356. Regulation of the Federal Minister for Transport, Innovation and Technology, amending the Regulation on the Disarmament of Ships

Pursuant to § 7 (4) of the Maritime Fulfillment Act-SSEG, BGBl. No 387/1996, as last amended by BGBl. I n ° 32/2002, shall be assigned:

Article I

Amendment of the Regulation on the Disarmament

The Ship Equipment Ordinance, BGBl. II No 139/1999, as last amended by BGBl. II No 394/2003, shall be amended as follows:

In § 2 Z 1, the word order shall be " as amended by Commission Directive 2002/75/EC of 2 September 2002 amending Council Directive 96 /98/EC on marine equipment (CELEX-No) 301 L 0053, OJ No. No. OJ L 204, 28. July 2001, p. 1 et seq.) " through the phrase " as amended by Directive 2009 /26/EC amending Directive 96 /98/EC on marine equipment, OJ L 206, 22.7.2009, p. No. OJ L 113, 6.5.2009, p. 1) replaced.

Article II

Entry into force and transitional provision

(1) This Regulation shall enter into force with the date following its presentation.

(2) The provisions of Annex A.1 to Directive 96 /98/EC on marine equipment, as amended by Directive 2008 /67/EC amending Directive 96 /98/EC, OJ L 327, 30.4.1996, p. No. 1., referred to in Annex A.2 of Annex A.1, which were manufactured before 21 July 2009, may be used for two years after that date in the Annex to Annex A.2. Transport and on board of Austrian seagoing vessels shall be carried out if the equipment has been manufactured in accordance with the type-approval procedures already in force in the territory of a Member State of the European Union prior to that date.

(3) The provisions of column 1 of Annex A.1 of Directive 96 /98/EC on marine equipment, as amended by Directive 2009 /26/EC amending Directive 96 /98/EC, OJ L 327, 30.4.1996, p. No. 1., referred to in Annex A.2 of Annex A.1, which were manufactured before 6 April 2010, may be used for two years after that date in the Annex to the Annex. Transport and on board of Austrian seagoing vessels shall be carried out if the equipment has been manufactured in accordance with the type-approval procedures already in force in the territory of a Member State of the European Union prior to that date.
