290. Regulation of the Federal Minister for Economic Affairs and Labour, amending the Regulation on the limitation of the emission of air pollutants from installations for the production of iron and steel

On the basis of § 82 (1) of the 1994 Commercial Code (Gewerbeordnung)-GewO 1994, BGBl. No. 194 (WV), as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 60/2007, is being assigned in agreement with the Federal Minister for Agriculture, Forestry, the Environment and Water Management:

The Regulation on the limitation of the emission of air pollutants from installations for the production of iron and steel, BGBl. II No 160/1997, shall be amended as follows:

1. § 3 (1) Z 1 reads:

" 1.

Dust-like emissions 10 mg/m 3

If the use of tissue filters is not possible due to the properties of the exhaust gases or the exhaust air (e.g. high moisture content), an emission limit value of 20 mg/m shall apply. 3 . "

2. § 3 (1) Z 2.1 reads as follows:

" 2.1

Organic substances, expressed as total carbon 50 mg/m 3

The Authority shall, in the presence of organic substances with special hazard characteristics, such as carcinogenic, mutagenic, reproductive and difficult to degrade, easily accumulate or highly toxic, organic substances, to impose additional emission limit values. "

3. § 3 (1) Z 2.2 lit. b is:

" (b)

Fluorine and its gaseous compounds, expressed as hydrogen fluoride (HF) 3 mg/m 3 "

4. § 3 (1) Z 3 reads:

" 3.

Emissions into steam and/or or particle form

a)

Antimony, chromium, copper, manganese, vanadium and tin, including their compounds and fluorides, readily soluble (e.g. NaF), indicated as element, and cyanides readily soluble (e.g. NaCN), given as CN, total 1 mg/m 3

b)

Lead, cobalt, nickel, selenium and tellurium, including their compounds, expressed as element, total 0.5 mg/m 3

c)

mercury and thallium, including their compounds, expressed as an element, in each case 0.05 mg/m 3

d)

Sum of all under lit. a to c substances 1 mg/m 3

e)

Arsenic and its compounds (excluding hydrogen sulphide), cadmium and its compounds and chromium-VI compounds (excluding barium chromate and bleachromate), expressed as an element, total 0.05 mg/m 3 "

5. § 3 para. 2, first sentence reads:

" The state-of-the-art arrangements must ensure that dust-containing exhaust gases and exhaust air are collected and supplied to a dedusting device or to a device which is comparable in its effect, or to other waste gases, or to other types of dust, appropriate measures will be taken to avoid diffuse dust emissions. "

6. In Section 3, Section 3, the word sequences shall be " of 0.25 ng/m 3 up to and including 31 December 2005 and " and "from 1 January 2006" is deleted.

7. § 3 (4) Z 2 reads:

" 2.

In the case of open combustion systems, in the case of exhaust air systems and in the case of furnaces heated with electrical energy, the emission limit values are based on the measured oxygen content of the exhaust gases, or respectively. Exhaust air; for the determination of nitrogen oxides in open combustion systems, the exhaust gas volume that would result from the use of air as an oxygen carrier in the case of combustion of the same amount of fuel should be assumed. 8. § 4 reads:

" § 4. (1) For facilities for the melting and casting of pig iron

1.

the following emission limit values shall not be exceeded in accordance with § 5:

a)

dustlike emissions (excluding winder heaters) 20 mg/m 3

b)

dustlike emissions (winder heaters) 10 mg/m 3

c)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 350 mg/m 3

d)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 350 mg/m 3

e)

Cyanides, indicated as hydrocyanic acid (HCN) 3 mg/m 3

2.

Dust-containing exhaust gases must be collected at the site of the production (e.g. in the blast furnace casting hall, at the high-furnace filling, on the blast furnace charge or in the emergency casting bed) and must be supplied to a dedusting facility;

3.

High-furnace gas is to be used energetically (e.g. for firing in power plants or in wind heaters); to the extent that blast furnace gas can be used for safety reasons or in emergencies not energetically, it is to be fed to a torch.

(2) At steel production facilities in converters and in vacuum melting plants

1.

the following emission limit values shall not be exceeded in accordance with § 5:

a)

dustlike emissions 20 mg/m 3

b)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 350 mg/m 3

c)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 350 mg/m 3

2.

