmetry, signal voltages, frequency);

g)

the average duration of the restoration of the supply;

Non-availability statistics, which shall include:

a)

the producers concerned;

b)

Performance, work and time indicators of non-availability, broken down by type of power station, as well as by age and performance classes.

4. Main piece

Transitional and final provisions

§ 20. (1) This Regulation shall enter into force on 1 November 2007.

(2) The breakdown in supply areas pursuant to § 6 (1) Z 2, § 7 (1) Z 2 and 3 are to be reported for the first time as at 31 March 2011 for the calendar year 2010, a complete notification must be submitted by 31 March 2012 at the latest.

(3) The information provided for in § 13 (Statistics on the Quality of Voltage) shall be reported for the first time at 31 March 2009 for the calendar year 2008, and a full report must be submitted by 31 March 2011 at the latest.

(4) The Regulation of the Federal Minister for Economic Affairs and Labour, with which statistical surveys for the electricity sector are arranged, BGBl. II No 486/2001, takes place at the end of the 30th October 2007, with the proviso that all pending work for the period of 1 January 2007 shall be repeal. January 2001 to 31 December 2006 in accordance with the provisions of the BGBl Regulation. II No 486/2001 and the statistics for 2007 are to be drawn up in accordance with the provisions of this Regulation.
