General information

Purpose



§ 1.

 (1) in this regulation, a public phone numbers - as well as a public dial plan as part of plan for communication parameters in accordance with § 24 para 1 and 63 TKG 2003, as well as provisions on value-added services in accordance with § 24 para 2 shall be adopted 2003 TKG.

(2) for the various number ranges are set usage characteristics and criteria for allocating, regulated the procedure for the acquisition of rights of use, as well as fixed charges and provisions on value-added services.

Scope of application



§ 2.

 (1) this Regulation applies to all public communications networks operated in the Federal territory, for all publicly available communications services and on public communications services based services which use numbers of the public telephone number plan governed by this regulation, or intend to use.

(2) the public dialing plan has validity at all termination points in the Federal territory, unless used for the offered services of communication parameters are laid down in this regulation.

(3) private numbering plans, as well as private dial plans are not covered by this regulation.

Definitions



§ 3.

 The purposes of this regulation



1 "Area code": a sequence of digits, which can be at the beginning of a national telephone number. For the number range that is determined by an area code and intended for the use a purpose is set, if necessary, taking into account the following points,

2. "operator-related service": a service of a communications service provider, which is directly related to the provided communication service, if the service does not also meets the criteria of a value-added service according to Z 16;

3. "Operator code": a sequence of digits that identifies a communication service providers, a communications operator, an operators of harmonised services of social value or an operator of a telephone directory services;

4. "Decade number block": a maximum large closed number area, with all included telephone numbers starting with a particular sequence of identical digits.

5. "dialer program": a program or part of program that directly or indirectly establishes a dial-up access or controlled, and the phone number for this used is determined by the program itself. A dialer program is also such a programme or sub-programme, which directly or indirectly affected the configuration of telecommunications terminal equipment of the user with respect to the production by communications or altered;

6 "Dial-up access": an access to the Internet or other data networks, which connect to an underlying data networks; built by choosing a number from the public telephone network

7 "Diensteroutingnummer": a national telephone number consisting of an area code for Routingnummern, followed by an operator code and a dependent by the relevant operator code sequence of digits, to call on a particular communication network to deliver or to network-internal functions to produce;

8 "Service provider": a person, information, or other services under a number of the public phone number plan through the use of communications services offered. Include communication service providers, which offer the public access to their communication services under a phone number;

9 "pay": the remuneration, which resolves to the participants;

'ENUM': one by the Internet Engineering Task Force - IETF defined protocol, the conversion of phone numbers in the format of the ITU-T Recommendation E. 164 ENUM domain names using the domain name system - DNS carry;

11 "Erotic services": all services of sex-related content, regardless of whether the content conveyed indirectly through tape, video recordings, texts, pictures, or other records or directly by voice, text, video links, or combinations thereof, services that provide access to such services, as well as all those services, that between users making Erotic contacts allow;

12 'event tarifierter service': a service where a specific time-independent for the one-time use of the offered service; charge applies

13 'Fax retrieval service': a service which is retrieving information via fax.

14 "Digits": the renewal of a national phone number or a public short number by the participant to the maximum length of the phone number. Among them is also a possible extension;

15 "international number": a maximum full 15 digits phone number, consisting of the maximum three-digit country code, followed by a national phone number;

16 'Value added service': a service for which the characteristics of a true to f.

17 'Mobile service': a communication service in which the telecommunications terminal equipment regardless of location can be used, are connected to the communications network via a radio interface and the used frequency is a right of exclusive use;

18 "Intelligence": a communications service used for the transmission of electronic messages that used telephone numbers for addressing, which are laid down in this regulation;

19 "national routing number": a phone number, consisting of an area code, followed by an operator code and additional digits used in calls at the communication network with the operator code specific to deliver;

20th "national number": a) a telephone number, consisting of an area code or area code, followed by a number of participants and, where appropriate, optional digits, or b) a Diensteroutingnummer, or c) the carrier selection test phone number;

21 'Use a number': the availability of the target addressed with the phone number in public communication networks or services;

