246. Regulation of the Federal Minister for Health, Family and Youth, which prohibits the placing on the market of genetically modified rapeseed from the oil rapslines Ms8, Rf3 and Ms8xRf3 in Austria and the regulation concerning the prohibition of the use of genetically modified oilseed rape The placing on the market of genetically modified maize BT 176 will be repealed

Due to § 60 of the Gentechnikgesetz-GTG, BGBl. N ° 510/1994, as last amended by the Federal Law BGBl. I n ° 127/2005 and the Federal Law BGBl. I n ° 6/2007, shall be arranged:

§ 1. (1) The placing on the market in Austria of products consisting of or containing GMOs described in the following shall be prohibited:

1.

Oilrap grains from the respectively male and female lines of the Brassica napus L. variety, which are the events Ms8 and/or Rf3, as well as grains of conventional cross-sections (Ms8xRf3-Hybrid) between these female and male parentalline lines, into which the following DNA was introduced:

a)

into the weibline line (Ms8):

aa)

PTA29-barnase-3 'nos:

-

the promoter PTA29 from Nicotiana tabacum, which is specific to the tapia cells,

-

the Barnase gene from Bacillus amyloliquefaciens for the production of male sterility,

-

Part of the non-coding region 3 'nos of the nopaline synthase gene of Agrobacterium tumefaciens;

bb)

pSSUAra-bar-3'g7:

-

the pSSUAra-promoter from Arabidopsis thaliana,

-

the bar gene isolated from Streptomyces hygroscopicus, which lends tolerance to the herbicide glufosinate ammonium,

-

the non-coding sequence 3 ' of the gene 7 of the DNA-TL of the Agrobacterium tumefaciens.

b)

to the male line (Rf3):

aa)

PTA29-barstar-3 'nos:

-

the promoter PTA29 from Nicotiana tabacum, which is specific to the tapia cells,

-

the Barstar gene from Bacillus amyloliquefaciens for the restoration of male fertility,

-

Part of the non-coding region 3 'nos of the nopaline synthase gene of Agrobacterium tumefaciens;

bb)

pSSUAra-bar-3'g7:

-

the pSSUAra-promoter from Arabidopsis thaliana,

-

the bar gene isolated from Streptomyces hygroscopicus, which lends tolerance to the herbicide glufosinate ammonium,

-

the non-coding sequence 3 ' of the gene 7 of the DNA-TL of the Agrobacterium tumefaciens.

The specific identification markers of the products shall be:

-

ACS-BN005-8 for lines that have only the Ms8 event,

-

ACS-N003-6 for lines that have only the Rf3 event,

-

ACS-BN005-8 x ACS-BN003-6 for hybrid lines that have both the Ms8 and the Rf3 events.

These products have been notified by Bayer BioScience under Directive 2001 /18/EC and by the Belgian competent authority on 25 May 2007 pursuant to the Decision of the European Commission 2007 /232/EC of 26 March 2007 on the Marketing authorisation

(2) The ban also includes grains that have emerged from intersections of the oil rapeseed Ms8, Rf3 and Ms8xRf3 with other oil rapslines.

§ 2. (1) With the entry into force of this Regulation, the Regulation prohibiting the placing on the market of genetically modified maize with the combined alteration of the insecticide effect of the BT endotoxin gene and increased tolerance to the Herbicide Glufosinatammonium, BGBl. II No 45/1997.

(2) This Regulation shall enter into force with the exception of paragraph 1 of this Regulation. October 2010.
