199. Regulation of the Federal Minister for Health, Family and Youth on measures for the control of foot-and-mouth disease (foot-and-mouth disease regulation)

On the basis of § 1 (5) and (6), § 2c, § 23 (2), and § § 31, 31a and 32 of the Animal Health Act (TSG), RGBl. No 177/1909, as last amended by the Federal Law BGBl. I n ° 6/2007 and the Federal Law BGBl. I n ° 36/2008, shall be:

Section 1

General

Scope

§ 1. (1) The provisions of this Regulation shall apply where animals suspected of foot-and-mouth disease (FMD) are suspected or where an outbreak of foot-and-mouth disease is detected.

(2) The measures provided for in this Regulation shall cover animals of susceptible species, including their semen, ova and embryos, and animals of non-susceptible species which may be carriers of the foot-and-mouth disease regiment, and cover animals of susceptible species which may be carriers of the foot-and-mouth disease.

Definitions and abbreviations

§ 2. (1) For the purposes of this Regulation:

1.

official veterinarian: an official veterinarian acting for the competent authority or a veterinarian appointed by the governor of the country in accordance with § 2a TSG;

2.

Official veterinarian according to § 24 LMSVG: a appointed official veterinarian in accordance with § 24 (3) third sentence or a representative of an official veterinarian in accordance with § 24 para. 4 LMSVG;

3.

Authority: unless expressly stated otherwise, the locally competent district administrative authority;

4.

Biosecurity measures: measures to help prevent diseases from being introduced into populations, herds or groups in which they do not yet exist or to restrict redistribution within populations, herds or groups;

5.

Disinfection: disinfection of the disinfection of animal diseases GZ 39.505/6-III/A/4b/96 of the Federal Ministry of Health and Consumer Protection of 3 October 1996 on the means and procedures for the implementation of disinfection in the case of notifiable animal diseases; published. on the homepage of the Federal Ministry of Health, Family and Youth (http://www.bmgfj.gv.at);

Epidemiological study: an investigation into the occurrence and distribution of foot-and-mouth disease within populations of susceptible species, taking particular account of geographical regions and time and risk factors;

7.

Animal disease control expert group: under the regulation of the Federal Minister for Health, Family and Youth on the establishment of an expert group on animal disease control, BGBl. II No 324/2004, the Commission established by the Federal Ministry of Health, Family and Youth;

8.

Fo-value: Fo is the calculated kill effect for bacterial spores; a Fo value of 3.00 means that the coldest point in the product has been sufficiently heated to the same killing effect as at 121 ° C (250 ° F) in three minutes at to achieve instantaneous heating and cooling;

9.

Incubation period: the period between the infection and the occurrence of the first clinical symptoms of foot-and-mouth disease; for the purposes of this Regulation, it shall be 14 days for bovine animals and pigs, for sheep, goats and other animals of susceptible species, in accordance with this Regulation 21 days;

11.

contact holdings: livestock holdings where the official veterinarian has established or, on the basis of confirmed data, has considered that the FMD agent is caused by the movement of persons, animals and products of animal origin, Vehicles or in any other way either from other livestock holdings to a livestock holding pursuant to § 3 (1) or § 7 (1) or from a livestock holding company pursuant to § 3 (1) or section 7 (1) have been introduced into other livestock holdings could be;

Special slaughter: a slaughtering of animals suspected of being a disease or a condition which may pose a risk to human and animal health;

22.

Other facilities: other facilities in which animals of susceptible species are kept temporarily or permanently, but which do not fall under the heading "livestock holding" in accordance with Z 26; belong to this category

a)

Slaughterhouses,

b)

means of transport and

c)

border inspection posts;

23.

Restricted area: the area to be determined by the Governor of the State in the event of outbreaks of foot-and-mouth disease in animals of susceptible species in the wild in accordance with § 12 ("Measures after confirmation of an outbreak of foot-and-mouth disease in animals of susceptible species in the wild");

24.

Restricted zone: the animal population (on domestic animals), the farmhouse, the pasture land, the closed part of the community or the entire community area, which has been locked in accordance with Section 20 or Article 24 of the TSG;

25.

Animals of susceptible species: animals of the suborders of ruminants (Ruminantia), pigs (Suina) and swimming sohler (Tylopoda) of the order Paarhufer (Artiodactyla); for special measures, in particular in the sense of § 9 (" Measures after confirmation of a Foot-and-mouth disease outbreak in animal gardens, zoos, show enclosures, laboratories, insemination facilities, laboratory equipment and facilities for the conservation of rare species "), animals of the orders of rodents (rodentia) or weed animals (proboscidea) can also be used as for foot-and-mouth disease to be considered receptive;

(2) In addition, the definitions of the EC Regulations referred to in paragraph 1 (1) (28) to (31) shall apply to this Regulation, unless otherwise expressly stated.

Section 2

Measures on suspicion of FMD

Measures on suspicion of foot-and-mouth disease in livestock farms

§ 3. (1) Immediately after notification of the suspicion of the disease, the mayor according to § 20 TSG or, where appropriate, the authority pursuant to Section 24 (2) of the TSG has to impose a provisional ban on the affected animal holding company and investigations according to MKS crisis plan to exclude or confirm the suspicion of FMD.

(2) Subsequently, the mayor or, where appropriate, the authority shall have the measures referred to in § 20 TSG for the provisionally locked livestock holding, as well as a sampling by an official veterinarian following the clinical trial. To carry out an investigation of all suspected animals. The samples shall be passed on to the national reference laboratory in a safe way. The results of the investigations referred to in paragraphs 1 and 2 as well as the sample analyses shall be transmitted immediately to the Governor of the State.

(3) In the course of these investigations, the official veterinarian also has the identification of all animals of susceptible species in the livestock holding and the register of stocks in accordance with the Animal Identification and Registration Ordinance 2007), BGBl. II No 166/2007 (TKZVO 2007) or the Cattle Labelling Regulation 1998), BGBl. II No 408/1997 idF BGBl. I No 55/2007 (RKZVO 1998), as well as other records concerning the stock of animals which have to be kept in accordance with veterinary or animal welfare legislation.

(4) All animals kept in livestock farming shall be counted under the supervision of the official veterinarian or another institution of the authority in accordance with Article 21 (4) TSG. For each category of animals of susceptible species, it shall be recorded how many animals have already died and how many animals are suspected of being infected or suspected of being infected. The census is to be updated regularly by the keeper. This information shall be provided by the keeper at the request of the official veterinarian and shall be checked by the veterinarian at any inspection visit.

(5) A list of all stocks of milk, milk products, meat, meat products, animal carcasses, hides and skins, wool, semen, embryos, ova, manure, manure and feedingstuffs shall be from the official veterinarian's inventory of all stocks of milk, milk products, meat, meat products, animal carcasses, hides and skins, To build and store litter.

(6) In so far as this is necessary in the interest of a rapid eradication of the disease, the Authority shall, in accordance with Article 25 of the TSG, order the killing of suspected infected animals of the animal in question to be carried out in the animal welfare state.

(7) On the occasion of the killing of animals, the official veterinarian shall take sufficient samples to carry out the epidemiological studies in accordance with § 14. The required number of samples to be taken in this case is based on the recommendations of the Animal Disease Control Panel and the relevant provisions of the MKS crisis plan.

(8) All of the animals which have been lost and are killed in accordance with paragraph 6, as well as animal products and objects which may be carriers of the foot-and-mouth disease pathogen, shall be immediately subject to official supervision in a safe manner in accordance with the Animal Material Act and the Regulation (EC) 1774/2002 in such a way that the risk of spread of the foot-and-mouth disease virus is excluded.

