132. Ordinance of the Federal Minister for Economic Affairs, Family and Youth and the Federal Minister for Agriculture, Forestry, Environment and Water Management, with which the Regulation on the statistics of the use of goods in the producing sector (freight operations statistics regulation) is amended

On the basis of § § 4 to 10 and 30 of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. I n ° 92/2007, shall be assigned in agreement with the Federal Chancellor:

The regulation of the Federal Minister for Economic Affairs and Labour and the Federal Minister for Agriculture, Forestry, Environment and Water Management on the statistics on the use of goods in the producing sector (Regulation on the Application of Goods Statistics Regulation), Federal Law Gazette (BGBl). II No 349/2003, shall be amended as follows:

1. § 1 reads:

" § 1. The Bundesanstalt Statistik Österreich (Bundesanstalt Statistik Österreich) has been responsible for the fulfilment of Austria's obligations on the basis of

Regulation (EC) No 2223/96 on the European system of national and regional accounts in the European Community,

2.

of Regulation (EC) No 1099/2008 on energy statistics

to carry out statistical surveys in accordance with this Regulation and to compile the corresponding statistics on the use of goods in the "producing area".

2. § 3 (1) to (3) are:

' (1) Statistical units within the meaning of this Regulation are:

1.

Enterprises as single and multi-business enterprises (legal entities) and enterprises (technical units) referred to in Articles 1 and 2 of Regulation (EEC) No 696/93 concerning statistical units for the observation and analysis of the economy in the Community,

2.

Working communities and

3.

Entities within the meaning of Section 2 of the Corporate Tax Act 1988, provided that these entrepreneurs are in the sense of Section 2 (3) of the VAT Act 1994, as well as water works, slaughterhouses, facilities for the disposal of waste and for the discharge of flushing water and waste, that are operated by public authorities,

which are an economic activity in accordance with sections B to F of the nomenclature of the Austrian Federal Statistics Act 2000, published in the Federal Statistical Office of Statistics Austria in accordance with Section 4 (5) of the Federal Statistics Act, and published under the Internet address www.statistik.at Economic activities-ENACE 2008, or a service associated with this economic activity, independently, on a regular basis and with the intention of obtaining a yield or other economic benefits.

(2) The locality of the statistical unit is determined by the location, the classification of its economic activity in principle by allocation of the activity in question to sections B to F of the ENACE 2008.

(3) Enterprise undertakings are undertakings which only operate (a technical unit) and multi-business enterprises are undertakings which carry out a number of establishments (technical units). "

3. § 3 (5) shall be deleted.

4. § 4 (1) Z 3 reads:

" 3.

used in the production process

a.

the quantity and value (actual consumption) of energy sources,

b.

Quantity and value (actual consumption) of the operating, raw, basic and auxiliary materials, as well as semi-finished products and finished products intended for installation,

Broken down by species according to the list of goods listed in the Federal Statistical Office of Statistics Austria and published under the Internet address www.statistik.at (GV-GES)-in the period applicable to the reporting period. Version. The breakdown of each species in the GM-GES must be done by specifying individual or aggregated headings of the items listed in the Annex to Regulation (EC) No 451/2008. "

5. The following paragraph 3 is added to Article 4 (2):

" (3) withdrawn from the survey of the characteristics referred to in paragraph 1 Z 3 lit. (b) are statistical units according to § 3 (1), which are self-employed in an economic activity according to Divisions 37 and 39 and in Groups 38.1, 38.2 and 41.1 of the ÖNACE 2008 or a service associated with this activity; shall, on a regular basis and with the intention of obtaining a yield or other economic benefits. "

6. In § 6, the terms of reference 1 and 2 shall be followed by the word order "an economic performance of more than 7.49 million euros" through the phrase "an economic output of 10 million euros and more" , and in paragraph 4, the phrase "Partnerships of commercial law" through the phrase "registered partnerships" replaced.

7. § 8 (1) reads:

" (1) The parties responsible for providing information pursuant to § 6 (4) shall be obliged to complete the survey forms laid down by the Federal Office in full and to the best of their knowledge, and these shall be required for the reporting period ended in 2008 until 30 June 2009 and as a result until 31 May of the year following the reporting period, to be sent to the Federal Institute for the address indicated in the survey form ".

8. § 10 (1) reads:

" (1) The Federal Institute has the results of the goods use statistics at the latest nine months in accordance with the date specified in § 8 (1) in the breakdown by department according to the Annex to Regulation (EC) No 451/2008 (goods approach) as well as by departments of the (activity approach) to be made available to the public free of charge on the Internet. "

9. In § 10 paragraph 2, the reference "in accordance with the Annex to Regulation (EEC) No 3696/93" by reference "in accordance with the Annex to Regulation (EC) No 451/2008" replaced.

§ 12 shall be deleted; § 11 shall be added to the following § § 12 and 13 together with the headings:

" Conclusion and transitional provisions

§ 12. § § 1 to 4, 6 and 10 in the version of the BGBl Regulation. II No 349/2003 shall apply to the reporting periods up to and including the calendar year or marketing year 2007.

11. The system shall be omitted.
