Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on reporting requirements in the livestock and meat, eggs and poultry sectors (livestock reporting regulation 2008)

On the basis of § § 22, 23 and 28 of the Market Order Act 2007 (MOG 2007), BGBl. I n ° 55, shall be assigned:

Scope

§ 1. This Regulation shall be used for the implementation of

Regulation (EC) No 295/96 on the application of Council Regulation (EEC) No 1892/87 as regards the determination of market prices on the basis of the Community scale for the classification of carcases of adult bovine animals, OJ L 327, 31.12.1996, p. No. OJ L 39, 17.2.1996, p. 1,

Responsibility

§ 2. The authority responsible for the enforcement of this Regulation and the acts referred to in § 1 is the Market Order Office, "Agricultural Market Austria" (AMA).

Definitions

§ 3. For the purposes of this Regulation:

1.

Livestock markets: livestock markets, which are regularly loaded with farm animals and in which in the last calendar year on average more than 100 units of hiring cattle, 100 pieces of calves or 500 pieces of piglet per market day have been sold;

2.

Slaughterhouses: slaughterhouses in which in the last calendar year on average more than 120 pieces of cattle, 50 pieces of calves, 1 000 pieces of pigs, 10 000 pieces of chickens, 2 000 pieces of turkey or 50 sheep were slaughtered every week. Slaughterhouses shall also be considered to be holdings which leave animals slaughtered and implement the quantities referred to in the first sentence;

3.

Intermediaries: natural or legal persons or groups of persons who, in the last calendar year, purchases of an average of more than 100 pits of useful calves, slaughtering and setting cattle, 1 000 pieces of pigs, 500 pieces of piglets or 50 sheep weekly or per event. As intermediaries, producer groups (e.g. bovine animals and swine blocs), which meet the volume turnover referred to in the first sentence, shall also be considered as intermediaries, and shall be considered as intermediaries;

4.

Packing centres: packing centres where, on average, more than 100 000 eggs have been packed weekly in the last calendar year;

5.

Disguised holdings: holdings in which, on average, more than 10 000 pieces of broiler chickens or 2 000 pieces of turkey chickens were disassembled weekly on average over the last calendar year.

Mandatory

§ 4. Reporting Obligations

1.

in the case of commercial markets, the person responsible for the management of the market; and

2.

in the case of slaughterhouses, brokers, packing centres and cutting plants, the farmer.

Frequency and timing of notifications

§ 5. (1) The reports of the commercial securities markets and intermediaries in accordance with § § 8 (4) and (9) (2) shall be made at the end of each livestock market and shall be transmitted in sufficient time for them to arrive at the AMA at the latest on the second subsequent Monday.

(2) The rest of the notifications pursuant to § § 8 to 12 shall be made weekly and must be received at the AMA on Tuesday after the end of the calendar week.

Country of origin

§ 6. The quantities and prices are to be shown separately in the cases of § § 8 (1), (3) and (4), (9) (1), (1), (1) and (12) (1), in the country of origin.

Formal requirements

§ 7. (1) The notifications shall be made using the forms laid down by the AMA, which shall be subject to the following conditions of entry:

1.

Name/Company and address of the reporting person,

2.

reporting period,

3.

Quantity data on the individual categories according to § § 8 to 12,

4.

Price indication of the individual categories according to § § 8 to 12,

5.

information on the country of origin, as provided for in § 6, and

6.

Signature.

(2) The AMA may allow notifications without the use of the form, provided that the information referred to in paragraph 1 is included.

(3) The notification may be made in any technically permissible form.

Reporting requirements for bovine animals and beef

§ 8. (1) slaughterhouses and intermediaries shall report quantities and prices for the marketed meat of the following categories:

1.

Halves, in each case after bulging animals, bulls, oxen, cows and calves separately, for the commercial classes E, U, R, O, P within the meaning of the Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management, on the basis of trade classes for Beef slaughtered body, BGBl. II No 289/2002, total,

Halves, each separated after bulls, oxen, cows and calves separately, for the commercial class E, U, R, O, P, separated according to these commercial classes,

3.

Halves of Sanimals for the trade class R,

4.

Halves of Jungsanimals of the trading classes U 2, U 3, R 2, R 3, O 2 and O 3,

5.

Halves of Sanimals of the trade class R 3,

6.

Halves of oxen of the commercial classes U 2, U 3, U 4, R 2, R 3, R 4, O 3 and O 4,

7.

Halves of cows of the commercial classes U 3, R 2, R 3, R 4, O 2, O 3, O 4, P 2 and P 3, and

8.