22 "Efficiency": the ratio of the number of the used numbers to a licence holder in relation to the it allocated numbers;

23 "public short number": a phone number, consisting of one with the access code beginning 1, if necessary, followed by an optional operator code, and any digits;

24 "public dial plan": a plan that sets the permissible choice digit sequences to the network termination points for public communication services that use numbers of the public telephone number plan laid down in this regulation for addressing,

25 'Platform operator': a company whose services infrastructure has a direct link to the associated communications networks of that communication service providers, their end customers use the service, and that provides the technical platform for the respective service, on which the contents of the service are stored, or coordinated the delivery of content. Such a platform operator does not exist, at the time of service provision is the communication service provider, providing access to the service with its associated communication network, as operator of the platform;

26 "private numbering plan": a numbering plan, which remains unaffected by changes of the public telephone numbers - or dial plan;

27 "private dial plan": a plan that contains the permissible choice digit sequences at the access points to a private communication service, which remains unaffected by changes of the public telephone numbers - or dial plan. At the access points of a private network, the terminal equipment of users of the private network are turned on;

28 "PSTN/IP gateway" function: a function to ensure interoperability of services in IP-based networks and the traditional circuit-switched telephone network;

29 "source tarifiert power": the definition of remuneration for a service by those communications service operator, which settles this service compared to the calling subscriber.

30 "poor": the user of a communication service or a service of a service provider, regardless of whether a voice, data, or intelligence is used;

31 "Numbering plan": the structuring of the addresses of network termination points, participants, or services;

32. "Participant": that sequence of digits of a national phone number that connects to the area code or area code and identified the participants, who is with the relevant communications service operators in a contractual relationship;

33. "Mediation function in private networks": a feature which is used usually making indirect connections to from users communicated to the caller by or connections to a private network;

34. "target tarifiert network": the definition of remuneration for a service through the communications service operators from its associated communication network, the service is offered in cooperation with the service provider. The fixed fee applies to all participants, regardless of the source network;

35. "Access code": a sequence of digits starting with 1 at the beginning of a public short number, which identifies the addressed service;

36. "associated communications network": the communication network used by a communications service provider for the provision of its services. This can either be operated by the same company that operates also the communication service, or by a third, with the communication service operator has completed a corresponding cooperation contract.

Accessibility of numbers



§ 4.

 (1) operators of public telephone networks and services have to ensure the national accessibility to national numbers and public short numbers with phone number length of maximum 12 digits.

(2) no right of use of a service can be derived from the obligation referred to in paragraph 1. Information of the calling is to ensure a permissible restriction of the service by the service provider.

(3) the international availability of national numbers is in the areas of 800 to allow 810 and all source network inquiries phone number sections, at least from all Contracting Parties of the EEA and Switzerland. If a service provider wants to restrict its international accessibility in the areas of 800 or 810, is the communication operators, by its associated communication network of the service offered, is entitled immediately to stop such calls.

The caller's number



§ 5.

 (1) in the national transport, the transport and the transmission of the phone number of the caller between all public communications network operators involved in the connection are mandatory.

(2) all communications network contributing to a National Association and communications service operators have to ensure, within their area of influence that starting with emergency calls from



1. a fixed network termination point with associated geographical phone number the geographical phone number;

2. a mobile telecommunications terminal equipment with associated mobile phone number mobile phone number;

3. an access point of a private network with a telephone number in accordance with § 55 et seq. without associated geographic or mobile telephone number the number of the private network.

4. a network termination point without associated geographic or mobile phone number and a phone number of a private network pursuant to sections 55 et seq. a phone number, which a) allows the identification of the current site, or, if this is not possible due to technical circumstances, b) allows a callback of the caller, or, if this is not possible, c) allows for the identification of the participant;

5. a mobile telecommunications terminal equipment without associated phone number no number is transferred.

