296. Regulation of the Federal Minister for Transport, Innovation and Technology with which the Regulation on a waterway traffic regulation (WVO) is amended

On the basis of § 5 (10), § § 9 and 11, § 16 paragraph 1 Z 1, 6 and 9 and paragraph 2 Z 7, § 17 paragraph 1, as well as § § 22, 25, 35, 36, 37 para. 3 and 38 of the Shipping Law, BGBl. I n ° 62/1997, as last amended by BGBl. I n ° 17/2009, pursuant to section 153 (2) of this Federal Act, is in agreement with the Federal Minister for the Interior:

The regulation of the Federal Minister of Transport, Innovation and Technology on a waterways traffic regulations (WVO), BGBl. II No 248/2005, as amended by the BGBl Regulation. II No 186/2008, shall be amended as follows:

1. The short title of the regulation reads as follows: "Wasserstraßen-Verkehrsordnung"

2. In § 1.10 Z 2, the parenthesis shall be "(sports vehicles)" is deleted.

3. § 11.01 Z 1 lit. b is:

" (b)

" Sports Car ": vehicle intended for sports or recreational purposes, and not a passenger ship;"

4. In § 11.15 Z 2 the expression "Annex 8" by the expression "Annex 15" replaced.

5. In § 14.04 Z 7, § 16.04 Z 6 and 7 as well as § 16.06 the expressions shall be "Sports vehicles" or "Sports vehicles" through the phrase "with a length of less than 20 m" is supplemented.

6. In § 16.04 Z 6 the phrase "festing in the upstream half of the lock chamber" through the phrase "festing within the upstream two thirds of the lock chamber" replaced.

7. In § 11.02 Z 6 lit. b and § 17.06 shall be the expression " Electricity, sluice or Port supervision " by the expression "Shipping supervision" replaced.

8. § 14.04 Z 6 and § 20.02 Z 6 are deleted.

9. According to § 50.03 the following § 50.04 is inserted:

" § 50.04 Traffic regulation on stairways

1.

The use of the stairways for purposes according to § 50.02 Z 1 lit. a, b and e as well as for the purposes excluded pursuant to § 50.02 Z 3 from the prohibition of § 50.02 Z 2 may be used for sections of stairways that are

a)

for assistance in the event of accidents or in the implementation of events approved in accordance with § 11.13; or

b)

for the implementation of regulatory and maintenance measures on waterways, as well as for the installation or maintenance of water structures, waterways or flood protection structures approved in a modest way

shall be temporarily prohibited by means of a ship-transport-related arrangement in accordance with Section 38 (3) of the Shipping Act. With the exception of this, the use of the stairways for the purposes according to lit. a or b. Such an arrangement must be limited to the extent strictly necessary in terms of time and location and, after the reason for the arrangement has been eliminated, should be immediately removed again immediately.

Ship inspection bodies are authorized to arrange the order in accordance with Z 1 lit. a by the installation of physical barriers and the attachment of square table signs with the inscription "Treppelweg" in white writing on a blue background with yellow edge and a yellow bar from top left to bottom right. The reason and the probable duration of the lock shall be indicated on a supplementary board. The date of the affixing or the removal of the table marks is in a document note (§ 16 of the General Administrative Procedure Act, BGBl. No 51/1991, as amended).

According to Article 38 (7) of the Maritime Law, the respective locally competent organs of the Federal Waterway Administration are authorized, the order according to Z 1 lit. b by the installation of physical barriers and the installation of square table signs with the inscription "Treppelweg" in white writing on a blue background with yellow edge and a yellow bar from the top left to the bottom right. The reason and the probable duration of the lock shall be indicated on a supplementary board. The date of the affixing or the removal of the table marks is in a document note (§ 16 of the General Administrative Procedure Act, BGBl. No 51/1991, as amended), which must be forwarded to the Maritime Inspection Authority. "
