462. Ordinance of the Federal Ministry of Labour, Social Affairs and Consumer Protection at the Federal Ministry of Labour, Social Affairs and Consumer Protection, which sets the minimum wage rate for au-pair forces

The Federal Ministry of Labour, Social Affairs and Consumer Protection is the Federal Ministry of Labour, Social Affairs and Consumer Protection in accordance with Section 22 (1) of the German Labour Constitution Act, BGBl. No. 22/1974, in the version of the Federal Law BGBl. I No 74/2009 authorises the minimum wage rate to be fixed at the request of a collective contractual body if no collective agreement is effective for the industry concerned.

The Federal Ministry of Labour, Social Affairs and Consumer Protection has set the following minimum wage rate with a decision of 14 December 2009 following the implementation of a senate negotiation:

Minimum wage rate for Au Pair forces

Scope

§ 1.

a)

Spatial: for the Federal Republic of Austria.

b)

Professional and personal: for workers who are acting as au-pair forces in accordance with § 49 (8) of the ASVG are employed.

Remuneration

§ 2. The Au-Pair force with housing and catering with employer (host family) is due for the job as an au pair (child care and slight assistance in the household) for a working time of 20 hours including willingness to work a Monthly minimum wage of 366.33 €.

§ 3. If the Au-Pair force is not in a position to use an agreed apartment and board (e.g. prevention of service by illness, renunciation of service during the period of notice, in the case of a justified early exit and in case of a justified early retirement). (a) shall be paid in cash for each calendar day in the amount of one 30th of the valuation rate determined for the valuation of benefits in kind for the social security system.

Working clothes and language course

§ 4.

1.

Work clothes are to be provided for the Au-Pair force at the expense of the employer/employer in the case of service entry in the proper condition. The cleaning is to be carried out by the employer/employer. the costs incurred are to be paid by him.

2.

In order to comply with the order to deepen the German language skills of an au-pair force, the employer/employer must pay at least half of the costs of a German course or a comparable educational offer.

3.

The costs of a course arranged by the employer/employer in the course of pedagogical qualification are to be borne by the employer/employer.

Christmas Remuneration

§ 5. In each calendar year, the Au-Pair Force shall be entitled to a Christmas Remuneration, which shall be due on 1 December, in the amount of a gross monthly barbecence. If the employment relationship on the due date has not taken place yet, or if it has been dissolved before the due date, the aliquot part of the Remuneration shall be due.

Holiday grant

§ 6. The Au-Pair force is due to a holiday grant, which is to be calculated and due in accordance with § 9 HGHAngG.

Accounting certificate

§ 7. The employer is obliged to provide the Au-Pair-Force with a precise date-provided settlement of the hours worked, the remuneration and the deductions during the payment of the payment. In the case of employment relationships, the employee and self-employment law of the company, BGBl. No 100/2002, as last amended by BGBl. I n ° 102/2007, the proof of settlement must also include the contribution to the operating pension fund and its tax base.

Onset of effectiveness

§ 8. This minimum wage is 1. January 2010 in force and applies only to employment relationships of au-pair forces, which will be completed after 31.12.2009.