(3) except in cases of paragraph 2 have within their area of influence of participants and all involved with a National Association communication network and communications service providers to ensure that a bare callback phone number to which the participant has the right to use, is transmitted to the called party. (5) telephone numbers from the areas of 718, 804, 900, 901, 930 and 931 may not be used as the caller's number. Telephone numbers from the areas of 900, 901, 930 and 931 are excluded if they are used in conjunction with a news service, and if the message or the message service by the user was asked. Numbers in the access code field 118 may be used only in direct connection with a telephone information service as the caller's number.

Ban on the use of unregulated number ranges



§ 6.

 It is forbidden to use all number ranges that are not governed by this regulation and not allocated numbers by communication carriers or communication service providers.

Free international phone numbers universal international freephone numbers - UIFN



§ 7.

 Services under an international phone number for universal international freephone numbers with the country code 800 is free of charge for the participants.

Dialerdienste international



§ 8.

 (1) communications service operators have for fixed networks within the framework of their technical and economic possibilities to take measures to protect its participants before making unwanted paid dial-up connections to foreign numbers.

(2) the provision of services abroad by means of dial-up access in Austrian phone numbers is not allowed. This is allowed only if a corresponding legal relationship underlying this link, which goes beyond the specific use of the service.

Publication of decisions



§ 9.

 Decisions pursuant to article 65, paragraph 3 TKG 2003 in connection with the administration of communications parameters are to publish on the RTR Web site.

Principles of number allocation



§ 10.

 (1) at the request of numbers or parts thereof, as well as operator metrics are the RTR-GmbH - depending on the respective number range - in connection with the carrier selection prefix to communication service providers, allot communications network operator or service provider to use.

(2) natural persons who have no main residence in Austria, or legal persons without seat in Austria, have a delivery agent within the meaning of § 9 delivery law for making the application, Federal Law Gazette No. 200/1982 idF BGBl. I to make their No. 5/2008. Any changes in the person of the delivery agents are telling the RTR-GmbH within two weeks after the change. (5) participants, phone numbers expressly contractually assigned to those as communication service providers in the area of geographical phone numbers, mobile phone numbers, or location-independent numbers of a licence holder referred to in paragraph 1 may maintain also independently last set TKG 2003 addressing children within the meaning of article 65, paragraph 1. Such contracts must be reported by the licence holder referred to in paragraph 1 of RTR-GmbH.

(6) the licence holder referred to in paragraph 1 has electronically viewing the RTR-GmbH in the format specified by the RTR-GmbH, as well as to specify to which participants they were assigned to the numbers that have been contractually assigned to a participant pursuant to subsection 5.

(7) participants were assigned numbers referred to in paragraph 4 or 5 expressly contractually as communication service providers may use these numbers themselves exclusively.

(8) an operator who has a right of use in accordance with section 4 or 7 on a phone number in the fields of 5 for private networks, 718, 720, 780, 800, 804, 810, 820, 821, 828, 900, 901, 930, 931, 939, or in the access code field 118, is entitled to use phone number services at different communication services providers.

(9) the right of use to a number includes all those identities derived for services that are related to the integrity of the number space.

(10) communication parameters, are not included in this regulation can be allocated on request for non-commercial testing in the framework of operation tests for six months period. The allocation may contain conditions that meet the purpose of the allocation.

(11) in justified individual cases, numbers or number ranges of the allocation can be excluded. Respectively, they are published on the RTR Web site.

(12) numbers, which are not included in this regulation, or for which under the provisions of the third paragraph, no allocation is made, can be allocated upon a reasoned request, when were they already mistakenly communicates a general public or made significant financial efforts to communicate of the number. Block number allocation



Number blocks unless otherwise determined in the third section, are § 11 (1) of the RTR-GmbH to allot.

1. a decade number block which consists of 100 numbers, or 2. a maximum big part within a common phone number block interrupted by already allocated numbers according to Z 1.

(3) the maximum number of blocks allocated numbers is regulated in the relevant areas of the phone number.

