34. Federal Law amending the Environmental Promotion Act

The National Council has decided:

The Environmental Promotion Act (UFG), BGBl. No. 185/1993, as last amended by the Federal Law BGBl. No 24/2007, is hereby amended as follows:

1. § 1 Z 1 reads:

" 1.		Protecting the environment by means of orderly disposal of waste water, including operational waste water, and ensuring adequate water supply, and by improving the ecological status of water (water management); "

2. In accordance with § 6 (1) Z 1 the following Z 1a is inserted:

" 1a.		for the purpose of improving the ecological status of water bodies (§ § 16a et seq.) from the cleanability of the environment and water management funds (§ 51 para. 5a); "

§ 6 (1a) Z 1 reads as follows:

" 1.		For the purpose of water management (§ § 16 et seq.) from the year 2000 on the cleanability of the environmental and water management fund (§ 51 para. 5a); "

3a. In § 6 (2d) the third sentence reads:

"In 2007, an additional 10 million euros will be made available, starting in 2008, an additional 20 million euros will be made available."

4. In accordance with Section 6 (2d), the following paragraph 2e is inserted:

" (2e) The Federal Minister for Agriculture, Forestry, Environment and Water Management can pledge funding for the purposes of improving the ecological status of water bodies (§ § 16a et seq.) in the years 2007 to 2015, the extent of which is the total value of the cash value of a maximum of EUR 140 million. "

5. In Section 6 (3), the following Z 1a is inserted after Z 1:

" 1a.		Contracts according to Article 17a (6) of the Reinfortune of the Environment and Water Management Fund, with the inclusion in the Additional Framework in accordance with § 6 (2); "

6. In § 7 Z 1, in the title of the second section, in the parenthesis in § 22 as well as in § 51 para. 3, the word "Municipal water management" by the word "Water Management" replaced.

7. In Section 12 (8), after the quote "§ 17 (1) Z 6," the citation "§ 17a Z 6," inserted.

8. In § 13 paragraph 5 Z 2 lit. a becomes after the phrase "concerning settlement water management," the phrase "Measures to improve the ecological status of waters," inserted.

9. The last sentence is deleted in Section 14 (1).

10. According to § 16, the following § 16a is inserted:

" § 16a. The aim of promoting measures to improve the ecological status of water bodies is the reduction of hydromorphological loads. "

11. In accordance with § 17, the following § 17a is inserted:

" § 17a. In the context of the improvement of the ecological status of the waters, it is possible to promote

1.		measures to improve continuity;
2.		measures to reduce the impact of discharges;
3.		measures to mitigate the effects of backlog;
4.		measures to mitigate the impact of the surge;
5.		measures for the restructuring of morphologically modified flow routes, provided that these are not combined with flood protection measures;
6.		Basic concepts, studies, studies, general planning, as well as expert reports which are necessary in connection with measures according to Z 1 to 5. "

12. In § 18 Z 2, after the word order "such pursuant to § 17 (2)" the phrase "or § 17a" inserted.

13. In § 19 Z 1, after the word order "Municipalities which, on their own behalf and on their own account, establish or operate water supply, waste water disposal or sludge treatment facilities" the phrase "or implement measures in accordance with § 17a" inserted.

14. In § 19 Z 6, after the word order "pursuant to § 17 (2)" the phrase "or measures according to § 17a" inserted.

15. In § 21, after the word order "for the purposes of urban water management" the phrase "or the improvement of the ecological status of the waters" inserted and the character "€" to the word "Euro" modified.

16. In Section 22a (1), after the phrase "for the funding opportunities of the settlement water management" the phrase "and the improvement of the ecological status of the waters" inserted.

17. In § 49 Z 1 lit. b becomes after the phrase "concerning settlement water management," the phrase "Measures to improve the ecological status of waters," inserted.

18. In Section 51 (5a), after the word order "with a cash value of 507,839 million euros" the phrase "and in order to support the improvement of the ecological status of the water bodies (§ 6 para. 2e) with a cash value of 140 million euros" inserted.