Halves of KalWithin of the commercial classes U 2, U 3, R 2, R 3, R 4, O 2, O 3 and O 4.

(2) slaughterhouses and intermediaries have to report the quantities and prices for bulls, oxen, cows and calves which are marketed live.

Slaughterhouses and intermediaries shall have the following categories for marketed meat within the meaning of Regulation (EC) No 700/2007 on the marketing of meat of bovine animals aged up to 12 months, OJ L 327, 30.11.2007, p. No. 1, the quantities and prices to be reported:

1.

Calves (cattle of up to 8 months) and

2.

Young cattle (cattle from more than 8 months to 12 months).

(4) Commercial markets and intermediaries have to report the quantities and prices for the marketed use calves and the setting cattle of the following categories:

1.

Use calves, in each case by sex, race and the following weight classes:

a)

Calves weighing up to 90 kg,

b)

Calves weighing over 90 to 110 kg,

c)

Calves weighing more than 110 kg,

2.

male setting cattle, separated according to the following breeds and the following weight classes:

a)

Fleckvieh,

b)

meat breeds and meat-and-meat cuts,

c)

other,

d)

Adjustable cattle with a weight up to 220 kg (Fresser),

e)

Setting cattle weighing more than 220 kg to 320 kg (sedimenters),

f)

Setting cattle with a weight over 320 kg.

(5) The quantities shall be determined in pieces and in kilograms (total weight, with regard to paragraphs 1 to 5 also with average weight).

(6) In the cases referred to in (1), (2) and (3), slaughterhouses have as prices the purchase prices without VAT (weighted average prices), based on 1 kg, and in all other cases the selling prices, excluding VAT (weighted average prices). Average prices), based on 1 kg.

Reporting requirements for pigs and pigmeat

§ 9. (1) slaughterhouses and intermediaries shall report quantities and prices for the marketed meat of the following categories:

1.

Pig halves of the trade classes S, E, U, R, O, P within the meaning of the regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on trade classes for pig carcases, BGBl. II No 290/2002, as a whole, and separately according to these trade classes.

2.

Halves of breeding sows.

(2) Commercial markets and intermediaries have to report the quantities and prices for the piglets marketed.

(3) The quantities shall be determined in pieces and in kilograms (total weight, with regard to paragraphs 1 to 2 also with average weight).

(4) In the case of paragraph 1, slaughterhouses have as prices the purchase prices without VAT (weighted average prices), in relation to 1 kg, and in all other cases the selling prices are without VAT (weighted average prices), in relation to 1 kg.

Reporting requirements for sheep and sheepmeat

§ 10. (1) slaughterhouses and intermediaries shall report the quantities in pieces and in kilograms (with average weight) and prices for the marketed live lambs and for meat of fattening lambs and alto sheep.

(2) Prices are the purchase prices, excluding VAT (weighted average prices), based on 1 kg.

Reporting requirements for eggs

§ 11. (1) Packers shall have the quantities (in pieces) and the prices of marketed eggs of grade A, sorted by humps, by weight classes XL, L, M and S, separately and separately according to the categories referred to in Article 12 (2) of Regulation (EC) No 557/2007 with detailed rules for the application of Council Regulation (EC) No 1028/2006 laying down marketing standards for eggs, OJ L 327, 30.12.2006, p No. OJ L 132, 24.5.2007, p.5,

Eggs from cages,

2.

Eggs from soil conservation,

3.

Free-range eggs and eggs

4.

Eggs from organic production

(2) Prices are the selling prices from the packing centre (packing set-off prices), without VAT (weighted average prices by weight), based on 100 pieces.

Reporting requirements for poultry and poultrymeat

§ 12. (1) slaughterhouses and cutting plants shall report the quantities in kilograms and prices for the marketed meat of the following categories:

1.

Broiler, fresh, bratready or grilled, each loose and on cup,

2.

Chest of turkeys, fresh, vacuum-packed.

(2) Prices are the selling prices of the free retail business, excluding VAT (weighted average prices), based on 1 kg.

(3) For slaughterhouses, for whole chickens of category A (chickens 65%), slaughterhouses have the selling prices of slaughterhouses, excluding VAT (weighted average prices), based on 1 kg.

Recording requirements

§ 13. The notifiers shall keep the records required for the reports in accordance with § § 8 to 12. The records shall be kept for three years from the end of the calendar year to which they relate, with the care of a regular entrepre. Longer retention periods in accordance with other regulations shall remain unaffected.

§ 14. This Regulation shall enter into force on 1 February 2008.
