356th regulation of the Federal Minister for transport, innovation and technology, modifies the ship equipment regulation

On the basis of section 7 para 4 of the maritime compliance Act SSEG, BGBl. No. 387/1996, last modified with Federal Law Gazette I no. 32/2002, is prescribed:

Article I

Change of ship equipment regulation

The ship equipment Ordinance, BGBl. II No 139/1999, as last amended with Federal Law Gazette II No. 394/2003, is amended as follows:

Section 2 Z 1 is the phrase "as amended by Directive 2002/75/EC of 2 September 2002 amending Directive 96/98/EC on marine equipment (CELEX number 301 L 0053, OJ)" (Nr. L 204 vondem 28. Juli 2001, Seite 1 ff.) " by the phrase "as amended by Directive 2009/26/EC amending Directive 96/98/EC on marine equipment, OJ No. L 113 of 5, p. 1) "replaced."

Article II

Entry into force and transitional provisions

1. this Regulation shall enter into force the day following their publication.

(2) the Appendix A. 1 of Directive 96/98/EC on marine equipment, as amended by Directive 2008/67/EC amending Directive 96/98/EC, OJ No. L 171 of 1.7.2008, p. 1, under the title "Name" as "new item" listed or Appendix A. 2 according to Appendix A. 1 transferred equipment manufactured prior to July 21, 2009, may be during two years after this date in the transport and brought on board by Austrian ships, if the equipment according to the applicable already before that date in the territory of a Member State of the EU type approval procedures was made.

(3) that in column 1 of Appendix A. 1 of Directive 96/98/EC on marine equipment, as amended by Directive 2009/26/EC amending Directive 96/98/EC, OJ No. L 113 of 5, S. 1, under the title "Name" as "new item" listed or Appendix A. 2 according to Appendix A. 1 transferred equipment that were manufactured before April 6, 2010, may be during two years after this date the market and brought on board by Austrian ships, if the equipment according to the applicable already before that date in the territory of a Member State of the EU type approval procedures was made.