Dust-containing waste gases must be collected at the site of production (e.g. during refilling, slag, desulphurisation, converter loading and emptying or crude steel treatment) and must be supplied to a dedusting device, which may differ from that of the Refilling of liquid pig iron the formation of dust-containing waste gases due to extensive inertisation, eg by carbon dioxide atmosphere, to be avoided; filter dust is to be supplied as far as possible to recovery;

3.

Converter gas is to be used energetically (e.g. for firing in power plants or in winder heaters); if converter gas cannot be used for safety reasons or in emergency situations, it is to be supplied to a torch.

(3) At facilities for steel production in electric arc furnaces and in induction furnaces as well as in ladle metallurgical facilities

1.

the following emission limit values shall not be exceeded in accordance with § 5:

a)

dustlike emissions 5 mg/m 3

b)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 350 mg/m 3

c)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 350 mg/m 3

d)

2-, 3-, 7-, 8-TCDD-equivalent 0.1 ng/m 3

2.

Exhaust gases at the site of formation (e.g. in the case of electric arc furnaces are to be collected on the primary side by means of a lid-hole suction and on the secondary side by means of a Hall suction or housing for the process steps of charging, melting, stitching) and Exhaust gas purification system; filter dust is to be fed as far as possible to recovery.

(4) In the case of steel production facilities in electric slag remelting plants (ESU), the following emission limit values may not be exceeded in accordance with § 5:

a)

dustlike emissions 20 mg/m 3

b)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 350 mg/m 3

c)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 350 mg/m 3

d)

Fluorine and its gaseous inorganic compounds, expressed as hydrogen fluoride (HF) 1 mg/m 3

(5) In the case of facilities for heating or Heat treatment or heat treatment of iron and steel (heat furnaces, heat treatment furnaces and heat treatment furnaces of continuous hot-dip galvanization systems) shall not be exceeded in accordance with the following emission limit values:

a)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ), when using Kokereigas 300 mg/m 3

b)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 500 mg/m 3

(6) In the case of facilities for the vials (vials), dust-like emissions may be 20 mg/m in accordance with § 5. 3 do not exceed.

(7) In the case of surface treatment facilities of metals by means of acids, the following emission limit values may not be exceeded in accordance with § 5:

a)

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 300 mg/m 3

b)

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 500 mg/m 3

(8) In the case of facilities for surface treatment by hot-dip galvanising (hot-dip galvanising), the following emission limit values in the exhaust gas of the galvanising boiler shall not be exceeded in accordance with § 5:

a)

dustlike emissions 5 mg/m 3

b)

inorganic chlorine compounds, indicated as hydrogen chloride (HCl) 10 mg/m 3

(9) In the case of secondary dedusting equipment, subject to the conditions laid down in § 5, dust-like emissions may be 20 mg/m 3 do not exceed. "

9. § 6 reads:

" § 6. (1) In so far as paragraphs 2, 3 and 4 do not determine otherwise, the owner of the plant has individual measurements of the emission concentration of those in § 3 para. 1 and in § 4 (with the exception of § 4 paragraph 3 Z 1 lit. (d) Substances listed according to the Z 1 lit. a to c and the Z 3 of the Appendix to this Regulation shall be carried out at regular intervals not to exceed three years (recurrent emission measurements). If, on a case-by-case basis, certain substances listed in § 3 (1) and 4 (4) cannot occur or the emissions of these substances can be proven to be 5% of the limit on the basis of the technology or the used materials used. , the Authority shall, at the request of the plant owner, determine which of these substances shall not be subject to recurrent emission measurements.

(2) In the case of installations for the production of iron and steel pursuant to § 3 (3) and in the case of facilities pursuant to § 4 (3) (with the exception of lathe metallurgical facilities), the operating plant owner has in addition individual measurements of the emission concentration of the 2-, 3-, 7-, 8-TCDD-equivalents corresponding to the Z 1 lit. a and d and the Z 3 of the Appendix to this Regulation shall be carried out in regular intervals not over three years. In addition, individual measurements of the 2-, 3-, 7-, 8-TCDD-equivalent shall be carried out during the initial operation of the plant as well as in accordance with the changes in the plant which cause the formation of dioxins or furans. .