Extension of measures in the event of FMD suspicion on contact holdings

§ 4. (1) In the light of the epidemiological situation, the Authority shall also extend the measures provided for in paragraph 3 to contact companies, provided that the risk of spread of the disease can be reduced by this means. In the case of contact holdings, the same provisions shall apply as for the livestock holding in which the first suspicion of the disease has occurred.

(2) In the event of a risk of default, the Authority may, taking into account the epidemiological conditions, establish a restricted zone within which all livestock holdings such as contact holdings must be treated. The list of affected livestock holdings in a restricted zone shall be sent to the Governor of the Land.

(3) If and to the extent that the Federal Minister for Health, Family and Youth is responsible for this after hearing the Governor of the State pursuant to Article 31 (2) of the TSG, the Authority shall have the animal welfare-friendly killing of animals of susceptible species within the framework of a preventive To have a tilting program for a lock zone.

(4) On the occasion of the killing of animals of susceptible species, a sufficient quantity of samples for epidemiological studies in accordance with § 14 shall be taken from the official veterinarian. (5) All of the animals which have died and are killed in accordance with paragraph 3, as well as animal products and objects which may be carriers of the foot-and-mouth disease pathogen, shall immediately be subject to official supervision in an epidemic manner in accordance with the Animal Material Act and the Regulation (EC) 1774/2002 in such a way that the risk of spread of the foot-and-mouth disease virus is excluded.

(6) The provisions of § 15 (6) and (7) (biosafety measures, cleaning and disinfection of vehicles and other means of transport) shall also apply to the blocking zone.

Measures on suspicion of foot-and-mouth disease in a slaughterhouse,
a veterinary border inspection post or a means of transport

§ 5. (1) If there is a suspicion of foot-and-mouth disease in a slaughterhouse or in animals of susceptible species in a means of transport, it is appropriate to proceed in accordance with § § 3 and 4.

(2) If there is a suspicion of FMD in a border inspection post, it is necessary to proceed in accordance with Section 11 (4) and (5).

Means of transport loaded with animals of susceptible species shall, in the event of a suspicions, be assigned by the authority to the nearest stable or quarantine station, suitable for this purpose and designated for this purpose by the regional governor.

Removal of measures under foot-and-mouth disease suspicion

§ 6. The measures in accordance with § § 3 to 5 shall be repealed as soon as the suspicion of FMD has been officially ruled out.

Section 3

Measures after confirmation of an FMD outbreak

Measures following confirmation of an FMD outbreak in livestock farms

§ 7. (1) After confirmation of an outbreak of foot-and-mouth disease, the Authority shall take measures in accordance with Section 24 of the TSG and shall order the killing of all animals of susceptible species of the livestock holding in accordance with § 25 of the TSG in accordance with the animal protection requirements.

(2) In addition, the following measures shall be taken by the Authority:

1.

In the case of the killing of animals of susceptible species, a sufficient quantity of samples shall be taken for the epidemiological studies referred to in § 14. The required number of samples to be taken in this case is based on the recommendations of the Animal Disease Control Panel and the relevant provisions of the MKS crisis plan.

2.

Fresh meat, meat preparations, meat preparations, meat products, milk, milk products, hides, semen, ova and embryos, in the period between the suspected introduction of the disease to the holding and its official the presence of existing animals and feedingstuffs, existing litter and manure, as well as existing manure and manure, shall be carried out under official supervision without delay in a health-safe manner in accordance with the Animal Material Act and of Regulation (EC) 1774/2002, in such a way as to ensure that the risk of Spread of the foot-and-mouth disease virus is excluded.

3.

Thereafter, all the premises in which the animals were established or with which they had direct or indirect contact, as well as all such objects, shall be considered, taking account of the environmental compatibility of the substances and methods used. to clean and disinfect.

4.

If there is a reasonable suspicion that residential or office areas of the livestock farm are contaminated with foot-and-mouth disease pathogens, these areas of operation shall also be disinfected by appropriate means.

5.

In addition, deforestation according to disinfection and foot-and-mouth disease plans must be carried out.

6.

The provisions of § 44 shall apply to re-occupancy.

(3) In the event of a risk of default, the Authority may, taking into account the epidemiological conditions, establish a restricted zone within which all livestock holdings such as contact holdings must be treated. The list of affected livestock holdings in a restricted zone shall be sent to the Governor of the Land.

(4) In the light of the epidemiological situation, the Authority shall also extend the measures provided for in paragraphs 1 and 2 of this Article to contact companies, provided that the risk of spread of the disease can be reduced by this means. The extension of the measures to contact companies is to be announced to the Governor of the country prior to their arrangement.

(5) Where the outbreak of foot-and-mouth disease is officially established in a holding, the Authority may, in addition, order the killing and destruction of animals of non-foot-and-mouth animals of susceptible species of the livestock holding, provided that: this is necessary for reasons of disease control.

(6) Paragraph 5, however, does not apply to animals of susceptible species not susceptible to FMD, such as, in particular, solipeds and dogs,

can be separated and disinfected in such a way as to rule out the disappearance of the control of the FMD, and

2.

in the case of equidae, in accordance with the Equidenpass (Commission Decision 93 /623/EEC on the identification document for registered equidae (Equidenpassport), OJ L 327, 30.11.1993, p. 45, as amended by Decision No 2000/68, OJ No L 302, 15.12.1993, p. No. 72), so that their shipment can be controlled.

Measures following confirmation of an FMD outbreak in livestock farms
with several epidemiological production units

§ 8. (1) In the case of livestock holdings with two or more separate production units, the Authority may decide, in exceptional cases and after weighing the risks, for production units not affected by foot-and-mouth disease (Article 7 (1)) (killing of all animals). of susceptible species in accordance with § 25 TSG).

(2) The exception referred to in paragraph 1 shall be granted only if, at the time of the official investigation, the official veterinarian confirms, in accordance with Section 3 (1), that, in order to prevent the transfer of the foot-and-mouth disease agent between the production units referred to in paragraph 1, the official veterinarian has been at least two incubation periods prior to the date on which the foot-and-mouth disease was detected in the livestock holding in question, the following conditions were met:

The structure, including the management and size of the plant, shall allow for a completely separate accommodation and keeping of the individual stocks of animals of susceptible species, including separation of airspace.

2.

The work in the various production units, in particular the supply of the stables and pastures, the feeding and the removal of manure or manure, are carried out completely separately and are carried out by different personnel.

3.

The machinery used in the production units, the working animals of non-FMD-susceptible species, equipment, equipment, instruments and disinfectants are completely separate from each other.

(3) For milk, a derogation from Article 7 (2) (2) (2) may be granted in milk producers, provided that the following requirements are met:

The livestock holding shall comply with the conditions laid down in paragraph 2.

2.

Milking is carried out separately in each production unit.

3.

The milk is stored separately in each production unit.

4.

Depending on the intended use, the milk shall be at least one of the treatments referred to in Appendix 9 ("Treatment of milk and milk products for the effective inactivation of the FMD Erreger") Section A or B.

§ 9. (1) Following the confirmation of an outbreak of foot-and-mouth disease in an animal garden, a zoo, a demonstration enclosure, a laboratory, a facility, a laboratory equipment or a facility for the conservation of rare species, the measures taken by the § 7.

§ 10. In the event of an FMD outbreak in a circus, the measures of § 7 shall apply.