(4) an allocation of telephone numbers immediately, para 3 shall only take place if



1. the need for the RTR-GmbH is made believable, or 2 in the fields for geographic numbers, location-independent phone numbers and mobile numbers an efficiency an efficiency is achieved by 50%, in any other numbering areas by 20% of each allocated numbers in the sector concerned or in the relevant charge level.

Allocation of individual numbers



§ 12.

 (1) the allocation of individual numbers is in the third section, are up to three individual numbers per phone number area without necessary proof to impart.

(2) the applicant for a corresponding need for a greater number of individual numbers, up to 100 individual phone numbers should be reported to.

(3) for each used individual number in accordance with paragraphs 1 and 2 a more number is to allocate upon request.

(4) in the case of phone number shortage in a number range can be deviated from the in para 1 to 3 procedures to ensure a sufficient number of available telephone numbers in this area. A shortage in a number range exists anyway, if already allocated 70% of the total available telephone numbers in this area.

Principles of the allocation procedure



§ 13.

 (1) eligible are the numbers as telephone number blocks or individually in accordance with the provisions of this regulation to allocate.

(2) value preferences are with regard to the requested number, except for geographic phone numbers and area for Routingnummern, to take into account.

(3) the processing of applications has to be in the order of their arrival. Is requested the allocation of same or overlapping numbering areas of several applicants on the same day, the lot decides. This provision does not apply when transferring rights according to § 65 ABS 5 TKG 2003.

(4) the requested telephone numbers or the requested parts for allocating available stand and also the other allocation requirements are met, is to allocate application.

(5) If a requested phone number block is already partly allocated to the applicant on request to allocate the remaining free telephone numbers in this phone number block are so.

Process sequence



§ 14.

 (1) the request for allocation of numbers or parts thereof should be installed using the application forms provided by the RTR-GmbH for this and has laid down each area-specific documents to include.

(2) applicants who in 2003 are not communications service providers or network operators TKG within the meaning of § 15, have to enclose an extract of the companies register or other appropriate proof of identity. Natural persons have to submit a copy of a valid government-issued photo ID.

Use



§ 15.

 (1) assigned numbers must be used within the time limit laid down in the allocation decision by at least 180 days and displayed within the same time limit their use in the electronic format provided by the RTR-GmbH this.

(2) the use of allocated numbers may not longer than 180 days will be interrupted, otherwise apply these numbers as not used.

(3) the right of use of phone numbers that match not the provisions of paragraph 1, shall expire.

(4) in the case that numbers block allocated to the licence holder, the entire block is used, if at least a phone number that is used.

(5) numbers used or is an existing use is interrupted, this RTR-GmbH by the communications operators, in their communication networks these numbers be used or were a contract with participants as well as by the communications service operators, or had to display electronically in the format provided respectively by the RTR-GmbH is.

(6) for telephone numbers in the fields of 718 800, 804, 810, 820, 821, 828, 900, 901, 930, 931, 939 is the indication referred to in paragraph 5 in accordance with section 65, subsection 2 2003 weekly TKG.

§ 16.

 Digits may not be used for addressing different participants of public services.

Public short numbers for emergency services

General information



§ 17.

 (1) a public short number for emergency services is the addressing of services referred to in paragraph 2.

(2) emergency services serve the defense of a present or imminent threat to life, physical integrity, environmental or asset.

(3) public short numbers for emergency services can be set if is for the provision of a nationwide emergency service referred to in paragraph 2 a legal order which provides for the use of communications services that require the use of a phone number, for alerting, and the provision of the service with one of the numbers set out in article 18 is not possible.

Laying down public short numbers for emergency services



§ 18.

 Public short numbers for emergency services are:



1 112 European emergency number, 2. 122 fire brigade headquarters, 3. 128 emergency number at gas affliction, 4. 133 police, 5 140 mountain rescue, 6 141 medical emergency service, 7 142 hotline, 8 144 emergency medical services and 9 147 emergency service for children and young people.

Intended use



§ 19.

