137. Regulation of the Federal Minister of Health, amending the Cosmetics Regulation

Due to § 20 of the Food Safety and Consumer Protection Act-LMSVG, BGBl. I n ° 13/2006, as last amended by the Federal Law BGBl. I n ° 121/2008, shall be:

The cosmetics regulation, BGBl. II No 375/1999, as last amended by the BGBl Regulation. II No 311/2008, shall be amended as follows:

1. § 5 (2) reads:

" (2) Cosmetic products not subject to the BGBl Regulation. The provisions of Regulation (EC) No 137/2009, as far as substances in Annex 1 (No 167) and the substance of Annex 4 (1) are concerned, are in accordance with the provisions in force until 7 November 2009. They shall be produced, imported or marketed in October 2009. "

2. § 5 (5) and (6) are:

" (5) Cosmetic products not subject to the BGBl Regulation. As far as substances in Annex 1 (1) 1329 to 1369 are concerned, as well as substances in Annex 2, Part 1, Nos 10 and 14 and Annex 2, Part II, Nos 57, 59 and 60, the provisions in force until 13 May 2009 are in accordance with the provisions in force until 13. The European Parliament and the Council of the European Parliament and of the Council of 20 October 2009 and as far as substances of Appendix 1, Nos 1370 and 1371 and substances of Appendix 2, No 186, 187 and 188 are concerned, shall be manufactured, imported or placed on the market until 4 November 2009.

(6) Cosmetic products not subject to the BGBl Regulation. As far as the substance of Annex 2, Part 1, No 185 relates, it may be manufactured, imported or placed on the market until 4 February 2010, the provisions currently in force are in accordance with the provisions of Annex II to the Directive.

3. § 6 reads:

" § 6. This Regulation repeals Directive 76 /768/EEC, OJ L 73, 27.4.1976, p. No. OJ L 262 of 27 September 1976 on the approximation of the laws of the Member States relating to cosmetic products, as last amended by Directive 2009 /6/EC, OJ L 262, 27.9.2009, p. No. OJ L 36 of 5 February 2009, transposed into Austrian law. "