Border inspection posts and means of transport

§ 11. Where an outbreak of foot-and-mouth disease is confirmed in a slaughterhouse, a veterinary border inspection post or a means of transport, the animals of susceptible species present in such facilities or means of transport shall be subject to the order of the Authority immediately to kill.

2. The bodies of the animals referred to in paragraph 1, animal products and objects which may be carriers of the foot-and-mouth disease pathogen, including manure, manure, animal feed and litter, shall be in a safe and health-safe manner, in accordance with the Animal Material Act and the Regulation (EC) 1774/2002 in such a way that the risk of spread of the foot-and-mouth disease virus is excluded.

The facilities, vehicles, transport containers and equipment shall be cleaned and disinfected under the supervision of an official veterinarian and shall be returned to animals at the earliest 24 hours after the completion of the cleaning and disinfection process. Contact is brought.

(4) The following provisions shall apply to outbreaks of foot-and-mouth disease in the official area of a veterinary border inspection post and in the event of a suspitation on foot-and-mouth disease within the limits of the physical inspection of the veterinary authorities:

1.

A suspicion or an outbreak must be reported immediately by the border veterinarian at the head of the office in the Federal Ministry of Health, Family and Youth, the head of the border police, the head of the border police, and the authority. 4.

a resumption of the frontier veterinary treatment shall be permitted at the earliest 24 hours after the completion of the cleaning and disinfection.

(5) If the disease situation requires it, in particular where there is a compelling suspicion of an infection of animals of susceptible species in livestock holdings situated close to the facilities or means of transport referred to in paragraph 1 above, the measures to be applied in accordance with paragraphs 1 to 3 above and in accordance with the disease situation in accordance with § § 3, 7 and 15.

Measures after confirmation of an FMD outbreak
in animals of susceptible species in the wild

§ 12. (1) In the event of foot-and-mouth disease outbreaks in animals of susceptible species in the wild (wild animals), the provincial governor shall immediately establish an FMD restricted area and inform the Federal Minister of Health, Family and Youth of this.

(2) The blocking of this area or areas shall be declared by the Authority (s) and, moreover, shall be notified by an attack on the official panel and on prominent points of the restriction of the restricted area; signs of traffic may be called shall be used, unless they are hidden.

(3) In the event of outbreaks of foot-and-mouth disease in wild animals, the Governor of the State shall arrange for the immediate reporting of all animals of susceptible species found or to be found in the restricted area to the authority and by official veterinarians in accordance with the conditions laid down in this Regulation. § 24 LMSVG are to be investigated. Livestock holdings in the FMD restricted area

§ 13. (1) In the case of detection of foot-and-mouth disease in wild animals, the following measures shall be taken by the Authority as soon as possible in the livestock holdings within the restricted area in accordance with Section 12 (1):

1.

The Authority shall immediately identify all livestock holdings situated in the restricted area and shall carry out in these livestock holdings in accordance with Article 3 (3) and (4), which shall always be kept up to date.

2.

All animals of susceptible species in the livestock farms of the restricted area are either in their usual stables or in another place that allows their isolation from wild animals. Wild animals may not have access to materials which can subsequently come into contact with animals of susceptible species kept in livestock holding.

3.

Shipments of animals of susceptible species from an animal holding operation within the restricted area pursuant to Section 12 (1) shall be prohibited, subject to the provisions of Section 2.

(2) shipments of animals of susceptible species from a livestock holding within the restricted area referred to in Article 12 (1) may be approved by the Authority at the request of the keeper, in accordance with the epidemiological situation, provided that:

1.

the animals of susceptible species come from livestock holdings in which all animals of susceptible species have been clinically examined for foot-and-mouth disease within 24 hours before the movement, and

2.

in the case of the introduction of breeding and farm animals of susceptible species to livestock holdings situated outside the restricted area, animals of susceptible species within the last 10 days prior to the introduction of serological products with negative results on foot-and-mouth disease have been investigated and ensured that:

a)

the animals of susceptible species are accompanied by an official veterinarian certificate, from which the identification of the animals and the conditions of the Z 1 are obtained, and

b)

the animals of susceptible species are transported directly and not together with other animals of susceptible species to the holding of destination; and

c)

the movement is indicated at least four working days before the competent authority responsible for the place of dispatch is brought under the indication of the holding of destination; and

d)

in the case of the introduction of breeding and farm animals of susceptible species, it is ensured that they are subject to official observation at the holding of destination for at least 30 days and, after the expiry of that period, shall be subject to clinical and serological conditions Foot-and-mouth disease

3.

in the case of slaughtered animals of susceptible species, they are only transported to a slaughterhouse within the restricted area or to a slaughterhouse in the country designated by the regional governor.,

(3) The provisions of § 15 (6) and (7) (biosafety measures, cleaning and disinfection of vehicles and other means of transport) shall also apply to the restricted area as well.

(4) All animals of susceptible species of susceptible species in the livestock farms of the restricted area are to be reported to the Authority.

(5) The Governor of the Land has to arrange that all slaughterings of animals of susceptible species within the restricted area are subject to the obligation to investigate in accordance with Section 53 (6) of the LMSVG by an official veterinarian in accordance with § 24 LMSVG. In the course of these investigations, samples for the serological examination should be taken on foot-and-mouth disease and sent to the national reference laboratory.

Epidemiological studies

§ 14. (1) The epidemiological surveys carried out by the official veterinarian are to be continued on an ongoing basis after confirmation of the outbreak of the disease and the results are to be transmitted to the regional governor. The Landeshauptmann has to organize and coordinate the further measures in consultation with the Federal Minister for Health, Family and Youth.

(2) The studies shall be carried out by the official veterinarians using the survey protocols contained in the FMD contingency plan.

(3) The investigative reports shall have all the information concerning the causes of the disease and all the factors leading to the disease, the extent of the infection, the possibilities of dissemination, the possible To include the contagion of other susceptible animals and the movements of animals, persons, vehicles and objects which could be carriers of the foot-and-mouth disease agent.

(4) The investigative reports referred to in paragraph 3 may contain, in personal form, only data relating to persons who could be the supercarrier of the FMD agent and shall be limited to the following types of data:

1.

Name, title, address and telephone number,

2.

Occupation or Activity,

3.

the name and address of the service provider (s),

4.

Date of contact with animals of the stock or their blood or excretions,

5.

Places of residence, travel and contact persons since the presumed start of a possible infection or contamination of the person concerned;

6.

the official identification marks of the motor vehicles used by these persons.

(5) The data referred to in paragraph 4 (1) (1) to (6) may only be processed as far as possible (§ 4 Z 9 of the Data Protection Act 2000-DSG 2000, BGBl. I n ° 165/1999 idF BGBl. I No 13/2005), which is necessary for the control and eradication of foot-and-mouth disease in the public sector. A transmission (§ 4 Z 12 DSG 2000) is permitted only to those recipients for which the control and eradication of foot-and-mouth disease is a legally delegated task.

Protection and surveillance zone

§ 15. (1) The Authority shall establish the following zones immediately after the outbreak of FMD:

1.

a Protection Zone With a minimum distance of 3 km around the infected holding, and

2.

a Surveillance zone with a minimum distance of 10 km around the holding of the disease, including the protection zone; the surveillance zone shall, in this case, be directly connected to the protection zone.

(2) In the definition of the zone referred to in paragraph 1, the following factors shall be taken into account in particular:

1.

the density of animals,

2.

topographical and meteorological conditions,

3.

the movements and trade structures of animals of susceptible species; and

4.

the presence of slaughterhouses.