 (1) the public short number 112 is used to report an acute or imminent threat to life, physical integrity, environmental or asset.

(2) the public short number 122 is used to report an acute and imminent threat to life, physical integrity, environmental or asset within the framework of the tasks of the fire service.

(3) the public short number 128 is used to report gas odor, gas leakage and any form of gas affliction, if this is an acute or imminent threat to life, physical integrity, environmental or asset.

(4) the public short number 133 is used to report an acute or imminent threat to life, physical integrity, environmental, or assets in the course of police duties.

(5) the public short numbers are used to report an acute and imminent threat to life, physical integrity or property within the framework of the emergency and rescue services 140, 141 and 144.

(6) the public short number 142 is used for the help and advice for people in difficult life situations, such as loneliness, strokes of fate, mourning, mental health problems, depression, partner problems or anxiety.

(7) the public short number 147 serves professional telephone psychological advice in connection with children and adolescents, particularly when violence, sexual abuse, or in all age-specific matters.

Numbers allocation



§ 20.

 (1) grant for public short numbers is 112 and 133 for the Federal territory the Federal Minister or the Federal Minister of the Interior.

(2) grant for public short numbers is 122, 128, 140, 141 and 144 of the federal country each of the Governor or the Governor.

(3) grant for the public short number 142 for the respective Federal State are the dioceses.

(4) grant for the public short number 147 for the entire Federal territory is the Austrian Broadcasting.

(5) the appropriate short number for emergency services shall eligible on request for use within the respective area to allocate.

(6) the coordination of those organizations providing the processing of the relevant emergency service responsibility the licence holder. For this purpose, you can assign the right of use of the allocated public short number for emergency services to appropriate organizations.


(7) in the cases of paragraph 3 and 4 the respective licence holder must, with organizations that want to offer a similar service to negotiate the sharing of allocated public short number for emergency services.

§ 86.

 Numbers in the ranges of 900, 901, 930, 931 and 939 are national numbers and basically serve the addressing of value-added services.

Number structure



section 87.

 Telephone numbers in the area for free to calculate value added services consist of a three-digit area code in accordance with § 86 and a six-digit subscriber number. Behind the subscriber number digits are allowed in accordance with the provisions of section 4.

Numbers allocation



88. (1) grant for telephone numbers in accordance with § 86 are communications service operators, which are also communication operators and communication network meet the technical requirements of use pursuant to § 86, or present a corresponding cooperation contract with a communications network operator, comprehensible emanates from the planned use in accordance with § 86, as well as service providers.

(4) referred to in paragraph 1, article 11 with the proviso that up to 300 numbers per area code, and fee level in call number blocks to self-employed persons efficient management in accordance with article 65, paragraph 1 to allocate TKG 2003 are without necessary proof in 901 and 931 applies for communication service providers.

(5) for service providers remains unaffected in 901 and 931 § 12, § 11 shall apply with the proviso that up to 10 numbers per area code, and fee level in call number blocks to allocate are without necessary proof.

(6) in the areas of 901 and 931, only subscriber numbers with the first two digits equal to 01, 02, 03, 04, 05, 06, 07, 08, 09, 10, 20, 30, 40, 50, 60 are allot of 70, 80, 90.

(7) telephone numbers in accordance with § 86, the subject to a pending revocation procedure according to § 68 TKG 2003 or pending regulatory proceedings pursuant to § 91 TKG 2003, may not be assigned.

Codes of conduct



§ 89.

 (1) in 900 and 901, erotic services is prohibited.

(2) in the areas of 900, 901, 930 and 931, the realization of dial-up access is forbidden by the means of a dialer program.

(3) in the area of 939, the provision of other services as dial-up access is forbidden by the means of a dialer program.

(4) in the areas of 901 and 931, only tarifierter event services is allowed.

