396. Ordinance of the Federal Minister for Education, Arts and Culture concerning the Museum Rules for the MAK-Austrian Museum of Applied Arts

On the basis of § 6 (1) of the Federal Museums Act 2002, Federal Law Gazette (BGBl). No 14/2002, as last amended by the Federal Law of the Federal Republic of Germany (BGBl). I n ° 52/2009, shall be ordered:

Legal Form

§ 1. (1) The MAK-Österreichisches Museum für angewandte Kunst (MAK) is a scientific institution of public law of the federal government. It is subject to the supervision of the Federal Minister of Education, Arts and Culture. In the fulfilment of its cultural and scientific mission, it respects internationally recognised ethical standards.

(2) The scientific institution pursues exclusively and directly non-profit-making purposes within the meaning of the Federal Tax Code (BAO), BGBl. No. 194/1961, and is not aimed at profit. The purpose and tasks of the scientific institution are by the Federal Museums Act 2002, Federal Law Gazette (BGBl). I n ° 14/2002, and this museum order.

(3) The ideals of the scientific institution are the activities and services carried out in order to achieve the purpose, which result from the Federal Museum of Museums Act 2002 and this museum order. The material resources for this consist of:

These funds will be used exclusively for the purposes specified by the Federal Museums Act 2002 and this museum order and will not be accorded any non-purpose advantages.

(4) In the event of a dissolution or cancellation of the scientific institution or in the event of a non-profit-making purpose, the assets shall fall to the Republic of Austria, which in turn shall be exclusively for charitable purposes within the meaning of the Federal Tax Code (BAO). is used.

§ 2. (1) To the greatest possible participation of the population in their cultural and social diversity in the art and cultural history as well as the natural scientific collection of the federal government, the mediation work is of central importance. (2) The collection holdings according to § 14 as well as their provision, exhibition and scientific research form the basis of the mediation work.

§ 3. (1) The expansion of the collection holdings according to § 14 shall be carried out in accordance with the special purpose provisions in accordance with § § 13 ff, the long-term museum concept pursuant to § 8 (7) and the framework target agreement in accordance with § 8 (8).

§ 5. (1) The inventory and cataloguing of collections according to § 14 shall be carried out on the basis of museological standards, research-related and administrative requirements as well as requirements of the pan-European project Europeana. The documentation of the collection objects is updated on an ongoing basis. The scientific institution shall draw up an annual report on the state of the inventory, collection and departure as well as findings of the revision. The report shall be submitted to the Federal Ministry of Finance by the Board of Trustees and the Federal Minister for Finance. Teaching, art and culture is brought to the attention of the people.

(2) The digitisation of the collections shall be carried out in accordance with the technical possibilities. Digitised collection objects shall be made available to the public electronically in accordance with the technical and legal possibilities.

Research

§ 6. (1) The research activity comprises the scientific processing and development of the collection holdings according to § 14 and all scientific questions arising therefrom.

(2) The scientific institution actively pursues networking, contact care and cooperation with other museums in Germany and abroad, as well as universities, universities and research institutions.

(3) The publication of research results is carried out in subject-specific media and events as well as in the context of the exhibition activities of the scientific institution.

(4) The scientific institution supports the Commission for Provenance Research established at the Federal Ministry for Education, Arts and Culture and grants access to all the provenance researchers at all times. Collection holdings in archives, depots and collections, if necessary under the supervision of the responsible employees. The management requires all employees of the scientific institution to provide all necessary assistance and information to the provenance researchers of the Commission.

§ 7. (1) The collection holdings according to § 14 shall be made available to the public according to current artistic, scientific and historical findings. The exhibition activities of the scientific institute supplement, as far as possible, content-related references to socially relevant topics of the present day. Special exhibitions in Germany and abroad will expand the range of special offers.

(2) Publications, lectures, discussion events and other mediating programmes accompany the exhibition activities.

Section 2

Organization

Management

§ 8. (1) The scientific institution is headed by a managing director.

(2) The Federal Minister for Education, Arts and Culture can order two managing directors. In this case:

1.

The scientific institution is headed by the scientific managing director and the economic managing director/managing director. The scientific managing director leads the term "Director-General/Director-General";

2.

