61. Customer's announcement concerning the scope of the Convention on the Protection of Children and Cooperation in the Field of International Adoption

According to the statement by the Ministry of Foreign Affairs of the Kingdom of the Netherlands, the following states have their authorities on the Convention on the Protection of Children and Cooperation in the Field of International Adoption (BGBl. III No 145/1999, last proclamation of the BGBl area. (III) No 22/2008) as follows:

Armenia:

Communication of the Republic of Armenia on central and other authorities, as required by the Convention on the Protection of Children and Cooperation in the Field of International Adoption.

According to the Law of the Republic of Armenia on civil status acts, the national authorities are entitled to issue the certificates required by the Convention.

The tasks of the said authorities shall be as follows:

-

acceptance of the state registration of births, deaths, marriages, divorces; fatherhood, adoptions and name changes; furthermore

-

the acceptance of amendments, additions and corrections to the said registrations;

-

the acceptance of the invalidation of such registrations;

-

Re-establishment of lost registrations;

-

Management and safekeeping of civil status lists;

-

Provision of copies of certificates and documents confirming the state registration of civil status acts.

The list 1 of the authorities responsible for the civil status of persons.

The Central Authority for the Republic of Armenia within the meaning of Art. 6 of the Convention is the Ministry of Justice of the Republic of Armenia.

The list 1 the central cantonal authorities referred to in Article 6 (2) and the competent authorities pursuant to Art. 23 of the Convention shall apply.

United States:

According to Art. 13 of the Convention, the Department of State (State Department) has been designated as the central authority for the United States for the purposes of the Convention. The tasks of the Department of State shall include all functions of the central authority within the meaning of the Convention, with the exception of the tasks listed below. In the Department of State, the Office for Children's Affairs in the consular office is the main contact point for matters relating to the Convention.

In order to accept adoption requests in accordance with Art. 14, the Service for Citizenship and Migration (USCIS), part of the Department of Homeland Security (Department of Homeland Security), is the competent authority of the USA.

The case-related tasks referred to in Articles 15 to 21 of the Central Authority pursuant to Article 22 of the Convention are generally carried out by persons accredited, temporarily accredited and authorised in the USA, with the exception of the Assent pursuant to Art. 17 lit. c, that an adoption process may be continued, which must be granted by the Department of State in the cases where the USA is the receiving State.

Pursuant to Articles 13 and 22 (3) of the Convention, the names and addresses of the accredited and authorised organisations may be viewed on the Department of State's website.