(3) In the case of installations for the production of iron and steel with an emission mass flow of dust-like substances

1.

from 1 kg/h to 3 kg/h, the relevant sources shall be equipped with measuring devices capable of continuously monitoring the operability of the exhaust gas purification devices (qualitative measuring devices);

2.

of more than 3 kg/h the relevant sources shall be equipped with measuring equipment, provided that the mass concentration of the dust-like emissions corresponding to the Z 2 and the Z 3 of the Appendix to this Regulation is determined by the relevant sources, unless otherwise specified. continuously determine (quantitative measuring devices).

(4) In the case of installations for the production of iron and steel whose emissions of gaseous substances exceed one or more of the following emission mass flows, the relevant sources shall be equipped with measuring equipment which shall be used for the mass concentration of the in accordance with Z 2 and Z 3 of the Annex to this Regulation, continuously:

1.

Sulphur oxides, expressed as sulphur dioxide (SO 2 ) 30 kg/h

2.

Nitrogen oxides, expressed as nitrogen dioxide (NO 2 ) 30 kg/h

Carbon monoxide as a key substance for the evaluation of combustion processes in combustion processes 5 kg/h

4.

Carbon monoxide in all other cases 100 kg/h

5.

Fluorine and its gaseous inorganic compounds, expressed as hydrogen fluoride (HF) 0.3 kg/h

6.

Chlorine compounds, indicated as hydrogen chloride (HCl) 1.5 kg/h

(5) In the case of gas-fired installations according to § 4, proof of compliance with the emission limit values for dust shall be deemed to have been provided if the inorganic dust content in the fuel gas is not more than 10 mg/m 3 . At a higher dust content in the fuel gas, a combustion air quantity of 10 m may be used 3 /m 3 The emission concentration to be expected is mathematically demonstrated.

(6) In order to carry out the measurements referred to in paragraphs 1 and 2, and for the control and calibration of measuring instruments for measurements pursuant to paragraphs 3 and 4, the following points shall be used:

1.

Accredited bodies (Accreditation Act, BGBl. N ° 468/1992, as last amended by the Federal Law BGBl. I No 85/2002),

2.

institutions of the Federal Government or of a federal state or bodies of public law,

3.

legally authorized bodies,

4.

Civil engineers of the relevant specialist area, technical offices-engineering offices of the relevant specialist area and chemical laboratories,

5.

the trader, within the limits of its powers,

provided that only validated analytical methods are used, a quality assurance system is established and the analyses are documented in a comprehensible way. "

10. § 7 reads:

" § 7. (1) The results of the measurements according to § 6 are presented in a measurement report according to ÖNORM M 9413 Measurement report for air pollutant emission measurements-requirements for the preparation 2002-07-01, printed under BGBl. II No 60/2007, which, in any event,

1.

in the case of measurements in accordance with Article 6 (1) and (2), the measured values and the operating conditions during the measurements (operating condition, fuel consumption, raw material and aggregates),

2.

in the case of measurements in accordance with § 6 (3) Z 2 and (4), the measured values in the form of records of a continuously registering measuring instrument,

3.

in the case of functional tests in accordance with § 6 para. 3 Z 1, the measured parameters in the form of records of a continuously registering measuring instrument

to be included.

(2) The measurement report shall be kept for at least three years in the operating system in such a way that it can be introduced at any time to the authorities of the public authorities for inspection.

The holder of a plant for the production of iron and steel referred to in Appendix 3 to the provisions of Annex 1994 shall, within three months of the end of a calendar year, report to the Authority on the results of the year under review in accordance with Article 6 of this Regulation. (3) and (4) carried out continuous measurements and verifications by electronic means. This report shall confirm compliance with the limit values for the pollutants to be measured continuously, or shall be notified of exceedances of the limit values of the individual pollutants, indicating the level of exceedance, the cause of exceedance and the duration of the exceedances. This report shall also include the results of the measurements to be carried out in accordance with Article 6 (1) and (2) (individual measurements). "

11. § 8 reads:

" § 8. The storage of dusty goods (e.g. sand, aggregates, slag) in installations for the production of iron and steel shall be carried out in such a way as to release as little air pollutants as possible; dustling goods shall be stored in closed halls or by suitable measures (e.g. wind protection belts, earth walls, cover or humidification of the surface) against the continued use of dust by wind. Doors and gates of such warehouses may only be kept open for transport purposes. If ventilation of such warehouses should be required, this may only be done by a ventilation system; for emissions from such a ventilation system, only the emission limit value shall apply in accordance with § 3 (1) Z 1. Conveying systems for dusting goods must be encapsulation, housing or the like corresponding to the state of the art. and be operated in such a way that as few air pollutants as possible are released. Road transport routes for motor vehicles shall be fitted with a ceiling made of asphalt, concrete or equivalent material, to be kept in a proper condition and to be cleaned in accordance with the degree of soiling. "

Section 9 (3) is deleted and the following paragraphs 3 to 7 are added in accordance with Article 9 (2):

" (3) At the time of the entry into force of the BGBl Regulation. II No 290/2007 already approved installations for the production of iron and steel, unless otherwise provided for in paragraph 4, of the Regulation on the limitation of the emission of air pollutants from installations for the production of iron and steel, BGBl. II No 160/1997, as amended by the BGBl Regulation. II No 290/2007, no later than five years after their entry into force. Up to that date, the provisions of the Regulation on the limitation of the emission of air pollutants from installations for the production of iron and steel, BGBl. II No 160/1997.

(4) At the time of the entry into force of the BGBl Regulation. II No 290/2007 already approved installations for the production of iron and steel falling under Appendix 3 to the 1994 ceiling must be covered by the Regulation on the limitation of the emission of pollutants from air pollutants from installations for the production of iron and steel Steel, BGBl. II No 160/1997, as amended by the BGBl Regulation. II No 290/2007, by 31 December 2007 at the latest. 1 October 2007. (5) At the time of the entry into force of the Regulation BGBl. II No 290/2007 already approved installations for the production of iron and steel shall be subject to an emission limit value of 20 mg/m by way of derogation from the provisions of § 3 (1) (1) (1) (1) 3 . However, this does not apply to the emission limit value of ventilation systems in accordance with § 8.

(6) At the time of the entry into force of the Regulation BGBl. By way of derogation from the provisions of section 4 (2) (3), II No 290/2007 already approved plants for the production of iron and steel should be used as energetically as possible. Where converter gas cannot be recovered, it shall be supplied to a torch; in this case, the dust content in the torch gas shall be 50 mg/m after the dedusting device. 3 do not exceed.

(7) At the time of the entry into force of the Regulation BGBl. II No 290/2007 already approved installations for the production of iron and steel shall apply by way of derogation from the provisions of § 4 (3) Z 1 lit. a) an emission limit value of 10 mg/m 3 , measured in the case of individual measurements as half-hourly average, for continuous measurements as the daily average. "

13. In Z 1 lit. a the asset will be the phrase "for all substances referred to in § 3 (1) and (3) and (4)" is deleted.

14. Z 1 lit. b of the installation is:

" b )

The dust concentration in the exhaust gas shall be determined by the determination of three measured values; the measurement duration for obtaining a measured value shall be at least half an hour. With regard to the determination of the dust-like emissions of surface treatment equipment by means of hot-dip galvanising (Article 4 (8) (a)), it is considered that the result of the individual measurement is to be determined by means of several diving operations; the The measurement time shall be equal to the sum of the individual immersion times and shall as a rule be half an hour; the immersion time shall be the period between the first and last contact of the galvanizing material with the galvanizing bath . "

15. In Z 2 lit. b and c of the plant shall be the word order "§ 6 (5)" in each case by the word sequence "§ 6 (6)" replaced.

16. After Z 2 lit. d the plant will be the following lit. e is added:

" e)

For emissions in accordance with § 4 para. 3 Z 1 lit. a shall differ from lit. d sublit. (cc) that the emission limit value of the emission limit value of 5 mg/m³ shall be deemed to be exceeded if a half-hourly average value exceeds three times that emission limit value. 17. After Z 2 of the plant the following Z 3 is added:

" 3.

Rules of technology for measurements, equipment and records

The measurements, equipment and records must be carried out in accordance with the provisions of Appendix 5 to the Regulation on the incineration of waste (Waste Incineration Ordinance-AVV), BGBl. II No 389/2002, in the current version, respectively, are carried out, or comply with the relevant technical standards referred to therein. "