(5) the fee for the use of time-based services in 900, 930 and 939 may on the basis of the minute fee pursuant to § 121 exclusively on one of the following types or in one of the participant for each connection, regardless of the duration of the connection, compared to one of these two variants more cost-effective way will be charged:

(7) Diensteroutingnummern in the field of 89 followed by an operator code starting with 9 301 160 and ETSI EN 301-161 may be used only for routing of ETNS services according to the standards ETSI EN.

(8) the source operator code in accordance with § 93 par. 5 has to correspond to an assigned operator code 85 and identifies the source network.

(9) the single-digit service code in accordance with § 93 par. 5 has one of the following values with the following meaning:

§ 107.

Value added services

General information



§ 117.

 (1) the provision of value added services in Austria is only using national numbers in the fields of 810, 820, 821, 900, 901, 930, 931, 939 and permitted in the access code field 118 under the sector-specific provisions.

(2) regardless of the classification of a service as a value added service within the meaning of § 3 16 are Z the provisions of this section anyway, for all services provided in the areas referred to in paragraph 1 according to the respective phone number range used.

Application



§ 118.

 (1) in the case of services relating to under 0, para 1 of the service providers ensures that all forms of application, it uses, clearly contain the following information:



1. the number of the service, 2. information concerning the fee payable for the service referred to in paragraph 2 to 5, as well as a unique label, it is euro, 3. one correct short description of the service content and restrictions at most existing 4. relating to the provision of the service.

(2) the fee information must include the fee in euro per minute based on time-based services. Based on time-based services with a fee under a EUR 1,00 per minute can be specified also in cents. If the duration of the connection or the total amount of the service on the basis of the type of service is to estimate, the total cost for the full take-up of the service to specify expected are in addition.

(3) in the case of event-based services, the fee in Euro fee information must contain per event. Event-based services with a remuneration at EUR 1.00 per event can be specified also in cents.

(4) are to comply with service, used over a data connection, which the participant resulting costs for the service provider not to estimate, so is together with the payment information to specify the total amount of data.

Dial-up access to value-added services



§ 119.

 In the provision of a value added service in the areas of 820 and 939, using a dialer program has to ensure service providers the following:



1. before setting up a connection to a value added service, you must appear the fee in euro per minute, the service provider and the complete phone number provided for the choice of whose address for service. It must be specified that the service establishes a phone connection to a value-added service numbers and payment over the phone bill.

2. connection may be established only after an action, through which the user confirms the knowledge of the information referred to in subpara 1. There must be the possibility to refuse the connection permanently, simply and free of charge.

3. information must be represented according to no. 1 in German language in clearly readable and to the background of contrasting font. Fixed, all information must appear in the user's field of vision. The presentation of the fee must be legible in the button, which starts the connection.

4 on the dial-up access only the paid content of service provider may retrieve, that are not freely accessible through a conventional Internet access on the Internet.

5. the storage of the dialer program on the user's device may only be a positive action of the user. The removal of the dialer program must be easily and a corresponding popularized and easily searchable note to the free distance exist.

6.

The current total remuneration and the duration of the connection must be shown permanently visible. Also must be displayed a button, by means of the connection at any time easily and without further delay can be definitively canceled.

Opt-in for the provision of value added services by using a dialer program



section 120.

 (1) communications service operators, which offer public telephone services at a fixed location, make sure that the area of 939 is only accessible if this was expressly requires the participants to communication service providers.

(2) communications service operators have the right to block individual foreign number ranges, if due to external circumstances can be assumed, that are in this number range of value added services provided or offered dial-up access in misuse.

(3) communications service operators have the right to block a national telephone number, if is likely due to the external circumstances that the service provider using this phone number violates paragraph 2 paragraph 8 or 0 the determination of 0.

Voice and fax services

Payment information immediately prior to the use of the service



§ 121.

 (1) in the case of services in the areas of 900 and 901, 930-931, as well as in the access code field 118, the communications service operators from its associated communication network, the service is provided, ensures that the amount of incurred per minute or per call fee in euros is immediately submitted to the user after connection in an appropriate manner. No fee charged must be installed for the pay information the participants and must enable the user upon receipt of this information free of charge to reject the use of the service.

