348. Ordinance of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the setting of conditions for quality wines typical of the region with origin profiles for the Kremstal wine-growing region (DAC Regulation "Kremstal")

On the basis of § § 10 (6) and 39a (1) of the Wine Act 1999, Federal Law Gazette (BGBl). I n ° 141, as last amended by the Federal Law BGBl. I No 55/2007, shall be ordered:

§ 1. Wine may be placed on the market under the name "DAC" or "Districtus Austriae Controllatus" in connection with the indication of the wine-growing region of Kremstal, if it meets the requirements for quality wine of certain production areas and the following Requirements are:

1.

The wine must have been prepared exclusively from grapes harvested in the Kremstal wine-growing region.

2.

The wine must have been prepared from the quality wine grape variety "Grüner Veltliner" or "Riesling"; a label-harmless incision must be tolerated.

3.

The indication of the vine variety must be made in such a way that it is clearly subordinate to the indication of the wine-growing region Kremstal.

4.

The indication of a further traffic description shall be prohibited (in particular, traffic names such as "quality wine", "cabinet" or "late harvest"). The designations "DAC" or "Districtus Austriae Controllatus" shall be indicated on the label in direct relation to the specific region of Kremstal and in characters not exceeding half the size of the name "Kremstal" used. In any case, the designation "Kremstal" in conjunction with "DAC" or "Districtus Austriae Controllatus" is to be found on the front label. The designation "DAC" or "Districtus Austriae Controllatus" in the same field of view with the mandatory data is to be referred directly to the state test number.

The indication of the wine-growing region shall be inadmissible.

The wine may only be delivered in glass bottles to the consumer, unless it is to be immediately enjoyed at the place of administration. The nominal volumes of 1.0 l and 2.0 l are not allowed when the glass is delivered in glass bottles.

The indication of the harvest year is compulsory.

8.

The content of unfermented sugar shall correspond to the term "dry".

The actual alcoholic strength by volume shall be indicated at 12.0% or 12.5% vol. on the label. According to the decision of the Regional Wine Committee Kremstal, the existing alcohol content can also be indicated in exceptional years with 13.0% vol. on the label. This decision shall be communicated to the Federal Ministry of Agriculture, Forestry, Environment and Water Management by 1 December of each harvest year at the latest.

Wines from the grape variety "Grüner Veltliner" must have the following typical taste:

fresh, fruit-stressed, fine seasoning, no botrytis note, no wooden shade, not alcohol-lastic.

Wines from the grape variety "Riesling" must have the following typical taste:

duftig, stoneobstaromatic, elegant, mineral, no botrytis note, no wooden shade, not alcohol-lastic.

A request to obtain the state test number for wine with the sales designation "Kremstal DAC" must not be allowed until 1. Jänner of the year following the harvest will be placed.

13.

The state test number issued for wine with the name "Kremstal DAC" may only be used for the placing on the market of the wine tested under the name "Kremstal DAC".

In the course of the procedure for the award of the state test number for wine with the sales denomination "Kremstal DAC", the Commission has to take part in the branch office of the Federal Office for Viticulture in Krems. At least four costume of the official cost commission must have been trained by the Regional Committee of Kremstal with regard to the evaluation of the typical taste profile of the wines mentioned above.

The use of the additional designation "reserve" shall be possible under the following conditions: the name "reserve" must be indicated on the label directly related to the specific region of Kremstal and in written signs which are equal to are like the one used for the "Kremstal". In any case, it must be indicated on the front label. By way of derogation from § 1 Z 9, the existing alcohol shall be at least 13% vol. . The wines have the following characteristics: strong stylistics, strong varietal aromas, densely and long in the demise; tender botrytis and wooden clay is permissible. By way of derogation from § 1 Z 8, the residual sugar content shall be no more than 9 grams. A request to obtain the state test number may not be made until 15 March of the year following the harvest.

§ 2. Wine with the sales designation "Kremstal DAC" is to be produced and bottled in the wine-growing region Kremstal. The production and bottling outside of the area may only be carried out with the approval of the Federal Office for Viticulture after hearing the Kremstal Regional Wine Committee. Such authorisation may be granted, in particular, if the vineyards of the manufacturer are located in the Kremstal wine-growing region and the production of the wine is carried out on an operation of the manufacturer outside the Kremstal wine-growing region, or if land contracts exist between a manufacturer with an establishment outside the Kremstal wine-growing region and owners of vineyards in the Kremstal wine-growing region. The place of provenance, land number (s) and area (s) shall be shown on the invoices, delivery notes and transport documents to be paid.

§ 3. Anyone intending to obtain an application for a state test number for a wine called "Kremstal DAC" has to inform the Kremstal Regional Wine Committee every year in writing (also e-mail or fax).

§ 4. For the implementation of measures to improve the knowledge and transparency of wine with the sales designation "Kremstal DAC", the Regional Committee of Kremstal is authorized to raise contributions. The amount of the contributions shall be determined by the Regional Committee. The Federal Office for Viticulture in Eisenstadt has the necessary data available to the Kremstal Regional Committee.

§ 5. Quality wines up to and including the 2007 vintage may continue to be placed on the market, subject to compliance with the rules on the designation of the quality of the wine.