(3) If the area of the necessary protection or surveillance zone exceeds the borough or national border, the authority in whose area of responsibility is the disease establishment shall have the earliest possible protection from the establishment of the protection and The surveillance zone in its local area of responsibility shall inform the Governor of the State and the other authorities concerned for coordination. In this case, the provincial governor must ensure the necessary coordination of the zone boundaries.

(4) In the event of the crossing of land or federal borders by the area of the necessary protection or surveillance zone, the competent regional governor shall immediately have the Federal Minister for Health, Family and Youth and the To inform the regional authorities of the other federal states, where appropriate, for coordination. (5) The Authority shall carry out investigations on the whereaby

1.

of animals of susceptible species, in the period of 21 years. (7) Vehicles and other means of transport used in the protection or surveillance zone for the transport of animals of susceptible species or objects which may be carriers of foot-and-mouth disease pathogens may be used in the protection or surveillance zone. after having been verifiably cleaned and disinfected and subsequently inspected by the official veterinarian and renewed for the purpose of transport, the slaughterhouses and slaughterhouses and the protection or surveillance zone themselves shall leave the zone. have been released. (8) The Governor of the Land has to arrange that all slaughtering of animals of susceptible species within a protection or surveillance zone shall be subject to the duty of investigation pursuant to Article 53 (6) of the LMSVG by an official veterinarian in accordance with § 24 LMSVG.

Section 4

Measures in the protection zone

Measures applicable to livestock farms in the protection zone

§ 16. The Authority shall immediately identify all livestock holdings with animals of susceptible species in the protection zone.

All livestock holdings referred to in paragraph 1 shall be subject to regular veterinary checks by the official veterinarian. The first inspection shall be carried out within the first seven days after the establishment of the zone. The following points shall in particular be taken into account in these checks:

1.

The veterinary control must be carried out in such a way that existing FMD pathogens are not disseminated in the livestock holdings.

2.

The veterinary control shall, in particular:

a)

the control of the labelling of all animals of susceptible species in the holding of livestock and of the register of stocks in accordance with the TKZVO 2007 or the RKZVO in 1998 and other animal-welfare or animal-welfare provisions leading records of the animal population, and

b)

the control of the measures used to prevent the introduction or spread of the foot-and-mouth disease virus

shall be included.

3.

The veterinary control must also:

a)

a clinical examination, as described in the FMD contingency plan and in Appendix 3 ("Clinical investigation and sampling procedures") Z 1 ("Clinical investigation"), and

b)

the collection of samples of susceptible animals in accordance with Z 2.2 ("Sample studies in livestock holdings") and Z 2.3 ("Sample studies in protection zones") of Appendix 3

.

4.

Veterinary control may also include the taking of samples from animals of susceptible species in accordance with the FMD crisis plan and Annex 3 Z 2.1.1.1 ("Serological Sampling Tests according to the recommendations of the Expert Group on Animal Health Control").

Animals of susceptible species shall not be taken out of their holding and shall be, as far as possible, kept separate by species.

(4) By way of derogation from paragraph 3 and section 17, animals of susceptible species may, under official supervision of the authority and with the agreement of the Federal Minister for Health, Family and Youth, be directly responsible for the special slaughter in one of the same A slaughterhouse situated in the protection zone or, if there is no slaughterhouse in that zone, be transported to a slaughterhouse outside the area designated by the Governor of the State; the carriage may only be carried in one after each carriage shall be carried out under official supervision and disinfected means of transport.

(5) The shipment as referred to in paragraph 4 may be approved by the Authority, provided that:

1.

all animals of susceptible species in the livestock farm have been previously clinically examined by an official veterinarian in accordance with Annex 3 Z 1; and

2.

the official veterinarian confirms, on the basis of the results of this study and the assessment of the epidemiological situation, that there is no reason for any suspicion of disease or contagion among the animals of that holding.

(8) All cases of dead or diseased animals of susceptible species in livestock holdings within the protection zone shall be notified by the persons referred to in § 17 (1) of the TSG. The Authority shall then carry out the necessary investigations into the presence of foot-and-mouth disease.

Other movement prohibitions and restrictions on animals within the protection zone

§ 17. (1) Within the protection zone, the following shall be prohibited:

1.

the movement and transport of animals of susceptible species between livestock holdings;

2.

the holding of animal exhibitions, animal markets, animal shows and other constellations of animals of susceptible species, including collection and distribution;

3.

the outpatient transport of animals of susceptible species;

4.

the artificial insemination or removal of ova and embryos of animals of susceptible species.

(2) Animals of non-susceptible species may only be brought from or to a livestock holding within the protection zone, with the authorisation of the authority.

(3) In the case of equidae, the provisions of Appendix 6 ("Movement Restrictions for Equidae") shall apply.

(4) Circuses which carry animals of susceptible species shall not change their location.

(5) The holding of notions in circuses carrying animals of susceptible species shall be prohibited from the date of the occurrence of the suspected, the confirmation of the disease, or the establishment of a zone within the same.

Movement prohibitions and restrictions on animals
in or through the protection zone from outside the protection zone

§ 18. (1) The movement of animals of susceptible species from livestock holdings outside the protection zone to the protection zone shall be prohibited, subject to the provisions of paragraph 3.

(2) In so far as the disease situation requires it, the Authority may also extend the prohibition of paragraph 1 to the movement of animals of non-susceptible species.

By way of derogation from paragraphs 1 and 2, the Authority may, upon request, approve the following:

1.

The transit of animals of all species through the protection zone, provided that the transport is carried out exclusively through the main transport links;

2.

the movement of animals of susceptible species (or, in the case of the application of paragraph 2, of non-susceptible species) to a slaughterhouse designated by the governor in the protection zone for immediate slaughter, subject to the following conditions and conditions:

a)

the application must be accompanied by a certificate issued by the official veterinarian to the effect that the animals in question come from animals outside the protection zone;

b)

the shipment has to be carried out directly via a route to be approved by the Authority;

c)

the means of transport must be cleaned and disinfected after delivery under official supervision at the slaughterhouse, and

d)

the cleaning and disinfection must be confirmed in writing by the official control body by means of an official certificate (s); this certificate (s) is/are provided by the transport operator (vehicle holder) for the duration of the official protective measures in the vehicle. , and to instruct official control bodies at the request of the Commission;

3.

the movement of animals of susceptible species (or, in the case of the application of paragraph 2, also of non-susceptible species) to a processing plant approved for this purpose in accordance with the Animal Material Act or to any other appropriate place in the protection zone, that they are immediately killed and their bodies destroyed under the supervision of the official veterinarian, or

4.

the movement of animals of susceptible species (or, in the case of the application of paragraph 2, also of non-susceptible) species in exceptional circumstances, that is to say, where special circumstances make this necessary, also to other places previously to be determined by the regional governor, in the Protection zone.

Restrictions on the introduction of fresh meat, carved meat
and meat preparations of animals originating in the protection zone

§ 19. (1) The movement of fresh meat, meat and meat preparations from animals of susceptible species originating in the protection zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition of movement referred to in paragraph 1 shall not apply to fresh meat, meat and meat preparations from animals of susceptible species originating in the protection zone, provided that they are each subject to the conditions set out below in Z 1 or 2; and Meet the following conditions:

1.

a)

shall be identified in accordance with Directive 2002 /99/EC,

b)

then, in sealed containers, are transported to a meat holding designated by the regional governor for this purpose,

c)

is processed there for meat products, and

d)

at least one of the treatments referred to in Appendix 2 ("Treatment of meat for the effective inactivation of the foot-and-mouth disease excier in accordance with Annex III to Directive 2002 /99/EC") , or

2.

they must

a)

have been produced at least 21 days before the estimated time when an infection with the FMD agent may have been carried out in a livestock holding within the protection zone at the earliest;

b)

after the production of meat obtained after that date, have been stored and transported in such a way that contamination with foot-and-mouth disease pathogens can be ruled out; and

c)

can easily be distinguished from meat which is not suitable for dispatch from the protection zone, by means of a labelling prescribed by Community law.

