335. Ordinance of the Federal Minister for Justice on the management of grades as usage designations in the executive service of the E1 in the justice department

On the basis of § 145a of the Civil Service Act 1979, BGBl. No. 333/1979, as last amended by BGBl. I No 67/2007, is being ordered:

§ 1. (1) For officials of the Executive Service of category E1 in the Department of Justice, the following levels of service shall be used as designations of use:

(2) By way of derogation from the grades referred to in paragraph 1, the following levels of service shall be provided for officials of the Executive Service in the following uses, provided that these officials belong to a lower functional group:

(3) Officials of the Executive Service shall carry out the degrees of service in the female form, as far as this is possible in a language.

(4) Where an official of the Executive Service is assigned a job with a lower level of service than the previous one, the previous level of service may only be continued if the official does not himself give the reasons for the change .

(5) Was an official in accordance with § 145a BDG 1979 in the version before the 2. Dienstrechts-Novelle 2003, BGBl. I No 130, because of its function to lead a higher designation of use or a higher official title, than this is the case under this Regulation, the official shall carry out this (higher) official title as a grade of service so long as until, in accordance with the provisions of this Regulation, a higher grade of service shall be acquired as a designation of use. This shall not, however, apply in the event of a change or change in the use of which the official himself has to be represented.

§ 2. (1) On the occasion of the transfer or the transfer into retirement, the official may:
The Executive Service of the Working Group E1 shall be awarded in place of the grade of the next level of service provided for its use, without any legal consequences in terms of service or employment law.

(2) The Executive Officers of the retirement age shall be entitled to conduct the degree of service which they have been entitled to maintain at the time of the transfer or the transfer. In doing so, they have to add "in retirement" ("i.R. ") to the degree of service.

§ 3. (1) Officials of the E1 of the Executive Service, used abroad, may be authorized to perform the lieutenant's degree of service for the duration of such use, provided that this is necessary for the performance of their function and do not already have the same or a higher grade of service under other provisions of this Regulation.

(2) The officials of the Executive Service of category E1, who shall be sent in accordance with Article 1 of the KSE-BVG, may be granted the right to carry out a higher degree of service to "Major General" for the duration of such use, who shall be responsible for the exercise of a function within the organisational structure of an international mission is necessary, provided that it does not already have the same or a higher level of service under other provisions of this Regulation. The authorization to carry out the Major General Service is granted only for the performance of the function of the Head of an international mission and only to the extent that this function requires this grade of service, provided that the executive staff concerned are do not already have the same or a higher grade of service under other provisions of this Regulation. The quota commander may be granted the authority to run the next higher grade, higher than that of its deputies.

(3) Where, in the case of service or remuneration, legal consequences are linked to the inexoration of certain grades, the officials of the Executive Service referred to in paragraphs 1 and 2 shall be presumed to be that degree of service to which they shall be subject: This would have been due to the fact that it would have served in the domestic sector.

§ 4. (1) The reporting obligation to superiors (point 6.2. of the law enforcement order for judicial institutions, JOJ L 327, 30.4.2004, p. No 13/1996) shall remain unaffected by the provisions of this Regulation.

(2) The degree of service as a designation of use shall be preceded by an appointment. Temporary uses such as those on project workplaces-with the exception of posting-are unaffected by the degree of service.

(3) The level of service shall be based on the use and function group (s) (or in the cases of § 1 (2) and § 3 (1) and (2) on the basis of the function) directly from the Regulation.

(4) This Regulation does not entail any changes in law and does not entail any changes in the assessment and assignment of the changes.

§ 5. (1) The personal expressions used in this Regulation shall apply equally to women and men.

(2) This Regulation shall enter into force on 1 December 2007.
