290. Regulation of the Federal Minister for Science and Research, amending the Regulation on statistical surveys of students at universities and universities of applied sciences.

On the basis of § 9 (6) of the Education Documentation Act, BGBl. No 12/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 24/2008, as well as § § 4 (4) and (8) of the Federal Statistics Act 2000, BGBl. I n ° 163/1999, as last amended by the Federal Law BGBl. I n ° 92/2007, shall be assigned in agreement with the Federal Chancellor:

The Regulation on statistical surveys of students at universities and universities of applied sciences, BGBl. II No 523/2003, shall be amended as follows:

1. § 1 reads:

" § 1. (1) Statistical surveys according to § 9 (6) of the Education Documentation Act are to be carried out by the Bundesanstalt "Statistik Österreich"

1.		at the universities (§ 6 of the University Act 2002, BGBl. I n ° 120/2002, as last amended by the Federal Law Gazette (BGBl). I n ° 81/2009) and at the University of Education and Training Krems on the occasion of the first admission to study and the completion of a regular degree programme,
2.		University of applied sciences and courses for further education according to § 14a of the Universities of Applied Sciences Law, Federal Law Gazette (BGBl). No 340/1993, as last amended by the Federal Law on the Law of the Federal Republic of Germany (BGBl). I n ° 2/2008, on the occasion of the first admission to study and
3.		at the private universities on the occasion of the conclusion of a Bachelor's, Diploma, Master's, Licentiate or Doctoral Studies.

(2) The universities, universities of applied sciences and training courses and the private universities are referred to below as "educational institutions". "

2. § 2 (1) reads:

' (1) Statistical surveys carried out under this Regulation shall be carried out by means of the electronic survey forms UStat 1, in accordance with the model of the Appendix 1 and UStat 2 according to the pattern of Appendix 2 "

3. In the first sentence of § 2 para. 2, the expression "the survey form" through the phrase "the survey forms" replaced.

4. § 3 (1) reads:

" (1) applicants shall have the right to study at educational institutions in accordance with § 1 (1) (1) (1) and (2) on the basis of the organisational and technical requirements of the educational institution concerned. Survey form UStat 1

1.		to be completed by the Federal Statistical Office (Bundesanstalt "Statistik Österreich") by means of remote data processing; or
2.		to be completed by the educational institution in the context of electronic data processing; or
3.		in the case of the educational establishment, to be completed in accordance with Z 1 or 2 for the purpose of processing. "

5. § 3 (2) deleted.

6. In the first sentence of Section 3 (3), the word order shall be "or to a university of applied sciences degree course" through the phrase "at an educational institution according to § 1 (1) (1) (1) and (2)" replaced.

7. § 3 (4) reads:

"(4) The social security number announced by the applicant or the applicant is in the cases of subsection 1 (2) and (3) of the relevant educational institution before the transfer of the data records to the Bundesanstalt" Statistik Österreich " according to the check the validity of the method used by the main association of the Austrian social insurance institutions. "

8. In accordance with § 3, the following § 3a together with the heading is inserted:

" Statistical survey on the occasion of the study

§ 3a. (1) Students in educational institutions according to § 1 (1) have to fill in the UStat 2 survey form at the Federal Statistics Office (Bundesanstalt "Statistik Österreich") on the occasion of the completion of a course of study by means of remote data processing. § 3 (5) is to be applied in a reasonable way. The provision for the participation of all respondents in the survey on the occasion of the graduation is the responsibility of that institution of the educational institution which is responsible for the issue of the certificate on which the degree of study is issued.

(2) The periods spent abroad of graduates of universities of applied sciences are to be collected from the administrative data of the University Council of Applied Sciences. The University of Applied Sciences Council has to provide this data free of charge by electronic means (Section 10 (2) of the Federal Statistics Act 2000). "

9. The following paragraph 4 is added to § 5:

" (4) § 1, § 2 including annexes 1 and 2, § 3 (1) to (4) and (3a) in the version of the BGBl Regulation. II No 290/2009, enter into force 1. October 2009, in force. "

10. The plant shall be replaced by Appendixes 1 and 2 and, in accordance with § 5, the following asset list shall be added:

" Appendix 1: Survey at the beginning of studies (UStat 1)

Appendix 2: Survey on study-related stays abroad (UStat 2) "
