166. Regulation of the Federal Minister of Health with which the dentists-EEA-Qualification of Qualifications-Regulation 2008 is amended (ZÄ-EWRV-Novelle 2009)

Pursuant to Section 9 (3) of the German Dental Doctors Act (ZÄG), BGBl. I n ° 126/2005, as last amended by the Federal Law BGBl. I n ° 102/2008 and the Federal Ministries of the Federal Ministries of Law 2009, BGBl. I No 3, shall be assigned:

The Dentists-EEA Qualification-Regulation 2008-ZÄ-EWRV 2008, BGBl. II No 194, shall be amended as follows:

1. In the table of contents, after the line " § 6 ... Acquired rights for dental training qualifications-Slovenia " the line " § 6a ... Acquired rights for dental training qualifications-further migration " inserted.

2. In the table of contents, after the line " § 10 ... Acquired rights for medical training certificates-Romania " the line " § 10a ... Acquired rights for medical training proof-further migration " inserted.

3. § 1 Z 1 reads:

" 1.		Directive 2005 /36/EC on the recognition of professional qualifications, OJ L 327, 30.4.2005, p. No. 22, as last amended by Regulation (EC) No 1137/2008 adapting a number of instruments subject to the procedure referred to in Article 251 of the Treaty to Council Decision 1999 /468/EC, with regard to the regulatory procedure with control, OJ No. OJ L 311, 21.11.2008 p. 1, and "

4. In accordance with § 6, the following § 6a and title shall be inserted:

" Acquired Rights for Dental Training Qualifications-Further Migration

§ 6a. As proof of qualifications, qualifications are from the former Soviet Union or Dental training qualifications issued by the former Yugoslavia pursuant to § § 5 and 6, provided that:

1.		in another EEA State Party or the Swiss Confederation, in accordance with the relevant provisions of Article 23 (4) and (4) respectively. 5 of Directive 2005 /36/EC, and
2.		is accompanied by a certificate attesting that the person concerned has been in the European Economic Area or the Swiss Confederation for at least three years in the European Economic Area or the Swiss Confederation for the last five years prior to the issue of the certificate; and has been lawfully engaged in the activities of the dentist/dentist
(Article 23 (1) in conjunction with Article 23 (4) and (4) respectively) 5 Directive 2005 /36/EC).

5. In accordance with § 10, the following § 10a and title shall be inserted:

" Acquired Rights for medical training certificates-Further migration

§ 10a. The qualifications of dental qualifications are from Italy, Spain, the former Czechoslovakia and the Netherlands, respectively. medical training certificates issued by Romania in accordance with § § 7, 8, 9 and 10, provided that:

1.		they have been recognised in another EEA State Party or the Swiss Confederation in accordance with the relevant provisions of Article 37 of Directive 2005 /36/EC; and
2.		is accompanied by a certificate attesting that the person concerned has been in the European Economic Area or the Swiss Confederation for at least three years in the European Economic Area or the Swiss Confederation for the last five years prior to the issue of the certificate; and has been lawfully engaged in the activities of the dentist/dentist
(Article 23 (1) in conjunction with Article 37 of Directive 2005 /36/EC). "

6. In § 11, the expression "§ § 3 to 10" by the expression "§ § 3 to 10a" replaced.

7. In § 12, the sales designation shall be deleted "(1)" ; the digit designation "3." is indicated by the number designation "2." replaced. "
