377. Regulation of the Federal Chancellor on the establishment of an Advisory Council on Building Culture in the Federal Chancellery

On the basis of § 8 of the Federal Ministries Act 1986-BMG, BGBl. N ° 76, as last amended by the Federal Law BGBl. I n ° 4/2008, will be in agreement with the Federal Minister for Women, Media and Regional Policy, the Federal Minister for European and International Affairs, the Federal Minister of Finance, the Federal Minister for Health, Family and Health, and Youth, the Federal Minister of the Interior, the Federal Minister for Justice, the Federal Minister for Agriculture, Forestry, the Environment and Water Management, the Federal Minister for National Defence, the Federal Minister for Social Affairs and Consumer Protection, the Federal Minister for the Protection of the Environment, the Federal Minister for the Protection of the Environment, the Federal Minister for Federal Minister for Education, the Arts and Culture, the Federal Minister for Transport, Innovation and Technology, the Federal Minister for Economic Affairs and Labour, and the Federal Minister for Science and Research, said:

Establishment of the Advisory Council on Building Culture

§ 1. In the Federal Chancellery, an Advisory Board for Building Culture (Advisory Board) is set up.

Tasks

§ 2. (1) The Advisory Board shall be responsible for advising the departments represented on the Advisory Board at the federal level in the performance of their respective responsibilities, in particular with regard to the following questions:

1.

Improvement of legal and fiscal frameworks;

2.

Anchoring the "building culture" principle at all political levels;

3.

Measures to strengthen environmental, economic and social sustainability;

4.

Measures for barrier-free planning and construction;

5.

measures to promote the compatibility of the building's cultural heritage with contemporary architecture and building culture;

6.

Measures to strengthen public awareness of the importance of contemporary architecture and building culture;

7.

Measures to promote competition culture by the Federal Government, other contracting authorities and private providers of publicly used buildings;

8.

Further development of the building culture report.

(2) The Advisory Board shall submit an annual activity report which shall be brought to the attention of the Federal Chancellor of the Federal Government.

(3) In view of the responsibilities in this area, the countries and municipalities will also be involved in the discussions.

Composition of the Advisory Board

§ 3. The Advisory Board shall include the following members and replacement members:

1.

One member and one alternate member representing the following federal services:

a)

Federal Chancellery;

b)

Federal Chancellery as the federal ministry responsible for coordination in matters of regional policy;

c)

Federal Ministry of Finance;

d)

Federal Ministry of European and International Affairs;

e)

Federal Ministry of Health, Family and Youth;

f)

Federal Ministry of the Interior;

g)

Federal Ministry of Justice;

h)

Federal Ministry of Agriculture, Forestry, Environment and Water Management;

i)

Federal Ministry of Defense;

j)

Federal Ministry of Social Affairs and Consumer Protection;

k)

Federal Ministry of Education, Arts and Culture;

l)

Federal Ministry of Transport, Innovation and Technology;

m)

Federal Ministry of Economics and Labour;

n)

Federal Ministry of Science and Research;

o)

Bundesimmobiliengesellschaft (BIG);

p)

Federal Monuments Office.

2.

Four members and alternate members representing the countries, nominated by the regional conference in the fields of housing, regional planning, construction law as well as a further department relevant to the building culture.

3.

Two members and alternate members representing the municipalities, each nominated by a member and a substitute member by

a)

Austrian town association;

b)

Austrian community debits.

4.

Ten external experts and substitute members from the field of building culture, of which

a)

One person each from the departments of Architecture, Spatial Planning and Civil Engineering, nominated by the Federal Chamber of Architects and Engineering Consultants;

b)

one person nominated by the Architekturstiftung Österreich;

c)

one person nominated by the Architekturzentrum Wien;

d)

one person nominated by the Platform for Architecture Policy and Building Culture;

e)

two persons from other departments relevant to the building culture, nominated by the Platform for Architecture Policy and Building Culture;

f)

a person from the Department of Construction Industry, nominated by the Austrian Chamber of Commerce;

g)

A person from the Faculty of Barrier-free Planning and Construction, nominated by the Austrian Working Group for Rehabilitation.

Members of the Advisory Forum

§ 4. (1) The function period of the members of the Advisory Board shall be five years. A one-time reorder is allowed.

(2) The question of a gender balance should be given special consideration when ordering members.

(3) From the circle of the members, the Federal Chancellor shall appoint a chairperson or a chairperson of the Advisory Board and two alternates or vice-chairpersons of the Chairperson for five years. A one-time reorder is allowed.

Convening of sittings

§ 5. (1) The Chairperson shall convene the Advisory Board at meetings. The convening shall be made as required, with the Advisory Council meeting at least half a year.

(2) Meetings of the Advisory Forum shall not be public.

(3) The invitation to the meeting is to be sent to the Members at the latest three weeks before the date of the meeting and shall contain the provisional agenda.

(4) The Advisory Council may, in so far as it is necessary, further experts or experts who are not regular members of the Advisory Board, for the technical discussion of a agenda item or Other persons providing information.

Management and conduct of meetings

§ 6. (1) The Chairman or Chairperson shall open and direct the meeting. The final agenda shall be established at the beginning of the sitting.

2. The Advisory Council may decide that its deliberations and the documents on which it is based, as well as the parts thereof, should be kept confidential.

(3) A protocol shall be drawn up on the outcome of the deliberations of the Advisory Forum. It should be noted that there are any divergent views that differ from the prevailing opinion.

(4) The Advisory Council shall meet in plenary. The Advisory Forum may be used for the preliminary consultation of objects.

(5) In so far as it does not require the performance of the tasks of the Advisory Board, the Advisory Board shall meet at the Federal Chancellery.

(6) The presence of at least half of the members shall be required for the quorum of the Advisory Board. The Advisory Council shall endeavour to reach the greatest possible consensus in the decision-making process. It shall take its decisions with the majority of the members present, and a abstention is inadmissible.

(7) In the event of a tie, the vote shall be taken by the Chairman or Chairperson.

Rules of

§ 7. Detailed rules governing the conduct of business shall be in accordance with the Rules of Procedure. They must be approved by the Federal Chancellor.

Office

§ 8. (1) The Federal Chancellery shall assist the Advisory Board and the Chairman or Chairperson in the performance of the tasks as the office of the office.

(2) It shall be the responsibility of the office, in particular:

1.

the ongoing operations of the Advisory Board;

2.

to respect the rules of procedure, together with the chairman or the chairman;

3.

prepare the meetings of the Advisory Forum;

4.

create and ensure the storage of the protocols;

5.

the decisions to be taken;

6.

to obtain the necessary information;

7.

document the working documents;

8.

to administer the travel expenses and expenses.
