420. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, which sets the minimum wage rate for domestic carers for Salzburg

The Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 22 (1) of the German Labour Constitution Act, BGBl. No. 22/1974, in the version of the Federal Law BGBl. I No 74/2009 authorises the minimum wage rate to be fixed at the request of a collective contractual body if no collective agreement is effective for the industry concerned.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has fixed the following minimum wage rate with a decision of 3 December 2009 following the implementation of a senate negotiation:

Scope

§ 1.

1.

Spatial: for the province of Salzburg;

2.

Personal: for home-care workers, to which the home-care law, BGBl. No 16/1970, and its employer,

-

who, in their capacity as employers, are not members of a collectivelyable body, or

-

if, after the entry into force of the minimum wage, they acquire collective contractual capacity or accede to a collective contractual body, as long as no collective agreement is concluded for them;

3.

Technical: only for the other activities of persons referred to in Z 2 within the meaning of Section 12 (1) of the Hausanxigergesetz (Hausanxigergesetz).

Services according to § 4 para. 3 of the Hausanxigergesetz

§ 2. In addition to the remuneration, which is guaranteed to him by virtue of § § 7 (1) and (12) of the House Concerned Law, the House concerned shall be entitled to the following remuneration in the case of the following work carried out at a house, this additional fee being taken from the sum of the sum of the total amount of the fee. for the residential areas and other premises (plus 20% of the material cost):

in the case of subsequent installation of lifts. In the case of possible aliquots, analogous to lit. b.

a)

The charge after Z 1 is due after completion of the respective work.

b)

If the caretaker service ends before the completion of the work mentioned in Z 1, then the caretaker must pay the fee in proportion to the services already provided.

c)

If cleaning work according to A. must be carried out on special grounds on Sundays and public holidays, an additional fee of 7.81 € per hour must be paid.

For extraordinary other agreed work, an hourly wage of € 7.81 is due. This is increased to € 15.62 if the work is carried out for special reasons in the night hours and/or the hours. on Sundays and holidays. This fee shall be no later than 10 years. of the following month. This hourly wage is only valid in so far as other rates of pay are not fixed in the minimum wage rate of Federal Office of Unification M 13/2009/XXVI/99/13.

For the once weekly cleaning of a place used by the house parties, each of these parties is due to pay € 19.65 per month. For the cleaning of an off-site for washing kitchens, a monthly fee of € 47.97 is to be paid if required.

For an agreed purification of particularly disgracable soiling (in particular blood, urine, feces, vomit), a lump sum of € 51.57 per disposal is due.

In the case of remuneration according to Z 1, 2, 3, 4 and 5, as far as cleaning works are concerned, the surcharge applicable in each case to the procurement of the cleaning material in accordance with § 8 of the Hausanxigergesetz (Hausanxigergesetz) is added.

If there is an agreement on the obligation of attendance beyond the provisions of Section 4 (1), (3) and (4) of the House procuration Act, an hourly wage of € 5.16 is to be paid. On Sundays and public holidays, this hourly wage increases by 100%.

For the care of a machine-washing kitchen (cleaning, maintenance and supervision of the machines and the washroom according to § 4 para. 3 house-care law) fees per washing machine together with any additional machines 16,28 € per month.

If the maintainer is to carry out an collection for the use of the facilities, a fee of 3% of the amount collected will also be charged. However, if the calculation of the fee is due to the household owner on the basis of the consumption of electricity or gas, a charge of 5% of the collected sum shall be charged.

For the cleaning of refuse boxes as well as the filling and replacement of refuse bins as well as for the cleaning of refuse storage places, a monthly flat rate is due, the amount of which is based on the actual work performance and on the basis of the is to be calculated on the basis of the hourly wage fixed in Z 3.

§ 3. Holiday grant and Christmas Remuneration

§ 5. In addition, the persons referred to in § 1 Z 2 shall charge each year a holiday grant in the amount of the fee due for the month of May (excluding remuneration for § 2 Z 1, 3 and 5) and a Christmas Remuneration in the amount of the amount of the month for the month. If the service starts or ends during the calendar year, the amount of the holiday grant and the Christmas Remuneration shall be based on the amount of the service period completed in the calendar year on the basis of the amounts mentioned in the first sentence.

Beneficiary clause

§ 6. Existing more favourable agreements will not be affected by this minimum wage.

Linguistic equality

§ 7. To the extent that personal names are only mentioned in male form, these refer to women and men in the same way. In the case of a particular person, the gender-specific form must be used.

Gelling Date

§ 8. This minimum wage rate changes the minimum wage rate of 19 November 2008, Zl. 55 /BEA/2008-4 (M 18/2008/XXVI/99/12) and occurs with 1. Jänner 2010 in force.
