465. Regulation of the Federal Minister for National Defence on the basic training for the use group M BUO 2 (basic training regulation M BUO 2)

On the basis of § § 26 to 31 and 149 (5) of the Civil Service Act 1979, BGBl. No. 333, as last amended by the Federal Law BGBl. I n ° 129/2008, shall be:

Scope

§ 1. (1) This Regulation lays down the basic training for the use group M BUO 2 (sub-official training), including the admission to basic training.

2. Without prejudice to their military grade, the persons participating in the training of the subofficers shall be deemed to be under-officers ' under-furnace warrior and shall be subject to the provisions of this Regulation.

Objectives

§ 2. The training of sub-officers shall provide the skills and skills necessary for the performance of the duties as commander and commander, as well as the training and training of an organizational element of the "Group" level, as well as within the framework of the Pre-deployment is necessary. Construction of basic training and forms of training

§ 3. (1) Subofficialtraining shall comprise:

1.

the preparatory course, including the admission examination for the further courses,

2.

the course of military leadership 2 and

3.

the course guide organizational element 2.

The courses according to Z 2 and 3 together form the further training of the under-ovary.

(2) The preparatory course must be carried out several times per calendar year according to the official requirements of the Heeresunteroffiziersakademie. It serves to determine the personal and professional aptitude of the subofficers of the subofficers and to the commander of an organizational element of the "Group" level in use and within the framework of the Preparation of the application and the admission to the further training of the under-oven. In the course of this course, an admission test must be completed.

(3) The course of the military tour 2 serves the purpose of communicating the objectives according to § 2 Z 1. It must be carried out several times per calendar year in accordance with the official requirements of the Heeresunteroffiziersakademie, and it has the following requirements in the Appendix 1 to include training courses (teaching and timetable "Military Leadership 2"). The training courses must be allocated in accordance with the service requirements and free apprenticeship places, taking into account the services provided during the preparatory course and in the approval test.

(4) The course management organization element 2 serves the purpose of conveying the objectives according to § 2 Z 2. It is in accordance with the service requirements according to the respective requirements for the use of the sub-officer and the sub-officer of the subcommittee. (5) The placement of individual training contents is also permitted in the form of self-employed courses or a distance education or a practical use or self-study or by other appropriate forms.

Eligibility requirements

§ 4. (1) Admission requirements for the preparatory course are

1.

the positive aptitude test for the training service in accordance with § 37 (1) of the Military Act 2001 (WG 2001), Federal Law Gazette (BGBl). I No 146,

2.

the successfully completed training of military leadership 1 and

3.

a troop practice in the scope necessary for further training of the sub-officialtraining.

(2) The admission examination for further training is to be taken as an overall examination before an examination senate and includes the examination subjects

1.

German,

2.

Mathematics,

3.

Battle Service,

4.

Maps and terrain,

5.

Weapons and Shooting Service and

6.

physical performance.

The examination subjects according to Z 1 to 4 are in writing, those according to Z 5 and 6 are practically to be deposited.

(3) During the preparatory course, the personal and professional aptitude of the subofficers to the subofficial is to be determined on the basis of the personal capacity to establish a military organizational element. ("Assessment"). This aptitude test shall be part of the authorisation.

(4) The three courses referred to in § 3 (2) shall remain valid for the three courses which follow the respective examination. After that, the entire preparation course must be repeated and an admission test must be taken again.

(5) In the event of an unpassed approval test, the entire preparation course must be repeated.

(6) Without prejudice to a positive authorisation, only those subofficers of the subofficers who are responsible for the training of the organizational element 1 in the training course shall be admitted to the course of the management organization element 2 in the course of the course of the course of the course. Underoffizer training, respectively, have been successfully completed and have successfully completed the military leadership training course 2. The successful completion of the Military Tour 2 course may be dismissed if the interests of the service require it.

Examination bodies for authorisation

§ 5. (1) An admission commission is to be set up for the approval procedure at the Heeresunteroffiziersakademie. This Commission shall consist of:

1.

the commandant or the commander of the Army Submission Academy as chairperson or chairperson,

2.

the Vice-Chairman and

3.

the required number of other members.

