487. Ordinance of the Federal Minister of Health, with which the Ordinance on Continuing Education and Training is changed
On the basis of § § 10 paragraph 1 Z 5 and 11 para. 2 Z 2 of the Suchtmittelgesetz, BGBl. I n ° 112/1997, as last amended by the Federal Law BGBl. I n ° 143/2008 and the Federal Ministries of the Federal Ministries of Law 2009, BGBl. I No 3/2009, shall be ordered:
The continuing training regulation for oral substitution, BGBl. II No 449/2006, as last amended by the BGBl Regulation. II No 5/2009, shall be amended as follows:
1. § 1 (1) reads:
" (1) This Regulation regulates the continuing training of doctors who are entitled to self-employed professional activities, who are active in a professional or service relationship, with the aim of obtaining the knowledge and skills of one or more of the following: With questions of addictive abuse, doctors/doctors who are sufficiently familiar with these questions (§ 11 paragraph 2 Z 2 of the Suchtmittelgesetz) qualify for the implementation of the substitution treatment. The continuing education and training

the comprehensive qualification for substitution treatment (indication and adjustment of patients on a substitution medium including further treatment), or |

a qualification which is restricted to the further treatment of patients already recrued on a substitution agent. " |
2. § 1 (3) reads:
" (3) Physicians may only be entrusted with the control of the substitution treatment (§ § 21 para. 2, 23g of the Suchtgiftverordnung) if they have completed the basic module according to § 3 paragraph 1 Z 1 or otherwise have completed a further training which is the Basic module is equivalent in accordance with § 3 (1) (1) (1). "
(3) The following paragraph 4 is added to § 1:

have been entered in the list of doctors and doctors qualified to carry out the substitution treatment, and |

submit to the regular in-depth further training according to § 3 paragraph 1 Z 2 (continuing training modules). |
(1a) Only for the further treatment of patients already recrued on a substitution agent are those doctors who, without having undergone the basic further education according to § 3 (1) (1) (1) (1), are qualified to continue the further training according to § 3 (1) of the German law. 1a Z 1 (basic module "further treatment") have completed the conditions set out in paragraphs 1, Z 1, 3 and 4. 5. § 3 (1) reads:

the regular in-depth training (in-depth further training modules) of at least 6 units per year or 18 units within 3 years, calculated from the date of entry in the list in accordance with § 5. " |
6. According to Article 3 (1), the following paragraph 1a is inserted:
" (1a) The further training qualifying for further treatment pursuant to § 1 (1) (1) (2) (2) shall be supplemented by the relevant medical training.

7. In § 3 (2), the words "The Federal Minister for Health and Women" by the words "The Federal Minister for Health" replaced.
8. § 4 (1) reads:
" (1) The Austrian Medical Association, in cooperation with the medical chambers in the federal states, the medical universities, the medical professional societies and the offices of the state governments, has the organization and implementation of a to ensure adequate training provision on the number of qualified doctors and doctors required to ensure patient care. "
9. According to § 4 (2), the following paragraphs 2a and 2b are inserted and § 4 (2) to (2b) are inserted:
" (2) The offer of continuing education has to correspond to the state of science, to take account of the multidisciplinarity of the treatment of addicted diseases and to take into account the proven methods of adult education.
(2a) Basic module as well as in-depth further training modules for the comprehensive qualification for substitution treatment (§ 3 para. 1) have uniform specific knowledge throughout Germany on all areas relevant for substitution treatment. , including the necessary knowledge of addiction and substance dependence, clinical syndromes and withdrawal syndromes of all relevant addictive substances and substances, clinical pharmacological and psychiatric bases, treatment approaches and -possibilities for substance dependence, the practical Implementation of the substitution treatment with due regard for accompanying diseases as well as the relevant legal bases. 20 units of the basic module can be completed by means of e-learning. (2b) Basic module and in-depth further training modules for the limited qualification for further treatment (Article 3 (1a)) shall have a uniform nationwide knowledge of the areas referred to in paragraph 2a which are intended for the further treatment of patients are already required to use a substitution agent. 10. The following paragraph 5 is added to § 4:
" (5) The Austrian Medical Association has the Federal Minister of Health annually up to 31. 11. § 5 together with headline reads:
" List of physicians and doctors qualified for substitution treatment
§ 5. (1) Doctors who intend to apply for substitution treatment in the course of their professional practice shall be required to demonstrate the existence of the relevant qualification to the district administration authority. The competence of the district administrative authority depends on the place of occupation or place of work on which the doctor or the doctor wishes to apply the substitution treatment.
(2) Qualification certificates as defined in paragraph 1 shall apply

