54. Revelation of the Federal Chancellor concerning the scope of the Council of Europe Convention on combating trafficking in human beings

On the occasion of the deposit of their instrument of ratification, the following states have declared the following reservations, or Statements made:

Latvia:

In accordance with Article 31 (2) of the Convention, the Republic of Latvia declares that it reserves the right to lay down the rules on jurisdiction in accordance with paragraph 1 of this article. d and e do not apply.

Malta:

With regard to Article 31 (1) of the Convention, Malta declares that it is subject to the rules on jurisdiction in accordance with lit. d only apply if the offence has been committed by one of its nationals. Malta declares that it does not apply the rules on jurisdiction in accordance with lit. This article will be applied.

Poland:

In accordance with Article 31 (2) of the Convention of the Council of Europe on combating trafficking in human beings, the Republic of Poland reserves the right to Article 31 (1) (lit). (d) of the Convention the right to have jurisdiction over criminal offences established in accordance with the Convention if the offence was committed by a stateless person who habituates his/her habitual residence in the territory of the Republic of Poland, in respect of those offences punishable by a custodial sentence of over two years in accordance with the Polish criminal law, if the offender is situated in the territory of the Republic of Poland and no decision about his extradition.

The Government of the Republic of Poland hereby declares that the effective implementation of the obligations of the Parties under Article 25 of the Convention shall be the establishment of effective international legal and technical mechanisms for the Exchange of information on judgments made by another Contracting Party requires, in connection with the offences established in accordance with this Convention.

Portugal:

The Portuguese Republic declares that, in the light of Article 31 (1), lit. (d) and (e) of the Convention, it reserves the right not to apply the provisions contained therein, since the Portuguese criminal law provides for stricter and final rules on jurisdiction than that laid down in Article 31 of this Convention.

United Kingdom:

In accordance with Article 31 (2) of the Convention, the United Kingdom reserves the right to: Article 31 (1) (lit). d and e of the Convention shall not apply.