The scientific managing director and the economic managing director go on fundamental questions of the management, which are explained in the Rules of Procedure in accordance with paragraph 5. , by mutual agreement. If the agreement cannot be reached, the voice of the scientific managing director shall indicate the rash. Such decisions shall be immediately brought to the attention of the Board of Trustees.

(3) The managing director/managing director shall lead the scientific institution on its own responsibility in accordance with the provisions of the Federal Museums Act 2002 and this museum order, as well as of the Rules of Procedure for the management pursuant to paragraph 5.

(4) Each managing director shall appoint, in agreement with the Board of Trustees, one or two of the members of the scientific institution for the duration of their term of office. Deputy/deputy. (5) The Management Board shall, in agreement with the Board of Trustees, draw up a point of order for management. (7) The Management Board, in agreement with the Board of Trustees, shall draw up a long-term museum concept on the basis of the special purpose provisions in accordance with § § 13 et seq. The long-term museum concept is approved by the Federal Minister for Education, Arts and Culture. A long-term museum concept will be created within three months for the re-appointment and re-appointment of business leaders.

(8) The Management Board, in agreement with the Board of Trustees with the Federal Minister for Education, Art and Culture, concludes a framework target agreement for the scientific institution in accordance with § 5 paragraph 7 of the Federal Museums Act 2002. (9) The Management Board shall draw up an annual project report in accordance with Section 8 (1) of the Federal Museums Act 2002, which includes a strategic report, a preview calculation and an analysis of the achievement of the objectives in relation to the framework target agreement in accordance with paragraph 8. According to Section 7 (3) of the Federal Museums Act 2002, the preliminary report will be submitted to the Federal Minister for Education, Art and Culture in accordance with Section 8 (1) of the Federal Museums Act 2002, following approval by the Board of Trustees.

(10) The management shall draw up the annual accounts according to § 2 paragraph 3 of the Federal Museums Act 2002 and Quarterly Reports. The quarterly reports will be brought to the attention of the Board of Trustees and the Federal Minister for Education, the Arts and Culture.

(11) The management shall comply with the guidelines of the Federal Minister of Finance for the uniform establishment of a planning, information and reporting system of the Federal Government for the participation and financial controlling (Controlling-Guidelines), BGBl. II No 319/2002. The Federal Minister of Education, Arts and Culture will provide the necessary data for the fulfilment of the planning, strategy and controlling tasks.

(12) The Management Board shall comply with the provisions of the third paragraph of this Article in respect of the accounts Book of the Company Law Book (UGB), dRGBl. S 219/1897, and carries out an accounting system, an internal control system and a risk management system, which meet the requirements of the scientific institution and the requirements of the Federal Minister for Education, Arts and Culture .

(13) The Management Board is responsible for the scientific and economic management of the scientific institute in a meaningful application of the provisions of the GmbH law.

(14) The Management Board shall establish a possible reorganization requirement in accordance with the appropriate application of the Corporate Reorganization Act (URG), BGBl. I n ° 114/1997, the Board of Trustees and the Federal Minister for Education, the Arts and Culture are immediately informed of this.

Director/Interior Conference

§ 9. (1) The Director/interior conference is a forum formed by the managing directors of the Federal Museums and the Austrian National Library. It aims at the exchange of information and advice with the aim of coordinating fundamental and cross-museumal issues. In particular, questions of collection and exhibition policy will be dealt with regularly within the framework of the Director/Interior Conference.

(2) The managing director, in the case of two managing directors/two managing directors, the scientific managing director, represents the scientific institution in the Director/interior conference.

(3) The chairmanship of the Director/Interior Conference alternates between the scientific institutions in accordance with the Federal Museums Act 2002 in each calendar half-year in alphabetical order.

(4) The Chairperson shall convene the Director at regular intervals, shall lay down the agenda, taking into account any additional items on the agenda of the Federal Minister for Education, the Federal Minister for Education, the Arts and culture, the Federal Minister for Education, the Arts and Culture regularly reports on the discussions and results of the Director/Interior Conference. § 10. (1) The Board of Trustees carries out the economic supervision of the Management Board in the appropriate application of the relevant provisions of the GmbH Act on the Supervisory Board.