(2) the fee information referred to in paragraph 1 may take no longer than 10 seconds.

(3) irrespective of paragraph 2 must exceeded the duration of 10 seconds, so far and so long this for the provision of any other legally prescribed information requirements is necessary.

(4) If a referral is done as part of directory enquiry services in accordance with § 43 or similar services of the users of the providers of directory enquiry services shall immediately prior to receipt of such a referral about the transactions after the referral to the application fee in euro per minute to inform. Such information may take no longer than 10 seconds.

(5) in the case of event-based voice services, a fee information referred to in paragraph 1 may be omitted if the fee for the whole service is maximum EUR 0.70 and para 3 the maximum remuneration results from the first two digits of the subscriber number in the area of 901 or 931 according to 0.

(6) in the case of event-based voice services, the users of the service provider is to inform that a paid connection is established immediately after conclusion the chargeable connection of language clearly.

(7) in the case of a time-based fax retrieval service fee information referred to in paragraph 1 may be omitted, if the service provider a fee information this ensures that he is clearly leading at the beginning of the first transmitted page of the applicable fee and the number of pages to be transmitted.

Time restrictions



Article 122.

 (1) in the case of connections to time-dependent offset value added services in 900, 930 and 939 as well as in the access code field 118 is the communications service operator from its associated communication network, the service is provided, a disconnection after at least 30 minutes, at a minute fee of less than EUR 2.20 after 60 minutes to make sure.

(2) in the case of fax retrieval services, which is not secure payment information according to 0, the service provider has to disconnect after 10 minutes.

Message services

Payment information immediately prior to the use of the service



section 123.

 (1) in the case of intelligence services in the areas of 900 and 901, 930-931, as well as in the access code field 118 is to ensure that the amount of the fee incurred per event in euros is immediately submitted to the user before each use of the service in an appropriate manner. No fee charged must be the user fee information. To order the service, the user must confirm actively the payment information and the service.

(2) more than just a one-time fee is charged with a message service, is in addition to paragraph 1 prior to the receipt of the service in an appropriate manner of the criteria triggering a pricing free of charge to inform immediately. The order by the user is regarded as the service. In addition, the following points to ensure are such services:



1. the user is to inform about the charge accumulated within a period of one month at least in increments of EUR 10.00 with a free message intended for this purpose used. (4) in the case of intelligence, which is invoiced on the messages sent by the user, a fee information referred to in paragraph 1 can be omitted, if the charges for the individual service use maximum is EUR 0.70, the service through a message of the user is requested, once provided in the connection and informs the first service message sent to the users clearly about the applicable fee.

(5) the observance of all obligations arising from paragraph 1 to 4 is the platform operator.

Special codes of conduct



section 124.

 (1) in the case of intelligence services that involve sending and receiving several messages in the context of an ongoing interaction, where the number of messages is not set in advance, the platform operator ensures that a transfer takes place only on the basis of messages sent by the user. A transfer of messages sent to the user is not allowed in this case.

(2) is sent to a message service where consecutive multiple charged inactivity of the user's messages, a message with "Stop" or "Stop" by the user, are immediately to terminate all services of the user behind a phone number. The message has to be free of charge for the users. This is the obligation of the platform operator.

(3) the user is clearly informed by the service provider through the provision of para 2.

Proof of compliance with messaging services



section 125.

1. the date and content of payment information prior to receipt of the service according to the 0 para 1, 2. the date and content of the information in accordance with 0 para 2 Z 1, 3. the timing and content of any sent confirmations of the user according to 0 para 1 and para. 2 Z 2 and 4. the timing and content of a message sent by the user, if necessary, in accordance with article 124, paragraph 2.

Transitional provisions / other

Transitional provisions



§ 126.


 (1) at the time of entry into force of this regulation, existing allocations of communication parameters, which are laid down in this regulation, remain valid in accordance with section 127. The scope of the relevant rights of use is determined by the provisions of this regulation.

