379. Regulation of the Federal Minister for Justice on the fixing of a surcharge to the fixed amounts mentioned in the Law on Law on Law of Law

On the basis of § 25 of the Federal Law on the Bar of Lawyers, BGBl. No. 189/1969, as last amended by the Federal Law BGBl. I n ° 8/2006, shall be assigned in agreement with the Main Committee of the National Council:

§ 1. (1) In the tariff of the Federal Law on the Bar of Lawyers, in the version of the Regulations of the Federal Minister of Justice BGBl. No. 198/1972, BGBl. No. 646/1974, BGBl. No. 368/1977, BGBl. No. 144/1981, BGBl. No. 102/1985, BGBl. No 491/1990, BGBl. No 224/1994 and BGBl. II No 227/2001, the fixed amounts mentioned above shall, unless otherwise specified in paragraph 2, be subject to a further surcharge of 11.5 vH.

(2) The increase in remuneration in accordance with § 23a of the second sentence of the RATG shall be excluded from the fixing of a surcharge. A surcharge of 4 vH shall be established for the amount referred to in Z 4 of the tariff post 9.

(3) The resulting remuneration of the attorney shall be determined in the annex forming part of this Regulation.

§ 2. (1) This Regulation shall enter into force 1. Jänner 2008 in force.

(2) It shall apply to the performance of lawyers and lawyers who shall be effected after 31 December 2007; in relation to the party, a different agreement on the level of remuneration shall remain unaffected.
