310. Regulation of the Federal Minister for Agriculture, Forestry, the Environment and Water Management on the statistics on the agricultural structure and livestock in 2007

On the basis of § § 4 to 12 of the Federal Statistics Act 2000, BGBl. I No 163/1999, as last amended by Federal Law BGBl. I n ° 71/2003, is in agreement with the Federal Chancellor, in respect of Section 18 in addition in agreement with the Federal Minister of Finance and with regard to § 19 on the basis of § 3 of the LFBIS Act, BGBl. Section 1

Agricultural Structure Statistics

Arrangement for the compilation of statistics

§ 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for fulfilling Austria's obligations under Regulation (EEC) No 571/88 on the implementation of Community surveys on the structure of agricultural holdings, OJ L 327, 31.12.1988, p. No. 1, as last amended by Regulation (EC) No 1928/2006, OJ L 210, 31.7.2006, p. No. 7., to carry out surveys in accordance with the provisions of this Regulation and to compile statistics on the basis of the data collected by 31 December 2008.

Statistical units, survey mass

§ 2. Statistical units are:

1.

Agricultural and forestry holdings with an agricultural area of at least one hectare;

2.

wine-growers with a minimum of 25 working wine-growing areas;

3.

Holdings with at least 15 working areas of intensively used mob areas, or 10 ares of soft fruit, strawberry, vegetable, flower or ornamental areas or reb, forestry or nursery areas;

4.

Holdings which operate greenhouses (high-glass, foil tunnel, glass) from a minimum size of an Ar mainly on a commercial basis;

5.

Forestry holdings with at least 3 hectares of forest area;

6.

Livestock holdings with at least one piece of one of the genera bovine, porcine, ovine, caprine or at least 100 poultry of all kinds.

Reference period, reference period

§ 3. (1) The reference date of the survey is 1 December 2007.

(2) Notwithstanding this, the reference period shall be:

1.

for data on area-related survey characteristics, the harvest year 2007,

2.

for workers in the period from 1 December 2006 to 30 November 2007, and

3.

for information on the non-examined slaughtering of pigs, the period from 2 June 2007 to 1 December 2007.

(3) For information on poultry, the same day as the date of the last eviction between 1 November 2007 and 1 December 2007 applies to stalls which are temporarily cleared on 1 December 2007.

Survey characteristics

§ 4. It's the one in the Annex I to the above-mentioned survey characteristics.

Survey Type

§ 5. (1) The survey characteristics in accordance with Annex I Z 2 to 5 and 9 are to be collected in the manner of a full survey by the procurement of administrative data at the agricultural market of Austria.

(2) The other survey characteristics and characteristics listed in Annex I Z 2 to 5 and 9 are, in so far as they are not available as administrative data at the time of the survey, personal data in the type of sample survey by survey of 40 000 to collect statistical units in accordance with § 2.

(3) The selection of the sample holdings must be carried out by the Federal Institute on the basis of a stratified random sample.

§ 6. In order to fulfil the obligations of Austria on the basis of Directives 93 /23/EEC on the statistical surveys on pig production, 93 /24/EEC on the statistical surveys on the production of bovine animals, the Bundesanstalt has 93 /25/EEC concerning the statistical surveys on the production of sheep and goat, respectively OJ L 206, 22.7.1993, p. No. 1., as last amended by Directive 97 /77/EEC, OJ L 73, 27.2.1997, p. No. OJ No L 10, 16. 28, to carry out surveys in accordance with the provisions of this Regulation and to compile statistics on the basis of the data collected by 31 May 2008.

§ 7. For the purposes of this Section, statistical units shall be agricultural holdings holding cattle, pigs, ovine or caprine animals on the cut-off date or slaughtering pigs which have not been investigated during the reference period.

Reference period, reference period

§ 8. (1) The reference date of the survey is 1 December 2007.

(2) The period from 2 June 2007 to 1 December 2007 shall be considered as the reference period for information on unexamined slaughterings of pigs.

Annex II to the public.

Survey Type

§ 10. (1) The survey characteristics in accordance with § 9 Z 1 are to be collected by questioning in relation to the statistical units according to § 7, which were selected for the sample in accordance with § 5 para. 3.

(2) The survey characteristics in accordance with § 9 Z 2 are to be collected in the manner of the full survey by the procurement of administrative data at the agricultural market Austria.

Common provisions

Implementation of the survey

§ 11. The survey is carried out by means of uniform survey documents (electronic questionnaires and explanations), which are to be submitted by the Federal Office and which are to be made available to the parties responsible for providing information.

Obligation to provide information

§ 12. (1) In the case of the surveys, the obligation to provide information according to § 9 of the Federal Statistics Act 2000 on the survey characteristics in accordance with § § 4 and 9, insofar as these cannot be determined by the procurement of administrative and statistical data, is required.

(2) For the purpose of providing information, those natural and legal persons as well as partnerships of commercial law are obliged to operate a statistical unit in accordance with § § 2 or 7 in their own name.

(3) In order to provide information in the form of a reasoned empty message, those natural and legal persons as well as partnerships of commercial law shall be obliged to operate either a selected holding on which the Conditions according to § § 2 and 7 do not apply or which have left the selected establishment.

Information on disclosure requirements

§ 13. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Obligation to provide information to the parties responsible for providing information

§ 14. The parties responsible for providing information shall make their data timely, complete and to the best of their knowledge. The information may be provided at any time within a period to be determined by the municipality directly by providing information to the congregation or by electronic means in the questionnaire until 14 December 2007 by the person responsible for providing information, and the The Federal Agency shall be sent.

Participation obligations of the municipalities

§ 15. (1) The municipalities in whose sphere of action a holding selected by the Federal Institute within the framework of the random sample (section 5 (3)) are obliged to participate in the survey in accordance with paragraph 2. (2) In the case of direct exchange of information with the municipality, the municipalities shall participate in the survey by means of electronic counting bodies used by the mayor to electronically survey the respondents in the questionnaire. § 16. Other co-action obligations

§ 17. Former managers (farmers) of statistical units in accordance with § § 2 and 7 are obliged to participate in the determination of the new information subject pursuant to § 12 para. 2 by the Federal Institute.

Cost severance

§ 18. The municipalities will be granted a cost compensation for the participation in the agricultural structure survey of EUR 4.47 per selected statistical unit.

Data transmission to the LFBIS

§ 19. The Federal Institute has the following: 1. Section identified individual operational data to be sent to the Federal Minister for Agriculture, Forestry, Environment and Water Management for inclusion in the agricultural and forestry operating information system (LFBIS).