Restrictions on the introduction of fresh meat, carved meat
and meat preparations from meat establishments in the protection zone

§ 20. (1) The movement of fresh meat, carded meat and meat preparations from animals of susceptible species obtained in meat establishments within the protection zone, or , is prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition of movement in accordance with paragraph 1 shall not apply to fresh meat, meat and meat preparations obtained in meat establishments within the protection zone, or , provided that they meet all the conditions and conditions set out below:

1.

The meat establishment is under the control of an official veterinarian according to § 24 LMSVG.

2.

Only fresh meat, meat or meat preparations within the meaning of Article 19 (2) (2) or only fresh meat, meat or meat preparations of animals of susceptible species outside the protection zone shall be treated or processed by the meat industry. , or of animals of susceptible species which have been transported to the protection zone for slaughter in accordance with the procedure laid down in Article 18 (2) (2).

3.

Fresh meat obtained in such a way shall be labelled with a health mark referred to in Chapter III of Annex I to Regulation (EC) No 854/2004 or, in the case of meat preparations, carcases and by-products of slaughtering (other fresh meat, including intestines and blood), with an identity marking in accordance with Section I of Annex II to Regulation (EC) No 853/2004.

4.

All such fresh meat, meat and meat preparations must/must be clearly labelled throughout the production process and of fresh meat, carded meat and meat preparations which are/are subject to the provisions of this Regulation do not qualify for a shipment from the protection zone, be transported and stored separately.

(3) For fresh meat, meat preparations and meat preparations, which is/are intended for intra-Community trade, compliance with the conditions laid down in paragraph 2 shall be confirmed by the competent authority of the meat establishment prior to the shipment from the meat establishment. Restrictions on the movement of the protective zone
prepared meat products

§ 21. (1) The movement of meat products made from meat from animals of susceptible species originating in the protection zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition of movement referred to in paragraph 1 shall not apply to meat products, provided that they fulfil the following conditions:

1.

They were at least one of the treatments referred to in Appendix 2 ("Treatment of meat for the effective inactivation of the foot-and-mouth disease agent in accordance with Annex III of Directive 2002 /99/EC") , or

2.

they were obtained from meat treated in this way or

3.

made of meat within the meaning of section 20 (3).

Restrictions on the introduction of milk from animals of susceptible species held in the protection zone and from milk products derived therefrom

§ 22. (1) The movement of milk obtained from animals of susceptible species originating in the protection zone and of milk products produced from that milk shall be prohibited, subject to the exceptions provided for in paragraphs 3 and 4.

(2) Likewise, the collection of raw milk samples from animals of susceptible species in livestock farms within the protection zone and their transport to a laboratory other than a veterinary diagnostic laboratory approved for the diagnosis of foot-and-mouth disease, as well as the treatment of and processing of the milk in these laboratories.

(3) The prohibition of movement referred to in paragraph 1 shall not apply to milk and milk products, provided that:

1.

their extraction, working or processing has been carried out at least 21 days before the estimated date of earliest infection and their subsequent storage and transport, separately from milk and milk products produced after that date; were carried out in such a way that contamination with foot-and-mouth disease pathogens can be ruled out, or

2.

a treatment according to Appendix 9 ("Treatment of milk and milk products for the effective inactivation of the FMD Erreger") Section A ("drinking milk and drinking milk products") or section B ("milk and milk products not intended for human consumption, and fodder milk and fodder milk products") have been subjected to this procedure.

(4) In the event that the milk and milk products have been treated in accordance with paragraph 3 (2), the following provisions shall also be complied with:

1.

If the treatment was carried out in a milk processing plant in the protection zone,

a)

has to be under strict official supervision of the milk processing plant;

b)

the milk (that is to say, the containers used for their storage or transport) shall be clearly marked throughout the production process and shall be separated from raw milk and raw milk products which are not dispatchable are intended to be transported and stored from the protection zone;

c)

the transport of raw milk from livestock holdings outside the protection zone to milk processing plants in the protection zone shall be carried out exclusively in those vehicles which have been cleaned and disinfected before the time of the journey, and which thereafter have no longer been in contact with livestock farms within the protection zone.

2.

If the treatment was carried out-because no milk-processing plant is located in the protection zone-in a milk-processing plant outside the protection zone, the transport of raw milk from livestock farms to the protection zone must be carried out within the protection zone. Milk processing plants outside the protection zone and in the processing of these raw milk shall comply with the following conditions:

a)

The processing of raw milk originating from animals of susceptible species kept within the protection zone shall be permitted in milk processing plants outside the protection zone only if it is carried out before the milk is removed from the holding has been approved by the competent authority for the holding of the livestock holding, in consultation with the other authorities concerned, at the request of the keeper.

b)

Will the application be referred to as lit. (a), the authorisation shall contain instructions and information on the transport route to the designated milk processing establishment.

c)

Transport shall be carried out exclusively in vehicles which have been cleaned and disinfected prior to transport and which are designed and maintained in such a way as to ensure that no milk is discharged during transport and which are equipped in such a way as to ensure that the transport of the milk is carried out during transport. of the filling or the removal of the milk does not come to any aerosol dispersion.

d)

Before leaving any livestock farm in which milk has been collected from animals of susceptible species, the connecting pipes, tyres, wheel boxes, the lower parts of the vehicle and the places where milk has been discharged must be cleaned and after the last disinfection and before leaving the protection zone, the vehicle must not come into contact with livestock farms within the protection zone in which animals of susceptible species are kept.

e)

The means of transport shall be labelled according to the authority of the authority and shall not continue to be placed under the responsibility of another authority until after cleaning and disinfection.

Restrictions on the introduction of milk and milk products derived from it which have been treated or produced in milk processing plants in the protection zone

§ 23. (1) The movement of milk obtained from animals of susceptible species and from the milk products produced therefrom shall be prohibited, subject to the exceptions provided for in paragraph 2, provided that such milk and the products produced therefrom are in: Processed or processed processing plants located in the protection zone.

Milk and milk products from milk-processing plants in the protection zone shall be excluded from the prohibition of movement in accordance with paragraph 1, provided that:

1.

Restrictions on the removal and transfer of semen, ova and embryos of animals of susceptible species in the protection zone

§ 24. (1) The artificial insemination of animals of susceptible species and the removal and transfer of ova and embryos of animals of susceptible species originating in the protection zone shall be prohibited, subject to the exceptions provided for in paragraphs 2 and 3.

(2) The prohibition referred to in paragraph 1 shall not apply to the movement of frozen semen, frozen ova and frozen embryos at least 21 days before the estimated date of earliest infection with the MKS pathogen in a livestock farm have been obtained and stored within the protection zone.

(3) Frozen semen obtained in accordance with the provisions of Community law after the date referred to in paragraph 2 shall be stored separately and may, on request, be carried out by the competent authority of the insemination station. shall be released if:

a)

all measures taken in connection with the FMD outbreak have been repealed in accordance with Section 30;

b)

all animals housed in the insemination station shall be examined clinically and samples taken in accordance with Appendix 3 ("Clinical investigations and sampling procedures") Z 2.2 for the detection of the freedom of infection of the relevant insemination station shall be serological have been investigated and

c)

the donor animal has been subjected to a serological examination on foot-and-mouth disease antibody with negative result, the sample used for this purpose being drawn not earlier than 28 days after the removal of sperm; and

d)

the agreement of the Federal Minister for Health, Youth and the Family to be present.

