391. Regulation of the Federal Minister for Agriculture, Forestry, Environment and Water Management on the statistics on livestock in 2008

Due to § § § 4 to 12 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. I n ° 92/2007, in agreement with the Federal Chancellor and with regard to § 13, is also ordered in agreement with the Federal Minister for Finance:

Arrangement for the compilation of statistics

§ 1. The Federal Institute of Statistics Austria (Bundesanstalt) has been responsible for fulfilling Austria's obligations under Directives 93 /23/EEC concerning the statistical surveys on pig production, 93 /24/EEC on statistical data Surveys on cattle production and 93 /25/EEC on the statistical surveys of sheep and goat production, OJ C 327, 28.2.1993, p. No. 10., as last amended by Directive 97 /77/EEC, OJ L 73, 27.3.1997, p. No. 28, to carry out surveys in accordance with the provisions of this Regulation and to compile statistics on the basis of the data collected by 31 May 2009.

Statistical units, survey mass

§ 2. Statistical units shall be agricultural holdings holding cattle, pigs, sheep or goats on the cut-off date, or slaughtering pigs which have not been investigated during the reference period.

Reference period, reference period

§ 3. (1) The reference date of the survey is 1 December 2008.

(2) The period from 2 June 2008 to 1 December 2008 shall be considered as the reference period for information on unexamined slaughterings of pigs.

Survey characteristics

§ 4. The survey characteristics referred to in Annex I and II to the public.

Survey Type

§ 5. (1) Di e survey characteristics relating to pigs, sheep and goats ( Annex I) are to be collected in terms of the type of sample survey by survey of 7,000 statistical units.

(2) The survey characteristics relating to bovine animals ( Annex II) are to be collected in the form of full-scale collection by the procurement of administrative data.

(3) The selection of the sample for the collection of the survey characteristics in accordance with Annex I has to be carried out by the Federal Institute on the basis of a stratified random sample.

Implementation of the survey

§ 6. (1) The survey according to § 5 (1) has to be carried out:

in the case of operators of statistical units acting as online reporting pursuant to § 6 (1) of the Animal Labeling and Registration Ordinance 2007, BGBl. II. 166/2007, registered with the Federal Institute, directly by the Federal Institute;

in the case of the other operators of statistical units, by the census of the municipality in which the establishment concerned is situated.

(2) For the survey, the Bundesanstalt has to produce uniform electronic survey documents (questionnaires and explanations) and the participating municipalities (§ 11) and the online melders (paragraph 1). 1).

(3) The Bundesanstalt has to make the online reporting documents available in paper form to the electronic survey documents.

Obligation to provide information

§ 7. (1) According to § 9 of the Federal Statistics Act 2000, there is a duty to provide information in the surveys.

(2) For the purpose of providing information, those natural and legal persons as well as registered partnerships are obliged to operate a statistical unit in accordance with § 2 in its own name.

Obligation to provide information to the parties responsible for providing information

§ 8. (1) The parties responsible for providing information shall be obliged to answer in full and to the best of their knowledge on matters relating to the body of the congregation's counting.

(2) Online detectors shall be obliged to enter their data in full and to the best of their knowledge in the electronic survey documents within twelve working days after the date of the reporting date and, if the survey documents are used in paper form, these shall be entered in the form of the electronic data collection documents. to transmit the address given in the survey documents.

Other co-action obligations

§ 9. Former managers (farmers) of statistical units in accordance with § 2 are obliged to participate in the determination of the new information subject pursuant to Section 7 (2) of the Federal Institute of the Federal Republic of Germany.

Information on disclosure requirements

§ 10. The Federal Institute has to provide information on the legal consequences according to § 66 of the Federal Statistics Act 2000 in the case of refusal of information and in the case of information which is knowingly incomplete or not to the best of its knowledge.

Participation obligations of the municipalities

§ 11. (1) The municipalities in whose scope of action a holding selected within the framework of the random sample from the Federal Institute of Selected Operations are obliged to participate in the survey in accordance with paragraph 2.

(2) The municipalities have to participate in the survey in the form that counting bodies used by the mayor, after questioning the information providers, fill in electronically the survey forms provided by the Federal Institute. The electronic transmission of the completed questionnaires to the Bundesanstalt is to be completed by the twelfth working day after the deadline.

(3) The obligation to participate shall also extend to the conduct of the survey of the respondents who have been notified in accordance with § 9.

Duty of participation of the holders of administrative data

§ 12. Agricultural market Austria is obliged to transmit the administrative data required for the determination of the survey characteristics in accordance with Annex II, at the request of the Bundesanstalt, free of charge and on electronic data storage medium.

Cost severance

§ 13. The municipalities will be granted a cost compensation for the participation in the livestock survey in the amount of 1.79 euro per statistical unit raised.

Override

§ 14. This Regulation shall enter into force after the end of 31 December 2009.
