167. Regulation of the Federal Minister of Health with which the Health and Health Care-EEA Qualification-Regulation 2008 is amended (GuK-EWRV-Novelle 2009)

On the basis of § 29 (2) Health and Health Care Act, BGBl. I n ° 108/1997, as last amended by the Federal Law BGBl. I n ° 101/2008 and the Federal Ministries of the Federal Ministries of Law 2009, BGBl. I No 3, shall be assigned:

The Health and Health Care-EEA Qualification-Regulation 2008-GuK-EWRV 2008, BGBl. II. No 193, shall be amended as follows:

1. In the table of contents, after the line " § 10 ... Acquired Rights-Romania " the line " § 10a ... Acquired Rights-Further Migration " inserted.

2. § 1 Z 1 reads:

" 1.

Directive 2005 /36/EC on the recognition of professional qualifications, OJ L 327, 30.4.2005, p. No. 22, as last amended by Regulation (EC) No 1137/2008 adapting a number of instruments subject to the procedure referred to in Article 251 of the Treaty to Council Decision 1999 /468/EC, with regard to the regulatory procedure with control, OJ No. OJ L 311, 21.11.2008 p. 1, and "

3. In accordance with § 10, the following § 10a together with the heading is inserted:

" Acquired Rights-Further Migration

§ 10a. As evidence of qualifications in general health and nursing care, the former Czechoslovakia, the former Soviet Union, the former Yugoslavia, Poland and the former Yugoslavia, respectively, are the first countries to be considered as health and nursing qualifications. Training qualifications issued by Romania in general health and nursing care in accordance with § § 6, 7, 8, 9 para. 1 and 10, provided that:

in another EEA Contracting State or the Swiss Confederation, in accordance with the relevant provisions of Article 23 (3) to (5), (2) and (2), respectively, 33a of Directive 2005 /36/EC, and

2.

is accompanied by a certificate attesting that the person concerned has been in the European Economic Area or the Swiss Confederation for at least three years in the European Economic Area or the Swiss Confederation for the last five years prior to the issue of the certificate; and legal activities of general health and nursing care, which have been fully responsible for the planning, organisation and implementation of the patient's health care/patient care,

(Article 23 (1) in conjunction with Article 23 (3) to (5), 33 (2) and 33a as well as Article 33 (1) Directive 2005 /36/EC).

4. In § 11, the expression "§ § 4 to 10" by the expression "§ § 4 to 10a" replaced.