Transport and discharge of manure and manure of animals of susceptible species in the protection zone

§ 25. (1) The transport and discharge of manure or manure from livestock farms situated within the protection zone and slaughterhouses situated within the protection zone, veterinary border inspection posts or means of transport in accordance with § 11, in which: Animals of susceptible species shall be prohibited within the protection zone, subject to the exceptions provided for in paragraph 2.

By way of derogation from the prohibition referred to in paragraph 1, the discharge of manure and manure of animals of susceptible species may be authorised by the authority of a livestock holding within the protection zone, provided that the transport is carried out.

1.

Section II ("Processed Manure and Processed Manure") Section II ("Processed Manure and Processed Manure") for the treatment referred to in Annex VIII, Chapter III ("Regulations on manure, processed manure and processed manure products"), approved in accordance with the Animal Processed Manure Products ") Part A (" Marketing ") Point 5 of Regulation (EC) No 1774/2002;

2.

of livestock holdings within the protection zone to which the measures are not applied in accordance with § § 3 or 7 of this Regulation, shall be carried out for the purpose of applying for this purpose designated fields; and

a)

the whole quantity of manure and gland has been produced at least 21 days before the estimated date of earliest infection in a livestock holding within the protection zone and the manure or manure near the ground and at a sufficient distance from the ground from livestock farms where animals of susceptible species are kept, and are immediately incorporated into the soil, or

b)

in the case of bovine or pig casing:

aa)

an official veterinarian has examined all the animals in livestock holding and has ruled out the presence of animals suspected of foot-and-mouth disease,

bb)

the total amount of quality shall be at least four days prior to the examination referred to in lit. (aa) has been produced; and

cc)

the manure is incorporated into the soil in certain areas close to the holding of origin and at a sufficient distance from other livestock holdings where animals of susceptible species are kept within the protection zone.

Restrictions on the movement of hides and skins of animals of susceptible species in the protection zone

§ 26. (1) The movement of hides and skins of animals of susceptible species originating in the protection zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition laid down in paragraph 1 shall not apply to hides and skins, which either:

1.

have been obtained at least 21 days before the estimated date of earliest infection with the foot-and-mouth disease virus in a livestock holding within the meaning of Article 7 (1), and which have been stored separately from hides and skins obtained after that date; or The

2.

have been salted for seven days with salt added to 2% sodium carbonate, or the

3.

have been dried for 42 days at a temperature of at least 20 ° C.

Restrictions on the introduction of sheep wool, ruminant hairs
and pork bust from the protection zone

§ 27. (1) The movement of sheep wool, ruminant hairs and pig carts obtained in the protection zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) exempted from the prohibition laid down in paragraph 1 shall be unprocessed wool, hair and bristles, which shall:

1.

have been obtained at least 21 days before the estimated date of earliest infection with the foot-and-mouth disease virus in a livestock holding within the meaning of Article 7 (1), and the wool, hair and bristles obtained after that date have been stored separately , or

2.

comply with the requirements laid down in Chapter VIII of Annex VIII ('Regulations on wool, hair, pig bristles, feathers and feathers '), Part A, No 1, of Regulation (EC) No 1774/2002.

Restrictions on the introduction of other animal products
from the protection zone

§ 28. (1) The movement of other animal products of animals of susceptible species not mentioned in § § 19 to 27 shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition referred to in paragraph 1 shall not apply to products within the meaning of paragraph 1, which shall:

1.

At least 21 days before the estimated date of the earliest infection with the FMD pathogen in a livestock holding within the meaning of Article 7 (1) and which have been stored and transported separately from the products obtained after that date or

2.

a heat treatment in a hermetically sealed container with a Fo value of at least 3,00, or

3.

a heat treatment at which the core temperature is maintained at least 70 ° C for at least 60 minutes, or

4.

in the case of blood and blood products, the requirements laid down in Appendix 7 ("Treatment of products of animal and non-animal origin for the effective inactivation of the FMD Erreger") Section A ("Products of animal origin") Z 5 ("Blood and blood products of animals of susceptible species") shall be complied with, or

5.

in the case of lard and rendered animal fats, which meet the requirements laid down in Annex 7, Section A, Z 6 ("Snarz and rendered animal fats"), or

6.

in the case of petfood and chewing toys, meet the requirements laid down in Annex 7, Section A, Z 7 ('pet food and chewing toys '), or

7.

in the case of hunting trophies of ungulates, which meet the requirements laid down in Annex 7 (A) (8) ('Hufting hunting trophies '), or

8.

in the case of animal casings, the requirements laid down in Annex 7 (A) (9) ('Animal casuals ') , or

9.

Compound products which do not have to be further treated and contain products of animal origin which are either subjected to an MKSV-inactivating treatment in accordance with Annex 7, Section A, or obtained from animals which do not are covered by the blocking measures of this Regulation; or

10.

are intended for use as packaged products for use as in vitro diagnostic agents or as laboratory reagents.

§ 29. (1) The placing of feedingstuffs, dried fodder, hay and straw from the protection zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition referred to in paragraph 1 shall not apply to products within the meaning of paragraph 1, which shall:

1.

either at least 21 days before the estimated date of the earliest infection with the FMD pathogen in livestock holdings within the meaning of Article 7 (1), and the feedingstuffs, dried fodder, hay and straw produced after that date have been stored and transported separately, or

2.

shall be designated for use within the protection zone, subject to approval by the competent authority, or

3.

have been produced in establishments where animals of susceptible species are not kept, or

4.

have been produced in establishments where animals of susceptible species are not kept and which refer to the raw material from the holdings within the meaning of Z 3 or from holdings outside the protection zone; or

5.

in the case of dried fodder and straw, produced in livestock farms in which animals of susceptible species are kept, provided that such products meet the requirements of Appendix 7 (" Treatment of products of animal and non-animal origin Origin for the effective inactivation of the FMD Erreger ") Section B ("Products of non-animal origin") Z 1.

Repeal of the measures in the protection zone

§ 30. (1) The measures in the protection zone shall be maintained until such time as:

1.

all measures for the purification and final disinfection of the disease holdings have been carried out and have since passed at least 15 days; and

2.

the animals of susceptible species have been subjected to clinical studies in accordance with the FMD contingency plan and Appendix 3 ("Clinical investigations and sampling procedures") in all livestock holdings, with negative results.

(2) After the removal of the protection zone, this area shall be the surveillance zone.

Section 5

Measures in the surveillance zone

Measures applicable to livestock farms in the surveillance zone

§ 31. (1) The Authority shall immediately identify all livestock holdings situated in the surveillance zone.

(2) All livestock holdings shall be subject to regular veterinary checks by the official veterinarian. The first inspection shall be carried out as soon as possible after the zone has been established. The following points shall in particular be taken into account in these checks:

1.

The veterinary inspection must be carried out in such a way that existing FMD pathogens are not disseminated in the livestock holdings;

2.

The veterinary control shall, in particular:

a)

the control of the labelling of all animals of susceptible species in the holding of livestock and of the register of stocks in accordance with the TKZVO 2007 or the RKZVO in 1998 and other animal-welfare or animal-welfare provisions leading records of the animal population, and

b)

the control of the measures used to prevent the introduction or spread of foot-and-mouth disease pathogens

shall be included.