(2) already before the 12.05.2004 under the numbering regulation Federal Law Gazette II No. 416/1997 (NVO) realized uses of geographic numbers with a beyond § 50 para 3 and 4 participants number length remain unaffected by this provision.

(3) already realised before the 12.05.2004 within the framework of the NVO uses of five - or six-digit mobile numbers are excluded from the provision of article 61, paragraph 1 concerning the minimum length of the phone number. Such numbers must be reported promptly by using communication service operator of RTR-GmbH.

(4) all allocated before 1 January 2002 by the communications service providers and used by participants geographical numbers with a the provisions of § 50 para 3 and 4 unterschreitenden subscriber number length remain unaffected by this provision.

(5) for geographic numbers starting with the sequence of the digits used in Linz in addition to the area code 732 70, second sentence, applies the provision of § 4 para 4 No.

(6) before the 12.05.2004 pursuant to § 60 Z 1 used mobile phone numbers that are, if necessary, in the blocks of telephone number in accordance with § 61 para 3 are exempt from the provision of this paragraph with respect to the only permissible use for operator services. Such numbers must be reported promptly by using communication service operator of RTR-GmbH.

(7) already before the 12.05.2004 in the context of the underlying allocation decisions realized uses an area code for private networks, which do not meet the requirements of § 56 paragraph 1 concerning the minimum length of subscriber numbers, are excluded from this provision.

(8) at the time of entry into force of this regulation, already realised further negotiations within the framework of a telephone information service, which contrary to the provision of § 121 4 the information on the applicable charges not immediately before the referral is communicated may still persist until 07.01.2010.

Cut-offs



section 127.

 (1) the use of area code 70 for Linz is set by 12.05.2014 at the latest.

(2) communications service providers have to inform in due form of the shut-off referred to in paragraph 1 in accordance with the following:



1. new participants in the local network of Linz, in the wake of the conclusion of the contract and 2 all participants at intervals of not more than six months, from 12.05.2012 at intervals not exceeding two months.

(3) communications service operators para have section 18 in accordance with the provisions of § 2003 for participants in the local network of Linz respectively to lead the area code 732 1 and 100 TKG.

(4) operators of telephone information services within the meaning of section 43 paragraph 2 have to specify only the area code 732 in the provision of the information service for phone numbers in the local network of Linz.

(5) communications service operators have the RTR-GmbH on demand



1. current evaluations to provide regarding the development of monthly usage of the area code 70 on their associated communication network, as well as 2 to submit a comprehensible informative documentation about date, type and content of made information measures referred to in paragraph 2.

(6) as the number of the caller in the meaning of the provisions of section 5 the area code 732 is allowed for Linz from 12.05.2013 at the latest.

(7) communication service providers, providing services on the basis of numbers for participants who are affected by shutdowns, are obliged to inform the concerned participants in a timely manner and comprehensively about the upcoming changes.

(8) in the case of all numbering areas affected by shutdowns, a tape recorder may be connected after setting for a period of up to two years, that informed about setting the phone number and, if necessary, refers to a new phone number.

Entry into force



section 128.

 (1) this Regulation shall, unless otherwise in the following paragraphs, with force, July 7, 2009.

(2) § 3 Z 16 lit. i and j with respect to intelligence services, as well as § 121 paragraph 6 with regard to event tarifierter voice services over EUR 0.70 enter into force on October 7, 2009.

(3) section 21 para 1 No. 4 except for the public short phone number for emergency services 112 7 January 2010 enter into force.

Expiry of legislation



§ 129.

 (1) with the entry into force of this regulation occurs 6 regulation of RTR-GmbH, with the provisions for communications parameters, fees and value-added services set to be (communications parameters, fees and value-added Services Ordinance - KEM-V) of 12 May 2004, published by Edition of RTR GmbH, amended Federal Law Gazette II No. 77/2008 except force.

(2) the exemption with regard to language services in section 3 is December 31, 2010 override Z 16.