(2) The Chairperson of the Commission or the Chairperson of the Commission shall have the Vice-Chairmen and the other members from the circle of officials of the categories M BO 1 or M BO 2 or M BUO 1 or M BUO 2 or equivalent. In each case, use groups or comparable contract staff for a period of five years. If necessary, the Commission shall be supplemented by other members for the remainder of the respective functional period.

(3) Membership of the Commission

1.

Rests on the day of the initiation of a disciplinary procedure until its final conclusion and during the period of a dismissal, and

2.

In any case, it ends with the final imposition of a stricter disciplinary penalty than a fine or with the expiry of the period of order or with the transfer to another country or with the departure from the service.

(4) The Commission has to decide on the approval test in accordance with § 4 (2) and on the results of the aptitude test procedure in accordance with § 4 (3) in the respective senates. The Senate shall be composed of at least three members of the Commission. The members of the Senate shall be appointed by the Chairperson or by the Chairperson of the Commission from among the members of the Commission in accordance with the technical requirements for the respective evaluation. A member of the Senate is to be entrusted with the chairmanship of the Council. The Senate has to decide with a simple majority of votes after non-public deliberation. A abstention is inadmissible. In the event of a tie, the vote shall be taken by the chairman or the chairman of the Senate.

(5) The assessment results of the approval test and the results of the aptitude assessment procedure shall be compiled for the authorisation for further training in the field of sub-officialtraining.

Examination Rules for the Service Examination

§ 6. (1) The service examination shall include the examination subjects

1.

Heereskunde und Gefechtsmittellehre,

2.

Principles of Austrian constitutional law and the organisation of public authorities as well as the law of the European Union,

3.

the foundations of the civil service and remuneration law of the federal staff,

4.

the basic principles of administrative procedural law,

5.

the foundations of military law,

6.

Political Education,

7.

physical education,

8.

Perform and perform tasks,

9.

Training methodology and management behaviour,

10.

Weapons, equipment and specialised training; and

11.

Perform and perform tasks in the insert/organizational element ("Operations/OrgEt").

The level of requirements of the examination subjects is the result of the teaching contents of annexes 1 to 3.

(2) The service examination is to be carried out in the examination subjects in partial examinations

1.

1 to 7 and 10 before individual examiners, as well as

2.

1 Z 8, 9 and 11 before an examination senate.

(3) The partial examinations are to be deposited in the examination subjects

1.

pursuant to paragraph 1 (1) and (6) in writing

2.

pursuant to paragraphs 1, Z 2 to 5 and 9, oral,

3.

in accordance with paragraph 1 Z 7 in practice and

4.

pursuant to paragraphs 1, Z 8, 10 and 11 in writing and in practice.

Written examinations are to be held as a written examination and must not last longer than two hours. If a test compartment consists of more than one of the above-mentioned test parts during a course, the last part of the test shall indicate the extent to which the test is carried out.

(4) The sub-officers shall be assigned to the partial exams (examination plan)

1.

Military tour 2 after completion of the respective training subject by the commandant or commander of the Army Submission Academy and

2.

In the course of the course, organization element 2 after completion of the respective training subject by the commandant or the commander or the head of the person responsible for the respective use of the sub-officer or of the Unteroffiziersanwärter's eligible training facility according to Appendix 2.

(5) The assignment to the partial exams referred to in paragraphs 1, Z 8, 9, 10 and 11 shall be admissible only if the training provided for that purpose has been completed to such an extent by the respective sub-officers of the subofficers concerned that: the attainment of the training objectives in question can be expected or proof of the completion of an equal education has been provided.

(6) No exams may be repeated twice. The repeat tests shall be made possible within three months. In any case, a second examination is to be taken before an examination senate.

(7) In the field of Music Service, the examination subject is no longer required in accordance with paragraph 1 Z 8.

Audit bodies for the service examination

§ 7. (1) The Examination Committee shall consist of:

1.

the commandant or the commander of the Army Submission Academy as chairperson or chairperson and

2.

the required number of other members.

(2) The other members shall be from the circle of officials of the categories M BO 1 or M BO 2 or M BUO 1 or M BUO 2 or equivalent groups of uses, or the comparable contract staff or the other in their Subject to the order of five-year-old persons. If necessary, the Examination Committee is to be supplemented by additional members for the remainder of the respective functional period.