3.

The veterinary control shall also:

a)

the clinical examination, as in the FMD crisis plan or in Appendix 3 ("Clinical investigation and sampling procedures") Z 1, and

b)

in particular in sheep and goats, the collection of samples of animals of susceptible species in accordance with foot-and-mouth disease contingency plan or foot-and-mouth disease plan shall be carried Appendix 3 Z 2.4, Z 2.4.1, Z 2.4.2 and Z 2.4.3

(3) Animals of susceptible species may not be taken from their holding establishments and, where possible, shall be kept separate by species.

Where there is no or only insufficient slaughter capacity within the surveillance zone, the competent authority may, by way of derogation from the prohibition laid down in paragraph 4, authorise the use of animals of susceptible species from livestock farms within the framework of the the surveillance zone shall be moved to a slaughterhouse outside the surveillance zone under official supervision and directly for slaughter, provided that the following conditions are met:

1.

The documents referred to in paragraph 2 (2) have been subject to official controls and, in accordance with the epidemiological situation of the holding, there is no suspicion of infection or contamination with foot-and-mouth disease pathogens, and

2.

the official veterinarian has clinically examined all animals of susceptible species in the holding with negative results; and

3.

the slaughterhouse has been designated by the competent provincial governor and must be as close as possible to the surveillance zone; and

4.

the meat obtained from the animals concerned shall be subjected to the treatment in accordance with section 33.

(5) All cases of dead or diseased animals of susceptible species in livestock holdings within the surveillance zone shall be notified by the persons referred to in section 17 (1) of the TSG. The Authority shall then carry out the necessary investigations into the presence of foot-and-mouth disease.

Movements of animals of susceptible species within the surveillance zone

§ 32. (1) Within the surveillance zone, the transport and movement of animals of susceptible species shall be prohibited, subject to the provisions of paragraph 2.

(2) The prohibition of paragraph 1 shall not apply to:

1.

Movements of animals of susceptible species to a pasture within the surveillance zone at the earliest 15 days after the last registered foot-and-mouth disease outbreak in the protection zone, without contact with animals of susceptible species of other livestock holdings;

2.

Transport operations under official supervision and directly to slaughter at a slaughterhouse within the same zone;

3.

Promotions pursuant to § 31 (4);

4.

the transit of animals of all species through the surveillance zone, provided that the transport is carried out exclusively through the major transport axes or on the main rail routes;

5.

the transport of animals of susceptible species, provided that a certificate from an official veterinarian is carried out, that the animal comes from non-surveillance zones and that it is directly accessible via a fixed route for immediate slaughter to a slaughterhouse designated by the competent provincial governor, and it is ensured that the means of transport are cleaned and disinfected after delivery under official supervision at the slaughterhouse and this decontamination is noted in the control book of the means of transport.

(3) Animal movements as referred to in paragraph 2 (1) may be authorised by the competent authority when an official veterinarian is responsible for all animals of susceptible species in the holding, including the carrying out of Annex 3 Z 2.2 Sampling tests have been carried out and the presence of suspected infected animals has been excluded.

(4) Animal movements within the meaning of Section 2 (2) (2) may be authorised by the competent authorities if the measures pursuant to § 31 (4) (1) and (2) have been carried out with satisfactory results and no indication of the existence of the MKS pathogen and the presence of suspected infected animals.

Restrictions on the introduction of fresh meat, carniated meat,
Meat preparations and meat products from the surveillance zone
originating animals of susceptible species

§ 33. (1) The movement of fresh meat, meat and meat preparations from animals of susceptible species originating in the surveillance zone and of meat products produced therefrom shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition of movement referred to in paragraph 1 shall not apply to fresh meat, meat preparations, meat preparations and meat products from animals of susceptible species originating in the surveillance zone, provided that they are each listed below in Z. 1 or 2 meet conditions and conditions:

1.

a)

have been produced at least 21 days before the estimated time when an infection with the FMD agent may have been carried out at the earliest in an animal holding operation of the appropriate protection zone; and

b)

after the production of meat obtained after that date, have been stored and transported in such a way that contamination with foot-and-mouth disease pathogens can be ruled out; and

c)

can be easily distinguished from fresh meat, meat, meat preparations and meat products which are not suitable for dispatch from the surveillance zone, by means of a Community-regulated marking; or

2.

they must have been obtained from animals which have been transported to the slaughterhouse under at least the same strict conditions and conditions as provided for in Article 31 (4) (1) to (4), provided that the fresh meat, the meat which has been washed, is Meat preparations and meat products shall be applied in accordance with Article 34 (2) (1) to (4).

Restrictions on the introduction of fresh meat, carded meat, meat preparations
and meat products from meat establishments in the surveillance zone

§ 34. (1) The movement of fresh meat, carded meat, meat preparations and meat products from animals of susceptible species which are obtained in meat establishments within the surveillance zone, or , shall be prohibited, subject to the exceptions provided for in paragraphs 2 and 3.

(2) The prohibition of movement in accordance with paragraph 1 shall not apply to fresh meat, meat and meat preparations obtained in meat establishments within the surveillance zone, or , provided that the following conditions and conditions are met:

1.

The meat establishment is under the control of an official veterinarian according to § 24 LMSVG.

2.

Only fresh meat, meat or meat preparations within the meaning of Article 33 (2) (2) (2) shall, subject to the additional requirements laid down in Appendix 8 ("Treatment of fresh meat and additional measures"), section B, or only fresh meat, meat or meat preparations obtained from animals reared and slaughtered outside the surveillance zone, or from animals transported to the meat establishment/slaughterhouse in accordance with Article 32 (2) (2) of the Z 5.

3.

Fresh meat obtained in such a way, is marked with a health mark in accordance with Annex I ("fresh meat") Section I ("Tasks of the official veterinarian") Chapter III ("Health labeling") of Regulation (EC) No 854/2004, or, in the case of meat preparations, carcases and by-products of slaughter, with an identity marking in accordance with Annex II ('Regulations for several products of animal origin ') Section I ("Identity marking") Regulation (EC) No 853/2004;

4.

Throughout the production process, all such fresh meat, meat or all such meat preparations must be clearly labelled and of fresh meat, carded meat or meat preparations which, in accordance with this procedure, must be prepared in accordance with the Regulation of the shipment from the surveillance zone is not eligible, separately transported and stored.

(3) The prohibition of movement in accordance with paragraph 1 shall also be exempted from meat products manufactured in meat establishments in the surveillance zone, provided that they are either:

have been produced from fresh meat from animals of susceptible species originating in the surveillance zone, accompanied by the health mark provided for in Directive 2002/99/EC, and under official supervision of a designated holding for the treatment referred to in Appendix 2 ("Treatment of meat for the effective inactivation of the foot-and-mouth disease regiment referred to in Annex III to Directive 2002 /99/EC") has been promoted, or

2.

produced from meat satisfying the requirements of paragraph 2 (1) (1) to (4).

(4) In the case of fresh meat, meat and meat preparations intended for intra-Community trade, compliance with the conditions laid down in paragraph 2 shall be carried out by the competent authority of the meat establishment prior to the shipment of the meat from the Meat establishment must be confirmed. 1.

If the treatment was carried out in a milk processing plant in the surveillance zone,

a)

has to be under strict official supervision of the milk processing plant;

b)

the milk (i.e. the containers used for their storage or transport) shall be clearly marked throughout the production process and shall be separated from raw milk and raw milk products which are not intended for dispatch from the the surveillance zone shall be designated, transported and stored;

c)

the transport of raw milk from livestock holdings outside the surveillance zone to milk processing establishments in the surveillance zone shall be carried out exclusively in those vehicles which have been cleaned and disinfected prior to the journey, and which subsequently no longer in contact with livestock farms within the surveillance zone.