If the qualifications referred to in paragraph 2 are available, the district administrative authority shall, after consulting the Austrian Medical Association, confirm this to the doctor or doctor and immediately to the list of doctors and doctors, that meet the qualification requirements for the implementation of the substitution treatment. The date of entry into the list shall be deemed to be the beginning of the qualification. (4) The district administrative authority has to count on the duration of further training periods completed at home or abroad after consultation of the Austrian Medical Association on the condition of equivalence to the duration provided for basic further education. The same applies to a further training completed at home or abroad if it has provided the comprehensive qualification for indication and recruitment (§ 3 para. 1) or the knowledge required for further treatment (§ 3 para. 1a). "
Article 6 (3) reads as follows:
" (3) In the application for the maintenance of registration the doctor or doctor must prove the completion of the in-depth further training (§ 3 paragraph 1 Z 2, 1a Z 2) by means of confirmation of the medical chamber concerned. After consulting the Austrian Medical Association, the district administrative authority shall maintain the registration if the relevant qualification is guaranteed by the visit of the prescribed in-depth training and if no other reason against the maintenance. "
Section 7 (1) reads as follows:
The district administrative authority shall, after consulting the Austrian Medical Association, immediately delete the list from the list if it has been informed that a condition for registration has been omitted or not , the doctor or doctor has not complied with medical professional duties or has otherwise repeatedly or repeatedly violated these professional duties. In addition, the physician or the physician must be removed from the list immediately due to the expiry of the time limit, unless otherwise indicated in § 6. Section 7 (3) reads as follows:
The district administrative authority may, after consulting the Austrian Medical Association, maintain registration under the condition of proof of the necessary qualification measures instead of the deletion, if it proves that: a doctor or a doctor in a number of areas who do not have the knowledge required to carry out the substitution treatment in accordance with the state of the art of medical science and experience. "
15. § 9 (4) and (5) reads:
' (4) The District Administrative Authority shall delete from the list doctors and doctors who have been entered in the list on the basis of a professional exercise in accordance with paragraph 3, until the end of 31 December 2010, unless the registration is up to that date. The reason for the qualification certificate concerning the completion of the basic module pursuant to § 3 (1) Z 1 or 1a (1) (1) (1) has been made and is not to be applied (5).
(5) Doctors and doctors who practise their profession (para. 3) have been made credible in the duration of more than 24 months, are to be deleted from the list at the latest until the end of December 31, 2010, unless the entry on the basis of the qualification certificate on the completion of the basic module is not up to that date pursuant to Section 3 (1) (1) (1) or (1a) (1). § 3 (1) (1) (1) shall apply with the proviso that the basic module (indication and setting) is shortened and comprises a total of at least 18 units. "
16. The following paragraphs 8 and 9 are added to § 9 and Article 9 (7) to (9) reads:
" (7) For the duration of the provisional entry in the list referred to in paragraph 4 or 5, the doctor or physician is not obliged to complete the regular in-depth further training. § 3 (1) (2) or (1a) (2) applies only from the date of the entry in the list on the basis of proof of successful completion of the basic module " Indication and recruitment (§ 3 para. 1 Z 1) or the abbreviated basic module (paragraph 1). 5 second sentence) or of the basic module "Further treatment" (§ 3 para. 1a Z 1). "
(8) The Austrian Medical Association shall immediately arrange for the organization of further training for the limited qualification to continue the treatment of patients already recrued on a substitution agent Austria-wide; the basic module in the case of further processing, it must be made in good time to ensure that the possibility of graduation by the relevant physicians and doctors is ensured at the latest by the end of 31 March 2010.
(9) By the end of 31.12.2010, in accordance with Article 1 (3), the amts-mediated training must be kept in the area of the control of the substitution treatment in the period of at least six months, provided that the End not more than 12 months ago. "
