79. Message of the Chancellor on the scope of the Convention on the Rights of Persons with Disabilities and the Optional Protocol to the Convention on the Rights of Persons with Disabilities

Following statements by the Secretary General of the United Nations, the following other States have their ratification or ratification. to the Convention on the Rights of Persons with Disabilities and to the Optional Protocol to the Convention on the Rights of Persons with Disabilities (BGBl. On the occasion of the deposit of their ratification or ratification. The following countries have declared or declared reservations. Declarations on the Convention:

Azerbaijan:

The Republic of Azerbaijan declares that it cannot guarantee the application of the Convention in the territories occupied by the Republic of Armenia until these areas are exempted from occupation.

Guatemala:

Under Art. 33 of the Convention and due to Decree No. 78-2009 has been agreed that the National Council for the Care of Persons with Disabilities CONADI is designated as a government agency responsible for matters relating to the application and implementation of the Convention on the Rights of Persons with Disabilities and for the constitution of reports required under this Convention.

Republic of Korea:

Work and Employment - Art. 27 of the Convention:

The United Kingdom acknowledges the provisions of the Convention, subject to the understanding that none of its obligations on equal treatment in employment and occupation are applied for admission to or for the service of the Gulf, Military or Air Forces of the Crown.

Training – Art. 24 paragraphs. 2 b) of the Convention:

The United Kingdom reserves the right for disabled children to be trained outside their community where there is a more appropriate training possibility. However, parents of disabled children have the same possibility as other parents of a school where they want to train their children.

Freedom of movement of persons:

The United Kingdom reserves the right to apply these legal provisions to entry, stay and departure from the United Kingdom to those who do not have the right to enter and reside in the United Kingdom in accordance with the United Kingdom law, if it appears necessary from time to time.

The same recognition before the law – Art. 12(4) of the Convention:

The arrangements of the United Kingdom, according to which the Minister selects a person entitled to claim social security rights of infring persons, are currently not subject to regular review, such as Art. 12. The United Kingdom reserves the right to apply such arrangements. The United Kingdom is working on a proportional review system.

Training – Art. 24 paragraphs. 2 b) of the Convention:

The UK Government acknowledges its commitment to developing an inclusive system where parents of disabled children have increased access to mainstream schools that have the opportunity to meet the needs of disabled children. The general training system in the United Kingdom comprises general schools and special schools which, according to the United Kingdom, are allowed under the Convention.

On the occasion of the deposit of its instrument of ratification, Azerbaijan has issued the following declaration on the Optional Protocol:

The Republic of Azerbaijan declares that it cannot guarantee the application of the Convention in the territories occupied by the Republic of Armenia until these areas are exempted from occupation.

Following further communication by the Secretary-General of the United Nations, China on 1st The following statement on the Convention on the Hong Kong Special Administrative Region and the Macao Special Administrative Region:

In accordance with the Constitution of the Hong Kong Special Administrative Region and the Constitution of the Special Administration Region of Macao, the Government of the People's Republic of China has decided that the Convention applies to the Hong Kong Special Administrative Region and the Special Administrative Region of Macao.

The application of the provisions on the freedom of movement of persons and nationality of the Convention on the Rights of Persons with Disabilities for the Hong Kong Special Administrative Region, does not change the effectiveness of the relevant laws of the Hong Kong Special Administrative Region on Immigration Control and Citizenship.
