185. Regulation of the Federal Minister for Labour, Social Affairs and Consumer Protection, amending the Regulation on Prohibition Of Employment Prohibition and Restrictions on Young People (KJBG-VO)

Pursuant to Section 23 (2) of the Children's and Young People's Employment Act 1987 (KJBG), Federal Law Gazette No. 599/1987, as last amended by the Federal Law BGBl. I n ° 138/2013, shall be arranged:

The regulation on employment bans and restrictions on young people, BGBl. II No 436/1998, as amended by the BGBl Regulation. II No 221/2010, shall be amended as follows:

1. In Section 1 (8), the phrase " last amended by the Federal Act BGBl. I No 47/1997 " replaced by " in the version of the Federal Law BGBl. I No 60/2015 " .

2. In § 3 (1), the reference to "Z 1 to 7" replaced by "Z 1 to 4" .

3. § 3 (1) Z 1 reads as follows:

" 1.		Work under the action of the following health-related agents:
a.			Acute toxicity (hazard class 3.1) Category 1 to 3,
b.			Etch/irritable effect on the skin (hazard class 3.2),
c.			Severe eye irritation/eye irritation (hazard class 3.3),
d.			Sensitisation of the respiratory tract or the skin (hazard class 3.4),
e.			germ cell mutagenicity (hazard class 3.5),
F.			Carcinogenicity (hazard class 3.6),
g.			Reproductive toxicity (hazard class 3.7),
h.			Specific target organ toxicity, single exposure (hazard class 3.8), category 1 and 2,
i.			Specific target organ toxicity, repeated exposure (hazard class 3.9) category 1 and 2,
j.			Risk of aspiration (hazard class 3.10),
k.			Acute toxicity (hazard class 3.1) Category 4, Specific target organ toxicity, unique exposure (hazard class 3.8) Category 3, which is due to its irreversible non-lethal or prolonged exposure to chronic toxic effects are classified as such,
L.			Substances which have fibrogenic or biologically inert properties; "

4. In § 3 (1), the previous Z 4 to Z 6 will be omitted; the previous Z 7 will be replaced by the digit designation "4" .

5. In § 3 (2), the reference " 1 Z 1 to 6 " replaced by " 1 Z 1 to 3 " .

6. § 3 (3) reads:

" (3) prohibitions are works with explosive working materials within the meaning of Section 40 (2) of the ASchG. The provision for the sale, transport and use of pyrotechnic articles of category F1 and F2 according to § § 11 and 47 of the pyrotechnic law 2010, BGBl. I No 131/2009. '

7. § 3 (4) reads:

" (4) prohibitions are works with fire-hazardous substances within the meaning of section 40 (3) of the ASchG:

1.		Working with the use of
a.			flammable gases (hazard class 2.2),
b.			Flammable aerosols (hazard class 2.3) Category 1,
c.			flammable liquids (hazard class 2.6) Category 1,
d.			substances or mixtures which, in contact with water, develop flammable gases (hazard class 2.12),
	if there are risks to safety and health arising from the quantity and concentration of these working substances occurring during the working process;
2.		Working with the use of
a.			Flammable aerosols (hazard class 2.3) Category 2,
b.			oxidising gases (hazard class 2.4),
c.			flammable solids (hazard class 2.7),
d.			flammable liquids (hazard class 2.6) Category 2,
e.			self-decomposable substances or mixtures (hazard class 2.8) other than type A and B,
F.			pyrophoric liquids (hazard class 2.9),
g.			pyrophoric solids (hazard class 2.10),
h.			self-heating-capable substances or mixtures (hazard class 2.11),
i.			oxidising liquids (hazard class 2.13),
j.			oxidising solids (hazard class 2.14),
k.			organic peroxides (hazard class 2.15) other than type A and B,
	if, on the basis of the quantity and concentration of these working substances occurring during the working process, risks to safety and health may occur; after 18 months of training and under supervision, the Commission shall be entitled to:

§ 10. This Regulation lays down Directive 94 /33/EC on the protection of minors, OJ L 327, 30.4.1994, p. No. 12., as amended by the amending Directive 2014 /27/EU in order to adapt it to Regulation (EC) No 1272/2008 on the classification, labelling and packaging of substances and mixtures, OJ L 206, 22.7.2008, p. No. OJ L 65 of 5.3.2014, p. 1.

9. The previous § 10 receives the paragraph designation "§ 11"; the heading is "Conclusion and transitional provisions" .

10. The paragraph 3 and paragraph 4 are added to the following § 11:

" (3) Insofar as work materials are still in accordance with their properties within the meaning of § 3 of the Chemicals Act 1996, BGBl. I n ° 53/1997, as amended by the BGBl version. I n ° 14/2015, § 3 of this Regulation shall apply under the appropriate application of Section 40 (8) of the German ASchG (German Act on the Law of the State).

(4) § § 1 para. 8, § 3, § 10 including the title and § 11 para. 3 and section 4, together with the title of § 11, in the version of the BGBl. II no. 185/2015, shall enter into force with the date of the day of the event; at the same time, the previous § 3 (1) Z 4 to 6 shall not apply. "