(3) The examination senate shall consist of three members of the examination board. Preference is preferably to be taken into account. A member shall be members of the M BUO 1 or an equivalent group of uses or comparable contract staff.

Accounting for subofficialtraining

§ 8. (1) Unteroffiziersanwärterinnen und Unteroffiziersanwärter, die

1.

have been allocated for the purposes of training under § 3 of the basic training regulation applicable to the use group M BUO 2 until 31 December 2008, or

2.

have been approved for training in troop officers

In any case, they are exempted from the completion of the preparatory course, including the admission test in accordance with § 4 (2) and the aptitude test procedure in accordance with § 4 (3). In these cases, Section 4 (4) shall not apply for the duration of the validity of an admission examination.

(2) As a successful completion of the Military Leadership Course 2, the successful completion of the 1. Semester of the underof-training course according to § 3 of the regulation on basic training for the use group M BUO 2, which is in force until the end of 31 December 2008.

(3) As a successful completion of the course Management organizational element 2, the successful completion of the course

1.

the second semester of the lower-end training programme in accordance with § 3 of the Regulation on basic training for the use group M BUO 2, applicable until 31 December 2008, with regard to the respective weapons attest or subject area referred to in Appendix 2,

2.

the one-year volunteer training (Milizoffiziersanwärter-Ausbildung), with regard to the respective gun classification or subject area according to Appendix 2,

3.

training as a military dog ("obedience and protection") with regard to the field of animal husbandry and use, military dogs and

4.

the practical fliegerischen suitability (selection) and the admission to the military pilot training and military pilot training with regard to the subject military pilot.

(4) The successful completion of the partial examination of the examination subject Weapons, equipment and specialist training pursuant to § 6 (1) Z 10 shall be deemed to be successful completion of the examination.

1.

training as emergency paramedics and emergency paramedics with the general emergency skills according to § 11 of the Sanitary Act (Sanitary Act), BGBl. I n ° 30/2002, with regard to the field of medical service,

2.

training at higher technical schools or in technical schools with a view to technical service in accordance with the intended use,

3.

vocational training in the fields of "electrical engineering and electronics" or "metal engineering and mechanical engineering" or "information and communication technologies" with regard to the technical service in accordance with the intended use,

4.

the Bundesfachschule für Flugtechnik (Bundesfachschule für Flugtechnik) in the field of aviation technology,

5.

vocational training in the fields of "Aircraft Mechanics/Technology", "Electrical Engineering and Electronics" and "Metalltechnik und Maschinenbau" with regard to the field of aviation technology,

6.

vocational training in the fields of "construction", "wood, glass and clay", "electrical engineering and electronics" and "metal engineering and mechanical engineering" with regard to the weapon control of the pioneering force in accordance with the intended use,

7.

the "cook" teaching profession with regard to the field of catering,

8.

the teaching qualification test for military instructors in the field of road transport and transport, and

9.

The first diploma examination of the study "Instrumental singing education" or an instrumental course at a music university or at a conservatory with regard to the subject of music service.

(5) Successfully filed partial examinations of the lower-end training course according to § 3 of the Regulation on the basic training for the use group M BUO 2, valid until the end of 31 December 2008, are considered to be a successful conclusion of the corresponding partial exams pursuant to this Regulation.

Transitional provisions

§ 9. (1) The successful completion of the basic training for

1.

the group of uses M BUO 2 and

2.

the usage group D-service in sub-officialfunction

the regulations in force at the time of the respective conclusion shall be considered to be a successful completion of the training of the sub-officialtraining under this Regulation.

(2) The accounting provisions of Section 8 (1) (1), (2) and (5) shall apply until the end of the 31 December 2012.

(3) The basic training for the use group M BUO 2, which began until 31 December 2008, is to continue to apply until 30 June 2010 the Regulation applicable until 31 December 2008.

In-and out-of-power

§ 10. (1) This Regulation shall enter into force 1. Jänner 2009 in force.

(2) With the expiry of 31 December 2008, the Federal Minister of State Defense Regulation shall enter into force on the basic training for the use group M BUO 2, BGBl. II No 519/2003, except for force.
