53. Federal Constitutional Law, amending the Federal Constitutional Law on the limitation of the remuneration of public officials, as well as a federal law with which the Federal Act of Reference and the Law on the Law of Remuneration are amended

Article 1

Amendment of the Federal Constitutional Law on the limitation of the references of public officials

The Federal Constitutional Law on the limitation of the references of public officials, BGBl. I No 64/1997, as last amended by the Federal Constitutional Law BGBl. I n ° 119/2001, is amended as follows:

1. § 3 reads:

" § 3. (1) By 5 December each year, the President of the Court of Auditors shall, for the first time in 2010, identify an adjustment factor and make it known in the Official Journal of the "Wiener Zeitung" with the amount of the initial amount applicable for the previous year in respect of the provisions of Article 1 (1) (1) (1) (1) (1)). 1 mentioned references with effectiveness to 1. January of the following year is to be adjusted. In this announcement, the following are also the same for those in § 1 para. 1 or in the Federal Remuneration Act, BGBl. I No 64/1997, the amounts involved, rounded to 10 cents, to be published. In the case of rounding, residual amounts of less than 5 cents shall be negligible and residual amounts of 5 cents and more shall be rounded up to full 10 cents ("commercial rounding").

(2) The Bundesanstalt "Statistik Österreich" has to inform the President of the Court of Auditors, by 30 September each year, of the relevant rate of inflation which is calculated by a factor which is due to the 2005 consumer price index, or to the rate of inflation of the latter. The index shall be calculated by dividing the average value of the twelve months from July of the previous year up to June of the current year by the corresponding value of the twelve months preceding this period. The Federal Minister for Labour, Social Affairs and Consumer Protection has to inform the President of the Court of Auditors of the adjustment factor applicable to the adjustment of pensions from the statutory social security scheme for the following year. The lower of the two factors is the adjustment factor referred to in paragraph 1. "

(2) The following paragraphs 14 and 15 are added to § 11:

" (14) The adjustment provided for in § 3 (1) shall be cancelled until 31 December 2010.

(15) § 3 in the version of the Federal Law BGBl. I n ° 53/2009 shall enter into force on 1 September 2010. '

Article 2

Amendment of the Federal Data Protection Act

The Federal Data Protection Act, BGBl. I No 64/1997, as last amended by the Federal Law BGBl. I n ° 142/2004, is amended as follows:

The following paragraph 6 is added to Article 21:

" (6) The adjustment of the initial amount in accordance with § 3 of the Federal Constitutional Law on the limitation of the references of public officials, BGBl, provided for in § 2 para. 2. I No 64/1997, no later than 31 December 2010. '

Article 3

Amendment of the Law on Bezüge

The Remuneration Act, BGBl. No 273/1972, as last amended by the Federal Law BGBl. I n ° 53/2007, is amended as follows:

In accordance with § 49q the following § 49r with headline is inserted:

" The removal of the adjustment of the pensions for 2010

§ 49r. The application of Section 41 (2) and (3) of the Pension Act 1965 provided for in Articles 31, 34 (4), 44 (1) and (44k) shall not be applicable until 31 December 2010. "