(2) The Board of Trustees consists of nine members. The Board of Trustees shall meet at least once in each calendar quarter. Other meetings shall also be held where necessary. The meetings of the Board of Trustees shall be convened by the Chairman of the Board of Trustees or, in the case of the prevention of chairpersons/chairperson, by the Vice-Chairman of the Chairperson/Chairman.

(3) The rights and obligations of the Board of Trustees shall include in particular:

the right to be heard when ordering a Managing Director pursuant to Section 6 (1) of the Federal Museum of Museums Act 2002,

the application for the appointment of a Managing Director pursuant to Section 6 (1) of the Federal Museum of Museums Act 2002,

3.

the agreement of the appointment and dismise of a deputy of the management pursuant to § 8 (4),

4.

agreement on the drawing up of the rules of procedure for the management pursuant to Section 8 (5),

5.

the approval of the Organigram pursuant to Section 8 (6),

6.

the agreement on the drawing up of the long-term museum concept pursuant to § 8 (7),

7.

the agreement reached at the conclusion of the framework agreement in accordance with § 8 (8),

8.

the approval of the preliminary report pursuant to § 8 (9),

9.

the knowledge of the annual accounts and the quarterly reports pursuant to § 8 (10) and

10.

the approval of those transactions and legal acts which, according to the Rules of Procedure for the Board of Trustees pursuant to Section 8 (5) of the Board of Management, may only be carried out with the approval of the Board of Trustees.

(4) The Board of Trustees shall draw up the Rules of Procedure for the Trustees The Rules of Procedure shall be adopted by the Federal Minister for Education, the Arts and Culture pursuant to Section 6 (4) of the Federal Museums Act 2002, after approval by the Federal Minister for Education, Arts and Culture. § 11. (1) The General Assembly consists of all staff members of the scientific institution.

Guidelines for special purpose

§ 13. (1) The MAK is the Bundesmuseum für angewandte Kunst (Federal Museum of Applied Arts) at the interface with design, architecture and contemporary art.

(2) The core competence of the MAK lies in the contemporary analysis of applied art, design and architecture, in order to create new perspectives on the basis of the tradition of the house and to explore border areas.

(3) Supplementary competences of the MAK concern the international exchange of cultural trends and the dialogue with designers, artists and architects/architects at the artistic and scientific level.

§ 14. (1) The collection of the MAK is structured as follows:

(2) The collection is the property of the Federal Republic without prejudice to the provisions of § 4 of the Federal Museum of Museums Act 2002. The objects of the collection are in accordance with § 2 paragraph 1 of the monument protection act, BGBl. No. 533/1923, under monument protection. § 15. (1) Objects of the Federal Artothek as well as collections and individual objects which are not owned by the Federal Government supplement the collection according to § 14 para. 1.

(2) The acceptance of permanent loan duties shall be necessary in view of possible financial implications for the economic situation of the scientific institution of the approval by the Board of Trustees and the approval by the Federal Minister for Economic Affairs and the Federal Minister for Education, Arts and Culture, in accordance with the provisions of the Rules of Procedure of the Board of Trustees pursuant to Section 10 (4).

Extension of the collection

§ 16. (1) The extension of the collection is primarily carried out within the scope of the core competence according to § 13 para. 2.

(2) The collection activity has the purpose of supplementing and completing the collection in accordance with Section 14 (1).

(3) Acquisitions in the field of architecture shall be carried out in coordination with the Albertina. Works in the field of contemporary art take place in Austrian art in coordination with the Österreichische Galerie Belvedere (Belvedere), in international art with the Museum of Modern Art Foundation Ludwig Vienna (MUMOK). § 18. To the extent that this Regulation refers to federal laws or to other regulations of a member of the Federal Government, they shall be applied in the version in force with the entry into force of this Regulation.

Override

§ 19. With the entry into force of this Regulation, the Regulation of the Federal Minister for Education and Cultural Affairs on the Museum Rules of the Austrian Museum of Applied Arts (BGBl) is to enter into force. II No 506/1999, as amended by the BGBl Novel. II No 4/2001, except for force.