2.

If the treatment was carried out-because no milk-processing plant is located in the surveillance zone-in a milk-processing plant outside the surveillance zone, the transport of raw milk from livestock holdings shall be carried out within the framework of the Surveillance zone for milk processing plants outside the surveillance zone and in the processing of these raw milk shall comply with the following conditions:

a)

The processing of raw milk originating from animals of susceptible species kept within the surveillance zone, in processing operations outside the protection and surveillance zone, shall be carried out in advance by the competent authority for the holding of the livestock sector in an agreement with the other local authorities, if any, has been approved;

c)

d)

before leaving any livestock farm in which milk has been collected from animals of susceptible species, the connecting pipes, tyres, wheel boxes, the lower parts of the vehicle and the places where milk has been discharged must be cleaned and in addition, after the last disinfection and prior to leaving the surveillance zone, the vehicle must not have been in contact with livestock holdings within the surveillance zone;

e)

the means of transport shall be labelled according to the authority of the authority and shall not continue until after cleaning and disinfection, under the supervision of an official veterinarian, within the area of responsibility of another authority.

§ 36. (1) The movement of milk obtained from animals of susceptible species and from the milk products produced therefrom shall be prohibited, subject to the exceptions provided for in paragraphs 3 and 4, provided that such milk and the products produced therefrom are: have been treated or produced in milk processing plants located in the surveillance zone.

Milk and milk products from milk-processing plants in the surveillance zone shall be excluded from the prohibition of movement in accordance with paragraph 1, provided that:

1.

c)

has previously been approved by the Authority.

Restrictions on the removal and introduction of sperm,

2.

have been salted for seven days with salt added to the 2% sodium carbonate, or

3.

have been dried for 42 days at a temperature of at least 20 ° C.

§ 41. (1) The placing of animals of susceptible species other than those referred to in § § 33 to 40 of animals of susceptible species from the surveillance zone shall be prohibited, subject to the exceptions provided for in paragraph 2.

(2) The prohibition referred to in paragraph 1 shall not apply to products within the meaning of paragraph 1, which shall:

1.

At least 21 days before the estimated date of the earliest infection with the FMD pathogen in a livestock holding within the meaning of Article 7 (1) and which have been stored and transported separately from the products obtained after that date or

2.

a heat treatment in a hermetically sealed container with a Fo value of at least 3,00, or

3.

a heat treatment at which the core temperature has been maintained at least 70 ° for at least 60 minutes, or

4.

in the case of blood and blood products, the requirements laid down in Appendix 7 ("Treatment of products of animal and non-animal origin for the effective inactivation of the FMD Erreger") Section A ("Products of animal origin") Z 5 ("Blood and blood products of animals of susceptible species") shall be complied with, or

5.

in the case of lard and rendered animal fats, which meet the requirements laid down in Annex 7, Section A, Z 6 ("Snarz and rendered animal fats"), or

6.

in the case of petfood and chewing toys, meet the requirements laid down in Annex 7, Section A, Z 7 ('pet food and chewing toys '), or

7.

in the case of hunting trophies of ungulates, which meet the requirements laid down in Annex 7 (A) (8) ('Hufting hunting trophies '), or

8.

in the case of animal casings, the requirements laid down in Annex 7 (A) (9) ('Animal casuals ') , or

9.

Compound products which do not have to be further treated and contain products of animal origin which are either subjected to an MKSV-inactivating treatment in accordance with Annex 7, Section A, or obtained from animals which do not are covered by the blocking measures of this Regulation; or

10.

are intended for use as packaged products for use as in vitro diagnostic or laboratory reagents.

Repeal of the measures in the surveillance zone

§ 42. (1) The measures in the surveillance zone shall be maintained until the following conditions are met:

a)

At least 30 days since the killing and destruction of all animals of susceptible species in livestock holdings or other establishments with a confirmed outbreak of foot-and-mouth disease and completion of the coarse cleaning and final disinfection. passed;

b)

After the measures adopted for the protection zone have been lifted, the measures for the surveillance zone shall remain in force in accordance with Articles 31 to 41, and

c)

all animals of susceptible species in all livestock holdings or other facilities of the surveillance zone in which animals of susceptible species are kept, have been subject to clinical investigations in accordance with the FMD crisis plan and in accordance with paragraph 2 with negative Result.

(2) The investigation according to paragraph 1 lit. (c) for the detection of the freedom of infection in the surveillance zone, it shall be carried out in accordance with the procedures laid down in Appendix 3 ("Clinical investigations and sampling procedures") Z 1. It includes the measures set out in Appendix 3 Z 2.4 on the basis of the criteria laid down in Annex 3 Z 2.1.

Notimpfungen and therapy trials

§ 43. (1) vaccinations against foot-and-mouth disease are prohibited, unless they have been ordered by the Federal Minister for Health, Family and Youth (emergency vaccination). In this case, the implementation of these vaccinations shall be carried out in accordance with the FMD crisis plan.

(2) Treatment tests in case of concrete suspicion or confirmed cases of FMD are prohibited.

Reusage

§ 44. (1) establishments in which the FMD has been officially confirmed may, under the supervision of an official veterinarian, and in compliance with the principles set out in Appendix 5 ("Reoccupancy of infected holdings"), must not be less than 21 days after the conclusion of the Cleaning and disinfection of holdings are again demonstrated with animals of susceptible species.

(2) In the case of holdings which are difficult to clean and disinfect (in particular open-air establishments), the Authority shall prescribe that:

a)

only Sentineltiere may be used for re-use, and

b)

additional security measures and checks shall be carried out during the re-occupation.

Regaining the status of the disease

§ 45. (1) After an outbreak of foot-and-mouth disease, the status of foot-and-mouth disease shall be deemed to be restored if:

1.

all measures in the protection and surveillance zones have been completed and

2.

at least three months have passed since the last registered foot-and-mouth disease outbreak, and

3.

No further case of foot-and-mouth disease has been confirmed within the prescribed final clinical and serological tests.

(2) After emergency vaccination, the status of FMD shall be deemed to be restored if:

1.

at least three months have elapsed since the killing of the last vaccinated animal, and serological tests have been carried out in accordance with the guidelines in accordance with the FMD crisis plan, or

2.

since the last outbreak of foot-and-mouth disease, At least six months have elapsed since the last emergency vaccination, whichever was the last, and on the basis of a serological test for the detection of antibodies to non-structural proteins of the FMD pathogen, which are based on the following: the guidelines have been implemented in accordance with the FMD crisis plan, and it has been demonstrated that the vaccinated animals are free of infection.

Compensation and penal provisions

§ 46. (1) The provisions of Sections VI and VII of the TSG shall apply to compensation.

(2) The provisions of the VIII shall apply to infringements of the provisions of this Regulation. Section of the TSG.

Referrals and personal names

§ 47. (1) Where reference is made in this Regulation to other regulations of the Federal Minister for Health, Family and Youth, these are to be applied in their respectively applicable version.

(2) In the case of all personal names used in this Regulation, the chosen form shall apply to both sexes.

Implementation of EU provisions

§ 48. This Regulation transposes Directive 2003 /85/EC on Community measures for the control of foot-and-mouth disease in Austrian law.

entry into force

§ 49. This Regulation shall enter into force with 1 June 2008, but not before the end of the day of its presentation in the Federal Law Gazans.
